乙方應及時以書面形式通乙方按修改或變更?施工中如發(fā)現因甲方要求而發(fā)生的設計錯誤或嚴重不合理的地方,知甲方，由甲方及時會同乙方等有關單位研究確定修改意見或變更設計文件,的設計文件進行施工。若發(fā)生增加費用（包括返工損失、停工、窩工、人員和機構設備調遷、材料構配件積壓的實際損失）由甲方負責，并調整合同造價。乙方應及時以書面形式通乙方按修改或變更IfandwhenanyerrorormaterialunreasonableproblemofdesignduetopartyArequirement.PartyBshallnotifyPartyApromptlyinwritinganddecidetheamendmentormodification ofthedesigndocumentationbytheconsultation andnegotiation betweenpartiesandunitsconcerned.PartyBshallcarryoutconstruction accordingtothedesigndocumentsmodifiedorchanged.Ifprojectcostincrease(includingtheactuallossofreworkloss,stoppageorslowdown,personnelandmachineequipmentrelocated,materialstructures,fixturesbacklog),shallberesponsibilitybyParty A,andbeadjustedthecontractpricetogetherwithPartyB.三?乙方在保證工程質量和不降低設計標準的前提下，提岀修改設計、修改工藝的合理化建議，經甲方、設計單位或有關技術部門同意后采取實施。AnyreasonablesuggestiononthemodificationsofdesignandcraftproposedbyPartyB,subjecttothequalityandwithoutreducingstandardsofdesign,couldbecarriedoutupontheapprovalofPartyA,designunitorconcernedtechnicaldepartment.四?甲方如需設計變更，必須作岀正式修改通知書和修改圖紙， 乙方才予實施。重大修改和增加造價時，必須另行協(xié)商，乙方才予實施。PartyAshould,ifanynecessarydesignchange,maketheformalamendmentandmodifydrawingsforPartyB 'simplementation..MaterialchangesandcostincreasedmustbenegotiatedbybothpartiesbeforePartyBimplementthesame.第七條 工程驗收Article7Acceptaneeofproject一?工程施工中地下工程、結構工程必須具有隱蔽驗收簽證、 試水、抗?jié)B等驗收合格記錄。甲方須及時辦理驗收簽訂手續(xù)。Theundergroundengineering,structuralengineeringintheconstructionofprojectshouldbecheckedandwithissueofcertificateandtherecordofacceptaneeofwatertest,anti-permeabilityandsoon.PartyAshoulddealwiththeacceptaneesignedformalitiestimely.二.工程竣工驗收后，甲方才可使用 PartyAcanusetheprojectaftercompletionacceptanee在規(guī)定的保修期內， 凡因施工造成的質量缺陷應由乙方無償保修。 其保修條件、范圍和期限按城鄉(xiāng)建設環(huán)境保護部(84)城建字第79號通知印發(fā)的《建筑工程保修辦法(試行)》執(zhí)行。Intheprovisionwarrantyperiod,anyconstructionquality defects,PartyBshouldmakemaintenancefreeofthequalitydefectduetoconstruction, thescopeanddurationcarryoutaccordingtotheissuaneeofChengJianNo.79notification"Constructionengineeringguaranteemeasures(Trial)"byUrbanandRuralConstructionandEnvironmentalProtectionDepartment(84).第八條 違約責任Article8Liabilityforbreachofcontract乙方的責任： ResponsibilityofPartyB:一?工程質量不符合合同規(guī)定的，負責無償修理和返工。Takechargeofgratisrepairandreworkifprojectqualitydoesn'tmeetcontact'sstipulation二?工程不能按合同規(guī)定的工期交付使用的， 按合同中關于建設工期提交或拖后的獎罰規(guī)定償付逾期罰款。Iffailtodelivertheconstruction accordingtothecontract ontime,Theoverduefinesaccordingtopunishmentorawardof theprovision concerningthedeliveryordelay.甲方的責任： TheresponsibilityofPartyA:一?未能按照合同的規(guī)定履行自己應負的責任， 除竣工日期得以順延外， 還應賠償乙方由此造成的實際損失。Failedtofulfilltheirresponsibilitiesinaccordaneewiththeprovisionsofthecontract,inadditiontothecompletiondatetobepostponedshouldbecompensationfortheactuallossofPartyB.二?工程中途停建、緩建或由于設計變更以及設計錯誤造成的返工， 應采取措施彌補或減少損失。同時，賠償乙方由此造成的停工、窩工、返工、倒運、人員和機械設備調遷、材料和構件積壓的實際損失。Theongoingprojectisstopped,postponedorduetodesign
