論自媒體時代的知識產權保護摘要由于我國成文法具有無法避免的滯后性、自媒體知識產權具有的法律上與計算機網絡技術上的雙重復雜的特性，在自媒體迅速發(fā)展的今天，我國自媒體領域對知識產權的保護體系并未有效建立。相比于傳統(tǒng)的知識產權，網絡知識產權具有以下特點：打破了傳統(tǒng)知識產權的地域性、專有性和時間性等特點，權利人的智力成果傳播范圍可以在瞬間達到全球各個角落，由此產生的知識產權侵權案件具有時間更短、范圍更廣、侵權人更多等特性。而網絡發(fā)展進入自媒體時代后，更是在知識產權保護的各個方面涌現出了許多新的挑戰(zhàn)與問題。立法上的滯后加之侵權手段之多、侵權成本之小、侵權利潤之巨導致了在自媒體平臺上知識產權的侵權案件頻發(fā)，各個類型的侵權手段層出不窮，越來越多人的合法權益受到侵害。長此以往，不僅將影響互聯(lián)網自媒體平臺的發(fā)展，更會給社會文化、科學領域的創(chuàng)新積極性帶來巨大的損害。本文希望通過調查網絡自媒體侵權傳播的現狀、分析我國現有立法、對比參照各國有關立法、借鑒以往知識產權制度面對新興媒體的對策以期找出更好的調和自媒體傳播快捷個性的優(yōu)勢與保護著作權人專有權利之間矛盾的方法：加強自媒體提供平臺監(jiān)管，嚴格自媒體平臺提供者責任，建立便捷快速維權渠道，創(chuàng)立新的利益分享模式。AbstractDuetoourstatuteisunavoidablelag,withselfintellectualpropertyrightsofmedialawandcomputernetworktechnology,thedoublecomplexcharacteristicsinfrommediarapiddevelopmenttoday,China'smediainthefieldofintellectualpropertyrightsprotectionsystemhasnotbeeneffectivelyestablished.Comparedtothetraditionalintellectualpropertyright,networkintellectualpropertyrightshasthefollowingcharacteristics:theresultingintellectualpropertyinfringementcaseswithshorterandwider,therightinfringementpersonmorepropertiesbrokethetraditionalintellectualpropertyofgeographical,exclusiveandtimecharacteristicsandintellectualachievementsofthepropagationofhumanrightscaninstantlyreacheverycorneroftheglobe.Anddevelopmentofthenetworkintosincetheeraofmedia,istheemergenceofamanynewproblemsandchallengesintheaspectsoftheprotectionofintellectualpropertyrights.Thelegislativelagcoupledwithmeansoftort,tortcostssmall,infringingprofitsgiantleadstoselfmediaplatformontheintellectualpropertyrightsofthefrequentcasesofinfringement,varioustypesoftortmeansemergeinendlessly,thelegitimaterightsandinterestsofmoreandmorepeopleinfringed.Continuouslyforalongtime,willnotonlyaffecttheInternetsincethedevelopmentofmediaplatform,itwillbringgreatharmtothesocial,culture,scienceandinnovationinitiative.Inthispaper,thehopethroughthenetworkinvestigationfromthemediadisseminationofinfringingthepresentsituation,analysisofourexistinglegislation,comparedwithreferencetotherelevantnationallegislation,fromtheprevioussystemofintellectualpropertyinthefaceofnewmediastrategiesinordertofindabetterharmonicfastmediapersonalityadvantageandprotectionasthemethodoftheconflictsbetweentherightofproprietaryrightsoftheperson:strengthenfromthemediasupervisionplatform,strictlyfromthemediaplatformpr
