補(bǔ)充租賃合同協(xié)議范例合同編號(hào):__________supplementalleaseagreementthissupplementalleaseagreement(this"supplement")isenteredintoasof__________(the"effectivedate")andbetween__________(the"landlord")and__________(the"tenant").referencesinthissupplementtothe"lease"aretothatcertainleaseagreementdatedasof__________(the"originallease"),andbetweenthelandlordandthetenant,pursuanttowhichthetenantisleasingfromthelandlord,andthelandlordisleasingtothetenant,certainpremiseslocatedat__________(the"premises").WHEREAS,thepartiesheretodesiretoamendandsupplementtheleaseto,amongotherthings,(i)consenttothetenant'sassignmentoftheleaseto__________(the"assignee")and(ii)modifycertainprovisionsoftheleaseinconnectiontherewith;andWHEREAS,thelandlordiswillingtoconsenttosuchassignmentandtomakesuchmodificationssubjecttothetermsandconditionssetforthherein.NOW,THEREFORE,inconsiderationofthemutualpromisescontainedhereinandforothergoodandvaluableconsideration,thereceiptandsufficiencyofwhicharehereacknowledged,thepartiesheretoagreeasfollows:articlei:assignmentoflease1.1assignment.subjecttothetermsandconditionsofthissupplement,thetenanthereassignsandtransferstotheassigneealloftenant'sright,andinterestinandtothelease,including,withoutlimitation,tenant'srighttooccupyandusethepremises,andalloftenant'srightsandobligationsunderthelease.1.2consent.thelandlordconsentstotheassignmentoftheleasetotheassignee,subjecttothetermsandconditionsofthissupplement.thelandlordacknowledgesthattheassigneehasagreedtoassumealloftenant'sobligationsunderthelease.1.3assignee'sobligations.theassigneeshallbeboundalloftenant'sobligationsunderthelease,asiftheassigneeweretheoriginaltenant.theassigneeshallexecuteanddelivertothelandlordacounterpartofthissupplement,dulyexecutedtheassignee,withinten(10)businessdaysaftertheeffectivedate.articleii:modificationsoflease2.1modificationofdefinitions.thedefinitionssetforthinsection1oftheleaseareamendedandrestatedintheirentiretyasfollows:[insertamendedandrestateddefinitions]2.2modificationofrentpayments.section2.1oftheleaseisamendedandrestatedinitsentiretyasfollows:"2.1rent.thetenantshallpaytothelandlord,inlawfulmoneyoftheunitedstates,asrentfortheuseandoccupationofthepremises,therentprovidedforinthescheduleofrentsattachedheretoasExhibitA(the"scheduleofrents"),whichscheduleisincorporatedintoandmadeapartofthisleaseasifsetforthinfullherein.thescheduleofrentsmaybeamendedfromtimetotimethemutualagreementofthelandlordandthetenant."2.3modificationofuseclause.section5.1oftheleaseisamendedandrestatedinitsentiretyasfollows:"5.1useofpremises.thetenantshallusethepremisesfor__________(the"PermittedUse")onlyandshallnotusethepremisesforanyotherpurposewithoutthepriorwrittenconsentofthelandlord.thetenantshallnotuseorallowtheuseofthepremisesinanymannerthatwouldviolateanylaworordinanceorcausetheinsurancerequiredunderthisleasetobevoidorvoidable."articleiii:representationsandwarranties3.1tenant'srepresentationsandwarranties.thetenantrepresentsandwarrantstothelandlordthat:(a)thetenanthastheright,powerandauthoritytoenterintothissupplementandtoperformitsobligationsunderthelease;(b)thetenantisnotawareofanydefaultorbreachitofanyprovisionofthelease;(c)thetenanthasnotassignedtheleaseoranyinterestinthelease,orencumberedorconveyedthepremises,oranypartthereof,exceptascontemplatedthissupplement;(d)thetenantisnotinsolventandiscapableofperformingitsobligationsunderthelease;and(e)theexecutionanddeliveryofthissupplementandtheperformancethetenantofitsobligationsundertheleasedonotandwillnotconflictwithorresultinabreachofanyagreement,instrumentorjudgmenttowhichthetenantisapartyorissubject.3.2landlord'srepresentationsandwarranties.thelandlordrepresentsandwarrantstothetenantthat:(a)thelandlordhastheright,powerandauthoritytoenterintothissupplementandtoperformitsobligations一、附件列表:補(bǔ)充租賃合同協(xié)議范例租賃合同(原始合同)租賃物業(yè)現(xiàn)場(chǎng)照片租戶身份證明文件房東授權(quán)書(如適用)租金支付記錄租賃物業(yè)維修記錄任何其他雙方同意作為補(bǔ)充的文件或資料二、違約行為及認(rèn)定:tenant未支付租金或未按時(shí)支付租金。tenant未履行租賃合同中規(guī)定的維護(hù)和保養(yǎng)義務(wù)。tenant未獲得房東同意就轉(zhuǎn)租或部分轉(zhuǎn)租給第三方。tenant未遵守租賃用途規(guī)定,擅自改變物業(yè)用途。landlord未按照合同約定提供物業(yè)或物業(yè)服務(wù)不符合約定。landlord未按時(shí)或未按照約定條件維修物業(yè)。違約行為的認(rèn)定將基于合同條款和適用的法律規(guī)定,以及雙方的具體行為和事實(shí)情況。三、法律名詞及解釋:補(bǔ)充租賃合同:對(duì)原有租賃合同的修改或增加條款的合同。租賃方(tenant):租用物業(yè)的個(gè)人或?qū)嶓w。出租方(landlord):擁有并出租物業(yè)的個(gè)人或?qū)嶓w。租金(rent):租戶為使用和占用物業(yè)而支付的費(fèi)用。違約(breach):違反合同條款的行為。轉(zhuǎn)租(sublet):租戶將租賃的物業(yè)部分或全部轉(zhuǎn)租給第三方。適用法律(applicablelaw):對(duì)合同執(zhí)行具有約束力的法律。四、執(zhí)行中遇到的問題及解決辦法:?jiǎn)栴}:租戶遲延支付租金。解決辦法:發(fā)送書面催款通知,如果在指定時(shí)間內(nèi)未支付,則房東有權(quán)采取法律手段追究違約責(zé)任。問題:租戶改變物業(yè)用途。解決辦法:立即書面通知租戶違
