考勤及勞動(dòng)紀(jì)律管理制度Assessment&Managesystemofthelabordiscipline第一章總則Chapter_1GeneralPrinciple為強(qiáng)化全體員工遵守考勤及勞動(dòng)紀(jì)律的意識(shí),形成良好的工作氛圍,提高員工隊(duì)伍素質(zhì),加強(qiáng)企業(yè)管理,根據(jù)有關(guān)法律、法規(guī)、政策,結(jié)合公司實(shí)際情況,特制定本制度。Article_1Forstrengthconsciousnessoftheassessmentandmanagesystemtoallthestaff,establishagoodworkingatmosphere,improvequalityofthestaffandstrengththeenterprisemanagement,accordingtotherelativelaws,rulesandpolicies,combinewithactualperformanceofourcompany,herebyestablishthissystem.勞動(dòng)紀(jì)律是企業(yè)進(jìn)行正常生產(chǎn)經(jīng)營(yíng)活動(dòng)的保證,是員工從事生產(chǎn)、工作等各項(xiàng)活動(dòng)必須遵守的勞動(dòng)秩序和規(guī)則。Article_2Labordisciplineistheguaranteewhichtheenterprisebusinesscanrunnormally,it’stheorderandruleofthelabor,thestaffmustfollowitwhentheyengagedintheproduction,worksandsoon.本制度適用于公司全體員工。Article_3thissystemsuitstoallthestaffofthiscompany.考勤管理制度Chapter_1AssessmentManageSystem第四條各類假期的規(guī)定及批準(zhǔn)權(quán)限Article_4Rulesofallkindofvacations&ApprovalAuthority(一)婚假。員工凡按正常法律程序辦理結(jié)婚手續(xù)的,可享受三天帶資婚假。屬于國(guó)家規(guī)定晚婚條件的初婚者,可給予十五天帶資晚婚假。1.MarriageLeave.Ifthestaffwhichhandlethemarriageprocedurebythelegalprocess,thenthestaffwillhave3daysmarriageleavewithpay.Andifthefirstmarriagecanmeetconditionofthelatemarriageofnationalregulation,thenthestaffcanbegivena15daysoffwithpay.(二)喪假。員工的直系親屬(父母、配偶、子女)死亡時(shí),可給三天帶資喪假。2.FuneralLeave.Whenthelinealconsanguinitiespassedaway(Parents,spouse,children),thestaffcanhave3daysoffwithpay.(三)病假。員工休病假,必須有區(qū)級(jí)以上醫(yī)院開出的診斷證明,車間和各部門才能憑此按病假處理。當(dāng)月病假在兩天以內(nèi)的,按日工資標(biāo)準(zhǔn)的50%計(jì)發(fā)工資,兩天以上至十五天以內(nèi),按統(tǒng)一基數(shù)(最低工資)計(jì)發(fā)工資。3.SickLeave.Ifthestaffasksthedaysoffforsick,he/shemusthavethediagnosisformthehospitalwhichbetterthanthedistrictlevel,thentheplantandeachdepartmentcanhandleitasasickleave.Ifthemonthlysickleaveislessthan2days,thenbaseon50%ofthedailysalarystandardtocalculateandissuethesalary,between2daysand15days,thenbaseonthesamecardinalnumber(Lowestsalary)tocalculateandissuethesalary.(四)事假。生產(chǎn)工人請(qǐng)事假,生產(chǎn)科長(zhǎng)批準(zhǔn)權(quán)限為一天,超過(guò)一天必須由常務(wù)理事批準(zhǔn);生產(chǎn)部管理人員請(qǐng)事假,由常務(wù)理事批準(zhǔn);管理部管理人員請(qǐng)事假,由理事批準(zhǔn);假期超過(guò)三天以上,必須由社長(zhǎng)批準(zhǔn)。4.Personalleave.Iftheproductionworkersaskforpersonalleave,astheapprovalauthority,productionsupervisoronlyhasthepowertoapproveonedayoff,ifit’sgoingtobemorethanoneday,thenitmustapprovebytheexecutivedirector;Iftheproductionmanagingpersonnelaskforpersonalleave,itneedstogettheapprovalfromtheexecutivedirectordirectly;Ifthemanagingpersonnelwhichinmanagementdepartmentaskforpersonalleave,thentheyneedstoapprovebythedirectordirectly;Ifthevacationisover3days,itmustapprovebythepresident.(五)產(chǎn)假。按國(guó)家規(guī)定執(zhí)行。哺乳期間的女員工(一周歲內(nèi)嬰兒),每班中可給予前后兩次哺乳時(shí)間,每次一小時(shí)(含往返路途時(shí)間)。男員工在妻子生產(chǎn)時(shí)可享受七天帶薪產(chǎn)假。5.Maternityleave.Outcompanyimplementsitaccordingtothenationalregulation.Thefemalestaffwhichinthelactation(babylessthan1weekold),shecanhavetwicelactationtimeduringtheshift,onehoureachtime(includetransportingtime).Themalestaffcanhave7daysoffasmaternityleavewithpaywhenhiswifeisinthelaborperiod.(六)工傷休假按國(guó)家、省、市有關(guān)規(guī)定執(zhí)行。6.Workinjuryvacationimplementsaccordingtorelativeregulationsofthenation,provinceandcity.第五條休假的審批程序Article_5VacationApprovalProcess(一)員工休婚假、喪假前,須持結(jié)婚證、相關(guān)證明和本人申請(qǐng),經(jīng)班組、車間、部室負(fù)責(zé)人逐級(jí)簽字同意后,方可休假。1.Beforethestaffasksforthemarriageleaveandfuneralleave,he/shemustprovetheweddingcertificate,relativeproofandpersonalapplication,afteritgotsignedandapprovedbyresponsiblepersonoftheworkingunit,plantanddepartmentoffice,thenthedaysoffcanbebecameeffective.(二)員工休產(chǎn)假,須持區(qū)級(jí)以上醫(yī)療單位開出的證明,經(jīng)班組、車間、部室負(fù)責(zé)人逐級(jí)簽字同意后,方可休假。2.Whenthestaffasksforthematernityleave,he/shemusthavetheproofwhichmadebythedistrictlevelmedicalinstitution,afteritgotsignedandapprovedbyresponsiblepersonoftheworkingunit,plantanddepartmentoffice,thenthedaysoffcanbebecameeffective.(三)員工工傷休假,須持相關(guān)醫(yī)療及工傷鑒定機(jī)構(gòu)作出的結(jié)論,并經(jīng)公司辦公會(huì)議研究確認(rèn)后,方可休假。3.Whenthestaffasksfortheinjuryleave,he/shemusthavetheconclusionwhichmadebytherelativemedicalandworkinjuryidentificationinstitution,afterconfirmbyworkmeetingofthecompany,thenthedaysoffcanbebecameeffective.(四)各種假到期,未經(jīng)批準(zhǔn)續(xù)假而超期不歸者,按曠工處理。4.Nomatterwhichkindofleave,aftertheleaverequestexpired,ifthestaffdon’tgetbackontimeandnotaskforaleaveextensionfromthecompany,thenthestaffwillbehandledastheabsencewithoutleave(五)不論什么原因請(qǐng)假,請(qǐng)假時(shí)間多長(zhǎng),必須本人寫請(qǐng)假條,并寫明請(qǐng)假事由及時(shí)間,逐級(jí)簽字批準(zhǔn)后在休息前交給考勤并打卡上下班。即使有假條而沒打卡的按曠工論處。除因急病、住院等特殊情況而無(wú)法在班前交假條的,應(yīng)委托家人或其它員工立即報(bào)告所在車間、部室負(fù)責(zé)人,上班后馬上補(bǔ)寫假條。凡不按上述規(guī)定執(zhí)行的,均按曠工或遲到違紀(jì)處理。Nomatterwhichkindofreasonandhowlongtheleaveisgoingtobe,theleaverequestmustbefilledbytheapplicant,andthereasonandtimemustbeclearlywrotedown,aftertherequestgetapprovedbythemanagelevel,itneedstobesubmittedtotheassessmentbeforethedaysoffstarts,andcheckthecardtostartandfinishtheshift.Eventheleaveapplicanthastheapprovedleaverequest,ifhe/shedoesn’tcheckthecard,thenitwillbehandledastheabsencewithoutleaveaswell.Exceptsomespecialsituationssuchlikehavinganacutediseaseorhospitalizationwhichthestaffcan’tsubmittheleaverequestbeforetheshift,inthatcase,thestaffneedstotellhis/herfamilymemberortheotherstafftonotifytheresponsiblepersoninplantanddepartmentofficeimmediately,thenrefillaleaveformrightaftercomebacktowork.Ifanyonedoesn’tfollowtheaboverulestoexecute,thenitwillbehandledasabsencewithoutleaveorlateanddisciplineviolating.第六條考勤規(guī)定Article_6AssessmentRule(一)、公司員工正常上下班必須打卡,且須本人打卡,如發(fā)現(xiàn)代其他人打卡的、被他人代打卡的給予開除。Whenstartorfinishtheshift,thestaffmustcheckthecard,anditmustbedonebythecardowner,ifthecompanyfindsthatanyonehelpstheotherscheckthecardoranyone’scardgetcheckedbysomeoneelse,thentherelativepersonnelwillgetdismissed.1.常上下班時(shí)間為早8:00—12:00,下午13:00—17:00。Normalworkingtime:8:00-12:00,13:00-17:00生產(chǎn)員工上下班時(shí)間,由所在班組根據(jù)生產(chǎn)計(jì)劃編制確定時(shí)間。Workingtimeoftheproductionstaff,itneedstobaseontheproductionplantoestablishanddetermine.2、打卡時(shí)間Checkcardtime:上班提前40分鐘打卡有效;下班滯后40分鐘打卡有效;超出此范圍時(shí)間打卡視為無(wú)效打卡,不計(jì)考勤,視為曠工。Thecheckingcanbeavailable40minutesbeforetheshiftstarts;Thecheckingcanbeavailable40minutesaftertheshiftfinished;Ifanycheckinghappensoutofthistimerange,thenitwillbeidentifiedasineffectivechecking,notcountintotheassessment,andthestaffwillgetidentifiedasabsencewithoutleave.超過(guò)上班時(shí)間打卡視為遲到,超過(guò)上班時(shí)間1小時(shí)打卡視為曠工半天。下班提前打卡視為早退,提前1小時(shí)以上視為曠工半天。班中吃飯時(shí)間目前暫不打卡。Checkcardovertheworkingtime,thenitwillbeidentifiedaslate;checkcardonehourovertheworkingtime,itwillbeidentifiedasabsentwithoutleaveforhalfaday;checkcardbeforetheshiftfinished,itwillbeidentifiedasleaveearly,;checkthecardonehourbeforetheshiftfinished,itwillbeidentifiedasabsentwithoutleaveforhalfaday.Currently,thecardcheckingisnotimplementedduringthelunchtime.只有上班打卡,無(wú)下班打卡,或者只有下班打卡,無(wú)上班打卡的,打卡不正確的,一律不算出勤。Onlyhavetheshiftstartchecking,nothavetheshiftfinishchecking,oronlyhavetheshiftfinishchecking,nothaveshiftstartchecking,orcheckingbytheincorrectway,noneoftheabovesituationswillcountintotheassessment.月底計(jì)算考勤以卡機(jī)原始記錄為準(zhǔn)。特殊情況(如漏打卡、特殊原因造成遲到或早退)由部門負(fù)責(zé)人書面說(shuō)明情況,屬于正當(dāng)理由的,經(jīng)相關(guān)領(lǐng)導(dǎo)確認(rèn)予以手工簽卡,否則按規(guī)定處理。Monthlyassessmentcountingbasesontheoriginaldatawhichonthecheckingmachine;ifthereisaspecialsituation(forexamplemisscheckingthecard,belateorleaveearlywhichcausedbyspecialreason),responsiblepersonofthedepartmentneedstomakeawrittenexplanation,ifthereasonisacceptable,thenaftertherelativeleaderapproved,itcanprocessamanualcardchecking,otherwiseitwillbehandledbytherelativerules.(二)、節(jié)假日上下班的打卡時(shí)間與正常上下班時(shí)間一樣。Theshiftcheckingtimeduringtheholidaysissameastheusualworkingdays.(三)、加班時(shí)間計(jì)算OvertimeCalculation加班時(shí)間為超出正常上班(8小時(shí))時(shí)間,且按實(shí)際加班時(shí)間計(jì)算。平日加班,加班工資按本人工資的150%計(jì)算;節(jié)假日加班,加班工資按本人工資的200%計(jì)算;法定節(jié)日加班,加班工資按本人工資的300%計(jì)算。Overtimeworkingmeanstheworkingtimewhichnotincludedinthenormalworkingtime(8hours)andtheovertimewillbaseontheactualovertimeworkingtocalculate.Overtimeinthenormalworkingday,theovertimesalarywillbaseon150%ofthebasicsalarytocalculate;overtimeintheholidays,theovertimesalarywillbaseon200%ofthebasicsalarytocalculate;overtimeinthenationalholidays,theovertimesalarywillbaseon300%ofthebasicsalarytocalculate.每天加班由班長(zhǎng)安排并上報(bào),經(jīng)上級(jí)批準(zhǔn)后方可加班并將《加班申請(qǐng)》交給考勤。如有工人加班而班長(zhǎng)沒有上報(bào)的,加班費(fèi)由班長(zhǎng)負(fù)責(zé)。Thedailyovertimeworkingneedstobearrangedandnotifiedbytheforeman,afterthe‘Overtimeworkrequest”gotapprovedbytheleader,thentheforemancanforwardittotheassessment.Iftheworkerworkedinovertimebuttheforemandidn’treportittotheassessment,thentheforemanwilltakeresponsibletothisovertimesalarybyhimself.(四)、遲到、早退每次罰款10元;曠工按本人工資的150%扣罰。Lateandleaveearlywillcharge10RMBforfineeverytime;Absencewithoutleavewillbaseon150%ofthebasicsalarytoprocessthepunishment.(五)、遲到或早退月內(nèi)累計(jì)3次視為曠工一天;一年累計(jì)曠工3天以上不參加年度工資晉升;連續(xù)曠工15天或一年內(nèi)累計(jì)曠工30天以上的,公司予以解雇(解除勞動(dòng)合同)。Ifbeinglateandleaveearly3timesinonemonth,thenitwillbeidentifiedasabsentwithoutleaveforoneday;iftheabsencewithoutleavehappensmorethan3days,thenthispersonnelwon’tallowedtohavetheyearlysalarypromotion;tothepersonnelwhobeingcontinualabsentfor15daysortotallybeingabsentfor30daysinayear,thecompanywillexecuteademissiontothem.(Cancelthelaborcontract)勞動(dòng)紀(jì)律管理制度Chapter_3LaborDisciplineManagementSystem第七條公司成立“勞動(dòng)紀(jì)律督查小組”。由公司領(lǐng)導(dǎo)和相關(guān)部門負(fù)責(zé)人組成。主要負(fù)責(zé)對(duì)公司勞動(dòng)紀(jì)律執(zhí)行情況,進(jìn)行不定期監(jiān)督檢查,并對(duì)檢查出的問題,按有關(guān)規(guī)定嚴(yán)肅處理。Article_7Companyestablisheda“LaborDisciplineMonitoringGroup”.Itcomposedbythecompanyleaderandresponsiblepersonintherelativedepartment.Mainresponsibility:processanirregularmonitoringinspectiontotheexecutingstatusofthecompanylabordiscipline,andseriouslyhandletheissuesbyfollowingtherelativerules.第八條各車間領(lǐng)導(dǎo)、班組長(zhǎng)對(duì)本單位的勞動(dòng)紀(jì)律負(fù)全面責(zé)任,并實(shí)行全面監(jiān)督檢查。Article_8theleaderandforemanwhichineveryplantneedstotakefullresponsibilitytothelabordisciplineoftheirunit,andimplementtheall-sidedmonitoringinspection.勞動(dòng)紀(jì)律要求Chapter_3LaborDisciplineRequirement第九條公司全體員工必須按規(guī)定出勤,嚴(yán)禁曠工。凡下列行為所占用的時(shí)間均視為曠工時(shí)間(20分鐘以上,2小時(shí)以下,視為曠工半天;2小時(shí)以上至8小時(shí),視為曠工一天)。Article_9allthestaffofthecompanymustfollowtheruletopresent,it’sforbiddentoabsentwithoutleave.Allthefollowingtimewhichtakebythestaffwillbeidentifiedasthetimeofabsentwithoutleave:(Morethan20minutesandlessthan2hourswillbeidentifiedasabsentwithoutleavehalfaday;between2hoursand8hourswillbeidentifiedasabsentwithoutleaveoneday)(一)不服從分配或臨時(shí)調(diào)動(dòng)未到崗的時(shí)間;Notfollowthejobtransferornotgotothenewworkingpositionafterthetemporaryjobtransferbemade;(二)無(wú)故離崗和脫崗的時(shí)間;Absentandleavetheworkingpositionwithnoreason;(三)未按規(guī)定程序辦理手續(xù)的各種休假時(shí)間;Everykindofdaysoffwhichnotgethandledbythenormalprocedure;(四)工作時(shí)間干私活的時(shí)間;Workonthepersonalstuffduringtheworkingtime;(五)提前用餐和提前洗澡超出20分鐘以上的時(shí)間;Havefoodandtakeshowerinadvancewhichtheadvancetimeismorethan20minutes.(六)因犯錯(cuò)誤被停職檢查的時(shí)間;Thetimeofsuspensionfromdutywhichcausebythestaffpersonalmistake.(七)觸犯刑律或社會(huì)治安管理?xiàng)l例,被公安、司法部門傳訊拘留的時(shí)間;Breakthelaworsocietysecuritymanagementrules,thetimewhichhandlewiththepoliceandrelativedepartmentsandthetimeinthejail.第十條員工在工作期間必須堅(jiān)守崗位,忠于職守,服從指揮,精心作業(yè),認(rèn)真工作,遵守下列條款:Article_10duringtheworkingperiod,thestaffmuststayintheirposition,performproperly,followtheorder,focusontheoperation,workseriously,observethefollowingclauses:(一)工作時(shí)間不準(zhǔn)串崗、睡崗或無(wú)故離崗;Duringtheworkingtime,it’snotallowedtoswitchposition,sleeporleavethepositionwithnoreason;(二)工作時(shí)間嚴(yán)禁喝酒,嚴(yán)禁酒后上崗;Duringtheworkingtime,it’sforbiddentodrink,andit’sforbiddentoworkafterdrinking.(三)工作時(shí)間嚴(yán)禁打撲克、下棋、打麻將等各種娛樂活動(dòng);Duringtheworkingtime,it’sforbiddentoplaypoker,chess,majiangandanykindofamusements.(四)工作時(shí)間嚴(yán)禁打架斗毆;Duringtheworkingtime,it’sforbiddentofight.(五)工作時(shí)間嚴(yán)禁洗曬衣物(班后洗本公司勞動(dòng)防護(hù)用品除外);Duringtheworkingtime,it’sforbiddentowashanddrythecloths(exceptwashthelaborprotectingtoolsaftertheshift)(六)工作時(shí)間不準(zhǔn)帶家屬及親友和小孩進(jìn)入生產(chǎn)工作場(chǎng)地。Duringtheworkingtime,it’snotallowedtobringfamilymembersorrelativesandchildrenintotheproductionworkingfield.違紀(jì)懲罰標(biāo)準(zhǔn)Chapter_4PunishStandardtothedisciplineviolation第十一條違反本規(guī)定第九條有關(guān)規(guī)定的,除按曠工規(guī)定扣發(fā)工資外,其他處罰按以下條款處理。Article_11totheonewhobreaktherelativerulesofarticle_9,besidethesalarywillgetdeductedbyrulesoftheabsencewithoutleave,theotherpunishmentswillfollowthefollowingclausestoexecute.(一)每月內(nèi)曠工三天者,扣發(fā)當(dāng)月工資總額的5%,曠工三天至五天者,扣發(fā)當(dāng)月工資總額的10%,曠工五天以上者,實(shí)行累計(jì)扣發(fā),但最多不超過(guò)當(dāng)月應(yīng)發(fā)工資的20%,直至除名。1.Theonewhoget3daysabsencewithoutleaveinonemonth,thesalarydeductionis5%ofthesalaryofthatmonth,get3to5days,thesalarydeductionis10%ofthesalaryofthatmonth,totheonewhogetmorethan5days,itwillbeexecutedastheaccumulativededuction,butthemaxcannotover20%ofthesalaryofthatmonth,executeittillthestaffgetdismissed.(二)每年內(nèi)累計(jì)曠工滿5天(含)以上者,視造成損失的輕重,予以辭退或處分。2.Ifthestaffgetabsentwithoutleavefor5daysormorethan5days,baseonthedamagewhichthestaffbroughttothecompany,thecompanywillprocessademissionorpunishment.(三)連續(xù)曠工15天或年內(nèi)累計(jì)曠工30天者,予以除名或開除。3.Ifthestaffhavecontinuousabsencewithoutleavefor15daysorhaveabsencewithoutleavefor30daystotallyinoneyear,thenthecompanywillexecutethedemission.第十二條凡違反本規(guī)定第十條規(guī)定的:Article_11towhoeverbreakstherulesofarticle_10:(一)串崗、離崗20分鐘(含)以內(nèi)者,罰款20元,并予以通報(bào)批評(píng)。Totheonewhoswitchorleavetheworkingpositionlessthan20minutes(include20minutes),thecompanywillgivethem20RMBfineandpublishanotificationcriticism.(二)工作期間喝酒及酒后上崗者,予以辭退。Totheonewhodrinkduringtheworkingperiodorworkafterdrinking,thecompanywillexecutethedemission.(三)工作期間打撲克、下棋、打麻將等各種娛樂活動(dòng)者,發(fā)現(xiàn)一次,罰當(dāng)事人20元,并通報(bào)批評(píng)。Totheonewhoplaypoker,chess,majiangandotherkindsofamusementsduringtheworkingperiod,ifcatchonce,therelativepartieswillget20RMBfineandnotificationcriticismfromthecompany.(四)工作期間打架斗毆者,予以辭退。Dismisstherelativepersonnelwhofightduringtheworkingperiod.(五)工作期間洗曬衣物及帶家屬、親友和小孩進(jìn)入生產(chǎn)工作現(xiàn)場(chǎng)者,發(fā)現(xiàn)一次,罰當(dāng)事人20元,并通報(bào)批評(píng)。Totheonewhowashclothsandbringthefamilymembersandchildrentotheproductionfelidduringtheworkingperiod,ifcatchonce,therelativepartieswillget20RMBfineandnotificationcriticismfromthecompany.第十三條公司員工對(duì)違紀(jì)問題有舉報(bào)的權(quán)力,公司負(fù)責(zé)對(duì)舉報(bào)者保密或獎(jiǎng)勵(lì)。Article_13thecompanystaffhastherighttodenouncethedisciplineviolation,companywilltakeresponsibilitytothesecretkeepingorgivethereporterareward.第十四條公司員工之間不許談戀愛,違者予以辭退。Article_14it’snotallowedtheloverelationshiphappensbetweenthestaff,otherwisetherelativepersonnelwillgetdismissed.處罰的程序Chapter_4PunishmentProcess第十五條給員工處分,由承辦部門核準(zhǔn)事實(shí),并征求有關(guān)部門意見和寫出報(bào)告,經(jīng)公司領(lǐng)導(dǎo)批準(zhǔn)(必要時(shí)提交公司辦公會(huì)議研究決定)后,處分才能生效。Article_15whenthecompanywantstoexecuteapunishmenttothestaff,theexecutingdepartmentneedstoclearth
