1、第一章 適用范圍Applicable Scope第一本“規(guī)定”適用于與北京首都航空有限公司以下簡稱“首都航空” 和上海金鹿公務(wù)航空有限公司以下簡稱“上海金鹿” 簽訂包機(jī)運(yùn)輸合同或執(zhí)行產(chǎn)品方案政策的各種客 戶類型。Article 1 This manual applies to various types of clients who signs Charter Flight Contract with Beijing Capital Airlines Co., Ltd. (hereinafter referred to as Capital Airlines) and Shanghai Dee

2、r Jet Airlines Co., Ltd. (hereinafter referred to as Shanghai Deer Jet) or conducts product scheme and policy.第二章 包機(jī)手續(xù)Charter Procedure第二承運(yùn)人解答包機(jī)人咨詢。In case of any consultation from the CHARTERER, the CARRIER shall explain.第三為包機(jī)人解釋承運(yùn)人公司產(chǎn)品方案或價格政策。The CARRIER shall explain the product scheme or price p

3、olicy to the CHARTERER.第四承運(yùn)人確認(rèn)意向飛行時間、飛機(jī)運(yùn)力、飛行申請、機(jī)組資源等和包機(jī)飛行相關(guān)事宜及所需信息。The CARRIER shall confirm charter flight relevant and required informationsuch as flight time, transport capacity, flight application, crew resource, etc.第五承運(yùn)人根據(jù)包機(jī)人飛行意向提供報價單。The CARRIER shall provide quotation in accordance with the

4、flight intention of the CHARTERER.包機(jī)人確認(rèn)飛行后承運(yùn)人為包機(jī)人提供包機(jī)運(yùn)輸合同及乘客保障信息單 (客戶填寫內(nèi)容包括航線、日期、時刻、人數(shù)、乘客姓名、證件名稱、證件號碼、行李重量、接送車輛、飛行各站聯(lián)系人及聯(lián)系方式、機(jī)上餐食要求等其他服務(wù)要求的詳細(xì)信息 , 詳見 附件六) 。After the CHARTERER has confirmed the flight, the CARRIER shall provide the CHARTEREwRith Charter Flight Contract and Flight Service Information

5、Form(see Appendix VI for the content filled in by the client , including the specific information of flight route, date, time, passenger number, passenger name, credential name, credential No., luggage weight, picking up vehicle, contact person and contact information of each flight station, flight

6、catering requirements and other service requirements).(一)如包機(jī)人在飛行過程中出現(xiàn)起飛時刻,飛行日期,任務(wù)航段、乘客信息、各地機(jī)場接送機(jī)聯(lián)系人或車輛等一切和飛行有關(guān)的信息變更,包機(jī)人有責(zé)任第一時間通知承運(yùn)人。In case there s change of information relevant to the flight including departure time, flight date, mission flight leg, passenger information, contract person for pick

7、up service in each airport, or vehicle, the CHARTERER has the responsibility to inform the CARRIER immediately.( 二 ) 包機(jī)人應(yīng)保證每位乘客持有符合中國民航現(xiàn)行規(guī)定的有效證件,進(jìn)出境乘客應(yīng)保證持有相關(guān)國家要求的有效旅行證件,國際飛行應(yīng)遵守各國航空管制規(guī)定和法律規(guī) 定。The CHARTERERshall guarantee that each passenger holds the valid credential complying with the existing laws

8、and regulations by China Civil Aviation. The crossing passenger shall guarantee to hold valid travel credentials required by relevant country, and international flight shall follow the air traffic control stipulations and legal regulations of each country.(三)由于包機(jī)人原因(如身份證、護(hù)照等證件與本人身份不符,或攜帶民航和國家法律法規(guī)規(guī)定的

9、危險品登機(jī),或不能按合同規(guī)定時間準(zhǔn)時登機(jī)等)包機(jī)人未能按約定時間執(zhí)行或未能履行簽訂的飛行計劃, 承運(yùn)人不負(fù)責(zé)因此導(dǎo)致未能飛行產(chǎn)生的后果,對于飛行計劃中未執(zhí)行的部分包機(jī)款, 承運(yùn)人應(yīng)返還包機(jī)人,但包機(jī)人應(yīng)承擔(dān)未執(zhí)行該飛行任務(wù)而產(chǎn)生的實(shí)際費(fèi)用。The CARRIER shall be exempted from the liability for breach of Contract for failure to implement the scheduled flight mission in light of the reasons caused by the CHARTERER(such a

10、s credential (ID or passport) not being consistent with one s identity, carrying any dangerous goods prohibited by civil aviation and state laws and regulat ions, or passenger s delayed boarding). The CARRIER shall return the unimplemented charter expense to the CHARTERER, but CHARTERER shall assume

11、 any expenses arising therefrom.(四) 包機(jī)人如租用多架承運(yùn)人飛機(jī),需事先將每架飛機(jī)乘坐的乘客名單提供給承運(yùn)人。In case the CHARTERERrents multiple aircrafts, he/sheshall provide CARRIERwith the passenger list for each aircraft.根據(jù)民航有關(guān)規(guī)定,如乘客攜帶行李超過承運(yùn)人機(jī)型限制范圍,承運(yùn)人可協(xié)助乘客辦理地面轉(zhuǎn)運(yùn)或儲存,費(fèi)用由乘客自理。 如乘客堅持要求攜帶超額行李乘坐公務(wù)機(jī),承運(yùn)人有權(quán)拒絕起飛。 如乘客攜帶特殊行李請?zhí)崆白稍兂羞\(yùn)人。According

12、 to the relevant stipulations by civil aviation, in case the passenger carries the luggage exceeding the limited range of the jet type, the CARRIERmay assist the passenger in ground transfer or storage and the expense shall be paid by the passenger. If the passenger still insists to take the extra l

13、uggage on board, the carrier shall be entitled to refuse to provide flight services. In case of special luggage, the passenger shall consult the CARRIER in advance.如因承運(yùn)人原因無法安排合同中原定機(jī)型執(zhí)行飛行,承運(yùn)人將免費(fèi)為包機(jī)人升級至更高級別機(jī)型保障飛行,若因包機(jī)人拒絕機(jī)型調(diào)配,則簽訂的包機(jī)合同可被終止,雙方承擔(dān)各自的損失。承運(yùn)人機(jī)型等級順序從低到高依次為“豪客系列f灣流 200系列- 灣流IVf灣流 A灣流450系列-達(dá)索 7X

14、f灣流550fBBJ1-BBJ2 ACJ。In case the planned jet type in the contract is not available because of theCARRIER ,the CARRIER shall provide a higher level jet type for the CHARTERER. If the CHARTERER refuses to accept the jet adjustment, the contract shall be ended. The CHARTERER and the CARRIER should assu

15、me their respective expenses deriving therefrom.第六條包機(jī)人按照合同規(guī)定時間支付包機(jī)款。The CHARTEREsRhall pay the charter expense in accordance with the Contract.第七條承運(yùn)人為包機(jī)人在指定保險公司承保。The CARRIER shall underwrite for the CHARTERER in specified insurance company.第八條承運(yùn)人在起飛前一天向包機(jī)聯(lián)系人提供航線各機(jī)場地面代理聯(lián)系方式,由各機(jī)場地面代理與包機(jī)聯(lián)系人直接聯(lián)系并約定飛行當(dāng)日

16、迎候乘客的時間和地點(diǎn)。The CARRIER shall provide the charter contact person with contactinformation of each airports ground agent one day before the flight, so the ground agent can directly contact the charter contact person to decide the time and location to meet the passengers.第九條 飛行當(dāng)日起飛前一至二小時確認(rèn)乘客到達(dá)當(dāng)?shù)貦C(jī)場的時間,并通

17、報各保障單位做好飛行前準(zhǔn)備,根據(jù)約定的時間,機(jī)場地面代理在約定地點(diǎn)接引乘客進(jìn)場、協(xié)助乘客辦理相關(guān)入場手續(xù)。Confirm the arrival time one or two hours before the departure and informall support units to well prepare for the flight. In accordance with the agreed time, the airport ground agent meets and guides the passengers to enter the airport at agreed

18、location and help them go through relevant boarding procedure.第十條執(zhí)行包機(jī)飛行。The charter takes the flight.第十一條飛機(jī)抵達(dá)目的地前當(dāng)?shù)氐孛娲硖崆芭c迎接乘客的接機(jī)人取得聯(lián)系,通知等候乘客的時間和地點(diǎn)。Before arriving at the destination, the local ground agent shall contact the pick-up person in advance to inform the pick-up time and location.第十二條 飛機(jī)降落

19、后當(dāng)?shù)貦C(jī)場地面代理安排乘客出場并送乘客至前來接機(jī)的車輛旁。After the aircraft is landed, the local airport ground agent shall arrange the passengers to exit the airport and send them to the pick-up vehicle.第十三條 飛行結(jié)束后承運(yùn)人征詢包機(jī)人的飛行意見,承運(yùn)人在接收到包機(jī)人提出的意見或投訴后需要在5 個工作日內(nèi)給予包機(jī)人回復(fù)處理意見或辦法。After the flight, the CARRIER shall ask CHARTERER for id

20、eas or comments on the flight and provide treatment plan or method within 5 workdays after receiving the opinion or complaint.第三章 乘機(jī)手續(xù)Chapter 3 Boarding Procedure第十四條 國內(nèi)飛行乘客需要在起飛前20 分鐘抵達(dá)起飛地機(jī)場,國際飛行乘客需要在起飛前 2 小時抵達(dá)起飛地機(jī)場;Article 14 The domestic flight passenger shall arrive at the airport 20 minutes bef

21、ore the departure, and international flight passenger shall arrive at the airport 2 hours before the departure.第十五條北京出港航班:送乘客車輛停在貴賓室停車場,乘客走VIP 通道過安檢,上貴賓擺渡車到達(dá)飛機(jī)下。For Beijing outbound flights: the pick-up vehicle shall stop at the parking lot for the VIP room. The passengers go through the safety insp

22、ection by VIP passage and arrive at the aircraft by VIP shuttle.第十六條北京進(jìn)港航班:乘客下飛機(jī)后上貴賓擺渡車,擺渡到機(jī)坪出口乘客接機(jī)車輛等候處。Beijing inbound flights: after getting off the aircraft, the passengers get on the VIP shuttle and the shuttle sends them to pick-up vehicles at the exit.第十七條包機(jī)人在飛行及進(jìn)出機(jī)場過程中需隨身攜帶有效證件。The CHARTERER

23、 shall bring valid credential along during flight and when entering and exiting the airport.第十八條根據(jù)中國民航乘客規(guī)定 ,如乘客攜帶貴重物品乘機(jī),需事先在乘客保障信息單中注明所帶物品清單并嚴(yán)格遵守國家與民航的法律法規(guī),如未事先聲明,造成的任何后果,由包機(jī)人自行承擔(dān)。In line withPassenger Requirements of Civil Aviation Administration ofChina, passengers bringing precious items shall id

24、entify the carrying items in Passenger Guarantee Information Form and strictly comply with the laws and regulations of China and civil aviation. If not stated in advance, the CHARTERER shall bear the consequences arising therefrom.第十九條貴重物品的性質(zhì)、價值等應(yīng)符合相關(guān)的國際規(guī)定和承運(yùn)人規(guī)定,如乘客攜帶危險品或違禁物品,造成的任何后果,由包機(jī)人承擔(dān)。The natu

25、re and value of precious items shall comply with relevantinternational stipulations and CARRIERregulations. In case passengers carry dangerous goods or prohibited items specified byPassenger Requirements ofCivil Aviation Administration of China,the CHARTERER shall be liable forany consequences arisi

26、ng therefrom.第二十條如乘客攜帶小動物,需參照中國民用航空旅客、行李國內(nèi)運(yùn)輸規(guī)則中關(guān)于小動物的規(guī)定。Passengers carrying small animals in the course of domestic flights shall abide by regulations on live animal stipulated byChinas civil aviationpassengers, baggage, domestic transportation rules.第二十一條包機(jī)人須認(rèn)真了解前往國家和地區(qū)的證件要求, 并應(yīng)保證每位乘機(jī)人持有有效證件。承運(yùn)人可按時

27、提醒并協(xié)助包機(jī)人辦理相關(guān)證件手續(xù), 但由于包機(jī)人所提供的乘客證件與本人不符、 失效或不符合前往國家或地區(qū)的相關(guān)規(guī)定而導(dǎo)致飛行未能按合同約定時間執(zhí)行或取消時,由包機(jī)人承擔(dān)所有相應(yīng)的責(zé)任,與承運(yùn)人無關(guān)。承運(yùn)人應(yīng)返還包機(jī)人合同中未執(zhí)行航段費(fèi)用,但包機(jī)人需承擔(dān)因此而產(chǎn)生的實(shí)際費(fèi)用,所有涉及乘客相關(guān)責(zé)任的問題,包機(jī)人和承運(yùn)人有義務(wù)向乘客傳達(dá)。The CHARTERER shall ensure that each passenger holds valid documents. Incase passenger documents provided by the CHARTERERare inconsi

28、stent or invalid, the CHARTEREsRhall assume all responsibilities incurred by failing to operate the flight on agreed schedule under the contract or flight cancellation. The CARRIER shall refund the fee of unimplemented fight legsto the CHARTERER according to the contract, but the CHARTERER shall pay

29、 theactual costs arising therefrom. All issues related to the liabilities ofpassengers shall be communicated to passengers by the CHARTEREaRnd CARRIER.第二十二條包機(jī)人所執(zhí)行的航線涉及到中國境內(nèi)外的相關(guān)機(jī)場時,乘客應(yīng)自覺遵守相關(guān)的機(jī)場規(guī)定,如有違反而導(dǎo)致的法律責(zé)任和刑事責(zé)任,由乘客自行承擔(dān)。Passengers should consciously abide by regulations stipulated by relevant domes

30、tic airports where the CHARTERER implements the flight routes. The passenger should bear legal and criminal liabilities deriving therefrom insured by himself or herself.第二十三條包機(jī)人乘坐北京首都國際機(jī)場進(jìn)出港國際航班時,需由客人本人填寫中華人民共和國海關(guān)統(tǒng)一制作的進(jìn)出境旅客行李物品申報單并簽字,銷售代表、乘務(wù)員、地面服務(wù)人員等均不得代客人填寫;Article 23The Charter need to fill in the

31、China Customs Luggage Declaration Forms whenCharter take international flights in and out of China by Beijing capital international airport, sales representatives, cabin crews, ground service staffs are not allowed to fill out Instead of Charter.第二十四條合同中提到的兒童,是指年齡滿兩周歲但不滿十二周歲的人。Article 24 Children me

32、ntioned in the contract are passengers over two (2) but less than twelve (12) years of age.第四章 標(biāo)準(zhǔn)空中服務(wù)Chapter 4 Standard Air Service第二十五條承運(yùn)人會根據(jù)航程時刻信息,結(jié)合機(jī)型特點(diǎn)、乘客國籍、宗教信仰、身體狀況(是否有糖尿病、高血壓等)安排餐食。Article 25 Based on the flight time, The CARRIER will arrange the catering bycombining the jet type features, pa

33、ssengers nationality, religion, physical condition (whether there s diabetes mellitus, high blood pressure, etc).第二十六條在自身具備配餐公司的機(jī)場,參照海南航空頭等艙標(biāo)準(zhǔn)配備餐食;在自身不具備配餐公司的機(jī)場,由機(jī)場代理或乘務(wù)員從星級酒店或高檔餐廳外購。 外購餐食受航班起飛時刻、包機(jī)人指定地點(diǎn)衛(wèi)生條件、運(yùn)輸保存等條件限制,承運(yùn)人不承擔(dān)因以 上不可控情況而產(chǎn)生的餐食安全和質(zhì)量責(zé)任。Article 26 The airports with catering company shall p

34、repare the catering by referring to first class standard of Hainan Airlines, and airports without catering company shall have the airport agent or flight attendants buy food from star hotel or first class restaurant.Outsourcing meals is chartered flightdeparture time, designated place sanitation, tr

35、ansportation, preservation conditions, such as more than the carrier does not undertake because of uncontrolled situation of food safety and quality responsibility.第二十七條配餐時段劃分標(biāo)準(zhǔn)如下:The division standard of catering period is as follows:本表飛行時間長度單位為“分鐘” 。The flight time in this table is in the unit of

36、Minute.起飛時間下限和起飛時間上限分別表示區(qū)間的起訖時間(不含地面滑行時間) 。The lower limit and upper limit of the departure time respectively represents the starting time and end time (ground taxi time excluded).“/ ”表示“或” ,如“0-60”時間段中,如果飛行時間在 30 分鐘左右配水果切片,60 分鐘左右視乘客人數(shù)和時間區(qū)域可配水果切片或點(diǎn)心餐。“/ ” means “or” . For example, in the time perio

37、d of “0 - 60” , if fruitslices are provided 30 minutes afterdeparture, fruit slices or dessert canbe provided about 60 minutes after departure according to passenger number and time range.本表主要是作為機(jī)上配餐的基本依據(jù),ACJ飛機(jī)、BBJ飛機(jī)及其他特殊航班、或乘客有特殊要求的航班需按實(shí)際情況另行調(diào)整。This table is taken as the basis of airline catering.

38、For ACJ aircraft, BBJ aircraft and other special flights, or the flights with special passenger requirements, adjustment shall be made correspondingly.點(diǎn)心餐的概念為:Dessert refers to:A 西式點(diǎn)心餐:三明治、甜點(diǎn)、新鮮果球;A Western dessert: sandwich, confection and fresh fruit balls;B中式點(diǎn)心餐:中式點(diǎn)心(多為冷點(diǎn))、粥或甜品、新鮮果球。B Chinese des

39、sert: Chinese refreshment (usually cold), porridge, confection and fresh fruit balls.第二十/l條承運(yùn)人每航班標(biāo)準(zhǔn)配備多種酒水飲料(含依云礦泉、可樂、健怡可樂、雪碧、蘇打水、帶汽礦泉、果汁 3款、啤酒1款、世界著名產(chǎn)地干紅/干白各1款、高木茶葉3 款、及咖啡、紅茶、牛奶)。As per the flight standard, the CARRIER shall provide various drinks(including Evian Mineral Water, Coca Cola, Coca Cola

40、Light, Sprite, sodawater, sparkling mineral water, 3 types of juices, one type of beer, one type of world famous dry red wine/dry white wine, 3 types of advanced tea, coffee, black tea and milk).第二十九條承運(yùn)人每航班標(biāo)準(zhǔn)配備多種小吃。As per the flight standard, the CARRIER shall provide various snacks.第三十條承運(yùn)人每航班標(biāo)準(zhǔn)配備多種

41、報刊雜志、影碟光盤,及象棋、圍棋等娛樂用品。As per the flight standard, the CARRIERshall provide various entertainment articles such as newspapers, magazines, video disks, chess, Weiqi, etc.第三H一條豪客飛機(jī)配餐時段劃分標(biāo)準(zhǔn)The division standard of catering period of Hawker aircraft:起飛時限下限Lower Limit of Departure Time起飛時間上限Upper Limit of

56、passengers go through the safety inspection and joint inspection and board.4 如果是國際離港,承運(yùn)人現(xiàn)場地面保障部保障專員在出境前由簽派席提醒機(jī)組按照乘客數(shù)量攜帶足量 進(jìn)出境旅客行李物品申報單 , 指導(dǎo)客人在公務(wù)機(jī)候機(jī)樓填寫 進(jìn) 出境旅客行李物品申報單協(xié)助交至海關(guān),并將盡量協(xié)調(diào)安排聯(lián)檢單位到貴賓室查驗(yàn)證件及行李;現(xiàn)場保障員負(fù)責(zé)向乘客收齊護(hù)照,并代為辦理乘客出境手續(xù);Before international departure, ground handlers of operator must remindcrews t
