2025【英文標準】設備租賃合同范本(中英文)EnglishStandardEquipmentLeaseAgreementTemplate2025本合同由以下雙方于年月日在中華人民共和國市簽訂。THISAGREEMENTismadeandenteredintoonthisdayofintheyearinthecityofinthePeople'sRepublicofChinabyandbetween:出租方（以下簡稱“甲方”）：LESSOR(hereinafterreferredtoas"PartyA"):名稱：Name:地址：Address:聯(lián)系人：ContactPerson:聯(lián)系電話：ContactTelephone:承租方（以下簡稱“乙方”）：LESSEE(hereinafterreferredtoas"PartyB"):名稱：Name:地址：Address:聯(lián)系人：ContactPerson:聯(lián)系電話：ContactTelephone:鑒于乙方因業(yè)務需要向甲方租賃設備，雙方根據(jù)《中華人民共和國合同法》等相關法律法規(guī)，經(jīng)友好協(xié)商，就設備租賃事宜達成如下協(xié)議：WHEREASPartyBrequirestheleaseofcertainequipmentforitsbusinessoperations,andPartyAiswillingtoleasesuchequipmenttoPartyB;andWHEREASbothpartiesheretohavereachedanagreementconcerningtheleaseoftheequipmentinaccordancewiththerelevantlawsandregulationsofthePeople'sRepublicofChina,includingbutnotlimitedtotheContractLawofthePeople'sRepublicofChina;NOW,THEREFORE,thepartiesheretoagreeasfollows:第一條設備租賃內(nèi)容Clause1:EquipmentLeasingTerms1.1租賃設備：1.1Equipmenttobeleased:設備名稱：NameofEquipment:數(shù)量：Quantity:型號：Model:規(guī)格：Specification:設備編號：EquipmentNumber:1.2設備用途：1.2EquipmentUse:乙方租賃上述設備僅限于用于（具體用途），不得用于其他任何目的。PartyBshallleasetheaforementionedequipmentsolelyforthepurposeof(specificpurpose)andshallnotuseitforanyotherpurposes.第二條租賃期限Clause2:LeaseTerm2.1租賃期限：2.1LeaseDuration:租賃期限為個月，自年月日起至年月日止。Theleasetermshallbemonths,commencingonthedayofintheyearandendingonthedayofintheyear.2.2續(xù)租：2.2Renewal:如乙方希望續(xù)租設備，應在租賃期限屆滿前日以書面形式通知甲方。續(xù)租事宜由雙方另行協(xié)商。IfPartyBdesirestorenewthelease,PartyBshallnotifyPartyAinwritingatleastdayspriortotheexpirationoftheleaseterm.Thetermsofrenewalshallbenegotiatedseparatelybybothparties.第三條租金及支付方式Clause3:RentandPaymentMethod3.1租金標準：3.1RentStandard:租金為人民幣元/月（大寫：），租金總計人民幣元（大寫：）。TherentshallbeRMBpermonth(inwords:),withatotalrentofRMB(inwords:).3.2支付方式：3.2PaymentMethod:租金按（月/季度/年）支付，首次租金應于日前支付，后續(xù)租金每期日前支付。Rentshallbepaid(monthly/quarterly/yearly).Thefirstpaymentshallbemadebyandsubsequentpaymentsshallbemadebytheofeachperiod.3.3押金：3.3Deposit:乙方應于本合同簽訂之日起日內(nèi)支付押金人民幣元（大寫：），押金用于保證乙方在租賃期間履行本合同項下的義務。PartyBshallpayadepositofRMB(inwords:)toPartyAwithindaysfromthedateofthisAgreement.ThedepositshallserveassecurityforPartyB'sobligationsunderthisAgreementduringtheleaseterm.3.4退還押金：3.4RefundofDeposit:租賃期滿后，如乙方未違反本合同任何條款且設備完好無損，甲方應在日內(nèi)退還押金。Upontheexpirationoftheleaseterm,ifPartyBhasnotbreachedanytermofthisAgreementandtheequipmentisingoodcondition,PartyAshallrefundthedeposittoPartyBwithindays.第四條設備使用及責任Clause4:EquipmentUseandResponsibilities4.1設備使用地點及方式：4.1EquipmentUseLocationandMethod:設備使用地點為，乙方不得擅自變更設備使用地點或改變設備用途。Theequipmentshallbeusedatthelocationof,andPartyBshallnotaltertheuselocationorthepurposeoftheequipmentwithoutthepriorwrittenconsentofPartyA.4.2設備保管及維護：4.2EquipmentCareandMaintenance:乙方應妥善保管和使用設備，并承擔設備在租賃期間的日常維護和保養(yǎng)責任。PartyBshallproperlycareforandusetheequipmentandshallberesponsibleforthedailymaintenanceandupkeepoftheequipmentduringtheleaseterm.4.3設備損壞及丟失：4.3EquipmentDamageandLoss:如因乙方原因?qū)е略O備損壞或丟失，乙方應承擔修復或賠償責任。IftheequipmentisdamagedorlostduetoPartyB'sfault,PartyBshallberesponsibleforrepairorcompensation.4.4不可抗力：4.4ForceMajeure:如因不可抗力導致設備損壞或無法使用，雙方應及時協(xié)商解決，無法協(xié)商的可依法終止合同。Ifequipmentdamageorunavailabilityiscausedbyforcemajeure,bothpartiesshallpromptlynegotiateasolution.Ifnoagreementcanbereached,thecontractmaybeterminatedinaccordancewiththelaw.第五條設備維修及保養(yǎng)Clause5:EquipmentRepairandMaintenance5.1設備日常維護：5.1DailyMaintenanceofEquipment:設備的日常維護由乙方負責，甲方提供必要的技術指導。ThedailymaintenanceoftheequipmentshallbehandledbyPartyB,andPartyAshallprovidenecessarytechnicalguidance.5.2設備故障處理：5.2EquipmentMalfunctionHandling:如設備發(fā)生故障，乙方應立即通知甲方，并采取必要措施防止損失擴大。甲方應在接到通知后小時內(nèi)響應并安排維修。Incaseofequipmentmalfunction,PartyBshallimmediatelynotifyPartyAandtakenecessarymeasurestopreventfurtherdamage.PartyAshallrespondandarrangeforrepairswithinhoursafterreceivingthenotice.5.3維修費用：5.3RepairCosts:維修費用由承擔（甲方/乙方）。Repaircostsshallbeborneby(PartyA/PartyB).第六條保險Clause6:Insurance6.1設備保險：6.1EquipmentInsurance:甲方負責為租賃設備購買保險，保險費用由甲方承擔。PartyAshallberesponsibleforpurchasinginsurancefortheleasedequipmentatitsownexpense.6.2保險責任范圍：6.2ScopeofInsuranceCoverage:保險覆蓋范圍包括設備的損失和損壞，但不包括因乙方操作不當或其他過失造成的損失。Theinsurancecoverageincludesdamagesandlossestotheequipment,butexcludesdamagesorlossescausedbyimproperoperationoranyothernegligenceonthepartofPartyB.第七條違約責任Clause7:LiabilityforBreachofContract7.1違約金：7.1Penalty:如一方違反本合同任何條款，違約方應向守約方支付違約金人民幣元（大寫：）。IfanypartybreachesanyprovisionofthisAgreement,thebreachingpartyshallpayapenaltyofRMB(inwords:)tothenon-breachingparty.7.2合同終止：7.2TerminationofContract:如一方嚴重違約，另一方有權單方面終止合同，并要求違約方賠償由此造成的全部損失。IfonepartycommitsamaterialbreachofthisAgreement,theotherpartyshallhavetherighttoterminatethisAgreementunilaterallyandclaimcompensationforalllossessustainedthereby.第八條合同的變更與解除Clause8:ModificationandTerminationoftheAgreement8.1合同變更：8.1ModificationofAgreement:本合同的任何變更須經(jīng)雙方協(xié)商一致，并以書面形式確認。AnymodificationtothisAgreementshallbemadeonlyaftermutualagreementbetweenthepartiesandconfirmedinwriting.8.2合同解除：8.2TerminationofAgreement:如需解除合同，雙方應提前日以書面形式通知對方。ToterminatethisAgreement,bothpartiesshallprovidewrittennoticetotheotherpartyatleastdaysinadvance.第九條爭議解決Clause9:DisputeResolution因本合同引起的或與本合同有關的任何爭議，雙方應友好協(xié)商解決。協(xié)商不成的，任何一方均可向人民法院提起訴訟。AnydisputesarisingoutoforrelatingtothisAgreementshallbesettledamicablythroughfriendlynego
