白俄羅斯語勞動合同范本合同編號:__________PartiesThisContract(hereinafterreferredtoasthe"Agreement")isenteredintoasof__________(the"EffectiveDate")andbetween:Employer:FullName:____________________________RegistrationNumber:____________________Address:______________________________ContactPerson:________________________Telephone:____________________________Employee:FullName:____________________________DateofBirth:_________________________PersonalIDNumber:_____________________Address:______________________________ContactPerson:________________________Telephone:____________________________(Eacha"Party"andcollectivelythe"Parties")SubjectMatterWHEREAS,theEmployerisengagedinthebusinessof_______________________(the"Business");WHEREAS,bothPartiesdesiretoenterintothisAgreementtosetforththetermsandconditionsoftheEmployee'semploymentwiththeEmployer.NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementscontainedherein,thePartiesagreeasfollows:Article1:Employment1.1PositionandDutiesTheEmployeeshallbeemployedtheEmployerinthepositionof_______________________(the"Position").TheEmployeeshallperformsuchdutiesandresponsibilitiesasmaybeassignedtohim/hertheEmployerfromtimetotime.1.2TermofEmploymentArticle2:Compensation2.1BaseSalaryTheEmployeeshallreceiveamonthlybasesalaryof_______________________(the"BaseSalary")payablewithinthirty(30)daysaftertheendofeachmonth.2.2BenefitsTheEmployeeshallbeendtothefollowingbenefits:(a)Vacation:TheEmployeeshallbeendto_______________(the"VacationDays")ofpaidvacationleaveperyear,proratedbasedontheEmployee'sstartdate.(b)HealthInsurance:TheEmployershallprovidetheEmployeewithhealthinsurancecoverageasspecifiedintheapplicableinsurancepolicy.(c)OtherBenefits:TheEmployeemaybeendtootherbenefitsasdeterminedtheEmployerfromtimetotime.Article3:WorkingHoursandLocation3.1WorkingHoursTheEmployeeshallwork_______________(the"WorkingHours")perweek,asdeterminedtheEmployer.3.2PlaceofWorkTheEmployee'splaceofworkshallbeattheEmployer'sprincipalplaceofbusinesslocatedat_______________________(the"Workplace").TheEmployermayrequiretheEmployeetoworkatotherlocationsasreasonablyrequired.Article4:ConfidentialityandNonDisclosure4.1ConfidentialityTheEmployeeagreestomaintaininstrictconfidenceandnotdisclosetoanythirdpartyanyConfidentialInformation(asdefinedbelow)obtainedtheEmployeeduringthecourseofemploymentwiththeEmployer.4.2NonDisclosureTheEmployeeagreesthathe/shewillnot,eitherduringoraftertheterminationofthisAgreement,useordiscloseanytradesecrets,proprietaryinformation,orotherconfidentialinformationoftheEmployeroranyofitsaffiliates,exceptasrequiredlaworwiththeexpresswrittenconsentoftheEmployer.Article5:Termination5.1TerminationeitherPartyThisAgreementmaybeterminatedeitherPartyuponwrittennoticetotheotherPartyifthePartiesmutuallyagreetoterminatethisAgreement.5.2TerminationtheEmployerTheEmployermayterminatethisAgreementforcause,includingbutnotlimitedtotheEmployee'sbreachofthisAgreement,failuretoperformhis/herduties,ormisconduct.Insuchevent,theEmployershallprovidetheEmployeewithwrittennoticeoftheterminationandthereasonstherefor.5.3TerminationtheEmployeeTheEmployeemayterminatethisAgreementwiththirty(30)days'writtennoticetotheEmployer.TheEmployeeshallbeendtoreceivepaymentofanyaccruedbutunusedvacationleaveupontermination.Article6:Miscellaneous6.1GoverningLawThisAgreementshallbegovernedandconstruedinaccordancewiththelawsof_______________________(the"GoverningJurisdiction").一、附件列表:1.員工身份證明文件2.雇主營業(yè)執(zhí)照副本3.社會保險登記證4.醫(yī)療保險登記證5.職位描述和工作職責(zé)說明6.員工績效評估標(biāo)準(zhǔn)7.保密協(xié)議8.員工手冊9.公司規(guī)章制度10.勞動合同續(xù)簽申請表二、違約行為及認(rèn)定:1.員工未經(jīng)許可擅自離崗或未經(jīng)批準(zhǔn)長期缺勤。2.員工未按約定提供服務(wù)或未達(dá)到工作標(biāo)準(zhǔn)。3.員工泄露或未妥善保管公司機(jī)密信息。4.員工違反公司規(guī)章制度或員工手冊中的規(guī)定。5.雇主未按時支付工資或未提供約定的福利。6.雇主未按約定提供工作條件或工作環(huán)境。7.任何一方違反法律、法規(guī)或本合同的約定。三、法律名詞及解釋:1.勞動合同:雇主與員工之間確立勞動關(guān)系的協(xié)議。2.雇主:提供工作崗位并支付報酬的法人或自然人。3.員工:提供勞動力并接受雇主管理的自然人。4.工資:雇主支付給員工的報酬,包括基本工資和獎金等。5.福利:雇主提供給員工的除工資以外的待遇,如醫(yī)療保險、年假等。6.保密信息:與公司業(yè)務(wù)有關(guān)且未公開的信息,包括客戶資料、商業(yè)秘密等。7.違約:違反合同約定的行為。四、執(zhí)行中遇到的問題及解決辦法:1.員工缺勤:與員工溝通原因,根據(jù)實際情況采取警告或紀(jì)律處分措施。2.工作標(biāo)準(zhǔn)未達(dá)成:提供培訓(xùn),明確期望,定期評估,必要時調(diào)整工作職責(zé)。3.泄露機(jī)密信息:立即采取補(bǔ)救措施,如內(nèi)部調(diào)查、法律追究,必要時終止合同。4.違反規(guī)章制度:依據(jù)公司規(guī)章制度給予相應(yīng)紀(jì)律處分,
