1、PAGE 聘 用 合 同 附 件甲方:聘方(聘請單位)單位名稱:廈門大學法定代表人:朱崇實(校長)委托代理人:林培三(人事處處長)用人單位: 乙方:受聘方(外國專家、外籍專業(yè)人員)姓名: 護照號碼: 國籍: 出生日期: 性別: 甲乙雙方在平等自愿和協(xié)商一致基礎上簽訂本協(xié)議,作為甲乙雙方已簽訂的國家外專局統(tǒng)一制定的聘用合同(編號 )的附件,與聘用合同享有同等法律效力。乙方的工作職責:合同期限: 年 月 日至 年 月 日。用人單位: 。工作職責:合同期內平均每周 課時,教授課程為 ,并應完成相關的教學行政手續(xù)。 上課地點: (填校區(qū))。二、乙方的工作和生活待遇:工資:乙方稅前月薪包含基本工資 元和
2、住房補貼 元,合計人民幣 元。漳州校區(qū)課時補貼按每周漳州校區(qū)課時數(shù)與每周課時總數(shù)的比例乘以500元/月的標準計算,與月薪同時發(fā)放。以上工資和補貼由甲方依法代扣稅收后,根據(jù)合同期按月打入乙方工資卡。午餐補貼乙方另享有午餐補貼440元人民幣/月,由甲方根據(jù)乙方上月考勤情況,于當月中旬予以打入其校園卡。如9月份的午餐補貼將于10月中旬發(fā)放。但根據(jù)全校統(tǒng)一的規(guī)定,2月和8月無午餐補貼,即3月和9月將無補貼打入校園卡中。住房甲方所提供的月薪中已包括住房補貼,乙方應自行解決住房。醫(yī)療保險:甲方為乙方購買外教團體商業(yè)醫(yī)療保險。乙方在合同期內發(fā)生醫(yī)療行為的,可根據(jù)甲方為乙方購買的外教團體保險協(xié)議向相關保險公司
3、理賠;自費部分由乙方自付。若因乙方的年齡和身體狀況導致甲方無法為其購買醫(yī)療保險的部分項目的,甲方不承擔責任。國際旅費報銷:乙方年度考核合格的、且完成所有工作職責的前提下,已簽署續(xù)聘合同者可在合同結束前的最后兩個星期內、不續(xù)聘者可在完整辦理離校手續(xù)后,憑機票(行程單)、航空發(fā)票、信用卡付款記錄、每一程的登機牌原件報銷最高額為 元人民幣以內的廈門至其常住地國的國際旅費。若無法提供完整票據(jù),則無法進行報銷。三、病假和事假(一)病假:若乙方因病請假,須提前將醫(yī)生證明和請假報告提交給用人單位。用人單位須將復印件及時送人事處和國際處備案。乙方在本合同期(通常為一學年)內累計請病假不滿三十天,工資按100發(fā)
4、給;超過三十天后,甲方有權解除聘用合同;若未解除合同,工資可按70發(fā)給,直至恢復正常工作為止。乙方因病假而缺課,甲方有權要求其予以補課。(二)事假或曠課:若乙方因緊急事故、自然災害、公務出差或其他個人原因等特殊情況需請假,須遞交書面請假報告給用人單位并獲得同意后,方可離開。用人單位須將復印件及時送人事處和國際處備案。乙方因上述事假而缺課,用人單位有權要求其予以補課。如乙方拒絕補課,甲方可按日扣減其工資。乙方在本合同期(通常為一學年)內因事請假一般不得累計超過10天,或連續(xù)超過3天(除非特殊情況)。若乙方未經(jīng)甲方同意而擅自曠課的,曠課一天,扣發(fā)三天工資。若乙方未經(jīng)甲方同意連續(xù)曠課超過3天或累計曠
5、課超過10天的,甲方有權解除聘用合同,并追究乙方的違約責任。四、合同試用期乙方的試用期為_30天,自 年 月 日至 年 月 日。乙方在試用期內被證明不符合錄用條件的,甲方有權解除合同;乙方可以在試用期內解除 HYPERLINK / t _blank 勞動合同,但需提前三日通知用人單位。五、考核和續(xù)聘(一)乙方應參加甲方組織的年度考核。(二)乙方本合同聘期結束如欲續(xù)聘,應向所在用人單位提交續(xù)聘申請,由用人單位報送人事處,甲方將根據(jù)年度考核結果及用人單位意見決定是否續(xù)聘。違約金甲乙雙方中任一方違反合同,應向對方支付違約金 5000 元(人民幣)。其他乙方應遵守甲方的各項工作管理制度。本合同未盡事宜

8、sed on the principles of equality, voluntary will and consensus, and has the same legal force as the Employment Contract. I. The Job Responsibilities of Party B: Contract duration: to (month/day/year)Employing Institution: Job Responsibilities: An average workload of class hours per week during the
9、contract duration, teaching (courses) and fulfilling relevant administrative procedures.Working Location: .II. Benefits for Party B:(I) Salary: The monthly salary(before tax) of Party B will be RMB in total, including RMB_ _ for basic salary and RMB_ _ for housing allowance. An additional monthly Zh
10、angzhou allowance (maximum 500 RMB) will be paid together with the monthly salary in proportion to the classes hours given on Zhangzhou campus over the contracted weekly class hours, as follows: (500RMB times weekly Zhangzhou class hours divided by contracted weekly class hours). The above-mentioned
11、 salary and allowances are subject to legal withdrawal of tax by Party A and shall be transferred monthly to the bank account of Party B in accordance with the contract duration. (II) Lunch Allowance: Party B is granted a lunch allowance of RMB440 /month, which will be transferred to his/her campus
12、card by the middle of the month if Party B has fulfilled all of his job responsibilities in the previous month. E.g., the lunch allowce for September will be deposited in October. Whereas,according to a university-wide policy, there is no lunch allowance for Feburary and August, meaning there is no
13、deposit in March and September.(III) HousingParty B is responsible for finding his/her own accommodation as the housing allowance is included in the monthly salary.(IV) Medical Insurance: Party A will buy for Party B group commercial medical insurance for foreign teachers. For any medical treatments
14、 during the contract period, Party B should claim indemnity from the designated insurance company according to this commercial medical insurance for foreign teachers which Party A buys for Party B. In addition, Party B is responsible for the part of the cost that is not covered by this insurance.If
15、Party A cannot buy for Party B any item of the medical insurance due to Party Bs age or health reason, Party A shall NOT bear any responsibility. (V) International Travel Airfare Reimbursement: On the condition that Party B has passed the Annual Evaluation and fulfilled all of his/her responsibiliti
16、es, during the last two weeks of the contract duration for those who have signed the renewed contract , or, after fulfilling the leaving procedures for those who are not renewing, he/she will get reimbursed for up to RMB for the international travel expense between Xiamen and Party Bs home country w
17、ith the following documents: E-ticket(itinerary) , invoice, relevant credit card statement and boarding passes for each flight taken. Lack of any part the above-mentioned documents will result in failure of reimbursing the tickets.III. Sick Leave and Other Leave (I) Sick LeaveWhen asking for sick le
18、ave, Party B must present a doctors statement and a written report to the employing institution, which shall make a copy of each of the two documents and send them to the Personnel Office and the Office of International Cooperation and Exchange. Party Bs salary will be paid 100% if the accumulative
19、total of sick leave is less than 30 days for this contract duration(commonly one academic year); if it is in excess of 30 days, Party A has the right to cancel the contract; if the contract is not cancelled, Party A can pay 70% of Party Bs salary to him/her until he/she resumes ordinary work. Party
20、A has the right to ask Party B to make up for the classes missed during his/her sick leave.(II) Leave of Absence or Absence Without ConsentFor emergency, natural disaster, business trip or any other special case, Party B may ask for leave of absence in advance by presenting a written report to the e
21、mploying institution, which will send a copy to the Personnel Office and the Office of International Cooperation and Exchange. With Party As consent, Party B will be granted leave. If classes are missed during the leave of absence due to the above reasons, the employing institution has the right to
22、ask Party B to make up the missed classes. If Party B refuses to make up the classes, Party A may deduct his/her salary on a daily basis. Party B shall not ask for leave of absence in excess of 10 days accumulatively in this contract duration(commonly one academic year), or for more than 3 consecuti
23、ve days (negotiable under specific circumstances). If Party B is absent from his/her post without Party As consent, 3 days salary will be deducted for each day absent. Furthermore, Party A has the right to terminate the contract and hold Party B responsible for breach of contract if Party B remains
24、absent for more than 10 days accumulatively or 3 consecutive days without Party As consent.IV. Trial Period of the ContractThe trial period for Party B is_30_ days, from to (month/day/year). During the trial period, Party A has the right to cancel the contract if Party B is found to be incompetent f
25、or the position; Party B has the right to cancel the contract but should give notice to Party A three days in advance during the trial period.V. Evaluation and Renewal of Contract(I) Party B shall be included in the annual evaluation organized by Party A. (II) If Party B wishes to renew the contract after it expires, Party B must apply to the employing institution in written form two months in advance. The employing institution will send the application to the Personnel Off
