一、定義
1.Cleargrounds:evidencethattheship,itsequipment,oritscrewdoesnot
correspondsubstantiallywiththerequirementsoftherelevantconventionsorthat
themasterorcrewmembersarenotfamiliarwithessentialshipboardprocedures
relatingtothesafetyofshipsorthepreventionofpollution.
明顯依據(jù):船舶及其設(shè)備或其船員實(shí)質(zhì)上不符合有關(guān)公約的要求的證據(jù),或船長或船員
不熟悉有關(guān)船舶安全或防止污染的船上基本程序的證據(jù)。

3.Detention:InterventionactiontakenbytheportStatewhenthecondition

滯留:當(dāng)船舶或船員實(shí)質(zhì)上不符合適用公約要求時(shí),港口國為保證該船舶只有在不會(huì)對

7.Stoppageofanoperation:Formalprohibitionagainstashiptocontinuean

continuationofsuchoperationhazardous.

第二章港口國監(jiān)督檢查概述
12.General
概要
PortStateControl(PSC)istheinspectionofforeignshipsinnationalports
forthepurposeofverifyingthattheconditionoftheshipanditsequipmentcomply
withtherequirementsofinternationalconventionsandthattheshipismannedand
operatedincompliancewithapplicableinternationallaws.Theprimary
responsibilityforensuringthatashipmaintainsastandardatleastequivalent
tothatspecifiedininternationalconventionsrestswiththeflagStateandif
allflagStatesperformedtheirdutiessatisfactorilytherewouldbenoneedfor
portStatecontrol.Unfortunatelythisisnotthecaseasevidencedbythemany
marineaccidentsaroundtheworld-hencetheneedforadditionalcontrol.
港口國監(jiān)督是港口國當(dāng)局對抵港的外國籍船舶實(shí)施的,以確保船舶及其設(shè)備符合國際公
約要求、船舶的配員與操作符合適用的國際規(guī)范為目的的一種檢查。確保船舶保持國際公
約中規(guī)定的標(biāo)準(zhǔn)是船旗國的首要責(zé)任,如果所有的船旗國都能令人滿意地履行他們的職責(zé),
那么港口國監(jiān)督就沒有必要存在,不幸的是,實(shí)際情況卻并非如此,世界范圍內(nèi)發(fā)生的諸
多海難事故已證明了這一點(diǎn),因此這種額外監(jiān)控也就成為必然。
TheauthorityforexercisingPSCisthenationallawbasedonrelevant
conventions.ItisthereforenecessaryforaportStatetobePartytothose
conventionsandtohavepromulgatedthenecessarylegislationbeforeexercising
PSC.Inaccordancewiththeprovisionsoftheapplicableconventions,Partiesmay
conductinspectionsofforeignshipsintheirportsthroughPortStateControl
Officers(PSCOs).

13.ProvisionsofportStatecontrol
港口國監(jiān)督條款
IMOconventionsplacetheresponsibilityfortechnicallyandenvironmentally
safeshipsprimarilyontheflagState.However,itisrecognizedthataportState
canmakeausefulcontributiontotheseaimsandmanyconventions,therefore,
containprovisionsthatpermitportStatecontrol.Theseinclude:

14.ExistingregionalagreementsonportStatecontrol
現(xiàn)有港口國監(jiān)督區(qū)域協(xié)定
WhilenationalportStatecontrolalonewillalreadyenhancethesafetyofships
andtheprotectionofthemarineenvironment,onlyaregionalapproachwillensure
thatsubstandardshipsandsubstandardoperatorshavefewerplaceslefttohide.
Unlessaregionalapproachisadopted,operatorswilljustdiverttheirshipsto
portsintheregionwherenoorlessstringentPSCinspectionsareconducted.This
mayseriouslyhampertheeconomicalsituationoftheportsofthosecountriesthat
doconductproperinspections.Toremedythisandtogenerallyimprovethe
effectivenessofinspections,manyregionsoftheworldhavealreadyorare
beginningtoenterintoregionalagreementsonPSC.

Theestablishmentofworldwideregionalportstatecontrolisonlyabeginning

Secretariats,thiswillresultinahugeincreaseinknowledgeaboutsubstandard
shipping,Thisknowledgeisnotonlyusefulinitself,itwillalsoprovidethe
maritimecommunitywiththeopportunitytobetteranalyzethecausesofincidents
andcasualtiesandascertain.,moreaccuratelythaneverbefore,howtheycanbe
preventedfromoccurringagain.

第三章港口國監(jiān)督檢查程序

港口國監(jiān)督檢查程序在IMO的A.882(21)決議以及各區(qū)域協(xié)定里都有詳細(xì)的闡述,現(xiàn)將
其概述如下:
16.Selectionofshipstobeinspected
選擇受檢查船舶
ThePortStateControlOfficer(PSCO),beforevisitingtheport,selectaship
orshipstobeinspected,takingintoaccountthecriteriafortheselectionof
shipstipulatedintheMOU.Shipssuchastankersandbulkcarriers,andshipswith
previousrecordsofdetention,etc.Indoingso,PSCOsearchpreviousPSCdatafrom
regionalornationaldatabankonshipsthePSCOintendstovisit.
船舶到達(dá)港口之前,檢查官會(huì)根據(jù)備忘錄里規(guī)定的選船標(biāo)準(zhǔn)選擇受檢查船舶。優(yōu)先檢查
的船舶包括第一次掛靠該港口的船舶、油船和散貨船等敏感型船舶、有滯留記錄的船舶,
等等。在選船的時(shí)候,檢查官會(huì)從該國家或該區(qū)域的數(shù)據(jù)庫中就以前的港口國監(jiān)督數(shù)據(jù)對
待檢船舶進(jìn)行調(diào)查。
17.Initialinspection
初檢
PSCOfirstchecksthecertificatesandotherdocumentscarriedonboardto
ascertainthattheyarevalidandinorder.Healsocheckthegeneralcondition
oftheshipinordertosatisfyhimselfthattheshipcomplieswiththeprovisions
oftherelevantinstruments.Ifeverythingisinorder,theinspectioniscompleted
andtheshipisallowedtosail.
檢查官首先檢查船舶配備的證書及其他相關(guān)文件,以確人其有效性和正確性。同時(shí),他
們也檢查船舶總體狀況,確認(rèn)該船舶是否符合相關(guān)條約的條款要求,以使自己滿意。如果
所有情況良好,檢查即告結(jié)束,船舶被允許開航。
18.Detailedinspection
詳細(xì)檢查
If,however,PSCOfindsthatthecertificatesarenotinorder,or,aftergeneral
inspection,considersthattherearecleargroundsforbelievingthattheshipdoes
notsubstantiallycomplywiththeprovisionsoftherelevantinstruments,thenhe
carriesoutdetailedinspections.ResolutionA.787(19)definesthecleargrounds
anddescribehowtocarryoutdetailedinspection.
然而,如果檢查官發(fā)現(xiàn)證書不符合要求,或者,初次檢查后有明顯依據(jù)認(rèn)為該船實(shí)質(zhì)上
并不符合相關(guān)公約條款的要求,檢查官就會(huì)對該船實(shí)施詳細(xì)檢查。A.787(19)決議定義了明
顯依據(jù)并對如何實(shí)施詳細(xì)檢查進(jìn)行了闡述。
19.Detention
滯留
IfPSCO,asaresultofdetailedinspections,hasfounddeficiencies,heorders
torectifysuchdeficiencies.Ifthedeficienciesareveryserious,theshipis
detainedandwillnotbeallowedtosailuntilthedeficienciesarerectified.In
suchcased,theflagStateadministrationandclassificationsocietyinvolvedare
notified.ResolutionA.787(19)providesforthedefinitionofdetainable
deficienciesandprocedurestobefollowedinthecaseofdetention.
如果檢查官在詳細(xì)檢查中發(fā)現(xiàn)有缺陷,通常會(huì)令船方糾正。如果發(fā)現(xiàn)的缺陷非常嚴(yán)重,
船舶將會(huì)被滯留,直到缺陷被糾正才允許船舶開航。在這種情況下,檢查官會(huì)通知船旗國
主管機(jī)關(guān)及相應(yīng)的船級(jí)社機(jī)構(gòu)。A.787(19)決議提供了可滯留的定義以及滯留所應(yīng)遵循的
程序。
Ifthedeficienciescannotberectifiedattheportofinspection,PSCOmayallow
theshiptoproceedtothenearestrepairyard.ResolutionA.787(19)andPSCManual
containprocedurestobefollowedinsuchcase.如果缺陷不能在檢查港糾正,檢查官
可允許船舶駛往最近的修船廠。A.787(19)決議以及港口國監(jiān)督手冊中包含了該種情

20.Reporting
報(bào)告
Afterinspection,theshipisprovidedwithFormAoftheportStateinspection,
andinthecaseofdeficiencies,FormsBaswell.Inthecaseofdetention,Forms
AandBaretransmittedtotheflagState.PSCOalsosendtheresultsofinspection
toregionaldatabase,suchasSIRENACinSt.Malo,France,undertheParisMOUand
APCISinVladivostok,theRussianFederation,undertheTokyoMOU.
檢查完畢后,將會(huì)給船舶提供一份港口國監(jiān)督檢查的A表,當(dāng)發(fā)現(xiàn)缺陷時(shí)還有B表。如
果船舶被滯留,A表和B表會(huì)被傳送給船旗國。檢查官也會(huì)把檢查結(jié)果送往區(qū)域數(shù)據(jù)庫中心,
例如巴黎備忘錄位于法國圣馬洛的SIRENAC、東京備忘錄位于俄羅斯海參蕨的APCISo

TheportStateregularlysubmittoIMOrecordsforthedetentionofships.IMO
publishedtheannualdetentionlist.FlagStatesareobligedtosubmittoIMOreports
ontheactiontakenfordetainedships.ManyportStatesandtheParisandTokyo
MOUspublishdetentionlistmonthlyintheirInternetwebsites.港口國定期把滯
留船舶的記錄呈送到國際海事組織(IM0)o然后,IM0發(fā)布年度滯留單。船旗國必須把被滯
留船舶所采取的措施上報(bào)IMOo許多港口國、巴黎備忘錄以及東京備忘錄都在他們的國際互
聯(lián)網(wǎng)網(wǎng)址上每月發(fā)布船舶滯留單。
