8、.四雙方責(zé)任及違約處理1、 甲方須征得該房屋共有人同意后方可簽訂本合同。甲方須保證該房屋權(quán)屬無爭(zhēng)議,若發(fā)生權(quán)屬糾紛而影響乙方使用該房屋,則由甲方承擔(dān)一切責(zé)任,并賠償由此給乙方造成的經(jīng)濟(jì)損失。2、 甲方對(duì)乙方的合法使用不得進(jìn)行干涉,在本合同租期內(nèi)不得收回房屋,或轉(zhuǎn)租他人。3、 甲、乙雙方應(yīng)按照成都市房屋租賃管理辦法,在本合同簽訂后30日內(nèi)到當(dāng)?shù)胤慨a(chǎn)管理部門辦理房屋租賃登記備案手續(xù)。非本地戶口的,還須到公安機(jī)關(guān)辦理暫住證。4、 乙方須按時(shí)支付本合同約定的租金,按時(shí)交納水電氣費(fèi)、電話費(fèi)、有線電視收視費(fèi)、寬帶網(wǎng)使用費(fèi)、衛(wèi)生費(fèi)、物管費(fèi)等費(fèi)用。如乙方逾期交付租金,則每逾期一天,甲方有權(quán)按月租金的1%加收滯

9、納金,并有權(quán)收回該屋。5、 乙方應(yīng)遵守小區(qū)物管制度,不得擅自改變?cè)摲课莸慕ㄖY(jié)構(gòu)和用途,不得將該房屋轉(zhuǎn)租他人,不得利用該房屋進(jìn)行違法活動(dòng),否則由乙方承擔(dān)一切責(zé)任,并賠償由此給甲方造成的經(jīng)濟(jì)損失,同時(shí)甲方有 權(quán)收回該房屋。6、 乙方如需對(duì)該房屋進(jìn)行裝修,必須經(jīng)甲方同意后方可實(shí)施。乙方遷出時(shí),不得拆卸固定的裝修設(shè)施,以維持該房屋的完整;在征得甲方同意的情況下,乙方可進(jìn)行拆卸,但必須將該房屋恢復(fù)原狀。7、 甲方應(yīng)保證該房屋的建筑質(zhì)量,發(fā)生嚴(yán)重裂縫、滲水、爆管等質(zhì)量問題,由甲方負(fù)責(zé)維修;租期內(nèi)房 屋的日常維修(如門窗、家具、電器等)由乙方負(fù)責(zé);租期內(nèi),該房屋發(fā)生被盜或因乙方引起的火災(zāi) 等事故,由乙方承

10、擔(dān)全部責(zé)任,并賠償相應(yīng)損失。8、 租賃期滿,乙方應(yīng)按時(shí)遷出。若要繼續(xù)租用,乙方須提前一個(gè)月向甲方提出續(xù)租申請(qǐng),經(jīng)重新簽約后 方可繼續(xù)租用。甲方在同等條件下應(yīng)優(yōu)先考慮乙方的續(xù)租。9、 租賃期未滿,甲乙雙方中任何一方均不得提前解除本合同,否則視為違約。違約方應(yīng)向?qū)Ψ街Ц抖€(gè) 月租金作為違約金。10、 若甲乙雙方任何一方未執(zhí)行本合同之約定而使合同無法履行的,則違約方須承擔(dān)甲乙雙方應(yīng)付經(jīng)紀(jì)方 的合計(jì)傭金。11、因不可抗力的因素致使本合同無法履行,甲乙雙方互不承擔(dān)責(zé)任。五. The responsibilities of both parties and the Breach of the contra

11、ct1、Party A must obtain the consent of the co-owner to sigh this contract. Party A guarantee the lease right of thepremises. Otherwise, Party A will be responsible to compensate Party Bs losses.2、Party A cannot interfere the legal use to Party B. Party A is not permitted to take back the leased prem

12、ises or subletto others during the tenancy period.3、According to“Chengdu lease management”, Party A and Party B have to deal with the house tenancy register inthe Local Property Management Department. The non-local has to apply for a temporary residence permit fromPublic Security Organs.4、Party B wi

13、ll pay the rent, the charges for water, electricity, gas, telephone, cable TV, internet, cleaning, and propertymanagement etc on time. Should Party B be overdue on rent payment, Party A has the right to receive fine fordelaying payment by around 1% of the monthly rental, and has the right to take ba

14、ck the lease premises.5、Party B shall abide by the rules of the community. Party B will use the premises lawfully according to this contractwithout changing the nature of the premises, and has no right to sublet to others. Otherwise, Party B will beresponsible for the damages caused by it and Party

15、A has right to take the premises back.6、Party B may decorate the premises with Party As approval. When this contract expires, Party B maynot remove the fixed decoration in order to maintain the integrity of the house; with Party As approval Party B mayremove the decorations which are removable witho

16、ut changing the good conditions of the premises for normal use.7、Party A will guarantee the quality of the premises. Party A will be responsible to repair the quality problems (seriouscrack, water seepage, tubes explosion etc); Party B will be responsible for the daily maintain(doors, windows,furnit

17、ure and electrical equipment etc); Party B will be undertook whole responsibility and pay the damages whenthe premises were stolen or damaged by the fire accident which caused by Party B.8、5.8 Party B should move out on time. Within onemonth before the contract expires, Party B willnotify Party A if

18、 it intends to extend the leasehold. In this situation, two parties will discuss matters over theextension.9、Both parties shall not terminate the contract before the contract expires; otherwise it defined infringement ofcontract. Two months rent will be paid by the defaulting party as liquided damag

19、e.10、If any party who fails to perform this contract agreed will be deemed to breach the contract.Thefaultless party will pay the amount commission which should paid by two parties as default fine.11、The force majeure to cause this contract failed, both parties shall not bear the responsibility.六其它1

20、、 本合同在履行過程中若發(fā)生爭(zhēng)議,應(yīng)協(xié)商解決。協(xié)商不成,任何一方均可向合同簽訂地人民法院提起 訴訟。2、 本合同一式二份(每份共兩頁) ,甲乙雙方各執(zhí)一份。六.Others1、Both parties will solve the disputes aris ing from executi on of the con tract or in conn ecti on with thecon tract through frien dly con sultati on. Each party will hold 1 origi nal(s), andthe Sichua n Ece n Estate Age ncy will hold 1 origi nal.3、This con tract is effective after both parties and the Sichua n Ecen Estate Age n
