根據(jù)有關(guān)法律、法規(guī),在自愿、平等、協(xié)商一致的基礎(chǔ)上,在熟悉、了解物業(yè)設(shè)施狀況的情況下,甲方將求真樓1號樓委托乙方實行外圍及公共設(shè)施區(qū)域整體物業(yè)管理,訂立本合同。ThisContractisenteredintoonthefollowingtermsandconditionsinaccordancewithrelevantlawsandregulationsandonthebasisofvoluntariness,equality,mutualagreement,basedonacknowledgementandunderstandingofthestatusofthefacilitiesoftheProperty,wherebyPartyAentrustsPartyBwithoverallpropertymanagementofthesurroundingandpublicfacilityareasofBlock1ofQiuzhenBuilding.、物業(yè)基本情況ArticleOneBasicInformationoftheProperty物業(yè)類型:標(biāo)準(zhǔn)辦公樓TypeofProperty:StandardOfficeBuilding座落位置:常熟市湖山路99號常熟理工學(xué)院東南校區(qū)求真樓1號樓LocationSite:Block1,QiuzhenBuilding,SoutheastCampus,ChangshuInstituteofTechnology,No.99,HushanRoad,ChangshuCity.管理服務(wù)類型:求真樓1號樓物業(yè)管理。Typeofmanagementservice:Block1QiuzhenBuildingpropertymanagement二、本合同中術(shù)語的定義ArticleTwo.Definition管理區(qū)域:是指求真樓1號樓區(qū)域。Managementarea:Block1QiuzhenBuildingarea.業(yè)主:是指物業(yè)的所有權(quán)人。Owner:OwneroftheProperty.管理公司:是指在物業(yè)前期由開發(fā)商委托根據(jù)物業(yè)管理服務(wù)合同進(jìn)行專業(yè)管理服務(wù)的江蘇XXXXXX服務(wù)外包(集團)有限公司。Managementcompany:IService(Jiangsu)Group,whichconductsprofessionalmanagementservicepursuanttothePropertyServiceContractinearlystageofthePropertyasentrustedbythedeveloper.共用部位:是指整棟建筑內(nèi)業(yè)主所有且共同使用的部位,其中包括(但不限于)入口、大堂、外墻、天臺、樓道、樓梯、樓梯間、電梯間、平臺、垃圾房、廁所、貨梯機房、電表房、泵房、共用倉庫、消防中心、電話機房、天井、水箱。CommonParts:Partsownedandcommonlyusedbyallownersinthebuilding,includingbutnotlimitedtoentrance,lobby,externalwall,balcony,corridor,stair,stairway,elevator,platform,garbageroom,toilet,freightelevatormachineroom,meterroom,pumproom,sharedwarehouse,firefightingcenter,telephoneroom,patioandwatertank.共用設(shè)備:是指整棟建筑內(nèi)業(yè)主所有且共同使用的設(shè)備,其中包括(但不限于)電梯系統(tǒng)、通風(fēng)系統(tǒng)、防火設(shè)備、消防系統(tǒng)、保安監(jiān)控系統(tǒng)、給、排水系統(tǒng)、污水處理系統(tǒng)、強弱電系統(tǒng)等。Commonequipments:Equipmentownedandcommonlyusedbyallownersinthebuilding,includingbutnotlimitedtoelevatorsystem,ventilationsystem,firefightingsystem,securitymonitoringsystem,watersupplyanddrainagesystems,sewagetreatmentsystem,strongandweakelectricitysystems,etc.公共設(shè)施:是指管理區(qū)域內(nèi)歸全體業(yè)主所有或共同使用的設(shè)施(共用設(shè)施除外),其中包括(但不限于)照明路燈、排水管道、水景、窖井、化糞池、垃圾房、配電房等設(shè)施。Commonfacilities:Facilitiesownedandcommonlyusedbyallownersinthemanagementareaotherthansharefacilities,includingbutnotlimitedtoroadlighting,drainagepipeline,waterscape,pitwell,septictank,garbageroom,distributingsubstation,etc.公共區(qū)域:是指管理區(qū)域內(nèi)歸全體業(yè)主所有或共同使用的部位和場所(共用部位除外),其中包括(但不限于)道路、綠地、停車場庫等部位和場所。Commonareas:Partsandvenuesownedandcommonlyusedbyallownersinthemanagementareaotherthansharedfacilities,includingbutnotlimitedtoroad,greenbelt,parkinglot,etc.三、甲方的權(quán)利與義務(wù)ArticleThreePartyA'sRightsandObligations1.監(jiān)督乙方管理工作的實施;OverseetheimplementationofPartyB'smanagement.按期支付乙方的物業(yè)管理費用;PaypropertymanagementfeetoPartyBwhendue.3.提供乙方物業(yè)管理有關(guān)所需的裝潢平面圖紙、電氣線路圖、消防驗收批文;Providedecoratingplanedrawings,electricwiringdiagram,fireinspectionapprovalrequiredinconnectionwithPartyB 'spropertymanagement.4.自用部位、自用設(shè)備自行負(fù)責(zé)管理、保養(yǎng)、維修或根據(jù)《房屋租賃合同》或《XXXXXX常熟站點委托建設(shè)及裝修合同》要求乙方保養(yǎng)、維修;Manage,maintainandrepairoccupiedpartsandprivateequipmentsorrequestPartyBtomaintainorrepairinaccordancewiththeHouseLeaseContractorChangshuSiteDecorationAgreement.5.配合乙方做好物業(yè)管理中的其它協(xié)調(diào)工作;CooperatewithPartyBinothercoordinationworkinpropertymanagement.四、乙方的權(quán)利與義務(wù)ArticleFourPartyB'sRightsandObligations遵守有關(guān)法律、法規(guī)及本合同的約定.制定詳細(xì)的物業(yè)管理工作計劃ComplywithrelevantlawsandregulationsandprovisionsofthisContract,andformulatespecificpropertymanagementplan.對業(yè)主和物業(yè)使用人有違反法律法規(guī)的行為,提請有關(guān)部門處理。Reporttorelevantauthorityontheviolationsoflawsandregulationscommittedbypropertyownersandusers.在求真樓1號樓二樓建設(shè)可同時提供100人同時用餐的餐廳。甲方支付餐廳租金并承擔(dān)水電費Buildupacanteenwhichcanseat100peopleontheSecondFloor,Block1oftheQiuzhenBuilding.向業(yè)主和物業(yè)使用人書面告知物業(yè)使用的有關(guān)規(guī)定,當(dāng)業(yè)主和物業(yè)使用人裝修物業(yè)時,書面告知有關(guān)限制條件,并負(fù)責(zé)監(jiān)督。Notifypropertyownersandusersinwritingofrulesinconnectionwithpropertymanagement,andnotifythemofrelevantrestrictionsthereonincasepropertyownersandusersdecoratetheProperty,andshallberesponsibleforoversightthereof.五、物業(yè)管理范圍:ArticleFiveScopeofPropertyManagement求真樓1號樓區(qū)域的共用部位。CommonpartsofBlock1ofQiuzhenBuilding;求真樓1號樓區(qū)域的共用設(shè)備。CommonequipmentofBlock1ofQiuzhenBuilding;求真樓1號樓區(qū)域的公共設(shè)施。CommonfacilitiesofBlock1ofQiuzhenBuilding;求真樓1號樓二樓的餐廳。Canteenof2ndFloorofBlock1ofQiuzhenBuilding.六、 物業(yè)管理服務(wù)內(nèi)容:ArticleSixContentofPropertyManagementServices1.求真樓外觀:完好整潔,室外設(shè)備安裝有序。QiuzhenBuildingappearance:Intactandclean,orderlyinstallationofoutdoorfacilities.2.公共環(huán)境衛(wèi)生:Publicandenvironmentalhygiene(1) 求真樓區(qū)域道路、停車點及公共走道、明溝、大廳、二樓餐廳、電梯廳、照明燈具、樓道、樓梯扶手、樓道玻璃、屋面、水泵房、配電房、電梯間及電梯機房等有專人負(fù)責(zé)保潔。Cleanersputinplaceinchargeofcleaningoftheroads,parkingspots,publicwalkways,opentrenches,lobbies,2ndfloorcanteen,elevatorhall,lighting,corridors,staircaserails,corridorglasses,roofing,pumproom,distributingsubstation,elevatorhoistwayandelevatormachineroomofQiuzhenBuildingarea.求真樓區(qū)域做好除蟲害工作,每月安排專業(yè)除蟲害公司來做除害工作,必須確保求真樓里沒有老鼠等蟲害。(費用由大樓業(yè)主分?jǐn)偅?)ConductinsectpestremovalintheQiuzhenBuildingarea,forthatpurposeaprofessionalpestremovalcompanyshallbeengagedtodopestremovalworkeachmonthtoensuretherearenoinsectpestssuchasmice.(3)配備垃圾箱、做到生活垃圾每日清運。Dustbinsareprovidedanddomesticgarbageisremovedeachday.(4)求真樓區(qū)域外的門前保潔,委托環(huán)衛(wèi)部門操作。CleaninginfrontofthedooroftheQiuzhenBuildingareaisentrustedtothepublicsanitationdepartment.(5)真樓1號樓外墻每年清洗一次。(費用由大樓業(yè)主分?jǐn)偅〦xteriorwallofBlock1ofQiuzhenBuildingshallbecleanedonceayear.公共區(qū)域安全管理:SecurityManagementofthePublicArea:(1)保安全天候巡邏、控制閑雜人等進(jìn)入辦公樓區(qū)域。24/7patrolbysecurityguards,precludingpeoplewithoutfixeddutiesfromentryintotheofficebuildingarea;(2)機動車與非機動車停放有序,保持道路暢通。Motorvehiclesandnon-motorvehiclesparkorderlytoenabletheroadunclogged.(3)機動車停車實行無償服務(wù),給予固定停車位10個。Motorvehiclesareparkedfreeofchargeandgiven10fixedparkingspaces.提供非機動車停放,搭建停車棚供甲方使用,至少提供200輛自行車的停放。車棚建造費用由大樓業(yè)主分?jǐn)?。Provideparkingspacefornon-motorvehicles,andconstructaparkingshedforPartyA,whichcanaccommodateatleast200bicycles.特約服務(wù):Specialservices:(1)水電費由委托方直接支付給常熟理工學(xué)院,付款信息如下。WaterandelectricityfeeswillbepaidtoChangshuInstituteofTechnology;受益人名稱常熟理工學(xué)院銀行帳號32201986152050594557受益銀行名稱常熟建行城中支行對于《房屋租賃合同》或《xxxxxx常熟站點委托建設(shè)及裝修合同》未涉及的部分,接受甲方提出的自用部位、自用設(shè)備的維修并合理收取費用。AcceptrepairsofoccupiedpartsandprivateequipmentappliedbyPartyAforthoseareasnotcoveredintheHouseLeaseContractorChangshuSiteDecorationAgreementandmaychargereasonablefeesthereof;代辦其它方面報修項目。Entrustedwithotherrepairs.設(shè)備運行及維護保養(yǎng): Equipmentoperationandmaintenance由大樓業(yè)主分?jǐn)倶菂^(qū)下水道疏浚費用,每一年疏浚二次(其中一次搖車進(jìn)場),確保下水道暢通。Sewerdredgingintheplantarea,dredgingtwiceayear(includingrockingcart,akindofhoist)toensureuncloggedsewer.由大樓業(yè)主分?jǐn)傎M用及時更換損壞的窨井蓋座。Promptlyreplacedamagedpitwellcover.對落水管道進(jìn)行日常維護,確保下水暢通。Conductroutinemaintenanceofdownspoutpipetoensureuncloggedsewer.由大樓業(yè)主分?jǐn)傎M用對二級生化處理池由物業(yè)公司進(jìn)行日常疏通、保養(yǎng)。SecondarybiochemicaltreatmentpondisdredgedandmaintainedroutinelybythePropertyCompany.(5) 由大樓業(yè)主分?jǐn)傎M用定時清洗水箱,保證水質(zhì)衛(wèi)生。Regularlycleanthewatertanktoensurewatersanitation.(6) 由大樓業(yè)主分?jǐn)傎M用定期進(jìn)行除蟲害工作。Regularlyremoveinspectpests.(7) 做好配電房、水泵房日常維護、保養(yǎng)工作。Conductroutinemaintenanceandrepairsofthedistributionsubstationandwaterpumproom.(8) 及時更換損壞的垃圾桶。Promptlyreplacedamagedgarbagebins.(9) 對機動車停車點定期劃線(油漆);自行車車棚維護保養(yǎng),一年兩次定期進(jìn)行油漆。Regularlydolinework(paint)forvehicleparkingspots;maintainandrepairbikeshelter,regularlypaintittwiceayear.(10) 對大樓內(nèi)避雷針的維護、保養(yǎng),保持暢通。對大樓區(qū)內(nèi)消防系統(tǒng)進(jìn)行日常檢查、保養(yǎng)。Repairandmaintenanceofarrestorsintheplantareatokeepthemoperative.Repairandmaintenanceoffireprotectionsystemintheplantarea.(11) 由大樓業(yè)主分?jǐn)偳笳鏄?號樓內(nèi)公共用電、用水等費用的支出。 BeartheexpenditureofpublicelectricityandwaterconsumptioninBlock1ofQiuzhenBuilding.(12) 由大樓業(yè)主分?jǐn)偡謹(jǐn)傠娞葸\行的操作和日常保養(yǎng)及年檢費用。Operationandroutinemaintenanceandannualinspectionofelevators.(13)由大樓業(yè)主分?jǐn)偡謹(jǐn)偝袚?dān)電梯水泵日常運行費用的支出。 Beartheexpenditureofroutineoperationcostofelevatorandwaterpump.(14)急修二十分鐘到現(xiàn)場,24小時修理完畢。Foremergencyrepair,arriveatthesitein20minutesandcompleterepairin24hours.(15)小修當(dāng)天報修,三十分鐘到現(xiàn)場,當(dāng)天處理,一般不超過三天。Arriveatthesitein30minutesforsmallrepairappliedontheday,maketreatmentontheveryday,generallynotexceeding3days.七、物業(yè)管理服務(wù)費用及期限ArticleSevenPropertyManagementServicesFeesandTerm1?收費標(biāo)準(zhǔn):運營場地整體物業(yè)管理,收費標(biāo)準(zhǔn)按建筑面積每平方米

36元人民幣/月收取。每年物業(yè)費在上一年度基礎(chǔ)上上漲 5%Rateofcharge:Conductoverallpropertymanagementofthesites,therateofchargeshallbeRMB1.5Yuanpersquaremetersofconstructionareapermonth;2?物業(yè)管理費按本協(xié)議及甲方委托之內(nèi)容收取,甲方按季支付管理費,PropertymanagementfeeshallbecollectedinaccordaneewiththisAgreementandPartyA'sentrustment.PartyAshallpaypropertymanagementfeeonaquarterlybasis.真樓1號樓4樓物業(yè)費收費標(biāo)準(zhǔn)從 xxxxxx年5月 1日至2017年4月30日;thTherateofpropertymanagementfeefor4Floor,Block1,QiuzhenBuildingshallapplyfromMay1,xxxxxtcXApril30,2017.2.2真樓1號樓3樓物業(yè)費收費標(biāo)準(zhǔn)啟用日開始至2017年4月30日;rdTherateofpropertymanagementfeefor3Floor,Block1,QiuzhenBuildingshallapplyfromthecommencementdatetoApril30,2017.2.3服務(wù)到期后如乙方選擇續(xù)租,甲方承諾在上述價格基礎(chǔ)上給予優(yōu)惠。IfuponexpirationoftheservicePartyBchoosestorenewthelease,PartyAundertakestoofferfavorablediscountsonthebasisoftheabove-mentionedrate.2.4水電價格將根據(jù)常熟市電力局、自來水公司給到常熟理工學(xué)院的價格的變動而變動,但不得高于常熟市電力局、自來水公司給到常熟理工學(xué)院的價格。TherateofwaterandelectricityshallfloatwithbutshallnotbehigherthantherateChangshuElectricPowerBureau,runningwatercompanyoffersto ChangshuInstituteofTechnology.物業(yè)管理服務(wù)期限:1)TermofPropertyManagementServices:求真樓4樓自xxxxxx年5月1日至2017年4月30日;FourthFloorofQiuzhenBuilding,commencesfromMay1,xxxxxandexpiresonApril30,2017.求真樓3樓自啟用日至2017年4月30日。ThirdFloorofQiuzhenBuilding,commencesfromtheopeningdayandexpiresonApril30,2017.3.3但如果甲方與江蘇xxxxxx服務(wù)外包(集團)有限公司

之間的租賃協(xié)議因任何原因被終止的, 本協(xié)議同時終止,在本合同項下任何一方不需承擔(dān)違約責(zé)任。Provided,however,incasetheLeaseAgreementbetweenPartyAandiService(Jiangsu)Groupisterminatedforanyreason,thisAgreementshallterminatesimultaneously,andeitherPartyheretoshallnotbeliableforbreachofcontracttotheotherParty.甲方收到乙方物業(yè)管理費和水電費通知后,在十日內(nèi)支付。甲方如逾期交納管理費、水電費,乙方可以按逾期天數(shù)每天加收應(yīng)交費用萬分之五的滯納金。UponreceiptofPartyB 'snotificationofpropertymanagementfeeandwaterandelectricityfees,PartyAshallpaythesamewithin10days.IfPartyAdelaysinpaymentofpropertymanagementfeeandwaterandelectricityfees,PartyBisentitledtoapenaltyof0.05%ofthefeesforeachdayofdelay.甲方延期交付水電費超過三個月后,滯納金則按每天千分之一計收。IncasePartyAdelayedpaymentofwaterandelectricityfeesexceedsthreemonthsthepenaltyrateshallbe0.1%ofthefeesforeachdayofdelay.八、乙方物業(yè)維修內(nèi)容概述:ArticleEightPartyB'sfreepropertymaintenancecontentoverview按國家及地方有關(guān)法規(guī)規(guī)定執(zhí)行。(法規(guī)中未明確的,按行業(yè)標(biāo)準(zhǔn)執(zhí)行)乙方物業(yè)為下列項目提供維修服務(wù),并按市場價收取費用Nationalandlocalrelevantregulationsshallapply.(ifnotspecifiedintheregulations,industrialstandardsshallapply)外墻屋面的修繕工作。Reparationofexteriorwallandroofing.道路損壞部分的修復(fù)工作。Recoveryofdamagedpartofroad.對受損的落水管進(jìn)行修繕及更新。Reparationandreplacementofdamageddownspoutpipe.二級生化處理池每兩年進(jìn)行一次內(nèi)部設(shè)備更新及大、中修項目。Thesecondarybiochemicaltreatmentpondundergoestwiceayearinternalfacilityreplacementandbigandmedium-repairitems.高壓配電房每兩年進(jìn)行一次電試。配電房內(nèi)部設(shè)備更新及大、中修項目。HVdistributingsubstationundergoestwiceayearelectricitytest.Internalfacilityofthedistributingsubstationundergoesreplacementandbigandmedium-repairitems.水泵房易損件的更換及大、中修項目。Replacementofwearingpartsinthewaterpumproomandbigandmedium-repairitems電梯零部件更換及大、中修項目。Replacementofelevatormainpartsandbigandmedium-repairitems公共走道內(nèi)墻的定期粉刷及維修。Regularwhitewashingandrepairintheinteriorwallofpublicsidewalks.園區(qū)內(nèi)所有公共管道的修繕工作。Reparationofallpubicpipesinthepark.消防設(shè)備設(shè)施的定期更換。Regularreplacementoffirepreventionequipmentandfacilities.九、業(yè)主和物業(yè)使用人的自用部位、自用設(shè)備的維修保養(yǎng),在甲方提出委任時乙方必須接受委托并合理收取費用。ArticleNineIncasePartyAmakesentrustmentwithrespecttomaintenanceandrepairsofoccupiedlocationsandprivateequipmentofpropertyownersandpropertyusers,PartyBshallaccepttheentrustmentandmaychargereasonablefeesthereof.十、其它ArticleTenMiscellaneous雙方可對合同的條款進(jìn)行補充,以書面形式簽訂補充協(xié)議,補充協(xié)議與本合同具有同等效力。ThePartiestheretomaysignsupplementaryagreementstotheAgreementwhichshallbemadeinwritingandshallhavethesameforceandeffectasthisAgreement.甲乙雙方在合同期內(nèi),如無法定或合同約定的理由而單方面解除本合同視為違約,違約方應(yīng)向?qū)Ψ街Ц哆`約金。違約金以三個月的物業(yè)管理費為標(biāo)準(zhǔn)。DuringthetermoftheAgreement,eitherParty 'sunilateralterminationofthisAgreementwithoutlegalcauseorcauseprovidedhereundershallbedeemedasbreachofcontract,andthedefaultingPartyshallpayliquidateddamagesintheamountofthreemonths'propertymanagementfeetotheotherParty甲方在本協(xié)議有效期內(nèi),將物業(yè)使用權(quán)或產(chǎn)權(quán)轉(zhuǎn)讓于第三方的,本協(xié)議的效力及于第三方。IfduringthetermoftheAgreement,PartyAtransferstherightofuseorownershipofthepropertytoathirdpar
