Work place: No.1 Wild Road, Development Zone, Rizhao.第三條 乙方必須按照甲方的合法要求,按時(shí)完成規(guī)定的工作數(shù)量,到達(dá)規(guī)定的質(zhì)量標(biāo)準(zhǔn)。 Party B should fulfill all the work in time and by quality standard according to Party As legal re

5、quirements.三、勞動(dòng)保護(hù)、勞動(dòng)條件、工作時(shí)間和休假 Work Protection, Condition, Time and Leaves第四條 甲方安排乙方執(zhí)行8小時(shí)/日工作制,甲方依法保證乙方的休息權(quán)利。乙方在勞動(dòng)合同履行期間依法享受法定節(jié)假日以及探親假、婚喪假、產(chǎn)假、帶薪年假等休假權(quán)利。 甲方安排乙方每日工作時(shí)間不超過8小時(shí),每周工作5天,平均每周不超過40小時(shí)。甲方保證乙方每周休息二天。因特殊原因需要延長工作時(shí)間的,在保障乙方身體健康的條件下,甲乙雙方友好協(xié)商執(zhí)行,原那么上每月不超過24小時(shí)。 There are 8 working hours per Day. 6、A promises rest time to Party B according to the laws. Party B has the right to enjoy the legal vacation, home leave, marriage and mourning leave, maternity leave and legal paid vacation, etc. Party A arranges Party B to work maximum 8 hours per day and 5 days every week, and the average work hours

7、per week should be not more than 40 hours. Party A gives Party B 2 days vacation every week. Because of special reasons Party B needs to work over-hours on the basis of normal health condition, after agreement of two parties. Basically it should not be more than 24 hours every month.第五條 甲方安排乙方加班的,應(yīng)安

8、排乙方同等時(shí)間補(bǔ)休或依法支付加班工資;加點(diǎn)的,甲方應(yīng)付加點(diǎn)工資。If party A requires party B to do overtime work, Party A should give the equal time leave in some other time or give overtime payment according to law; if party B needs to work in extension hours, Party A should pay for the extension hours.第六條 甲方為乙方提供必要的勞動(dòng)條件和勞開工具,建立健全

9、的生產(chǎn)工藝流程,制定操 作規(guī)程、工作標(biāo)準(zhǔn)和勞動(dòng)平安衛(wèi)生制度及其標(biāo)準(zhǔn)。Party A should provide the necessary work conditions and tools, build up complete production process and make operation regulations, rules and safety system and standards.第七條 甲方負(fù)責(zé)對(duì)乙方進(jìn)行政治思想、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動(dòng)平安衛(wèi)生及有關(guān)規(guī)章制度的教育和培訓(xùn)。 Party A should arrange to give the necessary t

10、raining for Party B about political thoughts, professional morality, operation skills and operation safety and regulations.四、勞動(dòng)報(bào)酬 Work payment第八條 乙方應(yīng)按照甲方的要求完成相應(yīng)的工作,甲方應(yīng)根據(jù)按勞分配、效率優(yōu)先、兼顧公平的原那么,按照國家規(guī)定和甲方依法制定的工資分配方法等規(guī)章制度按月以貨幣形式支付乙方的工資,公司每月7日前為員工支付上月工資(遇節(jié)假日那么順延)。甲方支付乙方的工資標(biāo)準(zhǔn)為: 元/月。工資額度必須對(duì)第三者保密,甲乙雙方都應(yīng)嚴(yán)格遵守。 Pa

Party A should give the payment in cash every month according to national law and party As salary payment regulation on the basis of working, efficiency priority with due consideration to fairness. Every month before 7th, Party A shou

12、ld pay Party Bs salary for last month. Party Bs salary is Yuan/Month. Both parties must keep the salary as a confidential matter to third party. 第九條 由于甲方生產(chǎn)任務(wù)缺乏,使乙方待崗的,甲方保證乙方的月生活費(fèi)不低于日照市最低生活保障。 If Party A doesnt have enough work task and Party B have no work to do, Party A should gives Party B the liv

13、ing allowance which should not be less than Rizhao Minimum living guarantee. 五、保險(xiǎn)福利待遇 Insurance and welfare第十條 甲乙雙方應(yīng)按國家和山東省社會(huì)保險(xiǎn)的有關(guān)規(guī)定交納職工養(yǎng)老、失業(yè)和大病醫(yī)療統(tǒng)籌及其他社會(huì)保險(xiǎn)費(fèi)用。乙方應(yīng)繳納的局部按照法律法規(guī)應(yīng)有甲方代扣代繳的,由甲方從乙方工資中代為扣繳。甲方應(yīng)為乙方填寫?職工養(yǎng)老保險(xiǎn)手冊(cè)?。雙方解除、終止勞動(dòng)合同后,?職工養(yǎng)老保險(xiǎn)手冊(cè)?按有關(guān)規(guī)定轉(zhuǎn)移。Party A and Party B should pay endowment insurance, un

14、employment insurance and serious illness insurance and other social insurance as national and province regulations about insurance. The Part which should be paid by Party B should be withheld from salary by Party A. Party A should fill in Employee Endowment Insurance Handbook for Party B. After the

15、termination of the contract, Employee Endowment Insurance Handbook should be handed over according to relevant regulations.第十一條 乙方患病或非因工負(fù)傷,其工資按照國家已經(jīng)制定相關(guān)規(guī)定執(zhí)行。 If Party B gets ill or gets hurt not because of work, then his/her salary should be calculated according to relevant national regulations. 第十二

16、條 乙方患職業(yè)病或因工負(fù)傷的工資和醫(yī)療保險(xiǎn)待遇按照國家和山東省有關(guān)規(guī)定執(zhí)行。 If Party B gets occupational disease or gets hurt because of work, then his salary and medical insurance should be calculated as relevant national and province regulations.六、勞動(dòng)紀(jì)律 Work Disciplines第十三條 乙方應(yīng)遵守甲方依法制定的規(guī)章制度,嚴(yán)格遵守勞動(dòng)平安衛(wèi)生、生產(chǎn)工藝、操作規(guī)程和工作標(biāo)準(zhǔn),以及?勞動(dòng)合同附件及職工保密協(xié)議書?

17、,保護(hù)甲方的財(cái)產(chǎn),遵守職業(yè)道德;積極參加甲方組織的培訓(xùn),提高思想覺悟和職業(yè)技能。 Party B should follow Party As disciplines and rules, following close to the line of operation safety requirements, process, operation rules and regulations, Appendix to Labor Contract and Employee Secret-Keeping Agreement. Party B should protect companys pro

18、perty, follow professional morality; Party B should be active to attend the training organized by Party A to increase professional skills.第十四條 乙方違反勞動(dòng)紀(jì)律,甲方可依據(jù)本單位規(guī)章制度,給予紀(jì)律處分,直至解除本合同。 If Party B violates disciplines or regulations, Party A could give the penalty according to the companys regulation or

19、rules, or even to end the contract.七、勞動(dòng)合同的變更、解除、終止、續(xù)訂 Change, terminate, end or renew the contract第十五條 訂立本合同所依據(jù)的法律、行政法規(guī)、規(guī)章發(fā)生變化,本合同應(yīng)變更相關(guān)內(nèi)容。 If the relevant laws, regulations or rules have changed, this contract will be changed accordingly as well.第十六條 訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行的,經(jīng)甲乙雙方協(xié)商同意,可以變更本合同相

20、關(guān)內(nèi)容。 If the objective circumstance has changed a lot, which makes it not possible to continue this contract; after agreement of the two parties, the contract could be modified accordingly.第十七條 乙方有以下情形之一的,甲方可以解除本合同: Party A could end the contract with Party B, If Party B:1在試用期間,被證明不符合錄用條件的;It is prov

21、ed during the probation period that Party B is not qualified for the work and employment;2. 嚴(yán)重違反勞動(dòng)紀(jì)律或甲方規(guī)章制度的;Materially violate Party As rules and regulations;以下行為屬于嚴(yán)重違反甲方勞動(dòng)紀(jì)律或規(guī)章制度的行為:Those following actions belong to materially Violation:1在工作期間飲酒的; Drinking during the work time;2連續(xù)曠工超過15天或一年內(nèi)累計(jì)曠工超過

22、30天的; Absent from work continue for 15 days or more than 30 days total a year.3乙方是駕駛員的,因其自身原因,其營運(yùn)效勞的證、照被吊扣或失效15天含以上的或發(fā)生行車事故次要責(zé)任含以上的; If Party B is driver, because of his mistake, the car or car license is caught by police or go out of valid period for more than 15 days (including), or in accident Pa

23、rty B take more than subordinate responsibility (including).(4) 在工作場所打架斗毆、阻礙干擾正常工作秩序及違犯社會(huì)治安管理?xiàng)l例的;Fight on working place, disturb normal working system, and violate society safety management regulation. (5) 乙方以欺詐、脅迫的手段,使甲方在違背真實(shí)意思情況下訂立或者變更合同的; Party B sign or change the contract with party A without t

24、he willing the Party A by cheating or threating.6 在勞動(dòng)關(guān)系存續(xù)期間,與其他用人單位或個(gè)人建立勞動(dòng)關(guān)系或發(fā)生勞務(wù)關(guān)系的;During the contract Period, Party B does work for any other third employment Party.7 在工作期間搞其他產(chǎn)業(yè)或第二職業(yè)的。During work time, Party B does other work or secondary job.(8) 乙方在招聘錄用時(shí)所填個(gè)人履歷和檔案等有關(guān)內(nèi)容不真實(shí),提供虛假信息的。包括但不限于:離職證明、身份證明

25、、戶籍證明、學(xué)歷證明、體檢證明等是虛假或偽造的;應(yīng)聘前患有精神病、傳染性疾病及其他嚴(yán)重影響工作的疾病而在應(yīng)聘時(shí)未聲明Party B gives the false information when filling in the Company Entrance Form, including but not limited to, Dimission Prove, ID prove, Residence Prove, Education Prove, Physical Checking Prove; have serious mental disorder, infected illness

26、or other illness which affects his work.3. 嚴(yán)重失職、營私舞弊,對(duì)甲方利益造成重大損害的(包括但不限于因個(gè)人成心或過失,一次給甲方造成3000元以上損失或連續(xù)12個(gè)月內(nèi)累計(jì)造成5000元損失的;Commits serious dereliction of duty or practices graft, causing substantial damage to the Party A (including but not limited to the loss of 3000Yuan by one time or total 5000Yuan wit

27、hin continue 12 months caused by Party Bs deliberately or fault) ;4, 被依法追究刑事責(zé)任的。Has his criminal liability pursued in accordance with the law.第十八條 以下情形之一,甲方可以解除本合同,但應(yīng)提前三十日以書面形式通知乙方: If one of the following situations applies, Party A could terminate the contract, but has to inform Party B 30 days in

28、 advance by written:1、 乙方患病或非因工負(fù)傷,醫(yī)療期滿后,不能從事原工作也不能從事由甲方另行安排的工作的;After the recovering period of medical care for an illness or non-work-related injury, Party B can engage neither in his original work nor in other work arranged for him by Party A.2、 乙方不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;Party B is incompeten

29、t and remains incompetent after training or adjustment of his position.3、 雙方不能依據(jù)法律律規(guī)定和本合同約定就變更合同達(dá)成協(xié)議的。 Two parties can not reach the agreement to modify the contract as law or this contract.第十九條 甲方瀕臨破產(chǎn)進(jìn)行法定整頓期間或者生產(chǎn)經(jīng)營發(fā)生嚴(yán)重困難,經(jīng)向工會(huì)或者全體職工說明情況,聽取工作或者職工的意見,并向勞動(dòng)行政部門報(bào)告后,可以解除本合同。 During restructuring period pu

30、rsuant to the Enterprise Bankruptcy Law or Serious difficulties in production and/or business operations, after Party A has explained the situations to its Labor Union or to all of his employees, and has considered the opinions of the Labor Union or the employees and has subsequently reported to the

31、 labor administration department, Party A may terminate the contract.第二十條 乙方有以下情形之一的,甲方不得依據(jù)本合同第十八條、第十九條終止、解除合同: Party A may not terminate an employment contract pursuant to Article 18 or Article 19 hereof if Party B:1、患病或非因工負(fù)傷、在規(guī)定的醫(yī)療期內(nèi)的;Has contracted an illness or sustained a non-work-related injur

32、y, and the recovering period of medical care therefore has not expired;2、女職工在孕期、產(chǎn)期、哺乳期內(nèi)的;Is a female employee in her pregnancy, maternity or breast feeding period3、在本單位連續(xù)工作滿十五年,且距法定退休年齡缺乏五年的;Has been working for the Employer continuously for not less than 15 years and is less than 5 years to his leg

33、al retirement age4、法律法規(guī)規(guī)定的其他情形。Other situations pursuant to Laws or regulations第二十一條 乙方患職業(yè)病或因工負(fù)傷,醫(yī)療終結(jié),經(jīng)市、區(qū)、縣勞動(dòng)鑒定委員會(huì)確認(rèn)完全或局部喪失能力的,按勞動(dòng)合同法有關(guān)規(guī)定辦理,不得依據(jù)本合同第十八條、第十九條解除勞動(dòng)合同。 Party B Has been confirmed as having complete lost or partially lost his ability to work due to an occupational disease contracted or a

34、 work-related injury sustained with the Employer, after diagnosed by City, Zone, County Labor authentication Committee ,Party A should not terminate the contract as Article18,19, but should follow relevant regulations. 第二十二條 乙方解除本合同,應(yīng)當(dāng)提前三十日以書面形式通知甲方。 If Party B wants to terminate the contract, he/sh

35、e should inform Party A by written 30 days in advance.第二十三條 有以下情形之一的,乙方可以隨時(shí)通知甲方解除本合同:Party B may terminate the contract in any time under the one of the following situations:1、在試用期內(nèi)的;During the probation period2、甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的;Party A forces or threats Party B to work or illegally restri

36、ct freedom of Party B. 3、甲方不能按照本合同規(guī)定支付勞動(dòng)報(bào)酬或者提供勞動(dòng)條件的。Party A can not pay or provide work conditions as Contract.第二十四條 本合同期限屆滿,甲乙雙方經(jīng)協(xié)商同意,可以續(xù)訂勞動(dòng)合同。 After the termination of the contract, Party A and Party B could renew the contract after discussion and agreement.第二十五條 訂立無固定期限勞動(dòng)合同的,乙方離休、退休、退職及死亡或本合同約定的解除條件出現(xiàn),本合同終止。 If the contract is open-ended contract, when Party B has leaved, retired, died or other factors which would end the contract as we mentioned in the contract, this contract can terminate.第二十六條 乙
