2、國(guó)合同法、中華人民共和國(guó)建筑法及其他有關(guān)法律、法規(guī)，及遵循平等、自愿、公平和誠(chéng)實(shí)信用的原則；茲以上述各點(diǎn)和契約所載條款為約因，雙方就本工程施工事項(xiàng)協(xié)商一致，訂立本合同。WHEREASparty A is ready to contract the project of excavation / transport of foundation trench earthwork (hereinafter referenced to as project ) to party B for execution and completion;WHEREAS party B possess the qua

4、ty.NOWTHEREFORE,in consideration terms and provisions contained, on this project as follows:of the premises and the covenants herein, the parties hereto makemutual agreement第 1 條：工程概況 Article one Project Overview 1.1 工程名稱：基坑土方開(kāi)挖、運(yùn)輸ProjectName: excavation/ transportof foundationtrench earthwork1.2工程地

5、點(diǎn)：Project Place1.3工程內(nèi)容：Project Content+2.3m 以下至墊層底以上 30cm深度范圍內(nèi)土方挖運(yùn)；樁頭破除后樁頭砼的挖運(yùn)；土方開(kāi)挖過(guò)程中地下障礙物的處理、挖運(yùn)及文物的保護(hù)；挖土場(chǎng)地內(nèi)及卸土場(chǎng)地臨時(shí)道路鋪設(shè)、維修；以及有關(guān)土方工程其他事項(xiàng)。Earthwork excavation / transportation within 30cm depth from +2.3m to cushion the bottom above; excavation / transportation of concrete of breaking pile head; trea

7、Project Scale: excavation / transport of foundation trench earthwork ， including cooperation of the execution of trench maintenance company and meet the requirement thereof.乙方自帶挖機(jī)、泥頭車、堆土機(jī)等機(jī)具挖運(yùn)基坑土方。將土方運(yùn)輸?shù)奖卷?xiàng)目場(chǎng)內(nèi)甲方指定地點(diǎn)（含臨建場(chǎng)地和甲方指定的其它地方堆放、回填，運(yùn)距約 3 公里）。棄土場(chǎng)地要將土方推堆土高度在 4 米內(nèi)。推土費(fèi)用在土方單價(jià)內(nèi)。Excavator, dump truck a

Earth pile in the waste soil site is within 4 meters, for which the cost is taken into the earthwork unit price.1.5 工程造價(jià)： Project Cost開(kāi)挖土方量按甲方測(cè)量放線的開(kāi)挖范圍，結(jié)合經(jīng)審批的施工方案確定的開(kāi)挖底標(biāo)高，確定深度。挖運(yùn)土方的工程量按實(shí)結(jié)算，具體根據(jù)指定開(kāi)挖范圍的有效面積乘以開(kāi)挖深度計(jì)算。開(kāi)挖前后的標(biāo)高由雙方測(cè)量確定。土方挖運(yùn)綜合單價(jià)為：元 / 立方米，該單價(jià)包含挖、運(yùn)并按甲方要求用機(jī)械堆放好，該單價(jià)不含稅

10、。Quantity of earthwork excavation is subject to the excavated scale ofparty A s survey and setting line and determine the depth thereof bycombining with the approval of bottom elevation of execution schedule.Quantityofearthwork ismadesettlementon actualworks and the specificcalculation thereof is su

11、bject to the effective area multiplied by theexcavationdepth withinthe designated scale. The elevationpriorto andafter excavation will be terminated jointly by parties hereto.Comprehensive unit priceof earth work isYuan/ cubicmeter,which,being exclusive of taxes, include the prices of excavation,tra

12、nsportation and stack using machinery under party As requirement.第 2 條：承包方式 Article Two Contracting Means本工程采取固定總價(jià)承包方式。 Fixed price is practicable to this project.第 3 條：工期Article Three Project Period基坑土方開(kāi)挖工期暫定為 30 天（以甲方通知開(kāi)挖日期為開(kāi)工日），如果因甲方原因造成工期延誤的，經(jīng)甲方確認(rèn)后工期可順延。如果因設(shè)計(jì)變更或其它非乙方能力所能抵御的原因，而不能按期完工或中途停工，則竣工日期應(yīng)

16、eafter.第 5 條：工程變更 Article Five Alteration of Project5.1 甲、乙雙方應(yīng)按照本工程的批文圖紙進(jìn)行施工，在施工中如確實(shí)需要變更設(shè)計(jì)時(shí)，甲、乙雙方應(yīng)按規(guī)定辦理變更手續(xù)，竣工結(jié)算時(shí)，其工程造價(jià)應(yīng)按實(shí)調(diào)整。Parties hereto should carry out the execution pursuant to the approved document and drawings of this project, where in necessary to change or alter design during construction,

17、 the alteration procedure should be processed by parties hereto and the project cost should, at the date of completion settlement, be made adjustment thereof.5.2 如果工程變更對(duì)工期有影響時(shí)， 因甲方或設(shè)計(jì)單位責(zé)任造成的工期應(yīng)順延，如乙方責(zé)任引起的，工期不得順延。Provided that if work period is effected or delayed by such alteration or the liabilitie

18、s of party A or design company, work period should beduly postponed, however where due to party B s liability, work period can not be postponed.第 6 條：各方義務(wù)與責(zé)任 Article Six Liabilities and Responsibilities of Parties6.1 甲方義務(wù)： Liabilities and responsibilities of party A（ 1）積極、合理安排乙方開(kāi)挖工作，確保乙方機(jī)械設(shè)備的利用率。Act

20、ity andtelecommunicationlineto the site,forwhich the relevantexpense shallbe account of party B.（ 3）工程開(kāi)工前，對(duì)乙方進(jìn)行基坑系統(tǒng)各方面情況的書(shū)面技術(shù)交底，并將工程地質(zhì)和地下管線資料提供給乙方，將水準(zhǔn)點(diǎn)、坐標(biāo)控制點(diǎn)在承包雙方以及監(jiān)理單位見(jiàn)證下進(jìn)行現(xiàn)場(chǎng)交驗(yàn)，并提供書(shū)面報(bào)告交乙方。Prior to commencement of work conduct the design briefing and joint check-up of drawings of all aspects of foun

23、ties hereto will be deemed as the basis of settlement.（ 5）負(fù)責(zé)基坑圍護(hù)、深井降水的施工、監(jiān)測(cè)和日常維護(hù)工作，若由于甲方支撐維護(hù)原因或降水不到位造成的工程施工難度增加或工期延長(zhǎng)而增加的工程造價(jià)由甲方負(fù)責(zé)承擔(dān)，并賠償由此給乙方造成的所有損失。Responsible for foundation trench support, the execution, supervision and daily maintenance of deep well, if, any increased difficulty of construction o

25、 1）積極配合甲方的工作安排，滿足整個(gè)基坑施工安全、進(jìn)度、質(zhì)量要求。Conduct active cooperation with party As arrangement and meet therequirements of the safety, schedule and quality of entire foundation trench project.（ 2）承擔(dān)施工安全責(zé)任，發(fā)生事故所產(chǎn)生的費(fèi)用由乙方負(fù)責(zé)， 并賠償由此給甲方造成的所有損失。Party B should undertake the liability of safety during construction,b

26、ear the expense for accident in work and make compensation for the loss arising therefrom to party A .（ 3）派測(cè)量員開(kāi)挖范圍的測(cè)量放線和開(kāi)挖過(guò)程的坑底標(biāo)高核查。Dispatch surveyor to carry out the measure and setting scope in addition to the check-up of bottom elevationline of excavation during excavation.（ 4）乙方負(fù)責(zé)派遣足夠的人力、物力（工人、機(jī)

27、械）參加施工作業(yè)，并按甲方的需要隨時(shí)增減調(diào)配車輛和挖土機(jī)械，根據(jù)甲方分段提供的工作面挖土，滿足建設(shè)方要求的工程進(jìn)度。Party B should responsiblefor dispatchingsufficientmanpower, materialresource including labor and machinery to participate in theconstruction, andas per partyAs requirementat any time increaseordecrease the deployment of vehiclesand machinery

28、 to conduct excavationon the working areas which are required separately by party A so as tosatisfy project progress of employer.（ 5）完成土方的挖、 運(yùn)、棄土場(chǎng)地的推堆土、 在基坑內(nèi)配合挖出排水 （土）溝、集水坑以便于集中抽水?；拥滓酒秸?，如果不平，乙方需要自行出機(jī)械設(shè)備整平。第 7 條：違約責(zé)任甲、乙雙方應(yīng)互相配合，確保工程合同工期（105 天）內(nèi)完成。若工程在招標(biāo)工期（ 120 天）內(nèi)完成，雙方不承擔(dān)違約責(zé)任。若工期超過(guò)招標(biāo)工期，分析原因：除不可抗拒力（

29、雨雪天等）及非甲、乙雙方原因外，因乙方原因造成工期延誤的，按延期每一日歷天罰5000 元，并全額賠償由此給甲方帶來(lái)的損失；因甲方原因造成乙方工期延誤的，則按延期每一日歷天罰5000 元，并全額賠償由此給乙方帶來(lái)的損失。第 8 條：質(zhì)量驗(yàn)收標(biāo)準(zhǔn) Article Six Standard of Quality Acceptance本工程嚴(yán)格按照國(guó)家現(xiàn)行建筑工程質(zhì)量檢驗(yàn)及評(píng)定標(biāo)準(zhǔn)、建筑地基與基礎(chǔ)工程施工質(zhì)量驗(yàn)收規(guī)范等進(jìn)行施工和驗(yàn)收。This project should be carried out and accepted in accordance withState s existing ST

30、ANDARD OF QUALITY INSPECTION AND EVALUATION FOR CONSTRUCTION ENGINEERING, and NORM OF CONSTRUCTION QUALITY ACCEPTANCE FOR FOUNDATION AND BASE ENGINEERING and others.7.1 工程質(zhì)量必須符合本工程設(shè)計(jì)圖紙和有關(guān)設(shè)計(jì)規(guī)范的要求，甲方必須指派施工技術(shù)人員檢查督促，以保證工程質(zhì)量。7.2 所有各部分分項(xiàng)工程應(yīng)由現(xiàn)場(chǎng)施工人員會(huì)同甲方指定人員共同驗(yàn)收合格，并按規(guī)定做好驗(yàn)收記錄后，方可進(jìn)行下道工序的施工。第 9 條：工程協(xié)調(diào)與安全8.1甲方應(yīng)積

31、極做好地方協(xié)調(diào)和工地安全監(jiān)督工作。8.2 乙方應(yīng)在甲方要求下按照施工規(guī)范做好安全管理工作，確保施工安全，否若發(fā)生一切安全責(zé)任，均由乙方負(fù)責(zé)。8.3 甲方委派 ，乙方委派 為施工現(xiàn)場(chǎng)負(fù)責(zé)人。甲乙雙方共同處理本工程的有關(guān)事宜和辦理施工中的各項(xiàng)驗(yàn)收簽證工作。第 10 條：其他約定10.1本合同雙方簽字蓋章后生效， 工程竣工驗(yàn)收，交付簽證，款項(xiàng)結(jié)清后失效，本合同一式份，10.2本合同如有未盡事宜，甲乙雙方協(xié)商解決。10.3 凡因執(zhí)行本合同所發(fā)生的或與本合同有關(guān)的一切爭(zhēng)議，雙方應(yīng)通過(guò)友好協(xié)商解決。協(xié)商不能解決的應(yīng)提交 _仲裁機(jī)構(gòu)，根據(jù)該仲裁組織的仲裁程序規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，雙方都有約束力。A

36、il and backfilling in the project.二、土方清土Cleaning of earthwork本工程機(jī)械挖土標(biāo)高控制在基底 300mm處，余下土方改用人工清槽至基底標(biāo)高，標(biāo)高誤差和平整度均嚴(yán)格按規(guī)范標(biāo)準(zhǔn)執(zhí)行。挖土接近坑底時(shí)，由現(xiàn)場(chǎng)專職測(cè)量員用水平儀將水準(zhǔn)標(biāo)高引測(cè)至坑底。將水平儀置于坑底，每隔 46m設(shè)置一標(biāo)高控制點(diǎn)，縱橫向組成標(biāo)高控制網(wǎng)，以準(zhǔn)確控制基坑標(biāo)高。In this project, excavating elevation made by machine should becontrolled intheplace of300mm of base found

45、coefficient is 0.95.2）施工前進(jìn)行擊實(shí)試驗(yàn)，并根據(jù)試驗(yàn)結(jié)果確定最優(yōu)含水率和擊實(shí)遍數(shù)。Before construction, compaction test should be made. Optimum moisturecontent and compacting times should be determined in accordance with test result.3）回填土應(yīng)分層鋪攤，蛙式打夯機(jī)每層需鋪土厚度為 200 250 mm；人工打夯處不大于 200mm。每層鋪攤后隨之耙平?；靥钔撩繉又辽俸淮蛉?。打夯應(yīng)一夯壓半夯，夯夯相連，行行相連，縱橫交叉。B

If the place is lower than standard height, is should be backfilled and hammered.第二套方案：土方工程施工方案Construction Plan for Foundation Pit1、工程概況Overview of Project由于工程地坪板、地坪梁、承臺(tái)標(biāo)高不一致，且相差甚遠(yuǎn)，但承臺(tái)布置密集，開(kāi)挖后相互間的距離很小， 故考慮每區(qū)土方先滿堂大開(kāi)挖至地坪梁墊層底 ( 個(gè)別地坪梁標(biāo)高或低或高于此標(biāo)高的另外處理 ) ，然后進(jìn)行承臺(tái)基坑、基槽（同一軸線上承臺(tái)相互間距離很
