ProductionSafetyLawofthePeople'sRepublicofChina目錄Contents第一章總則ChapterIGeneralPrinciples第二章生產(chǎn)經(jīng)營單位的安全生產(chǎn)保障ChapterIIGuaranteeofSafetybyProductionandBusinessOperationEntities第三章從業(yè)人員的權(quán)利和義務(wù)ChapterIIIRightsandObligationsofEmployees第四章安全生產(chǎn)的監(jiān)督管理ChapterIVSupervisionandAdministrationofProductionSafety第五章生產(chǎn)安全事故的應(yīng)急救援與調(diào)查處理ChapterVEmergencyRescue,InvestigationandHandlingofProductionSafetyAccidents第六章法律責(zé)任ChapterVILegalLiabilities第七章附則ChapterVIISupplementaryProvisions第一章總則ChapterIGeneralPrinciples第一條為了加強安全生產(chǎn)監(jiān)督管理，防止和減少生產(chǎn)安全事故，保障人民群眾生命和財產(chǎn)安全，促進經(jīng)濟發(fā)展，制定本法。Article1Thepresentlawhasbeenenactedforthepurposeofstrengtheningthesupervisionandadministrationofproductionsafety,preventingandreducingsafetyaccidents,defendingthesafetyoflifeandpropertyofthemasses,andpromotingthedevelopmentofeconomy.第二條在中華人民共和國領(lǐng)域內(nèi)從事生產(chǎn)經(jīng)營活動的單位（以下統(tǒng)稱生產(chǎn)經(jīng)營單位）的安全生產(chǎn)，適用本法；Article2ThepresentlawshallbeapplicabletotheproductionsafetyoftheentitiesthatareengagedintotheproductionandbusinessoperationactivitieswithintheterritoryofthePeople'sRepublicofChina(hereinafterreferredtoastheproductionandbusinessoperationentities).有關(guān)法律、行政法規(guī)對消防安全和道路交通安全、鐵路交通安全、水上交通安全、民用航空安全另有規(guī)定的，適用其規(guī)定。Wheretherearedifferentprovisionsinlawsoradministrativeregulationsconcerningthesafetyoffirecontrol,roadtrafficandtransportation,railwaytransportation,watertransportation,civilairtransportation,etc.,suchprovisionsshallbeapplied.第三條安全生產(chǎn)管理，堅持安全第一、預(yù)防為主的方針。Article3Fortheadministrationofproductionsafety,theguidelinesof"safetyfirst,focusonprevention"shallbeobserved.第四條生產(chǎn)經(jīng)營單位必須遵守本法和其他有關(guān)安全生產(chǎn)的法律、法規(guī)，加強安全生產(chǎn)管理，建立、健全安全生產(chǎn)責(zé)任制度，完善安全生產(chǎn)條件，確保安全生產(chǎn)。Article4Theproductionandbusinessoperationentitiesshallobservethepresentlawandotherrelevantlaws,regulationsconcerningtheproductionsafety,strengthentheadministrationofproductionsafety,establishandperfectthesystemofresponsibilityforproductionsafety,perfecttheconditionsforsafeproduction,andensurethesafetyinproduction.第五條生產(chǎn)經(jīng)營單位的主要負(fù)責(zé)人對本單位的安全生產(chǎn)工作全面負(fù)責(zé)。Article5Themajorperson-in-chargeoftheproductionandbusinessoperationentitiesshalltakechargeoftheoverallworkoftheproductionsafetyoftheentityconcerned.第六條生產(chǎn)經(jīng)營單位的從業(yè)人員有依法獲得安全生產(chǎn)保障的權(quán)利，并應(yīng)當(dāng)依法履行安全生產(chǎn)方面的義務(wù)。Article6Theemployeesoftheproductionandbusinessoperationentitieshavetherighttoproductionsafetyaccordingtolaw,andshallalsobeobligedtoperformtheirobligationsregardingtoproductionsafety.第七條工會依法組織職工參加本單位安全生產(chǎn)工作的民主管理和民主監(jiān)督，維護職工在安全生產(chǎn)方面的合法權(quán)益。Article7Thetradeunionsshallorganizestheworkerstoparticipateinthedemocraticmanagementandsupervisionoftheproductionsafetyoftheentitywheretheyworksoastosafeguardthelawfulrightsandinterestsoftheworkersinproductionsafety.第八條國務(wù)院和地方各級人民政府應(yīng)當(dāng)加強對安全生產(chǎn)工作的領(lǐng)導(dǎo)，支持、督促各有關(guān)部門依法履行安全生產(chǎn)監(jiān)督管理職責(zé)。Article8TheStateCouncilandthepeople'sgovernmentsatalllevelsshallstrengthentheleadershipovertheworkofproductionsafety,andsupportandurgetherelevantdepartmentstoperformtheirrespectivedutiesofsupervisionandadministrationofproductionsafety.縣級以上人民政府對安全生產(chǎn)監(jiān)督管理中存在的重大問題應(yīng)當(dāng)及時予以協(xié)調(diào)、解決。Thepeople'sgovernmentsonthecountylevelandaboveshallcoordinateandhandletheseriousproblemsthatexistinthesupervisionandadministrationofproductionsafetyingoodtime.第九條國務(wù)院負(fù)責(zé)安全生產(chǎn)監(jiān)督管理的部門依照本法，對全國安全生產(chǎn)工作實施綜合監(jiān)督管理；Article9ThedepartmentoftheStateCouncilinchargeofthesupervisionandadministrationofproductionsafetyimplementscomprehensivesupervisionandadministrationoftheworkofproductionsafetyofthewholecountry.縣級以上地方各級人民政府負(fù)責(zé)安全生產(chǎn)監(jiān)督管理的部門依照本法，對本行政區(qū)域內(nèi)安全生產(chǎn)工作實施綜合監(jiān)督管理。Thepeople'sgovernmentsonthecountylevelandaboveinchargethesupervisionandadministrationofproductionsafetyshallimplementcomprehensivesupervisionandadministrationoftheworkofproductionsafetywiththeirrespectiveadministrativejurisdictionsaccordingtothepresentlaw.國務(wù)院有關(guān)部門依照本法和其他有關(guān)法律、行政法規(guī)的規(guī)定，在各自的職責(zé)范圍內(nèi)對有關(guān)的安全生產(chǎn)工作實施監(jiān)督管理；TherelevantdepartmentsoftheStateCouncilshall,accordingtotheprovisionsofthepresentlawandotherrelevantlawsandadministrativeregulations,implementsupervisionandadministrationoftheworkofproductionsafetywithintheirrespectivefunctionsandduties.縣級以上地方各級人民政府有關(guān)部門依照本法和其他有關(guān)法律、法規(guī)的規(guī)定，在各自的職責(zé)范圍內(nèi)對有關(guān)的安全生產(chǎn)工作實施監(jiān)督管理。Therelevantdepartmentsofthepeople'sgovernmentsonthecountylevelandaboveshall,accordingtotheprovisionsofthepresentlawandotherrelevantlawsandregulations,implementsupervisionandadministrationoftheworkofproductionsafetywithintheirrespectivefunctionsandduties.第十條國務(wù)院有關(guān)部門應(yīng)當(dāng)按照保障安全生產(chǎn)的要求，依法及時制定有關(guān)的國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)，并根據(jù)科技進步和經(jīng)濟發(fā)展適時修訂。Article10TherelevantdepartmentsoftheStateCouncilshall,accordingtotherequirementsofguaranteeingproductionsafety,formulaterelevantnationalstandardsorindustrialstandardsaccordingtolawandingoodtime,andshallmakerevisionsaccordingtotheprogressoftechnologyanddevelopmentofeconomyingoodtime.生產(chǎn)經(jīng)營單位必須執(zhí)行依法制定的保障安全生產(chǎn)的國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)。Theproductionandbusinessoperationentitiesmustenforcethenationalstandardsandindustrialstandardsthathavebeenlawfullyformulatedforguaranteeingproductionsafety.第十一條各級人民政府及其有關(guān)部門應(yīng)當(dāng)采取多種形式，加強對有關(guān)安全生產(chǎn)的法律、法規(guī)和安全生產(chǎn)知識的宣傳，提高職工的安全生產(chǎn)意識。Article11Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsthereofshalltakevariousformstostrengthenthepublicityoflawsandregulationsconcerningproductionsafetyandknowledgeaboutproductionsafetysoastoenhancetheconsciousnessoftheworkersaboutproductionsafety.第十二條依法設(shè)立的為安全生產(chǎn)提供技術(shù)服務(wù)的中介機構(gòu)，依照法律、行政法規(guī)和執(zhí)業(yè)準(zhǔn)則，接受生產(chǎn)經(jīng)營單位的委托為其安全生產(chǎn)工作提供技術(shù)服務(wù)。Article12Theintermediaryinstitutionsthatarelawfullyestablishedforprovidingtechnologicalservicesinproductionsafetyacceptstheentrustmentoftheproductionandbusinessoperationentitiestoprovidetechnologicalservicesinproductionsafetyaccordingtotheprovisionsoflaws,administrativeregulationsandcodeofconduct.第十三條國家實行生產(chǎn)安全事故責(zé)任追究制度，依照本法和有關(guān)法律、法規(guī)的規(guī)定，追究生產(chǎn)安全事故責(zé)任人員的法律責(zé)任。Article13Thesystemofaffixingresponsibilitiestoproductionsafetyaccidentsisimplementedinourcountryandthosewhoareheldtoberesponsibleforproductionsafetyaccidentsshallbeaffixedlegalliabilitiesaccordingtothepresentlawandotherprovisionsoftherelevantlawsandregulations.第十四條國家鼓勵和支持安全生產(chǎn)科學(xué)技術(shù)研究和安全生產(chǎn)先進技術(shù)的推廣應(yīng)用，提高安全生產(chǎn)水平。Article14Thestateencouragesandsupportstheresearchofproductionsafetyscienceandtechnologyandthepopularizationandapplicationofadvancedtechnologiesofproductionsafetysoastoimprovethelevelofproductionsafety.第十五條國家對在改善安全生產(chǎn)條件、防止生產(chǎn)安全事故、參加搶險救護等方面取得顯著成績的單位和個人，給予獎勵。Article15Thestaterewardsthoseentitiesandindividualsthathavemadeoutstandingachievementsintheimprovementofconditionsofproductionsafety,preventingproductionsafetyaccidents,andrescueandreliefinemergencies,etc.第二章生產(chǎn)經(jīng)營單位的安全生產(chǎn)保障ChapterIIGuaranteeofSafetybyProductionandBusinessOperationEntities第十六條生產(chǎn)經(jīng)營單位應(yīng)當(dāng)具備本法和有關(guān)法律、行政法規(guī)和國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)規(guī)定的安全生產(chǎn)條件；Article16Theproductionandbusinessoperationentitiesshallbeequippedwiththeconditionsforsafeproductionasprovidedinthepresentlawandotherrelevantlaws,administrativeregulations,nationalstandardsandindustrialstandards.不具備安全生產(chǎn)條件的，不得從事生產(chǎn)經(jīng)營活動。Anyentitythatisnotequippedwiththeconditionsforsafeproductionmaynotengageinproductionandbusinessoperationactivities.第十七條生產(chǎn)經(jīng)營單位的主要負(fù)責(zé)人對本單位安全生產(chǎn)工作負(fù)有下列職責(zé)：Article17Themajorpersons-in-chargeoftheproductionandbusinessoperationentitiesshallhavethefollowingdutiesandresponsibilitiesregardingtheproductionsafetyoftheirownentity:（一）建立、健全本單位安全生產(chǎn)責(zé)任制；a.Establishingandperfectingthesystemofresponsibilityrelatingtoproductionsafety;（二）組織制定本單位安全生產(chǎn)規(guī)章制度和操作規(guī)程；b.Organizingtheformulationofrulesofsafeproductionandoperationalrulesoftheentity;（三）保證本單位安全生產(chǎn)投入的有效實施；c.Ensuringtheeffectiveexecutionofinputinproductionsafety;（四）督促、檢查本單位的安全生產(chǎn)工作，及時消除生產(chǎn)安全事故隱患；d.Overseeingandinspectingtheworkofproductionsafetyoftheentityandeliminatingingoodtimethepotentialproductionsafetyaccidents;（五）組織制定并實施本單位的生產(chǎn)安全事故應(yīng)急救援預(yù)案；e.Organizingtheformulationandexecutionofplansforemergencyrescueandreliefofproductionsafetyaccidentsoftheentity（六）及時、如實報告生產(chǎn)安全事故。f.Reportingproductionsafetyaccidentstruthfullyandingoodtime.第十八條生產(chǎn)經(jīng)營單位應(yīng)當(dāng)具備的安全生產(chǎn)條件所必需的資金投入，由生產(chǎn)經(jīng)營單位的決策機構(gòu)、主要負(fù)責(zé)人或者個人經(jīng)營的投資人予以保證，并對由于安全生產(chǎn)所必需的資金投入不足導(dǎo)致的后果承擔(dān)責(zé)任。Article18Thecapitalinvestmentnecessaryfortheconditionsforthesafeproductionoftheproductionandbusinessoperationentitiesshallguaranteedbythedecision-makingorganandmajorpersons-in-chargeoftheproductionandbusinessoperationentitiesortheinvestorsoftheprivateenterpriseswhoshallberesponsiblefortheaftermathsofinsufficientcapitalinvestmentnecessaryforsafeproduction.第十九條礦山、建筑施工單位和危險物品的生產(chǎn)、經(jīng)營、儲存單位，應(yīng)當(dāng)設(shè)置安全生產(chǎn)管理機構(gòu)或者配備專職安全生產(chǎn)管理人員。Article19Theminesandconstructionentitiesaswellasthoseengagedintheproduction,sellingandstorageofhazardoussubstancesshallestablishanadministrativeorganforproductionsafetyorhavefull-timepersonnelfortheadministrationofproductionsafety.前款規(guī)定以外的其他生產(chǎn)經(jīng)營單位，從業(yè)人員超過三百人的，應(yīng)當(dāng)設(shè)置安全生產(chǎn)管理機構(gòu)或者配備專職安全生產(chǎn)管理人員；從業(yè)人員在三百人以下的，應(yīng)當(dāng)配備專職或者兼職的安全生產(chǎn)管理人員，或者委托具有國家規(guī)定的相關(guān)專業(yè)技術(shù)資格的工程技術(shù)人員提供安全生產(chǎn)管理服務(wù)。Theproductionandbusinessoperationentitiesnotmentionedintheprecedingparagraphbuthavemorethan300employeesshallestablishanadministrativeorganforproductionsafetyorhavefull-timepersonnelfortheadministrationofproductionsafety;iftheyhavefewerthan300employees,theyshallhavefull-timeorpart-timepersonnelfortheadministrationofproductionsafetyorentrusttheengineeringtechnicianswhoareequippedwiththerelevantprofessionaltechnicalqualificationsasprovidedbythestatetoprovideservicesintheadministrationofproductionsafety.生產(chǎn)經(jīng)營單位依照前款規(guī)定委托工程技術(shù)人員提供安全生產(chǎn)管理服務(wù)的，保證安全生產(chǎn)的責(zé)任仍由本單位負(fù)責(zé)。Whereanyproductionandbusinessoperationentitythatentrustsengineeringtechnicianstoprovideservicesintheadministrationofproductionsafetyasprovidedintheprecedingparagraph,theresponsibilityforensuringsafeproductionshallalsoremainwiththeentityitself.第二十條生產(chǎn)經(jīng)營單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員必須具備與本單位所從事的生產(chǎn)經(jīng)營活動相應(yīng)的安全生產(chǎn)知識和管理能力。Article20Themajorpersons-in-chargeandthepersonnelfortheadministrationofproductionsafetyoftheproductionandbusinessoperationentitiesshallhavetheknowledgeandmanagementcapacitythatmatchtheproductionandbusinessoperationactivitiesoftheentitiesconcerned.危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員，應(yīng)當(dāng)由有關(guān)主管部門對其安全生產(chǎn)知識和管理能力考核合格后方可任職。Thepersons-in-chargeandthepersonnelfortheadministrationofproductionsafetyoftheentitiesthatareengagedintheproduction,sellingandstorageofhazardoussubstancesandtheminesandconstructionentitiesshallnottaketheirpositionsuntiltheyhavepassedtheexaminationsoftheadministrativedepartmentsconcerningtheknowledgeandmanagementcapacityofproductionsafety.考核不得收費。Nofeesmaybechargedforsuchexaminations.第二十一條生產(chǎn)經(jīng)營單位應(yīng)當(dāng)對從業(yè)人員進行安全生產(chǎn)教育和培訓(xùn)，保證從業(yè)人員具備必要的安全生產(chǎn)知識，熟悉有關(guān)的安全生產(chǎn)規(guī)章制度和安全操作規(guī)程，掌握本崗位的安全操作技能。Article21Theproductionandbusinessoperationentitiesshalloffereducationandtrainingprogramstotheemployeesthereofregardingproductionsafetysoastoensurethattheemployeeshavethenecessaryknowledgeofproductionsafety,knowtherelevantregulationsandrulesforsafeproductionandtherulesforsafeoperation,andmastertheskillsforsafeoperationfortheirownpositions.未經(jīng)安全生產(chǎn)教育和培訓(xùn)合格的從業(yè)人員，不得上崗作業(yè)。Noemployeewhohasnotpassedtheeducationandtrainingprogramsregardingproductionsafetymaystarttoworkathisposition.第二十二條生產(chǎn)經(jīng)營單位采用新工藝、新技術(shù)、新材料或者使用新設(shè)備，必須了解、掌握其安全技術(shù)特性，采取有效的安全防護措施，并對從業(yè)人員進行專門的安全生產(chǎn)教育和培訓(xùn)。Article22Whereanyproductionandbusinessoperationentitiesemploysanynewtechnique,newtechnology,newmaterialornewequipment,itmustknowandhavegoodunderstandingofthesafetyandtechnicalfeaturethereof,takeeffectivemeasuresforsafetyproductionandgivespecialeducationandtrainingprogramstotheemployeesconcernedaboutproductionsafety.第二十三條生產(chǎn)經(jīng)營單位的特種作業(yè)人員必須按照國家有關(guān)規(guī)定經(jīng)專門的安全作業(yè)培訓(xùn)，取得特種作業(yè)操作資格證書，方可上崗作業(yè)。Article23Thespecialoperationstaffmembersoftheproductionandbusinessoperationentitiesmaynotstarttoworkattheirpositionsuntiltheyhavepassedthespecialtrainingregardingsafeoperationsandobtainedqualificationcertificatesforspecialoperationsaccordingtotherelevantprovisionsofthestate.特種作業(yè)人員的范圍由國務(wù)院負(fù)責(zé)安全生產(chǎn)監(jiān)督管理的部門會同國務(wù)院有關(guān)部門確定。ThescopeofspecialoperationstaffshallbedeterminedbythedepartmentStateCouncilinchargeofthesupervisionandadministrationofproductionsafetyincollaborationwiththeotherrelevantdepartmentsoftheStateCouncil.第二十四條生產(chǎn)經(jīng)營單位新建、改建、擴建工程項目（以下統(tǒng)稱建設(shè)項目）的安全設(shè)施，必須與主體工程同時設(shè)計、同時施工、同時投入生產(chǎn)和使用。Article24Thesafetyfacilitiesofthenewlybuiltorrebuiltorexpandedengineeringprojectsoftheproductionandbusinessoperationentities(hereinafterreferredtoasconstructionprojectsasageneralterm)shallbedesigned,builtandputintoproductionanduseatthesametimeoftheprincipalpartoftheprojects.安全設(shè)施投資應(yīng)當(dāng)納入建設(shè)項目概算。Theinvestmentinsafetyfacilitiesshallbeincorporatedinthebudgetaryestimatesoftheconstructionprojectsconcerned.第二十五條礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目，應(yīng)當(dāng)分別按照國家有關(guān)規(guī)定進行安全條件論證和安全評價。Article25Safetyconditionsargumentationsandsafetyappraisalsshallbemadeaccordingtotherelevantprovisionsofthestatetotheminingconstructionprojectsandtheconstructionprojectsfortheproductionandstorageofhazardoussubstancesrespectively.第二十六條建設(shè)項目安全設(shè)施的設(shè)計人、設(shè)計單位應(yīng)當(dāng)對安全設(shè)施設(shè)計負(fù)責(zé)。Article26Thedesignersordesigningentitiesforthesafetyfacilitiesofconstructionprojectsshalltakeresponsibilityfortheirdesignsofsafetyfacilities.礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目的安全設(shè)施設(shè)計應(yīng)當(dāng)按照國家有關(guān)規(guī)定報經(jīng)有關(guān)部門審查，審查部門及其負(fù)責(zé)審查的人員對審查結(jié)果負(fù)責(zé)。Thesafetyfacilitydesignsoftheminingconstructionprojectsandtheconstructionprojectsfortheproductionandstorageofhazardoussubstancesshallbesubjecttotheexaminationandapprovalofrelevantdepartmentsaccordingtotherelevantprovisionsofthestate,andtheexaminationandapprovaldepartmentsandthepersonsthereofinchargeofexaminationsandapprovalshallberesponsiblefortheresultofexaminationandapproval.第二十七條礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目的施工單位必須按照批準(zhǔn)的安全設(shè)施設(shè)計施工，并對安全設(shè)施的工程質(zhì)量負(fù)責(zé)。Article27Theminingconstructionprojectsandtheconstructionentitiesoftheconstructionprojectsfortheproductionandstorageofhazardoussubstancesshallexecutetheconstructionsaccordingtotheapproveddesignsofsafetyfacilities,andshallberesponsibleforthequalityoftheconstructionofsafetyfacilities.礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目竣工投入生產(chǎn)或者使用前，必須依照有關(guān)法律、行政法規(guī)的規(guī)定對安全設(shè)施進行驗收；Afteraminingconstructionprojectoraconstructionprojectfortheproductionandstorageofhazardoussubstancesiscompletedandbeforeitisputintoproductionorputintouse,thesafetyfacilitiesthereofshallbesubjecttocheckandapprovalaccordingtotherelevantprovisionsoflawsandadministrativeregulations.驗收合格后，方可投入生產(chǎn)和使用。Theymaybeputintoproductionoruseonlyaftertheyhavepassedthecheckandapproval.驗收部門及其驗收人員對驗收結(jié)果負(fù)責(zé)。Thedepartmentinchargeofthecheckandapprovalshallberesponsiblefortheresultsofcheckandapproval.第二十八條生產(chǎn)經(jīng)營單位應(yīng)當(dāng)在有較大危險因素的生產(chǎn)經(jīng)營場所和有關(guān)設(shè)施、設(shè)備上，設(shè)置明顯的安全警示標(biāo)志。Article28Theproductionandbusinessoperationentitiesshallsetupeye-catchingsafetywarningmarksattheproductionorbusinessoperationsitesthathavesubstantialdangerouselementsorontherelevantfacilitiesorequipments.第二十九條安全設(shè)備的設(shè)計、制造、安裝、使用、檢測、維修、改造和報廢，應(yīng)當(dāng)符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)。Article29Thedesigning,manufacturing,installation,using,checking,maintenance,reformingandclaimingasuselessofsafetyequipmentsshallbeinconformitywiththenationalstandardsorindustrialstandards.生產(chǎn)經(jīng)營單位必須對安全設(shè)備進行經(jīng)常性維護、保養(yǎng)，并定期檢測，保證正常運轉(zhuǎn)。Theproductionandbusinessoperationentitiesshallservice,maintainthesafetyfacilitiesoftenandcheckthemregularlysoastoensurethenormaloperationthereof.維護、保養(yǎng)、檢測應(yīng)當(dāng)作好記錄，并由有關(guān)人員簽字。Recordsshallbemadefortheservices,towhichthesignatureofrelevantpersonsshallbeaffixed.第三十條生產(chǎn)經(jīng)營單位使用的涉及生命安全、危險性較大的特種設(shè)備，以及危險物品的容器、運輸工具，必須按照國家有關(guān)規(guī)定，由專業(yè)生產(chǎn)單位生產(chǎn)，并經(jīng)取得專業(yè)資質(zhì)的檢測、檢驗機構(gòu)檢測、檢驗合格，取得安全使用證或者安全標(biāo)志，方可投入使用。Article30Thespecialequipmentthatconcernsthesafetyoflifeorisratherdangers,thecontainerofhazardoussubstancesorthetransportationtoolthatanyproductionandbusinessoperationentityusesshall,accordingtotherelevantprovisionsofthestate,bemanufacturedbythespecializedproductionentities,andonlyafterithaspassedthedetectionsandtestsofthedetectingandtestinginstitutionsthatareequippedwiththeprofessionalqualificationsforwhichacertificateforsafeuseoramarkofsafetyhasbeenobtainedcoulditbeputintouse.檢測、檢驗機構(gòu)對檢測、檢驗結(jié)果負(fù)責(zé)。Thedetectingandtestinginstitutionsshallberesponsiblefortheresultsoftheirdetectionsandtests.涉及生命安全、危險性較大的特種設(shè)備的目錄由國務(wù)院負(fù)責(zé)特種設(shè)備安全監(jiān)督管理的部門制定，報國務(wù)院批準(zhǔn)后執(zhí)行。ThelistofspecialequipmentsthatconcernthesafetyoflifeorthatareratherdangerousshallbeformulatedbythedepartmentoftheStateCouncilinchargeofthesupervisionandadministrationofsuchspecialequipments,andshallbeexecutedaftertheapprovaloftheStateCouncilhasbeenobtained.第三十一條國家對嚴(yán)重危及生產(chǎn)安全的工藝、設(shè)備實行淘汰制度。Article31Thetechniquesandequipmentsthatseriouslyendangersthesafetyofproductionshallbeeliminatedbythestate.生產(chǎn)經(jīng)營單位不得使用國家明令淘汰、禁止使用的危及生產(chǎn)安全的工藝、設(shè)備。Noproductionandbusinessoperationentitymayuseanytechniqueorequipmentthatendangersproductionsafetyandthathasbeenexplicitlyannouncedforeliminationorpreventfromuse.第三十二條生產(chǎn)、經(jīng)營、運輸、儲存、使用危險物品或者處置廢棄危險物品的，由有關(guān)主管部門依照有關(guān)法律、法規(guī)的規(guī)定和國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)審批并實施監(jiān)督管理。Article32Theproduction,businessoperation,transportation,storageanduseofanyhazardoussubstancesordisposeoforabandonhazardoussubstancesshallbesubjecttotheexaminationandapprovalaswellasthesupervisionandadministrationofrelevantadministrativedepartmentsaccordingtotheprovisionsofrelevantlawsandregulations,nationalstandardsorindustrialstandards.生產(chǎn)經(jīng)營單位生產(chǎn)、經(jīng)營、運輸、儲存、使用危險物品或者處置廢棄危險物品，必須執(zhí)行有關(guān)法律、法規(guī)和國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)，建立專門的安全管理制度，采取可*的安全措施，接受有關(guān)主管部門依法實施的監(jiān)督管理。Fortheproduction,businessoperation,transportation,storageanduseofanyhazardoussubstanceordisposalorabandoningofanyhazardoussubstancebyanyproductionandbusinessoperationentity,theentityshallexecutetheprovisionsofrelevantlawsandregulationsaswellasthenationalstandardsorindustrialstandards,andestablishspecializedsafetyadministrationrules,takereliablesafetymeasures,andacceptthesupervisionandadministrationlawfullycarriedoutbyrelevantadministrativedepartments.第三十三條生產(chǎn)經(jīng)營單位對重大危險源應(yīng)當(dāng)?shù)怯浗n，進行定期檢測、評估、監(jiān)控，并制定應(yīng)急預(yù)案，告知從業(yè)人員和相關(guān)人員在緊急情況下應(yīng)當(dāng)采取的應(yīng)急措施。Article33Productionandbusinessoperationentitiesshallhavearchivistfilesforsubstantialhazardoussources,makeregularchecks,appraisals,supervisionsandcontrols,makeemergencyplans,andinformtheemployeesandotherrelevantpeopleoftheemergencymeasuresthatshouldbetakenunderemergentcircumstances.生產(chǎn)經(jīng)營單位應(yīng)當(dāng)按照國家有關(guān)規(guī)定將本單位重大危險源及有關(guān)安全措施、應(yīng)急措施報有關(guān)地方人民政府負(fù)責(zé)安全生產(chǎn)監(jiān)督管理的部門和有關(guān)部門備案。Theproductionandbusinessoperationentitiesshallreport,accordingtotherelevantprovisionsofthestate,thesubstantialhazardoussourcesandthecorrespondingsafetymeasuresandemergencymeasurestotheadministrativedepartmentandotherrelevantdepartmentsofthelocalpeople'sgovernmentinchargeofthesupervisionandadministrationofproductionsafetyforarchivistpurposes.第三十四條生產(chǎn)、經(jīng)營、儲存、使用危險物品的車間、商店、倉庫不得與員工宿舍在同一座建筑物內(nèi)，并應(yīng)當(dāng)與員工宿舍保持安全距離。Article34Theworkshops,stores,warehousesthatproduce,manage,storeorusehazardoussubstancesmaynotbelocatedinthesamebuildingasthedormitoriesoftheemployees,andthereshouldbeasafedistancebetweenthemandthedormitories.生產(chǎn)經(jīng)營場所和員工宿舍應(yīng)當(dāng)設(shè)有符合緊急疏散要求、標(biāo)志明顯、保持暢通的出口。禁止封閉、堵塞生產(chǎn)經(jīng)營場所或者員工宿舍的出口。Forthesitesofproductionandbusinessoperationandthedormitoriesoftheemployees,thereshallbeexitsthatmeettherequirementsforemergentdispersalofpeople,haveeye-catchingmarksandbeclearofobstructions.Itshallbeprohibitedtocloseorobstructtheexitsofthesitesofproductionandbusinessoperationandthedormitoriesoftheemployees.第三十五條生產(chǎn)經(jīng)營單位進行爆破、吊裝等危險作業(yè)，應(yīng)當(dāng)安排專門人員進行現(xiàn)場安全管理，確保操作規(guī)程的遵守和安全措施的落實。Article35Tocarryouttheoperationsofexplosionsandhoistings,theproductionandbusinessoperationentitiesshallarrangeforspecialpersonstotakechargeoftheon-spotsafetysoastoensurethattheoperationalrulesbeobservedandthesafetymeasuresbecarriedout.第三十六條生產(chǎn)經(jīng)營單位應(yīng)當(dāng)教育和督促從業(yè)人員嚴(yán)格執(zhí)行本單位的安全生產(chǎn)規(guī)章制度和安全操作規(guī)程；并向從業(yè)人員如實告知作業(yè)場所和工作崗位存在的危險因素、防范措施以及事故應(yīng)急措施。Article36Theproductionandbusinessoperationentitiesshalleducateandurgetheemployeesthereoftoobservestrictlytheregulationsandrulesthereofforsafeproductionandtherulesforsafeoperations,andshallinformtruthfullytheemployeesofthedangerouselementsthatexistinthesiteofoperationsandworkpositions,ofthepreventionmeasuresandcorrespondingemergencymeasuresfordealingwithaccidents.第三十七條生產(chǎn)經(jīng)營單位必須為從業(yè)人員提供符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)的勞動防護用品，并監(jiān)督、教育從業(yè)人員按照使用規(guī)則佩戴、使用。Article37Theproductionandbusinessoperationentitiesshallprovidelaborprotectionarticlesthatmeetthenationalstandardsorindustrialstandardstotheemployeesthereof,superviseandeducatethemtowearorusethesearticlesaccordingtotheprescribedrules.第三十八條生產(chǎn)經(jīng)營單位的安全生產(chǎn)管理人員應(yīng)當(dāng)根據(jù)本單位的生產(chǎn)經(jīng)營特點，對安全生產(chǎn)狀況進行經(jīng)常性檢查；Article38Thepersonsinchargeoftheproductionsafetyoftheproductionandbusinessoperationentitiesshallconductregularinspectionsovertheproductionsafetyoftheentitiesconcernedbytakingthepeculiaritiesofbusinessoperationoftheentitiesintoconsideration.對檢查中發(fā)現(xiàn)的安全問題，應(yīng)當(dāng)立即處理；不能處理的，應(yīng)當(dāng)及時報告本單位有關(guān)負(fù)責(zé)人。Thesafetyproblemsthatarefoundoutintheinspectionsshallbedealtwithimmediately;iftheycannotdealwiththeproblems,theyshallreporttotherelevantpersons-in-chargeoftheentitiesingoodtime.檢查及處理情況應(yīng)當(dāng)記錄在案。Recordsshallbetakenfortheinspectionsandthehandlingoftheproblems.第三十九條生產(chǎn)經(jīng)營單位應(yīng)當(dāng)安排用于配備勞動防護用品、進行安全生產(chǎn)培訓(xùn)的經(jīng)費。Article39Theproductionandbusinessoperationentitiesshallarrangefundsbuyinglaborprotectionarticlesandholdingtrainingsinproductionsafety.第四十條兩個以上生產(chǎn)經(jīng)營單位在同一作業(yè)區(qū)域內(nèi)進行生產(chǎn)經(jīng)營活動，可能危及對方生產(chǎn)安全的，應(yīng)當(dāng)簽訂安全生產(chǎn)管理協(xié)議，明確各自的安全生產(chǎn)管理職責(zé)和應(yīng)當(dāng)采取的安全措施，并指定專職安全生產(chǎn)管理人員進行安全檢查與協(xié)調(diào)。Article40Twoormoreproductionandbusinessoperationsthatconductproductionandbusinessoperationactivitieswithinasameareaandmayendangertheproductionsafetyofeachothershallenterintoagreementsconcerningtheadministrationofproductionsafetysoastospecifythedutiesandfunctionsofeachotherintheadministrationofproductionsafetyaswellasthesafetymeasurestobetaken,andshallarrangeforfull-timepersonsinchargeoftheadministrationofproductionsafetytoconductionsafetyinspectionsandcoordinations.第四十一條生產(chǎn)經(jīng)營單位不得將生產(chǎn)經(jīng)營項目、場所、設(shè)備發(fā)包或者出租給不具備安全生產(chǎn)條件或者相應(yīng)資質(zhì)的單位或者個人。Article41Noproductionandbusinessoperationentitymaycontractorleaseanyproject,siteorequipmentofproductionandbusinessoperationtoanyentityorpersonthatdoesnothavetheconditionsforsafeproductionorhavethecorrespondingqualifications.生產(chǎn)經(jīng)營項目、場所有多個承包單位、承租單位的，生產(chǎn)經(jīng)營單位應(yīng)當(dāng)與承包單位、承租單位簽訂專門的安全生產(chǎn)管理協(xié)議，或者在承包合同、租賃合同中約定各自的安全生產(chǎn)管理職責(zé)；Incaseaproductionandbusinessoperationprojectorsiteiscontractedorleasedtomorethanoneentity,theproductionandbusinessoperationentityshallenterintospecialagreementswiththecontractororleaseholderconcerningtheadministrationofproductionsafety,orstipulateinthecontractingagreementsorleaseholdcontractsthedutiesandfunctionsofeachpartyintheadministrationofproductionsafety.生產(chǎn)經(jīng)營單位對承包單位、承租單位的安全生產(chǎn)工作統(tǒng)一協(xié)調(diào)、管理。Theproductionandbusinessoperationentityshallexerciseunifiedcoordinationandadministrationoverthecontractorsandleaseholdersconcerningtheworkofproductionsafety.第四十二條生產(chǎn)經(jīng)營單位發(fā)生重大生產(chǎn)安全事故時，單位的主要負(fù)責(zé)人應(yīng)當(dāng)立即組織搶救，并不得在事故調(diào)查處理期間擅離職守。Article42Whereanyseriousproductionsafetyaccidentoccursinanyproductionandbusinessoperationentity,themajorpersons-in-chargeoftheentityshallorganizeimmediaterescuesandmaynotleavetheirpositionswithoutpermissionduringtheperiodforinvestigatingandhandlingtheaccident.第四十三條生產(chǎn)經(jīng)營單位必須依法參加工傷社會保險，為從業(yè)人員繳納保險費。Article43Theproductionandbusinessoperationentitiesmustbuyemploymentinjuryinsurancesaccordingtolaw,andpayinsurancepremiumsfortheemployeesthereof.第三章從業(yè)人員的權(quán)利和義務(wù)ChapterIIIRightsandObligationsofEmployees第四十四條生產(chǎn)經(jīng)營單位與從業(yè)人員訂立的勞動合同，應(yīng)當(dāng)載明有關(guān)保障從業(yè)人員勞動安全、防止職業(yè)危害的事項，以及依法為從業(yè)人員辦理工傷社會保險的事項。Article44Intheemploymentcontractsenteredintobetweentheproductionandbusinessoperationsandtheemployees,itshallincludestipulationsabouttheguaranteeofthelaborsafetyoftheemployees,theavoidanceofvocationalinjuries,andthebuyingofemploymentinjuryinsurancesfortheemployeesthereofaccordingtolaw.生產(chǎn)經(jīng)營單位不得以任何形式與從業(yè)人員訂立協(xié)議，免除或者減輕其對從業(yè)人員因生產(chǎn)安全事故傷亡依法應(yīng)承擔(dān)的責(zé)任。Noproductionandbusinessoperationentitymayconcludeanyagreementwiththeemployeesthereofsoastoexemptormitigatetheliabilitieswhichresultfromanyproductionsafetyaccidentcasualtiesoccurredtotheemployeesthereofandwhichithastoundertake.第四十五條生產(chǎn)經(jīng)營單位的從業(yè)人員有權(quán)了解其作業(yè)場所和工作崗位存在的危險因素、防范措施及事故應(yīng)急措施，有權(quán)對本單位的安全生產(chǎn)工作提出建議。Article45Theemployeesofaproductionandbusinessoperationentityshallbeentitledtoknowthedangerouselementsthatexistinthesiteorpositionofworkaswellasthecorrespondingpreventionmeasuresandemergencymeasures;theyshallbeentitledtogivesuggestionsconcerningtheworkofproductionsafetyoftheentitywheretheywork.第四十六條從業(yè)人員有權(quán)對本單位安全生產(chǎn)工作中存在的問題提出批評、檢舉、控告；有權(quán)拒絕違章指揮和強令冒險作業(yè)。Article46Theemployeesshallbeentitledtocriticize,exposeorinstitutelegalproceedingsonthegroundoftheproblemsthatexistintheproductionsafetyoftheentityconcerned.生產(chǎn)經(jīng)營單位不得因從業(yè)人員對本單位安全生產(chǎn)工作提出批評、檢舉、控告或者拒絕違章指揮、強令冒險作業(yè)而降低其工資、福利等待遇或者解除與其訂立的勞動合同。Theproductionandbusinessoperationentitymaynotlowerthesalariesorwelfareorothertreatmentordissolvethelaborcontractsenteredintowiththeemployeessimplybecausetheemployeeconcernedhascriticized,exposedorfiledlawsuitsonthegroundoftheproblemsexistingintheproductionsafetyoftheentityorbecausehehasrefusedtogivedirectionsasagainstth
