7、經(jīng)濟(jì)合同由標(biāo)題、首部、正文、尾部組成。（1）標(biāo)題（合同內(nèi)容+種類(lèi)）。如“計(jì)算機(jī)（合同內(nèi)容）銷(xiāo)售合同（合同種類(lèi)）”（2）首部:包括合同簽訂人、合同編號(hào)、合同簽訂的時(shí)間和地點(diǎn)、套語(yǔ)等。（3）正文：合同的正文包括以下幾項(xiàng)內(nèi)容：合同標(biāo)的、數(shù)量和質(zhì)量、價(jià)款和酬金、履行合同的期限地點(diǎn)方式、違約責(zé)任（免責(zé)條款）、依法律規(guī)定或按合同性質(zhì)必須具備的條款、當(dāng)事人一方要求必須具備的條款。（4）尾部：合同的變更和解除、違反合同的責(zé)任、無(wú)效合同的確認(rèn)及處理措施等。作為一種重要的文體形式，它的語(yǔ)言具有其自身的特點(diǎn)。內(nèi)容的專(zhuān)業(yè)性首先其格式規(guī)范有一定的專(zhuān)業(yè)性，其次合同適用范圍很廣，可以涉及不同的領(lǐng)域，如商品、貿(mào)易、商檢、運(yùn)輸

17、nt Venture and Party X (or a third party)譯文:甲、乙雙方同意，由合營(yíng)公司與X方（或第三方）簽訂技術(shù)轉(zhuǎn)讓協(xié)議例句中的Party A和Party B指合同當(dāng)事人，在合同中只能翻譯成甲方和乙方。類(lèi)似的還有如the Seller（賣(mài)方），the Buyer（買(mǎi)方）；the Transferor（轉(zhuǎn)讓方），the Transferee（受讓方）等。其次，同一個(gè)單詞在不同的合同文本中所表達(dá)的意思也有差別。譯者應(yīng)根據(jù)專(zhuān)業(yè)特點(diǎn)和搭配關(guān)系等方面來(lái)判斷確定具體的詞義。例：（1）If Party A insists on its original quotation, Pa

19、000美元的信用證。動(dòng)詞一般是做“包括，囊括”的意思講，但在以上三個(gè)例句中，不但不能按原來(lái)的意思翻譯，而且在各句中由于所屬領(lǐng)域范圍不同，其所表達(dá)的意思也是不同的。在（1）句、（2）句、（3）句中分別表示“購(gòu)進(jìn)貨物”、“投保險(xiǎn)”、“償付”等意思。2. 注意規(guī)范組句翻譯合同時(shí)，應(yīng)注意分析句子結(jié)構(gòu)，理清思路，規(guī)范組句，以實(shí)現(xiàn)順暢而清晰的表達(dá)。例：We hereby certify to the best of our knowledge that the foregoing statement is true and correct and all available information and
