EmploymentEqualemploymentopportunityPolicyDAATheMountPleasantISDdoesnotdiscriminateagainstanyemployeeorapplicantforemploymentbecauseofrace,color,religion,sex,nationalorigin,age,disability,militarystatus,oronanyotherbasisprohibitedbylaw.Employmentdecisionswillbemadeonthebasisofeachapplicant’sjobqualifications,experience,andabilities.Employeeswithquestionsorconcernsaboutdiscriminationonthebasisofrace,color,religion,sex,nationalorigin,age,ormilitarystatusshouldcontacttheSuperintendent’sOffice.EmployeeswithquestionsorconcernsaboutdiscriminationonthebasesofadisabilityshouldcontacttheSuperintendent’sOffice.JobvacancyannouncementsPolicyDCTotheextentpossible,announcementsofjobvacanciesbypositionandlocationaredistributedonaregularbasisandpostedatthecentraladministrationbuilding.EmploymentafterretirementIndividualsreceivingretirementbenefitsfromtheTeacherRetirementSystem(TRS)maybeemployedincertainpositionsoronapart-timebasiswithoutaffectingtheirbenefits,accordingtoTRSrulesandstatelaw.ServiceretireeswhoretirebeforeMay31mayreturntoworkinaTexaspublicschoolwithoutareductioninbenefitsonefullcalendarmonthaftertheretirementdateprovidedtheymeetcertainstrictconditions.Retireesmayworkinthefollowingcapacitieswithoutalossofretirementbenefits:Asaprincipalorassistantprincipalonafull-timebasis,ifcertifiedasaprincipalandfollowinga12-monthbreakinservice.Retireesthatretiredunderearlyageordisabilityprovisionsareexcluded.Asafull-timebusdriver(earlyageanddisabilityretireesexcluded).Asasubstituteatnomorethantheestablisheddailysubstitutepayrate(Individualsreceivingdisabilityretirementbenefitsmaynotworkformorethan90daysinaschoolyear.)Onahalf-timeorlessbasisduringanymonth,providedtheyarenotalsoemployedasasubstituteinthatmonth.Half-timeemploymentcannotexceedthelesserof50percentoftheposition’sfull-timeloador92hoursinamonth.Onafull-timebasisduringasix-monthperiodduringaschoolyear,providedthatthisistheironlyemploymentinaTexaspublicschool.IndividualswhoretireinAugustmaybeginemploymentinOctoberoftheschoolyearfollowingtheirretirement.Underthislastprovision,retireesmustsubmitannualwrittennoticetoTRSbythelastdayofthefirstmonthoffullemploymenttoavoidadisruptionofbenefits.Workinganypartofamonthcountsasafullmonth.Otherrestrictionsapplywhenapersonhasretiredbecauseofadisability.IndividualsretiringbecauseofadisabilityshouldcontactTRSfordetailsaboutemploymentrestrictions.Shortageareas.Certainretireesmayreturntoworkonafull-timebasisasaprincipalorassistantprincipalorteacherinanacuteshortageareawithoutareductionintheirannuities.AcuteteachingshortageareasaredeterminedbytheBoardofTrusteesbasedonCommissionerofEducationguidelines.Whenfillingacuteshortageareapositions,thedistrictmustgivehiringpreferencetocertifiedapplicantswhoarenotretirees.TobeeligibleforfullTRS,benefitsaretireemustmeetthefollowingcriteria:HavenotbeensubjecttoareductioninbenefitsforretirementatanearlyageorretiredunderdisabilityprovisionsHavea12-monthcontinuousbreakinpublicschoolservicesinceretirementBeappropriatelycertifiedforthepositionintheapplicableschoolyearEmployeescancontacttheMPISDHumanResourcesOfficeforadditionalinformationorcontactTRSbycalling800-223-8778or512-397-6400.TRSinformationisalsoavailableontheWeb(trs.state.tx.us).ContractandnoncontractemploymentPoliciesDC,DCA,DCB,DCC,DCD,DCEStatelawrequiresthedistricttoemployallfull-timeprofessionalemployeesinpositionsrequiringacertificatefromStateBoardofEducatorCertification(SBEC)andnursesunderprobationary,term,orcontinuingcontracts.Employeesinallotherpositionsareemployedat-willorbyacontractthatisnotsubjecttotheproceduresfornonrenewalorterminationunderChapter21oftheTexasEducationCode.Theparagraphsthatfollowprovideageneraldescriptionoftheemploymentarrangementsusedbythedistrict.Probationarycontracts.Nursesandfull-timeprofessionalemployeesnewtothedistrictandemployedinpositionsrequiringSBECcertificationmustreceiveprobationarycontractsduringtheirfirstyearofemploymentiftheyhavenotbeenpreviouslyemployedbythedistrict.Formeremployeeswhoarehiredafteratleastatwoyearlapseindistrictemploymentalsomaybeemployedbyprobationarycontract.Theprobationaryperiodforthosewhohavebeenemployedinpublicschoolsforatleastfiveoftheeightyearsprecedingemploymentwiththedistrictmaynotexceedoneschoolyear.Forthosewithlessexperience,theprobationaryperiodwillbethreeschoolyears,withanoptionalfourthschoolyeariftheboarddeterminesitisdoubtfulwhetheratermorcontinuingcontractshouldbegiven.Termandcontinuingcontracts.Full-timeprofessionalsemployedinpositionsrequiringcertificationandnurseswillbeemployedbytermorcontinuingcontractsaftertheyhavesuccessfullycompletedtheprobationaryperiod.MountPleasantISDhasnoteachersemployedthroughcontinuingcontract.Campusprincipalsandcentralofficeadministratorsareemployedundertwo-yeartermcontracts.Termsandconditionsofemploymentaredetailedinthecontractandemploymentpolicies.Allemployeeswillreceiveacopyoftheircontractandemploymentpolicies.Paraprofessionalandauxiliaryemployees.Allparaprofessionalandauxiliaryemployees,regardlessofcertification,areemployedatwillandnotbycontract.Employmentisnotforanyspecifiedtermandmaybeterminatedatanytimebyeithertheemployeeorthedistrict.
PayrollInformation.Beforeapaycheckcanbeissuedtoanewemployee,allrequiredformsmustbecompletedandonfilewiththePayrollDepartmentand/orthePersonnelDepartment. SearchesandalcoholanddrugtestingPolicyDHENoninvestigatorysearchesintheworkplace,includingaccessinganemployee’sdesk,filecabinets,orworkareatoobtaininformationneededforusualbusinesspurposesmayoccurwhenanemployeeisunavailable.Therefore,employeesareherebynotifiedthattheyhavenolegitimateexpectationofprivacyinthoseplaces.Inaddition,thedistrictreservestherighttoconductsearcheswhenthereisreasonablecausetobelieveasearchwilluncoverevidenceofwork-relatedmisconduct.Suchaninvestigatorysearchmayincludedrugandalcoholtestingifthesuspectedviolationrelatestodrugoralcoholuse.Thedistrictmaysearchtheemployee,theemployee’spersonalitems,workareas,lockers,andprivatevehiclesparkedondistrictpremisesorworksitesorusedindistrictbusiness.Employeesrequiredtohaveacommercialdriver’slicense.Anyemployeewhoisrequiredtohaveacommercialdriver’slicense(CDL)issubjecttodrugandalcoholtesting.Thisincludesalldriverswhooperateamotorvehicledesignedtotransport16ormorepeople,countingthedriver;driversoflargevehicles;ordriversofvehiclesusedinthetransportationofhazardousmaterials.Teachers,coaches,orotheremployeeswhoprimarilyperformdutiesotherthandrivingaresubjecttotestingrequirementswhentheirdutiesincludedriving.Drugtestingwillbeconductedbeforeanindividualassumesdrivingresponsibilities.Alcoholanddrugtestswillbeconductedwhenreasonablesuspicionexists,atrandom,whenanemployeereturnstodutyafterengaginginprohibitedconduct,andasafollow-upmeasure.Testingmaybeconductedfollowingaccidents.Return-to-dutyandfollow-uptestingwillbeconductedwhenanemployeewhohasviolatedtheprohibitedalcoholconductstandardsortestedpositiveforalcoholordrugsreturnstoduty.AllemployeesrequiredtohaveaCDLwhoaresubjecttoalcoholanddrugtestingwillreceiveacopyofthedistrict’spolicy,thetestingrequirements,anddetailedinformationonalcoholanddrugabuseandtheavailabilityofassistanceprograms.EmployeeswithquestionsorconcernsrelatingtoalcoholanddrugpoliciesandrelatededucationalmaterialshouldcontacttheMPISDHumanResourcesOffice.FirstaidandCPRcertificationPolicyDBAHeadmarchingbanddirectors,headcoaches,orchiefsponsorsofanextracurricularathleticactivity(includingcheerleading)thatissponsoredorsanctionedbythedistrictortheUniversityInterscholasticLeaguemustmaintainandsubmittothedistrictproofofcurrentcertificationinfirstaidandcardiopulmonaryresuscitation(CPR).CertificationmustbeissuedbytheAmericanRedCross,theAmericanHeartAssociation,oranotherorganizationthatprovidesequivalenttrainingandcertification.ReassignmentsandtransfersPolicyDKAllpersonnelaresubjecttoassignment/reassignmentbytheSuperintendent.Reassignmentisatransfertoanotherposition,department,orfacilitythatdoesnotnecessitateachangeintheemploymentcontract.Campusreassignmentsmustbeapprovedbytheprincipalatthereceivingcampus.Whenreassignmentsareduetoenrollmentshiftsorprogramchanges,theSuperintendenthasfinalplacementauthority.Extracurricularorsupplementaldutyassignmentsmaybereassignedatanytime.Employeeswhoobjecttoare-assignmentmayfollowtheprocessforemployeecomplaintsasoutlinedinpolicyDGBA(Local).Employeeswiththerequiredqualificationsforapositionmayrequestatransfertoanothercampusordepartment.Awrittenrequestfortransfermustbecompletedandsignedbytheemployeeandtheemployee’ssupervisor.TeachersrequestingatransfertoanothercampusbeforetheschoolyearbeginsmustsubmittheirrequestbyJune1ofthatyear.Requestsfortransferduringtheschoolyearwillbeconsideredonlywhenthechangewillnotadverselyaffectstudentsandafterareplacementhasbeenfound.Alltransferrequestswillbecoordinatedbytheemployee’ssupervis
