12、為逐步完善我項(xiàng)目部農(nóng)民工工資支付與實(shí)名制管理,切實(shí)保障農(nóng)民工合法權(quán)益,保證農(nóng)民工工資足額支付到個(gè)人,進(jìn)一步遏制因項(xiàng)目糾紛引發(fā)的群訪事件的發(fā)生,結(jié)合我公司實(shí)際情況制訂本方案細(xì)則。第二條 此方案細(xì)則適用于在本合同項(xiàng)目施工活動(dòng)的各類施工合作隊(duì)伍,各施工合作隊(duì)伍必須遵照執(zhí)行。第三條 細(xì)則所稱農(nóng)民工管理員是指受施工總承包企業(yè)委托,負(fù)責(zé)施工現(xiàn)場農(nóng)民工管理的專門人員。第二章 管理機(jī)構(gòu)農(nóng)民工工資支付管理領(lǐng)導(dǎo)工作小組:組 長:薄文祥副組長:葉永建 劉劍鋒 王明管理員:張冠一成 員:李業(yè)金 黃耀亮 劉世如 齊立社 李厚峰 葉東海 劉國成第一條 本項(xiàng)目部農(nóng)民工工資支付與實(shí)名制管理工作進(jìn)行組織推動(dòng),具體工作由各施工合
13、作隊(duì)伍負(fù)責(zé)。第二條 本項(xiàng)目負(fù)責(zé)該項(xiàng)目所承包范圍內(nèi)所有在建項(xiàng)目的農(nóng)民工管理工作。第三條 設(shè)立專門農(nóng)民工管理機(jī)構(gòu),將農(nóng)民工工資支付與實(shí)名制管理納入管理范疇。項(xiàng)目部設(shè)立農(nóng)民工管理員,管理員:張冠一,負(fù)責(zé)該項(xiàng)目的農(nóng)民工的考勤等管理工作。第四條 勞務(wù)合作隊(duì)伍設(shè)立農(nóng)民工管理專門機(jī)構(gòu),在項(xiàng)目工地委派現(xiàn)場負(fù)責(zé)人、農(nóng)民工管理員專門負(fù)責(zé)施工現(xiàn)場的農(nóng)民工工資日常管理工作。第三章 具體實(shí)施保證方案一、嚴(yán)格執(zhí)行國家勞動(dòng)和社會保障部關(guān)于保障農(nóng)民工工資支付的四項(xiàng)基本措施:1、是建立工資支付監(jiān)控制度,全面監(jiān)控和重點(diǎn)監(jiān)控相結(jié)合,列為重點(diǎn)監(jiān)控對象的,要定期向勞動(dòng)保障部門報(bào)送工資支付情況;建立企業(yè)工資支付信息網(wǎng)絡(luò),完善監(jiān)控手段。2
14、、是推行工資保證金制度,被重點(diǎn)監(jiān)控的建筑施工企業(yè)和有過欠薪行為的企業(yè),要繳納一定數(shù)額的工資保證金,以保證農(nóng)民工工資不因企業(yè)資金狀況而被拖欠。3、是全面實(shí)施小時(shí)最低工資標(biāo)準(zhǔn),防止一些企業(yè)以計(jì)件工資名義壓低和克扣農(nóng)民工工資。4、是推行企業(yè)勞動(dòng)保障誠信制度,規(guī)范企業(yè)用工和工資支付行為。全面推進(jìn)勞動(dòng)合同制度實(shí)施行動(dòng)計(jì)劃,用人單位招用農(nóng)民工都依法訂立書面勞動(dòng)合同,建立權(quán)利義務(wù)明確、規(guī)范的勞動(dòng)關(guān)系。二、為了保證民工工資,我項(xiàng)目部做了多項(xiàng)保證措施。1、俗話說,一份辛勞一份收獲,我項(xiàng)目部各有關(guān)部門積極采取措施,保證農(nóng)民工工資及時(shí)發(fā)放、讓農(nóng)民工勞有所得,也促進(jìn)了施工企業(yè)的發(fā)展。為了保證工人工資得到保障,我項(xiàng)目部
15、單獨(dú)開設(shè)了農(nóng)民工調(diào)查小組。專門調(diào)查解決農(nóng)民工拖欠、糾紛等現(xiàn)象,一經(jīng)發(fā)現(xiàn)項(xiàng)目或者合作隊(duì)伍由此現(xiàn)象,將對其嚴(yán)厲處罰,做到“工程清工資清”,決不拖欠民工一分錢。2、本項(xiàng)目為民工設(shè)立了綠色通道及意見箱,民工有意見或事情可以直接到項(xiàng)目部找相關(guān)部門人員,并且為其大力解決難題。3、我項(xiàng)目部及早與民工簽訂了勞動(dòng)合同,保證民工及時(shí)拿到自己的辛苦錢,也保證了建設(shè)的順利進(jìn)展。4、我項(xiàng)目部預(yù)設(shè)立民工工資專用賬戶,避免了由于工程中一些復(fù)雜問題而造成資金困難,使的工資遲遲發(fā)不下去。建立專用帳戶正是能保障工程在危急時(shí)候能夠保證民工工資。5、保證按月發(fā)放工資,每月5日準(zhǔn)時(shí)發(fā)放民工工資。6、我項(xiàng)目部采取“舉證責(zé)任倒置”辦法,即
16、由用人隊(duì)伍負(fù)責(zé)舉證,項(xiàng)目拿不出工資發(fā)放證據(jù)就視為欠薪,解決了農(nóng)民工討薪時(shí)“舉證難”的問題。在目前農(nóng)民工討薪難的大環(huán)境下,不失為一種方便農(nóng)民工的行政舉措。三、不拖欠農(nóng)民工工資的承諾書公司項(xiàng)目在多年的市場經(jīng)營中,始終堅(jiān)持“保質(zhì)守約、薄利重義”的企業(yè)宗旨。為認(rèn)真貫徹落實(shí)各上級主管部門關(guān)于切實(shí)解決建設(shè)領(lǐng)域拖欠工程款的民工工資問題的要求,我公司承諾:若有幸中標(biāo),決不拖欠民工工資。具體措施為:1、與所有民工簽訂勞動(dòng)合同。2、開設(shè)專門帳戶,由項(xiàng)目財(cái)務(wù)派專人專管,保證工程款的??顚S?。3、根據(jù)工程進(jìn)度計(jì)劃,制訂出民工工資支付計(jì)劃表。4、將民工工資的支付情況納入項(xiàng)目經(jīng)理部的各項(xiàng)考核指標(biāo)中進(jìn)行統(tǒng)一考核。特此承諾!
17、5、嚴(yán)格按上級主管部門規(guī)定,足額繳納農(nóng)民工工資保證金,如果發(fā)生農(nóng)民工工資拖欠現(xiàn)象,無條件接受上級主管部門處罰。第四章 相關(guān)設(shè)備要求第一條 為提高管理效率,項(xiàng)目部在項(xiàng)目施工現(xiàn)場配備電腦微機(jī)、數(shù)碼相機(jī)、固定窗式公告牌等設(shè)備。第二條 施工現(xiàn)場具備適當(dāng)?shù)摹⒛軌蚋嬷r(nóng)民工工資發(fā)放程序、施工安全教育、施工技術(shù)交底等培訓(xùn)內(nèi)容的場地或場所。第三條 施工現(xiàn)場要利用固定窗式公告牌告知和公示農(nóng)民工考勤和工資的支付情況及舉報(bào)電話。第五章 附 則第一條 項(xiàng)目部把農(nóng)民工工資管理制度方案細(xì)則納入監(jiān)管范圍,對不按本方案細(xì)則執(zhí)行,拖欠農(nóng)民工工資造成嚴(yán)重后果的隊(duì)伍,給予限期或停工整改。第二條 各合作隊(duì)伍要充分發(fā)揮各自管理作用,組
