1、農(nóng)村土地違法、非法使用現(xiàn)實(shí)情況的調(diào)查報(bào)告調(diào)查對象：農(nóng)民，開發(fā)商，村干部，鄉(xiāng)領(lǐng)導(dǎo)；調(diào)查目的：對現(xiàn)農(nóng)村土地的現(xiàn)實(shí)情況及特點(diǎn)，違法使用土地造 成的危害的原因等方面進(jìn)行分析，提出相應(yīng)的防范對策；調(diào)查方法：面談，實(shí)際走訪，田間實(shí)際考察；調(diào)查地點(diǎn)：靛水街道，石柳鄉(xiāng)，調(diào)查時(shí)間：2014年4月28日-4月30日前言：俗話說：民以食為天。而土地是發(fā)展糧食產(chǎn)物的基礎(chǔ)個(gè)關(guān)鍵。作為傳統(tǒng)農(nóng)業(yè)大國，土地是農(nóng)民生存的基礎(chǔ)，也是社會經(jīng)濟(jì)發(fā)展的先 決條件之一！但目前違法使用土地，非法占用土地越來越嚴(yán)重，為了 進(jìn)一步了解土地現(xiàn)狀，特點(diǎn)和規(guī)律，減少土地流失，針對目前的情況 進(jìn)行了一次社會調(diào)查，現(xiàn)將情況報(bào)告如下：一、基本情況及特點(diǎn)（

7、moralandChinesetraditionalvirtue(二)特點(diǎn)1、違法使用土地主要在廣大農(nóng)村和城鄉(xiāng)集合部占現(xiàn)有土地的 30 %2、農(nóng)民在承包地上私自種植非糧食植物(比如載樹，)或農(nóng)田改為魚塘和建房，傳統(tǒng)土葬；3、政府為城鎮(zhèn)化建設(shè)劃地,開發(fā)商商業(yè)用地圈地；4、外出打工，年紀(jì)大的農(nóng)民違法使用土地的占40%,由于左右栽樹無法再種植農(nóng)作物的占20%,政府以及開發(fā)商占40%;5、違法使用土地、非法占用土地居高不下，據(jù)調(diào)查由于外出打工的人越來越多，人口老年化越來越重在自家承包地栽樹和其它非農(nóng)業(yè)行為的也會越來越嚴(yán)重，政府為了加大開發(fā)速度也會不斷的占用農(nóng)田，開發(fā)商利益驅(qū)使圈地也會越來越大。二、違法

8、使用土地和非法占用土地的危害1、糧食減少。我國是一個(gè)人口大國，糧食問題始終是關(guān)系國家安全、社會穩(wěn)定的重大戰(zhàn)略問題，與自然災(zāi)害相比，違法使用土地和非法占用土地是影響我國糧食生產(chǎn)的主要因素，造成的糧食損失更為嚴(yán)重。據(jù)統(tǒng)計(jì)分析， (按一村民小組)有 60 畝違法使用土地和非法占用土地按每畝每年 500 公斤糧食計(jì)算，一村民小組每年就減少30000公斤糧食。所以說違法使用土地和非法占用土地是始終困擾著我國經(jīng)濟(jì)、社會特別是農(nóng)業(yè)的發(fā)展的主要因素之一。2、對環(huán)境的影響。隨著城市企業(yè)向農(nóng)村轉(zhuǎn)移，工業(yè)廢水、廢氣、廢渣的污染向農(nóng)業(yè)環(huán)境蔓延。違法使用土地使土地荒漠化，植被減少間接影響氣候；3、糧價(jià)飛漲。由于違法使用

9、土地和非法占用土地使糧食種植面積減少糧食產(chǎn)量減產(chǎn)，直接導(dǎo)致糧食漲價(jià)。三、違法使用土地和非法占用土地原因分析。1、 無法農(nóng)作物種植，由于承包人土地少種地已不能滿足家庭開資，只有離地外出打工，土地要么栽樹或挖塘，或托付親友做非農(nóng)業(yè)用途。2、不能農(nóng)作物種植，由于承包人年紀(jì)大已不能農(nóng)業(yè)種植。3、 無奈放棄農(nóng)作物種植，由于承包人的土地左右原因自己的土地已無法再種植農(nóng)作物。4、政府劃地，由于政府規(guī)劃。5、開發(fā)商用地，由于利益驅(qū)使圈地。四、對策。1、加快法制進(jìn)程建設(shè)在非法、違法使用土地的很多案例中，對于具體案例找不到實(shí)施法律制裁的依據(jù)，使具體的責(zé)任人逃脫法律在制裁。只有不斷完善社會主義法律體系，增強(qiáng)國家土地

18、ne S ociali stcore val ues, promote Socialistt houghtmoralandChinesetraditionalvirtue2、加強(qiáng)思想道德教育與法制宣傳。加強(qiáng)思想道德教育，使廣大的群眾了解土地對于農(nóng)戶、國家、民族的重要性，自覺形成合理使用土地、保護(hù)土地的思想道德意識。加大土地法等相關(guān)法的宣傳，做到每個(gè)村民及村干部，鄉(xiāng)領(lǐng)導(dǎo)，以及政府，開發(fā)商，都要知法，懂法，依法。3、強(qiáng)化法律執(zhí)行力，做到有法必依、違法必究。在針對違法使用土地和非法占用土地行為中，加大打擊力度，嚴(yán)厲打擊各種違法使用土地和非法占用土地的個(gè)人和集體。并形成長期有效的執(zhí)行機(jī)制，來遏制違法使

19、用土地和非法占用土地行為的發(fā)生。4、優(yōu)化土地承包，有效合理的利用土地。根據(jù)目前現(xiàn)況讓所有進(jìn)城農(nóng)民回鄉(xiāng)種地是不可能，只有現(xiàn)在把農(nóng)民的土地集中成片以承包人名義自愿的情況下轉(zhuǎn)包給他人(不改變種植結(jié)構(gòu)) ，開發(fā)商不開發(fā)的地要無常還給原先農(nóng)民，政府謹(jǐn)慎劃地。5、加大政府的職能作用。政府要加大農(nóng)業(yè)投入，加大對現(xiàn)在確實(shí)還在種植的農(nóng)民的直補(bǔ)，做好基礎(chǔ)農(nóng)田，道路、水利合理化規(guī)劃建設(shè)，解決農(nóng)民種地難的一系列問題。報(bào)告人：龐家生ullstrictlyrule partyis all memberscommon re sponsibilit y,must impl ementationtoea ch bra ncha
