動(dòng)物醫(yī)院停車場(chǎng)使用規(guī)范合同編號(hào)：__________AnimalHospitalParkingLotUseRegulationsThisAnimalHospitalParkingLotUseRegulations(hereinafterreferredtoas"thisAgreement")isenteredintoasof__________(the"EffectiveDate")andbetween:PartyB:____________________(hereinafterreferredtoas"theUser"),anaturalperson/legalperson/otherorganizationwithalegalrepresentativenamed____________________,andaregisteredaddressat____________________.Basedonthemutualinterestsoftheparties,andinconsiderationoftheprovisionsofrelevantlaws,regulations,andstandardsofthePeople'sRepublicofChina,thepartieshavereachedthefollowingagreements:Article1:ScopeofApplication1.1ThisAgreementshallapplytotheparkinglot(hereinafterreferredtoasthe"ParkingLot")locatedat____________________,whichisownedandmanagedtheHospital.Article2:UseoftheParkingLot2.1TheUserisgrantedanonexclusive,nontransferable,andrevocablelicensetousetheParkingLotinaccordancewiththetermsandconditionsofthisAgreement.2.2TheUsershallusetheParkingLotforlegalpurposesandshallnotengageinanyactivitiesthatmaydamagethepropertyoftheHospitalorotherUsers,orviolatepublicorderandmorality.2.3TheUsershallparktheirvehicleinadesignatedparkingspaceandshallnotparkinamannerthatobstructstheflowoftrafficorimpairsthesafetyofotherUsers.2.4TheUsershallberesponsibleforthesafekeepingoftheirvehicleanditscontents,andshallbearallrisksandliabilitiesassociatedwiththeuseoftheParkingLot.2.5TheUsershallnotmakeanymodificationstotheParkingLotoritsfacilitieswithoutthepriorwrittenconsentoftheHospital.Article3:FeesandPayment3.1TheUsershallpaytheparkingfeesasdeterminedtheHospitalfromtimetotime.Thecurrentparkingfeesare____________________RMBperhour/day/month,payableinadvance.3.2TheUsershallmakepaymentfortheuseoftheParkingLotwithinthetimeframespecifiedtheHospital.FailuretomakepaymentwithinthespecifiedtimeframeshallresultintheUserbeingliableforlatepaymentpenaltiesasdeterminedtheHospital.3.3TheUsershallnotbeendtoarefundofanyparkingfeespaid,exceptasprovidedinthisAgreementoratthesolediscretionoftheHospital.Article4:TerminationofAgreement4.1ThisAgreementshallterminateupontheexpirationofthetermspecifiedinArticle6.4.2eitherPartymayterminatethisAgreementwithimmediateeffectgivingwrittennoticetotheotherPartyintheeventofamaterialbreachofthisAgreementtheotherParty,ifthebreachisnotcuredwithinareasonableperiodoftimeasdeterminedthenonbreachingParty.4.3TheHospitalmayterminatethisAgreementwithimmediateeffectgivingwrittennoticetotheUserintheeventof:(i)TheUser'sfailuretomakepaymentfortheuseoftheParkingLotinaccordancewiththetermsofthisAgreement;or(ii)TheUser'sengagementinanyactivitiesthatmaydamagethepropertyoftheHospitalorotherUsers,orviolatepublicorderandmorality.Article5:DisputeResolution5.1AnydisputesarisingoutoforinconnectionwiththisAgreementshallberesolvedthrough友好協(xié)商.IfthePartiesareunabletoresolvethedisputethroughfriendly協(xié)商,eitherPartymaysubmitthedisputetotherelevantpeople'scourtwithjurisdictionoverthelocationoftheParkingLotforresolution.Article6:EffectiveDateandTerm6.2ThetermofthisAgreementshallbe____________months/yearsfromtheEffectiveDate,andshallautomaticallyrenewforsuccessivetermsofthesameduration,unlesseitherPartygiveswrittennoticeofitsintentionnottorenewthisAgreementatleastthirty(30)dayspriortotheexpirationofthethencurrentterm.INWITNESSWHEREOF,thePartieshavecausedthisAgreementtobeexecutedasoftheEffectiveDatetheirdulyauthorizedrepresentatives.PartyA:____________________Representative:____________________Date一、附件列表：1.動(dòng)物醫(yī)院停車場(chǎng)使用規(guī)范合同2.停車場(chǎng)平面圖3.停車費(fèi)用收費(fèi)標(biāo)準(zhǔn)4.停車場(chǎng)使用指南5.停車場(chǎng)安全管理規(guī)定二、違約行為及認(rèn)定：1.未按照約定時(shí)間支付停車費(fèi)用2.未經(jīng)允許擅自modify停車場(chǎng)或其設(shè)施3.在停車場(chǎng)內(nèi)進(jìn)行違法活動(dòng)或違反公共秩序和道德的行為4.占用他人停車位，造成交通堵塞或影響其他用戶安全停車5.未按照規(guī)定的停車位停放車輛三、法律名詞及解釋：1.停車場(chǎng)：指供車輛停放的場(chǎng)所，包括地面和地下停車場(chǎng)。2.停車費(fèi)用：指用戶使用停車場(chǎng)應(yīng)支付的費(fèi)用。3.違約行為：指用戶違反本合同約定的行為。4.有效期限：指本合同約定的有效期限。5.違約金：指用戶違約行為應(yīng)支付的賠償金。四、執(zhí)行中遇到的問題及解決辦法：1.用戶未支付停車費(fèi)用：及時(shí)發(fā)出催款通知，逾期未支付可采取限制停車等措施。2.用戶擅自modify停車場(chǎng)
