英文聘用合同聘用外國(guó)人通用合同編號(hào):__________甲方(用人單位):甲方名稱:甲方地址:甲方聯(lián)系方式:乙方(受聘外國(guó)人):乙方姓名:乙方護(hù)照號(hào)碼:乙方聯(lián)系方式:乙方居住地址:1.Introduction1.1DefinitionsandInterpretationsInthisEmploymentContract(the"Contract"),thefollowingtermsshallhavethemeaningsascribedtothembelow:"Employer"refersto[甲方名稱],thepanythatisofferingtheemployment."Employee"refersto[乙方姓名],theforeignindividualwhoisbeingemployed."EmploymentPeriod"referstothedurationoftheemploymentasspecifiedinthisContract."Compensation"includesthesalary,bonuses,incentives,andbenefitsprovidedtotheEmployee.2.EmploymentPositionandDuties2.1PositionTheEmployerhereemploystheEmployeeinthepositionof[具體職位].2.2DutiesandResponsibilitiesTheEmployeeshallperformthefollowingdutiesandresponsibilities:[詳細(xì)列出工作職責(zé)和任務(wù),例如:Conductresearchandanalysisonrelevanttopics,Preparereportsandpresentations,Assistintheimplementationofprojects,etc.]3.EmploymentPeriod3.1CommencementDateTheemploymentshallmenceon[開始日期].3.2TerminationDateTheemploymentshallterminateon[結(jié)束日期],unlessotherwiseextendedorterminatedinaccordancewiththeprovisionsofthisContract.3.3ExtensionTheEmploymentPeriodmaybeextendedmutualagreementofthepartiesinwriting.Thetermsandconditionsoftheextensionshallbesetforthinaseparateagreement.4.CompensationandBenefits4.1SalaryTheEmployershallpaytheEmployeeamonthlysalaryof[具體金額]currency.Thesalaryshallbepaidona[支付周期]basis.4.2BonusesandIncentivesTheEmployeemaybeeligibleforbonusesandincentivesbasedontheEmployer'sperformanceevaluationandincentiveprograms.ThecriteriaandamountofsuchbonusesandincentivesshallbedeterminedtheEmployeratitssolediscretion.4.3BenefitsTheEmployershallprovidetheEmployeewiththefollowingbenefits:[詳細(xì)列出福利內(nèi)容,例如:Healthinsurance,Lifeinsurance,Paidvacation,etc.]5.WorkingHoursandLeave5.1WorkingHoursThenormalworkinghoursoftheEmployeeshallbe[工作時(shí)間安排],witharestperiodof[休息時(shí)間]perday.5.2OvertimeIntheeventthattheEmployeeisrequiredtoworkovertime,theEmployershallpaytheEmployeeovertimepensationinaccordancewiththeapplicablelawsandregulations.5.3LeaveEnmentsTheEmployeeisendtothefollowingleaves:AnnualLeave:TheEmployeeisendto[年假天數(shù)]daysofannualleaveperyear.SickLeave:TheEmployeeisendto[病假天數(shù)]daysofsickleaveperyear.MaternityLeave:FemaleEmployeesareendto[產(chǎn)假天數(shù)]daysofmaternityleaveinaccordancewiththeapplicablelawsandregulations.PaternityLeave:MaleEmployeesareendto[陪產(chǎn)假天數(shù)]daysofpaternityleaveinaccordancewiththeapplicablelawsandregulations.6.PerformanceEvaluation6.1EvaluationProcessTheEmployershallconductaperformanceevaluationoftheEmployeeatleastonceayear.TheevaluationshallbebasedontheEmployee'sjobperformance,includingbutnotlimitedtothequalityandquantityofwork,workattitude,andteamwork.6.2FeedbackandImprovementTheEmployershallprovidetheEmployeewithfeedbackontheperformanceevaluationresultsandidentifyareasforimprovement.TheEmployeeshallmakeeffortstoimprovetheirperformancebasedonthefeedback.7.ConfidentialityandIntellectualProperty7.1ConfidentialInformationTheEmployeeshallkeepconfidentialallconfidentialinformationoftheEmployer,includingbutnotlimitedtotradesecrets,businessplans,customerlists,andfinancialinformation.TheEmployeeshallnotdiscloseorusesuchconfidentialinformationforanypurposeotherthantheperformanceoftheirdutiesunderthisContract.7.2IntellectualPropertyRightsAllintellectualpropertyrightscreatedordevelopedtheEmployeeduringthecourseoftheiremploymentshallbelongtotheEmployer.TheEmployeeshallassignallsuchintellectualpropertyrightstotheEmployerandshallcooperatewiththeEmployerinobtainingandprotectingsuchrights.8.NonCompetitionandNonSolicitation8.1NonCompetitionDuringtheEmploymentPeriodandforaperiodof[競(jìng)業(yè)禁止期限]aftertheterminationofthisContract,theEmployeeshallnotengageinanypetingbusinessoractivitythatissimilartothebusinessoftheEmployer.8.2NonSolicitationDuringtheEmploymentPeriodandforaperiodof[禁止招攬期限]aftertheterminationofthisContract,theEmployeeshallnotsolicitorattempttosolicittheEmployer'scustomers,employees,orbusinesspartnersforanypurpose.9.Termination9.1GroundsforTerminationThisContractmaybeterminatedeitherpartyforthefollowingreasons:BreachofthisContracttheotherparty;TheEmployee'sfailuretoperformtheirdutiestothesatisfactionoftheEmployer;TheEmployer'sbusinessneedsorrestructuring;Anyotherreasonspermittedtheapplicablelawsandregulations.9.2NoticePeriodIntheeventofterminationofthisContract,thepartyinitiatingtheterminationshallgivewrittennoticetotheotherpartyatleast[提前通知期限]daysinadvance.9.3ConsequencesofTerminationUpontheterminationofthisContract,theEmployeeshallreturnallpropertyanddocumentsbelongingtotheEmployer.TheEmployershallpaytheEmployeealloutstandingpensationandbenefitsuptothedateoftermination,subjecttothetermsandconditionsofthisContract.10.DisputeResolution10.1NegotiationIntheeventofanydisputeorcontroversyarisingoutoforinconnectionwiththisContract,thepartiesshallfirstattempttoresolvethedisputethroughfriendlynegotiation.Thenegotiationshallmencewithin[開始協(xié)商期限]daysafteronepartyhasgivenwrittennoticetotheotherpartyoftheexistenceofthedispute.10.2MediationIfthenegotiationfailstoresolvethedisputewithin[協(xié)商期限]days,thepartiesmayagreetosubmitthedisputetomediation.Themediationshallbeconductedamediatormutuallyagreedupontheparties.10.3ArbitrationIfthemediationfailstoresolvethedisputewithin[調(diào)解期限]days,orifthepartiesfailtoagreetomediation,thedisputeshallbesubmittedtoarbitration.Thearbitrationshallbeconductedinaccordancewiththerulesof[仲裁機(jī)構(gòu)]andtheseatofarbitrationshallbe[仲裁地].Thelanguageofthearbitrationshallbe[仲裁語(yǔ)言].11.GoverningLawandJurisdiction11.1ApplicableLawThisContractshallbegovernedandconstruedinaccordancewiththelawsof[適用法律的國(guó)家或地區(qū)].11.2JurisdictionAnylegalactionorproceedingarisingoutoforinconnectionwiththisContractshallbebroughtinthecourtsof[管轄法院的所在地].Thepartiesheresubmittothejurisdictionofsuchcourts.12.MiscellaneousProvisions12.1EntireAgreementThisContractconstitutestheentireagreementbetweenthepartieswithrespecttothesubjectmatterhereofandsupersedesallprioragreementsandunderstandings,whetherwrittenororal.12.2AmendmentsThisContractmaybeamendedonlyawrittenagreementsignedbothparties.12.3NoticesAllnoticesandothermunicationsrequiredorpermittedunderthisContractshallbeinwritingandshallbedeemedtohavebeendulygivenifdeliveredpersonally,sentregistered,oreedtotheaddressesspecifiedinthisContract.12.4SeverabilityIfanyprovisionofthisContractisheldtobeinvalidorunenforceable,suchprovisionshallbeseveredfromtheremainderofthisContract,andtheremainingprovisionsofthisCo
