1、英文書寫海上聲明、海事報(bào)告、業(yè)務(wù)函電一、海事聲明:船舶在錨泊,系泊,裝貨,航行,卸貨等某一運(yùn)輸環(huán)節(jié)中,遭到了自然災(zāi)害襲擊,船員雖然竭 盡全力保護(hù)船舶和貨物安全,但仍然擔(dān)心或認(rèn)為船體,設(shè)備和貨物有某種程度的損失或損壞, 則應(yīng)在到達(dá)受災(zāi)襲擊 后的第一個(gè)停泊港口時(shí)盡快向有關(guān)方面提出海事聲明,取得簽證后,抄送貨方及其他有關(guān)方,這種聲明是日后宣布損失,索賠或申報(bào)免責(zé)的初步證明文件,其正文一般包括下列內(nèi)容:1本船船名,船籍港,噸位,貨種,貨物數(shù)量,出發(fā)港,目的港及掛靠港等。2遭遇自然災(zāi)害的時(shí)間,地點(diǎn)或海域。3自然災(zāi)害的性質(zhì),程度。4聲明對(duì)可能發(fā)生的 損失或損壞不負(fù)責(zé)任。5保留適當(dāng)時(shí)間和地點(diǎn)延伸該聲明的權(quán)利

2、。海事聲明要有 2到3名經(jīng)歷災(zāi)難的人員作證并簽 字,常應(yīng)附有記錄當(dāng)時(shí)海況,天氣及爭取的措施等航海日志摘要。二、海事報(bào)告:船舶在航行或是停泊中發(fā)生事故,對(duì)船舶,貨物,水域環(huán)境造成了損害,為了說明事故發(fā)生的 過程和責(zé)任情況,船長應(yīng)向有關(guān)方面提交海事報(bào)告, 這是船長在履行的一項(xiàng)法律義務(wù), 其格式與內(nèi)容要嚴(yán)格按照當(dāng)?shù)刂鞴軝C(jī)關(guān)餓規(guī)定,應(yīng)以陳述事實(shí)為主,切記推斷,更不必檢討個(gè)人過失,船長應(yīng)召集全體駕駛員和值班水手認(rèn)真回憶事故經(jīng)過,并畫出示意圖,依照事實(shí)剔除記憶誤差,最后謹(jǐn)慎的將有關(guān)情況填在正式報(bào)告中,其內(nèi)容一定要與航海日志,車鐘記錄簿和海圖作業(yè)相符,附送的材料要盡可能詳盡齊全,其格式一般有以下幾部分構(gòu)成:

3、1、海事報(bào)告封面包括標(biāo)題,接受海事報(bào)告的機(jī)關(guān),事故發(fā)生的時(shí)間和水域,附送材料的份數(shù),以及船長簽字船章和遞交報(bào)告的日期。2、本船概況,該部分應(yīng)按照當(dāng)事船舶所持有的國籍證書中的有關(guān)資料填寫,國籍證書中涉及的項(xiàng)目按船舶的其他資料填寫。3、船舶航行及避讓情況,當(dāng)船舶發(fā)生碰撞事故時(shí)才填寫本部分。4、發(fā)生事故的詳細(xì)經(jīng)過。5、事故示意圖要求標(biāo)明船名,時(shí)間,船位,航跡或隊(duì)形。6、損失情況,包括本船損失情況和他船損壞情況,重點(diǎn)為本船損失情況。7、附件:根據(jù)事故性質(zhì)和具體情況,通常在海事報(bào)告后附有下列材料:航海日志,機(jī)艙輪機(jī)日志摘要,海圖,原航線和船位的記錄,船舶受損部位簡圖以及海事經(jīng)過簡圖,船舶檢驗(yàn)或堅(jiān)定報(bào)告,

4、船員證明材料 等等。三、業(yè)務(wù)函電:航海英語信函大多數(shù)情況下具有一定的法律作用,因而行文必須注意使用法律方面的措辭,準(zhǔn) 確使用法律方面的術(shù)語,以避免日后引起不必要的糾紛,有關(guān)技術(shù)環(huán)節(jié)方面的敘述必須注意使用技術(shù)術(shù)語, 不可隨 意措辭造句,行文應(yīng)嚴(yán)謹(jǐn),明確,不生歧義,其格式一般如下:1公文紙的文頭,一般應(yīng)包括公司的標(biāo)志,公司的名稱,地址,電話,電報(bào),電傳,傳真號(hào)碼,電子郵件地址等。2本船船名及地址,打印本船船名,本船所在地,一般是船舶所在港口的名稱。3日期,通常應(yīng)是信函擬發(fā)出之日期,而不是撰稿之日期。4對(duì)方地址,打印對(duì)方所在部門。5稱呼,稱呼后可接姓或全名,名前不能加稱呼。6正文。7致謝或盼望。8客

13、surveyor to survey.There is no question that this accident was due to the fact that those in charge of the maneuvering of the lighter did not pay due attention when passing close to our stern and that they failed to take proper steps to keep clear of our propeller as they should have done in compliance with our Notice Board showed on our poop counter.Such being the case, I hold the owner of the lighter responsible for the damage sustained.Accordingly, I
