2、受的損失提出索 賠。(13) 單 據(jù)：賣(mài)方應(yīng)向議付銀行提供已裝船清潔提 單、發(fā)票、中國(guó)商品檢驗(yàn)局或工廠(chǎng)出具的品質(zhì)證明、中國(guó)商 品檢驗(yàn)局出具的數(shù)量/重量簽定書(shū)；如果本合同按CIF條 件，應(yīng)再提供可轉(zhuǎn)讓的保險(xiǎn)單或保險(xiǎn)憑證。(14) 凡以CIF條件成交的業(yè)務(wù)，保額為發(fā)票價(jià)值 的110%,投保險(xiǎn)別以本售貨合同中所開(kāi)列的為限，買(mǎi)方 如要求增加保額或保險(xiǎn)范圍，應(yīng)于裝船前經(jīng)售方同意，因此 而增加的保險(xiǎn)費(fèi)由買(mǎi)方負(fù)責(zé)。(15 )質(zhì)量、數(shù)量索賠：如交貨質(zhì)量不符，買(mǎi)方須于 貨物到達(dá)目的港3 0日內(nèi)提出索賠；數(shù)量索賠須于貨物到達(dá) 目的港15日內(nèi)提出。對(duì)由于保險(xiǎn)公司、船公司和其它轉(zhuǎn)運(yùn) 單位或郵政部門(mén)造成的損失賣(mài)方不承擔(dān)

3、責(zé)任。(16 )本合同內(nèi)所述全部或部份商品，如因人力不可 抗拒的原因，以致不能履約或延遲交貨，售方概不負(fù)責(zé)。(17) 仲裁：凡因執(zhí)行本合同或與本合同有關(guān)事項(xiàng)所 發(fā)生的一切爭(zhēng)執(zhí)，應(yīng)由雙方通過(guò)友好方式協(xié)商解決。如果不 能取得協(xié)議時(shí)，則在中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)根據(jù)該仲 裁機(jī)構(gòu)的仲裁程序規(guī)則進(jìn)行仲裁。仲裁決定是終局的，對(duì)雙 方具有同等約束力。仲裁費(fèi)用除非仲裁機(jī)構(gòu)另有決定外，均 由敗訴一方負(fù)擔(dān)。仲裁也可在雙方同意的第三國(guó)進(jìn)行。(18) 買(mǎi)方在開(kāi)給售方的信用證上請(qǐng)?zhí)钭⒈敬_認(rèn)書(shū)號(hào) 碼。(19 )其它條款：賣(mài)方：買(mǎi)方：2. 9、t is made on CIF basis.(14) For this contract signed on CIF basis, the premium should be 110% of invoice value. All risks insured should be included within this contract.If the Buyer asks to increase the insurance premium or scope of risks, he should get the permission of the Seller before time of l

10、oading,and all the charges thus incurred should be borne by the Buyer.(15) Quality/Quantity Discrepancy; In case ofquality discrepancy,claim should be filed by the Buyer within 30 days after the arrival of the goods at port of destination; while for quantity discrepancy, claim should be filed by the

11、 Buyer within 15 days after the arrival of the goods at port of destination. It is understood that the Seller shall not be liable for any discrepancy of the goods shipped due to causes for which the Insurance Company, Shipping Company, other transportation organizations and/or Post Office are liable

12、.(16) The Seller shall not be held liable for failure or delay in delivery of the entire lot or a portion of the goods under this Sales Contract in consequence of any Force Majeure incidents.(17) Arbitration:All disputes in connection with this contract or the execution thereof shall be settled frie

13、ndly through negotiations. In case no settlement can be reached, the case may then be submitted for arbitration to China International Economic And Trade Arbitration Commission in accordance with the provisional Rules of Procedures promulgated by the said Arbitration Commission. The arbitrationshall

14、 take place in Beijingand the decision of the Arbitration Commission shall be final and binding upon both parties; neither party shall seek recourse to a law court nor other authorities to appeal for revision of the decision.
