1、外國人在中國永久居留審批管理辦法 Measures for the Administration of Examination and Approval of Foreigners Permanent Residence in China第一條 為規(guī)范外國人在中國永久居留審批管理工作，根據(jù)中華人民共和國外國人入境出境管理法及其實(shí)施細(xì)則的有關(guān)規(guī)定，制定本辦法。Article 1 In order to standardize the examination and approval of foreigners permanent residence in China, these Measure

2、s are formulated in accordance with the relevant provisions of the Law of the Peoples Republic of China on Control of Entry and Exit of Foreigners and the Detailed Rules for its implementation.第二條 外國人在中國永久居留是指外國人在中國居留期限不受限制。Article 2 Foreigners permanent residence in China refers to that the period

3、of foreigners residence in China is not limited.第三條 外國人永久居留證是獲得在中國永久居留資格的外國人在中國境內(nèi)居留的合法身份證件，可以單獨(dú)使用。Article 3 The Foreigners Permanent Residence Card is a valid ID certificate for a foreigner who has obtained permanent residence status in China and may be used independently.第四條 獲得在中國永久居留資格的外國人，憑有效護(hù)照和外

4、國人永久居留證出入中國國境。Article 4 A foreigner with permanent residence status in China may enter and leave China with his(her) valid passport and Foreigners Permanent Residence Card.第五條 受理外國人在中國永久居留申請(qǐng)的機(jī)關(guān)是設(shè)區(qū)的市級(jí)人民政府公安機(jī)關(guān)，直轄市公安分、縣局；審核外國人在中國永久居留申請(qǐng)的機(jī)關(guān)是各省、自治區(qū)、直轄市公安廳、局；審批外國人在中國永久居留申請(qǐng)的機(jī)關(guān)是公安部。Article 5 The authorities

7、 in China is the Ministry of Public Security.第六條 申請(qǐng)?jiān)谥袊谰镁恿舻耐鈬藨?yīng)當(dāng)遵守中國法律，身體健康，無犯罪記錄，并符合下列條件之一：（一）在中國直接投資、連續(xù)三年投資情況穩(wěn)定且納稅記錄良好的；（二）在中國擔(dān)任副總經(jīng)理、副廠長(zhǎng)等職務(wù)以上或者具有副教授、副研究員等副高級(jí)職稱以上以及享受同等待遇，已連續(xù)任職滿四年、四年內(nèi)在中國居留累計(jì)不少于三年且納稅記錄良好的；（三）對(duì)中國有重大、突出貢獻(xiàn)以及國家特別需要的；（四）本款第一項(xiàng)、第二項(xiàng)、第三項(xiàng)所指人員的配偶及其未滿18周歲的未婚子女；（五）中國公民或者在中國獲得永久居留資格的外國人的配偶，婚姻關(guān)系存續(xù)

8、滿五年、已在中國連續(xù)居留滿五年、每年在中國居留不少于九個(gè)月且有穩(wěn)定生活保障和住所的；（六）未滿18周歲未婚子女投靠父母的；（七）在境外無直系親屬，投靠境內(nèi)直系親屬，且年滿60周歲、已在中國連續(xù)居留滿五年、每年在中國居留不少于九個(gè)月并有穩(wěn)定生活保障和住所的。本條所指年限均指申請(qǐng)之日前連續(xù)的年限。Article 6 Foreigners applying for permanent residence in China must abide by Chinese laws, be in good health and without any criminal record, and must me

9、et at least one of the following requirements:(1) Having made direct investment in China with stable operation and a good tax paying record for three successive years;(2) Having held the post of deputy general manager, deputy factory director or above or of associate professor, associate research fe

10、llow or other associate senior titles of professional post or above or enjoying equal treatment, for at least four successive years, with a minimum period of residence in China for three cumulative years within four years and with a good tax paying record;(3) Having made a great and outstanding cont

11、ribution to and being specially needed by China;(4) Being the spouse or unmarried child under 18 years old of a person with reference to the item(1), (2) or (3) of this paragraph;(5) Being the spouse of a Chinese citizen or of a foreigner with permanent residence status in China, in a marriage relat

12、ionship for at least five years, with at least five successive years of residence in China and at least nine months of residence in China each year, and having stable source of subsistence and a dwelling place;(6) Being an unmarried person under 18 years old turning to his parent; or(7) Being a pers

13、on who is or above 60 years old, who has no direct relativeabroad and is dependent on any direct relative in China, and has stayed in China for at least five successive years with at least nine months residence in China each year, and has a stable source of subsistence and a dwelling place.The perio

14、ds of time in this Article mean the successive ones till the date of application.第七條 本辦法第六條第一款第一項(xiàng)所指的外國人，其在中國投資實(shí)際繳付的注冊(cè)資本金應(yīng)當(dāng)符合下列條件之一：（一）在國家頒布的外商投資產(chǎn)業(yè)指導(dǎo)目錄鼓勵(lì)類產(chǎn)業(yè)投資合計(jì)50萬美元以上；（二）在中國西部地區(qū)和國家扶貧開發(fā)工作重點(diǎn)縣投資合計(jì) 50萬美元以上；（三）在中國中部地區(qū)投資合計(jì)100萬美元以上；（四）在中國投資合計(jì)200萬美元以上。Article 7 In the case of a foreigner under item (1) of t

15、he first paragraph of Article 6 herein, the registered capital paid by him as investment in China shall meet any of the following requirements:(1) In the case of investment in any industry encouraged under the Catalogue for Guidance of Foreign Investment Industries, at least US$500,000 in total;(2)

16、In the case of investment in the western area of China or any key county under poverty reduction and development program, at least US$500,000 in total;(3) In the case of investment in the central area of China, at least US$1million in total; or(4) In the case of investment in China, at least US$2 mi

17、llion in total.第八條 本辦法第六條第一款第二項(xiàng)所指的外國人，其任職單位應(yīng)當(dāng)符合下列條件之一：（一）國務(wù)院各部門或者省級(jí)人民政府所屬的機(jī)構(gòu)；（二）重點(diǎn)高等學(xué)校；（三）執(zhí)行國家重點(diǎn)工程項(xiàng)目或者重大科研項(xiàng)目的企業(yè)、事業(yè)單位；（四）高新技術(shù)企業(yè)、鼓勵(lì)類外商投資企業(yè)、外商投資先進(jìn)技術(shù)企業(yè)或者外商投資產(chǎn)品出口企業(yè)。Article 8 In the case of a foreigner under item (2) of the first paragraph of Article 6 herein, the entity in which he holds a post must be

18、any of the following:(1) An institution subordinate to any department of the State Council or to the peoples government at the provincial level;(2) A key college or university;(3) An enterprise or government-sponsored institution implementing a key engineering project or major scientific research pr

19、oject of the state;(4) A high-tech enterprise, foreign invested enterprise in encouraged fields,technologically advanced enterprise with foreign investment or export-oriented enterprise with foreign investment.第九條 申請(qǐng)人申請(qǐng)時(shí)需如實(shí)填寫外國人在中國永久居留申請(qǐng)表，并提交下列材料：（一）有效的外國護(hù)照或者能夠代替護(hù)照的證件；（二）中國政府指定的衛(wèi)生檢疫部門出具的或者經(jīng)中國駐外使、領(lǐng)館認(rèn)

20、證的外國衛(wèi)生醫(yī)療機(jī)構(gòu)簽發(fā)的健康證明書；（三）經(jīng)中國駐外使、領(lǐng)館認(rèn)證的國外無犯罪記錄證明；（四）四張二英寸近期正面免冠彩色照片；（五）本辦法規(guī)定的其他有關(guān)材料。Article 9 The applicant shall faithfully fill in the Form of Application for Foreigners Permanent Residence in China and submit the following materials:(1) A copy of his(her) valid passport or other certificate that may b

21、e used instead of the passport;(2) A health certificate issued by a health quarantine agency designated by the Chinese government or by a foreign health quarantine agency recognized by the relevant Chinese embassy or consulate;(3) A certificate of no criminal record in the country concerned as issue

22、d by the relevant Chinese embassy or consulate;(4) Four recent full-face color photos (2 by 2 inches, bareheaded) of the applicant; and(5) Other relevant materials provided herein.第十條 本辦法第六條第一款第一項(xiàng)所指人員申請(qǐng)時(shí)還需提交外商投資企業(yè)批準(zhǔn)證書、登記證明以及聯(lián)合年檢證明、驗(yàn)資報(bào)告、個(gè)人完稅證明。鼓勵(lì)類外商投資企業(yè)還應(yīng)當(dāng)提交國家鼓勵(lì)發(fā)展的外商投資項(xiàng)目確認(rèn)書。Article 10 An applicant un

23、der Item (1) of the first paragraph of Article 6 herein shall submit a certificate of approval for the foreign-invested enterprise, certificate of registration and a joint annual inspection certificate, report on the verification capital and personal tax payment receipt in addition.In the case of a

24、foreign-invested enterprise in encouraged fields, a letter of confirmation in respect of the foreign-invested project as encouraged by the state shall be submitted in addition.第十一條 本辦法第六條第一款第二項(xiàng)所指人員申請(qǐng)時(shí)還需提交下列材料：（一）任職單位出具的本人職務(wù)或者職稱證明；（二）外國專家證或者外國人就業(yè)證；（三）任職單位的登記證明以及年檢證明、個(gè)人完稅證明；任職單位是外商投資企業(yè)的，還需提交外商投資企業(yè)批準(zhǔn)證書

25、和聯(lián)合年檢證明；（四）在執(zhí)行國家重點(diǎn)工程項(xiàng)目或者重大科研項(xiàng)目的企業(yè)、事業(yè)單位中任職的人員需提交省、部級(jí)政府主管部門出具的項(xiàng)目證明文件；在高新技術(shù)企業(yè)中任職的人員需提交高新技術(shù)企業(yè)證書；在鼓勵(lì)類外商投資企業(yè)、外商投資先進(jìn)技術(shù)企業(yè)或者外商投資產(chǎn)品出口企業(yè)中任職的人員需提交國家鼓勵(lì)發(fā)展的外商投資項(xiàng)目確認(rèn)書或者外商投資先進(jìn)技術(shù)企業(yè)確認(rèn)書或者外商投資產(chǎn)品出口企業(yè)確認(rèn)書。Article 11 An applicant under Item (2) of the first paragraph of Article 6 herein shall submit the following materials

26、in addition:(1) A certificate certifying his (her) position or professional title as issued by his employer;(2) The Foreign Expert Card or Foreigner Employment Card;(3) A certificate of registration and certificate of annual inspection of his (her) employer, certificate of personal tax payment issue

27、d to him (her); where the employer is a foreign-invested enterprise, a certificate of approval for the foreign-invested enterprise and a joint annual inspection certificate is required in addition; and(4) In the case of an applicant who holds a post in an enterprise or institution that carries out a

28、 key engineering project or major scientific research project of the state, a certificate certifying the project as issued by the competent authority of the government at the provincial or ministry level; in the case of an applicant who holds a post in a high-tech enterprise, a high-tech enterprise

29、certificate; in the case of a foreign-invested enterprise in encouraged fields, technologically advanced enterprise with foreign investment or export-oriented enterprise with foreign investment, a certificate certifying the foreign-invested enterprise in encouraged fields, advanced-tech enterprise w

30、ith foreign investment or export-oriented enterprise with foreign investment.第十二條 本辦法第六條第一款第三項(xiàng)所指人員申請(qǐng)時(shí)還需提交中國政府主管部門出具的推薦函及有關(guān)證明。Article 12 An applicant under Item (3) of the first paragraph of Article 6 herein shall submit a letter of recommendation and the relevant certificates as issued by the compet

31、ent authority of the Chinese government in addition.第十三條 本辦法第六條第一款第四項(xiàng)所指人員申請(qǐng)時(shí)，屬于配偶的，還需提交婚姻證明；屬于未滿18周歲未婚子女的，還需提交本人出生證明或者親子關(guān)系證明；屬收養(yǎng)關(guān)系的，還需提交收養(yǎng)證明。外國有關(guān)機(jī)構(gòu)出具的上述證明需經(jīng)中國駐該國使、領(lǐng)館認(rèn)證。Article 13 An applicant under Item (4) of the first paragraph of Article 6 herein shall, in addition, submit a marriage certificate

32、in the case of a spouse, his birth certificate or parentage certificate in the case of an unmarried child under 18 years old, and a adoption certificate in the case of an adopted child. The above-mentioned certificates as issued by a foreign agency shall be subject to the authentication of the Chine

33、se embassy or consulate in the country concerned.第十四條 本辦法第六條第一款第五項(xiàng)所指人員申請(qǐng)時(shí)還需提交其中國籍配偶的常住戶籍證明或者其外國籍配偶的外國人永久居留證、婚姻證明、經(jīng)公證的生活保障證明及房屋租賃或者產(chǎn)權(quán)證明。外國有關(guān)機(jī)構(gòu)出具的上述證明需經(jīng)中國駐該國使、領(lǐng)館認(rèn)證。Article 14 An applicant under Item (5) of the first paragraph of Article 6 herein shall, in addition, submit his (her) Chinese spouses reg

34、istered permanent residence certificate or foreign spouses Foreigners Permanent Residence Card, marriage certificate, and a notarized certificate of source of subsistence and house leasing certificate or muniments of title. The above-mentioned certificates as issued by a foreign agency shall be subj

35、ect to the authentication of the Chinese embassy or consulate in the country concerned.第十五條 本辦法第六條第一款第六項(xiàng)所指人員申請(qǐng)時(shí)還需提交其中國籍父母的常住戶籍證明或者外國籍父母的外國人永久居留證、本人出生證明或者親子關(guān)系證明；屬收養(yǎng)關(guān)系的，還需提交收養(yǎng)證明。外國有關(guān)機(jī)構(gòu)出具的上述證明需經(jīng)中國駐該國使、領(lǐng)館認(rèn)證。Article 15 An applicant under Item (6) of the first paragraph of Article 6 herein shall, in addit

36、ion, submit his Chinese parents registered permanent residence certificate or foreign parents Foreigners Permanent Resident Card, his birth certificate or parentage certificate and, in the case of an adopted child, the adoption certificate in addition. The above-mentioned certificates as issued by a

37、 foreign agency shall be subject to the authentication of the Chinese embassy or consulate in the country concerned.第十六條 本辦法第六條第一款第七項(xiàng)所指人員申請(qǐng)時(shí)還需提交被投靠的中國公民常住戶籍證明或者外國人的外國人永久居留證、經(jīng)公證的親屬關(guān)系證明以及投靠人國外無直系親屬關(guān)系證明、經(jīng)公證的投靠人經(jīng)濟(jì)來源證明或者被投靠人經(jīng)濟(jì)擔(dān)保證明、經(jīng)公證的投靠人或者被投靠人的房屋租賃或者產(chǎn)權(quán)證明。外國有關(guān)機(jī)構(gòu)出具的上述證明需經(jīng)中國駐該國使、領(lǐng)館認(rèn)證。Article 16 An applican

39、e certifying that the applicant has no direct relative abroad, a notarized certificate certifying the applicants financial source or notarized certificate of financial guarantee by the person to whom the applicant is to depend, and notarized house leasing certificate or muniments of title of the app

40、licant or the person on whom the applicant is to depend. The above-mentioned certificates as issued by a foreign agency shall be subject to the authentication of the Chinese embassy or consulate in the country concerned.第十七條 外國人申請(qǐng)?jiān)谥袊谰镁恿簦杀救嘶蛘呶礉M18周歲未婚子女的父母或者被委托人向主要投資地或者長(zhǎng)期居留地的設(shè)區(qū)的市級(jí)人民政府公安機(jī)關(guān)或者直轄市公安分、縣局

41、提出申請(qǐng)。由被委托人代為申請(qǐng)的，需提交申請(qǐng)人出具的委托書。申請(qǐng)人在國外出具的委托書，需經(jīng)中國駐該國使、領(lǐng)館認(rèn)證。Article 17 An application for foreigners permanent residence in China shall be submitted by the applicant himself (herself)or his(her) parent if he(she) is unmarried and under 18 years old or his (her)attorney to the public security organ of th

42、e peoples government of the city with subordinate districts, or the branch or county bureau of public security of the municipality directly under the Central Government, in the place where the principal investment was made or of long-term residence.In the case of applying through an attorney, a powe

43、r of attorney issued by the applicant shall be submitted. A power of attorney issued by the applicant abroad shall be subject to the authentication of the Chinese embassy or consulate in the country concerned.第十八條 公安機(jī)關(guān)自受理外國人在中國永久居留的申請(qǐng)之日起六個(gè)月以內(nèi)做出批準(zhǔn)或者不批準(zhǔn)的決定。Article 18 The public security organ shall ma

44、ke an approval or disapproval decision within six months from the date of the acceptance of the application .第十九條 被批準(zhǔn)在中國永久居留的外國人，由公安部簽發(fā)外國人永久居留證；申請(qǐng)人在境外的，由公安部發(fā)給外國人永久居留身份確認(rèn)表，申請(qǐng)人持外國人永久居留身份確認(rèn)表到中國駐外使、領(lǐng)館辦理“D ”字簽證，入境后30日以內(nèi)向受理其申請(qǐng)的公安機(jī)關(guān)領(lǐng)取外國人永久居留證。Article 19 The Ministry of Public Security shall issue a Foreign

45、ers Permanent Residence Card to the applicant whose permanent residence status in China has been approved. If the applicant is not in China, the Ministry of Public Security shall issue a Confirmation Form of Foreigners Permanent Residence Status to the applicant, who shall apply for a D visa to the

46、Chinese embassy or consulate in the country concerned by producing such Conformation Form and, within 30 days from his(her) entry into China, obtain the Foreigners Permanent Residence Card from the public security organ that accepted his(her) application.第二十條 被批準(zhǔn)在中國永久居留的外國人，每年在中國累計(jì)居留不得少于三個(gè)月。確因?qū)嶋H需要每年

47、不能在中國累計(jì)居留滿三個(gè)月的，需經(jīng)長(zhǎng)期居留地省、自治區(qū)、直轄市公安廳、局批準(zhǔn)，但五年內(nèi)在中國累計(jì)居留不得少于一年。Article 20 A foreigner who has been approved to permanently reside in China must stay in China for at least three cumulative months a year. If the foreigner is unable to stay in China for such minimum period due to any reason, he(she) shall ap

48、ply for the approval of the department or bureau of public security of the province, autonomous region or municipality directly under the Central Government where he (she)resides, provided that the cumulative period of his(her) residence in China shall not be less than one cumulative year in five ye

49、ars.第二十一條 外國人永久居留證的有效期為五年或者十年。被批準(zhǔn)在中國永久居留的未滿十八周歲的外國人，發(fā)給有效期為五年的外國人永久居留證；被批準(zhǔn)在中國永久居留的十八周歲以上的外國人， 發(fā)給有效期為十年的外國人永久居留證。Article 21 A Foreigners Permanent Residence Card shall be valid for five or ten years.In the case of a foreigner under 18 years old approved to permanently reside in China ,he(she) shall ha

50、ve a Foreigners Permanent Residence Card valid for five years; those being or above 18 years old shall have one valid for ten years.第二十二條外國人永久居留證有效期滿、內(nèi)容變更、損壞或者遺失的，持證人應(yīng)當(dāng)向其長(zhǎng)期居留地的設(shè)區(qū)的市級(jí)人民政府公安機(jī)關(guān)或者直轄市公安分、縣局申請(qǐng)換發(fā)或者補(bǔ)發(fā)。公安機(jī)關(guān)經(jīng)審核對(duì)沒有喪失在中國永久居留資格規(guī)定情形的，一個(gè)月以內(nèi)換發(fā)或者補(bǔ)發(fā)證件。Article 22 In the case of expiry of, any change of

51、 particulars in, damage to or loss of a Foreigners Permanent Residence Card, the holder shall apply for renewal or reissue of the Card to the public security organ of the peoples government of the city with subordinate districts, or the branch or county bureau of public security of the municipality

52、directly under the Central Government in the place of his(her) long-term residence. The public security organ shall make such renewal or reissue within one month if, upon examination, it holds that the holder still meets the requirements for a foreigner to be approved to permanently reside in China.

53、第二十三條 持有外國人永久居留證的外國人應(yīng)當(dāng)在證件有效期滿前一個(gè)月以內(nèi)申請(qǐng)換發(fā)；證件內(nèi)容變更的，應(yīng)當(dāng)在情況變更后一個(gè)月以內(nèi)申請(qǐng)換發(fā)；證件損壞或者遺失的，應(yīng)當(dāng)及時(shí)申請(qǐng)換發(fā)或者補(bǔ)發(fā)。Article 23 The holder of a Foreigners Permanent Residence Card shall apply for a renewal of the Card within a month before the expiry of the old one, for a renewal within a month after any change of particulars

54、in the Card, or for a renewal or reissue promptly in the case of any damage to or loss of the Card.第二十四條 具有在中國永久居留資格的外國人有下列情形之一的，公安部可以取消其在中國永久居留資格，同時(shí)收繳其所持外國人永久居留證或者宣布作廢：（一） 可能對(duì)國家安全和利益造成危害的；（二）被人民法院判處驅(qū)逐出境的；（三）通過提供虛假材料等非法手段騙取在中國永久居留資格的；（四）未經(jīng)批準(zhǔn)每年在中國累計(jì)居留不滿三個(gè)月或者五年內(nèi)在中國累計(jì)居留不滿一年的。Article 24 The Ministry of Public Security may cancel such status of him and withdraw or revoke his(her) Foreigners Permanent Residence Card in the case of a foreigner wit
