./外籍教師合作協(xié)議Agreementofcooperation甲方：XX樂學三人行教育咨詢有限公司PartyA：ShenzhenLexuesanrenxingEducationalandconsultingcompany以下稱乙方：PartyB：名字:性別:生日Name:Gender:Birthdate國籍：護照號碼：Nationality：PassportNo.：雙方本著友好合作精神,自愿簽訂本合同并保證認真履行合同中約定的各項義務.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfilconscientiouslyalltheobligationsstipulatedinit.合同期自起至止.LengthofContract:fromto.甲乙雙方合作內(nèi)容Cooperationcontent:甲方與乙方進行教學合作,乙方為甲方提供教學服務,并接受甲方的監(jiān)督管理Bothpartiescooperatetogethertofulfilltheteachingtasks.PartyBoffersteachingandorganizingservice.PartyAhastherighttosupervisetheserviceandresultfrompartyBduringthecooperation.乙方在合作期間享受的福利BenefitsofpartyB在合作期間,甲方有責任保證乙方工作環(huán)境的安全,并且對此提供相應的援助.Duringcooperation,partyAcanofferassistanceandadviceregardinganyissueswithlocalofficial’senquiringaboutcooperation.甲乙雙方合作滿半年后,乙方可以享受5天的帶薪休假.Aftersix-monthcooperation,partyBiseligiblefor5dayspaidleave.甲方為乙方提供不定期的團隊出行和團隊用餐的補貼.Onregularoccasion,theschoolwillpayfordaysoutorlunchsubsidies.甲乙雙方合作滿一年并續(xù)簽一年新合約,甲方將為乙方提供9000元人民幣年終獎勵,此獎勵將作為辦理工作簽證的補貼.如果乙方不需要辦理工作簽證,則可以選擇5000元人民幣現(xiàn)金獎勵.Uponcompletionofoneyearcooperationandsigninganewcontract,partyAwillofferupto9000RMBsubsidytowardstheworkingvisaofpartyBorreceivea5000RMBbonusifnoassistanceisrequiredfortheworkingvisa.乙方工作時間和工作內(nèi)容TheworkinghoursofpartyB根據(jù)學校的作息時間表,每周工作日為6天〔節(jié)假日除外,如遇節(jié)假日學校調(diào)換課程時間則按學校要求安排授課.每周授課時間為23小時〔不包含活動,培訓時間為4小時.如遇特殊情況,超出的小時數(shù)將以￥50/小時支付給乙方.工作時間安排如下：星期一,休息星期二至星期五,15:00-21:00星期六,9:00-12:00,14:00-17:00,17:30-18:30星期日,9:00-12:00,14:00-17:00,17:30-18:30寒假和暑假學期期間的課時安排如下:星期一至星期六,9:00-12:00,14:00-17:00星期日,休息Accordingtotheschool’steachingschedule,teachersusuallywork6daysaweek<exceptholidays>.Iftheschoolchangesthescheduleduringtheholiday,teachershavetheobligationtotakeuptheclassesaccordingtotheschool’sarrangement.Thereare21teachinghours<activitiesarenotincluded>and4traininghoursperweek.Everymonth,therearelessthan84teachinghours.Duringthenormalsemester,ifnecessaryandrequired,PartyAwillpayextra￥50/hourtopartyBforeveryadditionalteachinghourmonthly.Thescheduleisasfollows:〔theschedulemaybeswitchedbyspecialoccasionMonday,offTuesdaytoFriday,15:00-21:00Saturday,9:00-12:00,14:00-17:00,19:00-20:00Sunday,9:00-12:00,14:00-18:00Duringthesummerandwintervacationsemesters,theworkingschedulewillbeswitchedtoasfollowsMondaytoSaturday9:00-12:00,14:00-18:00Sunday,Off2.乙方有責任準時到校備課,如果違反一次,將予以警告.違反兩次以上,將從乙方每月工資中扣除50元/次,乙方接受甲方各店店長的監(jiān)督.PartyBhastheobligationtobepresentintheschoolontimeanddonotbelate.IfpartyBdoesn’tobeythisregulationforthefirsttime,partyBwillreceiveaverbalwarning.IfpartyBreceivesasecondwarning,partyAhastherighttocutthesalaryby50RMBeachtimepartyBislate.3.遇甲方在合作學校有特殊活動時,乙方應該參加,如慶祝日、教研活動及一些重要的英語活動等,甲方對此給予乙方一定的交通補助,但不再支付其他費用.IfpartyAhostssomespecialactivities,partyBshouldattendit.Forexample,celebrationday,teachingresearchactivitiesandsomeimportantEnglishactivities.PartyAwillprovidefinancialhelptowardstransportfeesforpartyB,butnoextrapayment<salary>.4.乙方服從甲方分配的教學任務和課程安排；在甲乙雙方約定的教學時長和工作時長內(nèi),對于甲方的課程安排,乙方不得拒絕接受.乙方應按期完成工作任務,保證教學工作的質(zhì)與量.PartyBhastheobligationtoacceptthereasonablearrangementoftheclassesandschedule.PartyBisnotallowedtobeabsentfromtheclasseswithintheteachinghoursasagreed.Ifthereisaspecialreasonforabsence,partyBhastoinformpartyAatleast3daysahead.Incaseofanemergencyorillnessoraccident,partyBhastosubmitpropercertificationdulysignedbyanauthorizedperson.5.乙方有義務遵守甲方的外教管理工作守則,包括主要工作時間安排,日常工作職責獎懲制度等.乙方有義務認真完成上級領(lǐng)導所下達的工作任務和按時按質(zhì)完成.It’stheobligationforPartyBtofollowtheRulesandRegulationssetoutforallforeignteachers,includingtheworkingschedule,dailyworkandresponsibility,PartyBalsohastheobligationtokeepclassroomscleanandtidyaftereachclasshasfinishedandanyadditionaltasksthatmaybeaskedbythesupervisor.6.甲方為乙方提供教學內(nèi)容和教學材料,乙方有責任提前完成備課任務,并與助教和教學主管核對每周備課內(nèi)容.PartyBwillbegivenmaterialforeachclass,theymustfullypreparebeforecommencementofeachclassandisobligedandrequiredtofulfillthistasktothelevelrequiredbytheschoolorsupervisor.7.乙方有責任參加甲方舉行的戶外推廣活動.如因推廣活動而導致超時工作,超過30分鐘將按加班工資核算.OccasionallypartyBisrequiredtoparticipateandattendpromotionalactivitiesandoutdooractivitiestopromotethecauseoftheschool.Thisperiodiswithintheworkinghours.Anyextratimeextending30minuteswillbepaidaccordingly.8．每三個小時的課程將有兩個課間休息,每次休息不得超過10分鐘.在此期間,乙方必須留在學校,不允許在此期間抽煙、喝酒、接打私人電話.Twobreaksoftenminutesarepermittedwithineach3-hourclass.PartyBmustremainonschoolpremisesduringthesebreaksandisnotpermittedtosmokeordrinkalcoholorattendpersonalphonecalls.Supervisionisstillrequiredofthechildrenduringthesebreaks.9.乙方在工作時間不允許閑聊,玩手機,玩電腦游戲,外出用餐,外出購物等活動.如需外出,需向上級提出口頭申請,并經(jīng)得各店店長同意.AnyperiodduringtheworkinghourswhenpartyBisnotteaching,mustrefrainfromusingtheirmobilephonefromanyuseapartfrommakingorreceivingphonecalls.Anyuseofschoolequipmentsuchascomputersismeantforofficialworkandnotforplayinggames,etc.PartyBisnotallowedtoleavetheschoolwithoutpermissionofthesupervisor.10.UniformprovidedbytheschoolmustbewornatalltimeswhenpartAisinschool.三、授課地點Workingaddressandlocation甲方根據(jù)乙方的實際情況,為乙方安排的課程在內(nèi),如有其他變化,雙方協(xié)商解決.Onrareoccasions,partyBmayberequestedtocoverorsubstituteanotherteacheratoursecondbranchwithorwithoutpriornotice.四、薪酬標準Salarycriteria1.雙方協(xié)商達成一致,按月薪資的方式計算工資,首月工資結(jié)算自入職日起至每月最后一天,按實際工作天數(shù)結(jié)算.次月工資自每月第一天起,自每月最后一天為止.每月甲方支付乙方人民幣_____10000______元整,每月15日發(fā)放上月工資.Whenthetwopartiesagreewitheachother,partyBwillbepaidmonthly.PartyBwillreceivetheirsalaryafterthecompletionofeachmonthonthe15thofeverymonth.PartyApaysPartyB______10000________RMBpercalendarmonth.<Forexample,ifpartyBsignstheagreementon20thofthemonth,thenthesalaryfrom20thofthatmonthtothelastdayofthatmonthwillbepaidonthe15thofthenextmonth.Thesalaryofthefirstdayofthecalendarmonthtothelastdayofthemonthwillbepaidonthe15thofthenextmonth>雙方合作期間,甲方為乙方提供____1000/月______交通補助.Duringthetimeofcooperation,partyAofferspartyBanadditional￥1000/monthsubsidytowardsthecostsoftransportation.五、其他事項Mattersofreference:1.乙方在合作期間的健康及醫(yī)療由乙方自行解決.Personalmattersincludingaccommodation,healthandillnessaretheresponsibilityofpartyB.PartyAisavailableforadviceandhelpatalltime.2.病假及事假：Sickleaveandcompassionateleave〔1如果乙方因患病并經(jīng)醫(yī)院證明確不能工作,可以向甲方提出請假.如果乙方連續(xù)7天請病假,甲方可以按照國家外專局合同有關(guān)規(guī)定中止與受聘方的合同.Intheeventofsickness,partyBmustproduceadequatecertificationfromthecorrecthospitaltoprovetheirsicknessinregardstosickleave.Uponprovidingcertificatesickleavewillbegranted.Ifthesickleaverunsfor7dayscontinually,partyAhastherighttoterminatethecontractaccordingtothecontractissuedbystateadministrationoftheForeignExpertsAffairs.〔2如果乙方在工作時間內(nèi)需要請事假,須得到甲方的批準；如果乙方未向甲方提出請假,而曠工不上課,甲方有權(quán)在其曠工期間罰扣其一個月工資IfPartyBappliesforadayoffbecauseofpersonalreasonsduringtheworktime,itmustbeconfirmedbypartyA.IfpartyBisabsentfromclasswithoutapplicationorinforming,thenpartyAhastherighttocutonemonth’ssalarytocoverthelossofouradministrationcosts,reputationandhiringofareplacementteacher.七．保密協(xié)議confidentialityagreement1.雙方不得將合作內(nèi)容和任何合作詳細信息透露給第三方,包括甲方內(nèi)部員工.BothpartiesarenotallowedtodivulgeanyinformationordetailsregardingeithertheschoolorpartyB.AllaspectsofcooperationbetweenpartyAandBareconfidential2.在任何情況下,甲乙雙方不得將工資,協(xié)議內(nèi)容,國籍,年齡,教學年限和中介來源透漏給第三方,包括甲方公司員工.Thetwopartiesarenotallowedtodivulgepersonalinformationregardingsalaries,contract,nationality,andageorrecruitmentagency.UnderNOCIRCUMSTANCEcanthisinformationordetailsbepassedontoanyoftheotherstaff.IfpartyBhasbeenfoundguiltyofthis
