I.INTRODUCTION

1.ThisannualreportassessestheprogressoftheAsianDevelopmentBank(ADB)inimplementingtheAccesstoInformationPolicy(AIP)from

1January2023to31December2023.1TheAIPguidesADB’scommitmenttotransparencyandaccountabilitybypubliclydisclosinginformationand

providingrequestedinformation.ItalsoensuresthatinformationisavailabletopeopleaffectedbyADBprojectsandotherstakeholdersinaformand

languagetheycanunderstand.2

2.In2023,ADBrolledoutanewoperatingmodeltomeettherapidlychangingneedsofitsdevelopingmembersinAsiaandthePacificwhile

maximizingitsdevelopmenteffectiveness.Thenewoperatingmodel—the

resultofanorganizationalreviewinitiatedin2021—marksthebank’sbiggestandmostambitiousreorganizationsince2002.

3.ADB’sOfficeoftheSecretary(SEC)overseestheimplementationoftheAIP.Tomitigatedisruptionstodisclosurebecauseoforganizationalchanges,SEC(i)updatedtheAIPimplementationarrangementsto

includenewprojectdocumenttypesrequiringdisclosureandidentifythedepartmentsandofficesresponsiblefordisclosure,3(ii)establishedan

interdepartmentaldisclosureworkinggrouptostreamlinetheprocedureformonitoringdocumentsrequiredtobedisclosed,and(iii)identified

informationtechnology(IT)enhancementstoautomaticallytriggerdisclosurenotifications.

4.Theworkinggroup,comprisingfocalpersonsfromregional

departmentsandsectoroffices,4developedadisclosureactionplanaimed

atstreamliningandstandardizingADB’sdisclosuremonitoringpracticesfor

projectandsafeguarddocuments.Theplanisdesignedtopreventdelaysandbetterservestakeholders,particularlythoseaffectedbyprojects.Theplan

wasdisseminatedtoallregionaldepartmentsandsectorofficesforimmediateimplementation.

5.Overall,ADBmaintainedahighlevelofcomplianceindisclosingprojectdocumentsandmeetingtimelydisclosurerequirements.However,thereweredelaysintheon-timedisclosureofsomeprojectdocuments.

providesinformationontheAIP,includingtranslationsofthepolicyinto16languages,informationrequestswithonlinerequestformsande-mailcontactformsforstaff,theappealsprocesswithe-mailcontactforms,annualreports,andthecontactinformationofstaffoverseeingdisclosure.

6.TheAIPcallsfortheproactivedisclosureofdocumentsthroughouttheprojectcycle—fromcountry

programmingtocompletionandevaluation.ADBdisclosesinformationonitswebsite(

)unlesstheinformationfallsundertheexceptionstodisclosureoutlinedintheAIP.Forstakeholderswithoutaccesstotechnology,ADBusesmoreappropriatemeansofinformationdisseminationbyconsideringliteracylevels,geographiclocations,infrastructure,andpopularmassmedia.

7.In2023,ADB’sBoardofDirectorsconsideredthreenotableinstitutionalpolicypapers:(i)theReviewoftheAsianDevelopmentBank’sCapitalAdequacyFramework,whichproposedrevisionstosafeguardADB’srisk-bearingcapacitywithoutrelyingoncallablecapitalandtomaintainADB’sAAArating;(ii)ImprovingConcessionalOrdinaryCapitalResourcesLendingTermsforSmallIslandDevelopingStates,whichproposedthemostconcessional

financingtermsavailablefromADB,asidefromgrants;and(iii)theRemovaloftheADBCharterLendingLimitation,markingtheinitialformalsteptowardamendingtheagreementestablishingADB.5Thesedocumentswerekept

confidentialandwithheldbecausetheycontainfinancialinformationthatisexemptfrompublicdisclosure.TwoofthepolicydocumentsrequiredchairsummariesoftheBoardmeeting,andbothweredisclosedontime.

8.NotableinstitutionaldocumentspostedonADB.orgduringtheyearincluded(i)theClimateChangeActionPlan,2023–2030;(ii)theEstablishmentoftheInnovativeFinanceFacilityforClimateinAsiaandthePacific

FinancingPartnershipFacility;and(iii)theEnvironmentalandSocialFrameworkconsultationdraftandworkingpaper.6TheBoardwillconsiderthefinalversionoftheframeworkin2024.

9.TheBoardofDirectorsendorsedthreecountrypartnershipstrategies(CPSs):Kazakhstan,KyrgyzRepublic,andIndia.7TheKazakhstanandKyrgyzRepublicCPSsweredisclosedatthesametimethesewerecirculatedtotheBoardforendorsement,andtheIndiaCPSwasdisclosedwithintheprescribed14-daytimeframeaftertheBoard’sendorsement.IfaCPSistranslatedintoanationallanguage,thetranslatedversionshouldbedisclosedwithin90

calendardaysofBoardendorsement.TheKazakhstanCPSwastranslated,andthetranslatedversionwasdisclosedwithintherequiredtimeframe.

10.In2023,ADBposted5,641projectdocumentsonitswebsite,7%lessthanin2022.Projectdocumentsweredownloaded1,220,479times,12%morethanin2022.

11.TheAIPmandatesADBtodiscloserelevantinformationwithinspecifiedtimeframestoensureproject-

affectedpeoplecanparticipateinprojectdesignandimplementation.Since2012,ADBhasassessedpolicy

13.Ofthedisclosedprojectdocuments,79%weredisclosedontimecomparedwith81%in2022and69%

in2021(Table2).Thetimelydisclosureofsovereigndocumentswas83%in2023(86%in2022),with97%of

documentsdisclosedbytheendoftheyear.Thedocumenttypeswiththeloweston-timedisclosurearetheannualauditedprojectfinancialstatementsbynumber(124outof501disclosedstatementswerenotdisclosedontime)

andtechnicalassistance(TA)reportsbypercentage(50%of110disclosedreportswerenotdisclosedontime).Staffattributedthedelaysinpostingannualauditedprojectfinancialstatementsaschangesintheinternalprocessesandstaffreassignmentsduringthetransitiontothenewoperatingmodel.ForTAreports,staffidentifiedthereasonsas

(i)alackofawarenessregardingthenewrequirementtocirculateallManagement-approvedTAreportsupontheirapprovaltotheBoardforinformation,(ii)staffdelaysinsubmittingdocumentsforcirculationimmediatelyafter

approval,and(iii)delaysinprocessingcirculationrequestsbecausealargevolumeofdocumentsweresubmittedforcirculationatthesametime.

14.Theon-timedisclosureofnonsovereigndocumentswas44%(downfrom49%in2022),with92%ofthe

documentspostedontheADBwebsitebytheendoftheyear.Thedecreasewasmainlybecauseofdelaysingettingapprovalfromprivatesectorclientsforthedisclosureoftheredactedversionsofdocuments.

17.ADBalsodisclosestheevaluationreportsproducedbytheIndependentEvaluationDepartment(IED).In2023,IEDproducedoneannualevaluationreview,fourcorporateevaluations,onesector-wideevaluation,five

projectevaluations,onesynthesisnote,andtwotopicalreports.IEDalsovalidated8CPSfinalreviews,68projectcompletionreports,and80TAcompletionreports.ThesereportsweredisclosedontheADBwebsitewithintheprescribedtimeframes.IEDvalidated37extendedannualreviewreports,ofwhich36werenotdisclosedbecausetheycontaininformationthatfallsunderoneormoreexceptionstodisclosureasoutlinedintheAIP.

B.RequestsforInformation

18.Recognizingthepublic’srighttoaccessinformationaboutADB’swork,theAIPmandatesstafftorespondtorequestsforinformationaboutitsoperationsandadministrationwithinprescribedtimeframes.

19.In2023,ADBreceived3,145requestsforinformation,aslightdecreasefrom3,305in2022,throughthe

inquiryformontheADBwebsite(figure).Ofthese,90%(2,815)weredeemedvalid,anincreasefrom83%(2,740)

20.Themajorityofrequestswasrelatedtoprojectinformation(1,247requests,accountingfor44%ofthetotal),andmostrequestscamefromtheprivatesector(1,100requests,or39%ofthetotal).ADBdenied10requestsfor

informationbecausetheyfellunderoneormoreoftheexceptionstodisclosureasoutlinedintheAIP.

III.GOINGFORWARD

21.ADBwillcontinueitseffortstoensurestakeholdersareprovidedwiththetimelyinformationtheyneedtoparticipateinitsdevelopmentactivitiesbyimplementingthedisclosureactionplan,whichincludessendingalertsandreminders,monitoringdocumentdisclosuremorefrequently,developingreferenceguides,andexploringIT

solutions(paras.3–4).SECwillidentifystrategiestoovercomedelaysinprocessingthelargenumberofdocumentssubmittedforcirculationatthesametime.

22.ThemembersofthedisclosureworkinggroupwillplayavitalroleinhelpingSECmonitordisclosure

requirementsacrossregionaldepartmentsandsectoroffices.SECwillprovidethemwithlistsofundisclosedprojectdocumentsthatarenotautomaticallydiscloseduponapproval,andtheywillsendreminderstoprojectteamsuntilthedocumentsarepublishedontheADBwebsite.Biweeklyreminderswillbesentfordocumentswitha14-day

disclosurerequirement,andmonthlyreminderswillbesentfordocumentswitha30-daydisclosurerequirement.TheywillalsosenddisclosurealertstoprojectteamsfollowingtheapprovalofprojectandTAreports.

23.SECwillgeneratequarterlydisclosuremonitoringreportsandsharethemwithregionaldepartmentsand

sectoroffices.Thisapproachwillhelpmonitorcompliancemoreeffectivelyandprovideopportunitiestoidentifyandcorrectthecausesofdelaysmorequickly.

24.Asthenewoperatingmodelcontinuestobeimplemented,SECwillraiseawarenessbydevelopingupdatedpracticalguidesandworkflowdiagramsthatprovideclear,step-by-stepinstructionsandvisualrepresentationsofprocesses.Thiswillhelpstaffbetterunderstanddisclosurerequirementsandsystems,reducedelays,andeasily

locateanswerstobasicdisclosureinquiriesatanytime.Theguideswillalsoallowthedisclosureprocesstobeincorporatedmoreeasilyintotheinternalguidelinesandpracticesofregionaldepartmentsandsectoroffices.
