工程發(fā)包人的一般義務(wù)中英文對照版發(fā)包人應(yīng)按合同約定向承包人及時支付合同價款。Theemployershouldaspercontractagreementmakeanycontractcostintime.設(shè)計人提交全部設(shè)計文件之前，發(fā)包人結(jié)清設(shè)計費，不留尾款。Beforethedesignersubmitsalldesigndocuments.thedesignchargeisallsquaredbytheemployer,andnofinalpaymentleft.Theemployershouldaspercontractagreementorganizethecompletionacceptanceintime.發(fā)包人應(yīng)遵守法律，并辦理法律規(guī)定由其辦理的許可、批準(zhǔn)或備案，包括但不限于建設(shè)用地規(guī)劃許可證、建設(shè)工程規(guī)劃許可證、建設(shè)工程施工許可證、施工所需臨時用水、臨時用電、中斷道路交通、臨時占用土地等許可和批準(zhǔn)。發(fā)包人應(yīng)協(xié)助承包人辦理法律規(guī)定的有關(guān)施工證件和批件。Theemployershouldabidebythelawsandconductthepermission,approvalandfiling,whicharestipulatedbylaws,includeinteraliaPlanningpermissionofconstructionusedland,Permissionofconstructionprojectplanning,Permissionofprojectexecution,andotherpermissionsorapprovalsfortemporarywater,temporarypower,interrupttraffic,temporaryuseland,andsoon.Theemployershouldassistthecontractortoconductthelicensesandapprovaldocumentsforconstruction,whicharestipulatedbylaws.發(fā)包人應(yīng)要求在施工現(xiàn)場的發(fā)包人人員遵守法律及有關(guān)安全、質(zhì)量、環(huán)境保護(hù)、文明施工等規(guī)定，并保障承包人免于承受因發(fā)包人人員未遵守上述要求給承包人造成的損失和責(zé)任。Theemployershouldrequireitspersonnelonsitetoabidebythelawsandregulationsofsafety,quality,environmentalprotection,orderedconstructionandsoon,andindemnifythecontractoragainstthelossandliabilityduetotheemployerpersonneltoobserveaboverequirements.除專用合同條款另有約定外，發(fā)包人應(yīng)最遲于開工日期7天前向承包人移交施工現(xiàn)場。Unlessotherwisestipulatedintheparticularconditiontheemployershouldnolaterthansevendayspriortothecommencementdatehandoverthesitetothecontractor.提供施工條件Provisionofconstructionconditions除專用合同條款另有約定外，發(fā)包人應(yīng)負(fù)責(zé)提供施工所需要的條件，包括：Exceptotherwisestipulatedinparticularconditiontheemployershouldprovidethenecessaryconditionsforconstructionincluding:（1）將施工用水、電力、通訊線路等施工所必需的條件接至施工現(xiàn)場內(nèi)；Thefacilitiesofwater,powerandcommunicationlines,whichnecessaryforconstruction,shouldbeconnectedintothesite.（2）保證向承包人提供正常施工所需要的進(jìn)入施工現(xiàn)場的交通條件；Ensuretoprovidethecontractorwiththenormalandusualtransportationandcommunicationconditionsnecessaryforenteringthesite.（3）協(xié)調(diào)處理施工現(xiàn)場周圍地下管線和鄰近建筑物、構(gòu)筑物、古樹名木的保護(hù)工作，并承擔(dān)相關(guān)費用；Coordinationoftreatmentfortheundergroundpipelinesaroundthesiteinadditiontotheprotectionoftheadjacentbuildings,structuresandfamoustreesandundertakerelatedcoststhereof.（4）按照專用合同條款約定應(yīng)提供的其他設(shè)施和條件。Provisionofotherfacilitiesandconditionswhichshouldbeprovidedpursuanttotheparticularcondition.發(fā)包人應(yīng)當(dāng)在移交施工現(xiàn)場前向承包人提供施工現(xiàn)場及工程施工所必需的毗鄰區(qū)域內(nèi)供水、排水、供電、供氣、供熱、通信、廣播電視等地下管線資料，氣象和水文觀測資料，地質(zhì)勘察資料，相鄰建筑物、構(gòu)筑物和地下工程等有關(guān)基礎(chǔ)資料，并對所提供資料的真實性、準(zhǔn)確性和完整性負(fù)責(zé)。Theemployershould,priortotransferthesite,makeavailabletothecontractorwiththedatawhicharenecessaryforthesiteandconstruction,concernedtheadjacentzone?sdrainage,suppliesofwater,power,gas,heatandundergroundpipelinesofcommunicationandradio/TVandsoon,inadditiontotheinformationofmeteorological,hydrologicalobservationandgeologysurvey,andthebasisinformationinrelationtotheadjacentbuildings,structuresandundergroundengineering,andshouldbeliablefortheauthenticityandcompletenessofthesubmitteddata.TheEmployershall(whereheisinapositiontodoso)providereasonableassistancetotheContractorattherequestoftheContractor:雇主應(yīng)(按其所能)根據(jù)承包商的請求,對其提供以下合理的協(xié)助:(a)byobtainingcopiesoftheLawsoftheCountrywhicharerelevanttotheContractbutarenotreadilyavailable,and取得與合同有關(guān),但不易得到的工程所在國的法律文本;(b)fortheContractor’sapplicationsforanypermits,licensesorapprovalsrequiredbytheLawsoftheCountry:協(xié)助承包商申辦工程所在國法律要求的以下任何許可、執(zhí)照或批準(zhǔn)：TheEmployershallsubmit,within28daysafterreceivinganyrequestfromtheContractor,reasonableevidencethatfinancialarrangementshavebeenmadeandarebeingmaintainedwhichwillenabletheEmployertopaytheContractPrice(asestimatedatthattime)inaccordancewithClause14[ContractPriceandPayment].IftheEmployerintendstomakeanymaterialchangetohisfinancialarrangements,theEmployershallgivenoticetotheContractorwithdetailedparticulars.雇主在應(yīng)在收到承包商的任何要求28天內(nèi),提出其已做并將維持的資金安排的合理證明,說明雇主能夠按照第14條[合同價格和付款]的規(guī)定,支付合同價格(按當(dāng)時估算).如果雇主擬對其資金安排做任何重要變更,應(yīng)將其變更的詳細(xì)的情節(jié)通知承包商.Unlessotherwisestipulatedinparticularconditiontheemployershouldwithin28daysfollowingreceiptofthecontractor’swrittennoticeofrequiringprovisionofFundResourceCertificate,makeavailabletothecontractorwiththecertificateoffundresourcetohavecapacitytomakecontractpayment.發(fā)包人按本合同第五條規(guī)定的內(nèi)容，在規(guī)定的時間內(nèi)向設(shè)計人提交基礎(chǔ)資料及文件，并對其完整性、正確性及時限負(fù)責(zé)。發(fā)包人不得要求設(shè)計人違反國家有關(guān)標(biāo)準(zhǔn)進(jìn)行設(shè)計。TheEmployershalldeliverbasicmaterialsanddocumentstothedesignerwithinthespecifiedtimeinaccordancerequirementsstipulatedinArticle5,andshallberesponsiblefortheircompleteness,correctnessandtimelimit.Theemployershallnotrequestthedesignertodesignbyviolatingtheconcernednationalstandards.Theemployerpromisestothecontractorthatheshallpaytothecontractorthecontractpriceandanyotherpayableamountsinaccordancewiththepaymenttermsandmethodsasagreedinthecontract.發(fā)包人向承包人承諾按照合同約定的期限和方式支付合同價款及其他應(yīng)當(dāng)支付的款項。業(yè)主應(yīng)提供工地，并在本合同有效期內(nèi)允許承包商自由地、不受干擾地出入該工地。TheOwnershallmakeavailabletheSiteandgranttheContractorfreeanduninterruptedaccesstheretothroughoutthedurationofthisContract.業(yè)主應(yīng)按時提供附錄×中指定的物件和設(shè)施。TheOwnershallprovidethoseitemsandfacilitiesspecifiedinAppendix(…)atthetimethereinestablished.業(yè)主將從有關(guān)部門獲取為工廠建造、設(shè)備運行所必需的執(zhí)照和許可證，包括承包商雇員的工作許可證。TheOwnerwillobtainfromtherelevantAuthoritiesthoselicensesandpermitsnecessarytoconstr?uctandoperatethePlantontheSiteincludingworkpermitfortheContractor'semployees.雇主的責(zé)任Employer'sResponsibilities根據(jù)第66條的規(guī)定，如果雇主用自己的工作人員在現(xiàn)場工作，在這方面他應(yīng)當(dāng)：IfunderClause66theEmployershallcarryoutworkontheSitewithhisownworkmenheshall,inrespectofsuchworks:對所有授權(quán)在現(xiàn)場的人員的安全負(fù)全面責(zé)任；以及havefullregardtothesafetyofallpersonsentitledtotheupontheSite,and保持現(xiàn)場的井然有序，以防對這些人員造成危險。keeptheSiteinanorderlystateappropriatetotheavoidanceofdangertosuchpersons.如果根據(jù)第66條的規(guī)定，雇主在現(xiàn)場還雇用其他承包商時，雇主應(yīng)同樣地要求這些承包商在安全和避免危險方面負(fù)同樣責(zé)任。IfunderClause66theEmployershallemployothercontractorsontheSiteheshallrequirethemtohavethesameregardforsafetyandavoidanceofdanger.TheClientshallpayanadvancepaymenttotheSupervisorpriortothecommencementoftheservicesoftheSupervisor,ifsuchadvancepaymentisstatedintheConditionsofParticularApplication.委托人在監(jiān)理人開展監(jiān)理業(yè)務(wù)之前應(yīng)向監(jiān)理人支付預(yù)付款,如果該預(yù)付款在專用條件中陳述。甲方的權(quán)利和義務(wù)RightsandObligationsofPartyA向乙方提供經(jīng)確認(rèn)的施工圖紙或做法說明五份，并向乙方進(jìn)行現(xiàn)場交底，向乙方提供施工所需要的水電設(shè)備，并說明使用注意事項。PartyAshallprovideFIVEcopiesofconfirmedconstructiondrawingsandexplanationsofworkprocedures,andshallconducttechnicalclarification.PartyAshallprovidePartyBwithnecessarywaterandpowerequipmentandtheinstructionsonusingtheequipment.甲方按照付款約定向乙方支付工程款。PartyAshouldmakepaymentstoPartyBaccordingtothepaymentterms.甲方應(yīng)在開工前確認(rèn)施工圖紙并騰出足夠的施工空間，以清除影響施工的障礙物。甲方向乙方提供施工需用的水、電等必備條件，并說明使用注意事項WhenPartyAconfirmsthepre-constructionandconstructiondrawings,hemustalsomakesurethereissufficientspaceavailableattheconstructionsiteforconstructiontotakeplace.PartyAmustmakesurethatPartyBhaseverythingnecessaryonsiteforcompletionoftheconstruction,particularlyelectricityandwater.做好施工中因臨時使用公用部位操作影響鄰里關(guān)系等的協(xié)調(diào)工作PartyAmusttakecareofthepublicrelationsintheconstructionsitearea–particularlywiththeneighbors.發(fā)包人按專用條款約定的內(nèi)容和時間完成以下工作：Theemployershouldcompletethefollowingworkaccordingtothecontentandtimespecifiedinspecialterms.（1）辦理土地征用、拆遷補償、平整施工場地等工作，使施工場地具備施工條件，在開工后繼續(xù)負(fù)責(zé)解決以上事項遺留問題；Expropriateland,compensateforresettlementandlevelofflandforconstruction.Aftertheconstructionstarts,theemployerwillcontinuetodealwiththeleftproblemsoftheabovework.（2）將施工所需水、電、電訊線路從施工場地外部接至專用條款約定地點，保證施工期間的需要；Connectwiresandpipesforwater,powerandtelecommunicationfromoutsidetothesitespecifiedinspecialtermstomeetconstructiondemands.（3）開通施工場地與城鄉(xiāng)公共道路的通道，以及專用條款約定的施工場地內(nèi)的主要道路，滿足施工運輸?shù)男枰?，保證施工期間的暢通；Buildpassagesbetweenconstructionsiteandpublicroadsandalsomainroadsintheconstructionsitewhicharespecifiedinspecialterms.Thisistoguaranteesmoothtrafficduringconstruction.（4）向承包人提供施工場地的工程地質(zhì)和地下管線資料，對資料的真實準(zhǔn)確性負(fù)責(zé)；Provideinformationonconstructiongeographyandundergroundpipelinesofconstructionsitetothecontractor.Theemployershouldberesponsiblefor
