14、use only印鑒核符簽名：備注：開證申請人承諾書中國光大銀行：我公司已辦妥一切進(jìn)口手續(xù)，現(xiàn)請貴行按我公司不可撤銷跟單信用證申請書內(nèi)容（見正面英文）開出不可撤銷跟單信用證，我公司茲承諾如下： 一、我公司同意貴行依照開證之日有效的國際商會跟單信用證統(tǒng)一慣例開出不可撤銷跟單信用證及辦理該信用證項下一切事宜，并同意承擔(dān)由此產(chǎn)生的一切責(zé)任。二、我公司保證該信用證項下進(jìn)口業(yè)務(wù)具有真實的貿(mào)易背景，一切手續(xù)符合國家現(xiàn)行有關(guān)法律法規(guī)和外匯管理規(guī)定，并根據(jù)貴行要求及時提供相應(yīng)的有效憑證和資料。貴行有權(quán)根據(jù)有關(guān)法律法規(guī)及貴行的有關(guān)規(guī)定決定是否受理我公司的開證申請。三、我公司保證在貴行規(guī)定的時間內(nèi)向貴行支付該信用

15、證項下的貨款、手續(xù)費、利息及一切費用（包括電訊費、雜費、國外受益人拒絕承擔(dān)的有關(guān)銀行費用、因貴行發(fā)生信用證項下墊款我公司應(yīng)付的逾期利息、違約金、賠償金及貴行為實現(xiàn)債權(quán)而支付的費用等）所需的外匯和人民幣資金。四、我公司保證于貴行到單通知書中規(guī)定的期限之內(nèi)通知貴行辦理對外承付款，否則貴行可認(rèn)為我公司已接受單據(jù)并同意承付。五、我公司保證在交單相符的條件下辦理有關(guān)承付手續(xù)。如我公司認(rèn)為交單不符而請求貴行拒付，我公司保證于貴行到單通知書中規(guī)定的日期之前將全套單據(jù)如數(shù)退還貴行并隨附書面拒付理由，由貴行按照國際慣例決定能否對外拒付。如果貴行確定我公司所提拒付理由不成立，或雖然拒付理由成立，但我公司未能退回全

16、套單據(jù)，或單據(jù)退到貴行時已超過到單通知書中規(guī)定的期限，貴行有權(quán)主動辦理對外承付，并從我公司帳戶中扣款。如果帳戶中資金不足，不足部分按逾期貸款處理，我公司保證按貴行的有關(guān)規(guī)定和要求辦理必要的手續(xù)。六、如果在貴行開立信用證及/或?qū)ν飧犊钗夜臼褂觅F行提供的授信融資便利時，我公司保證按照貴行的有關(guān)規(guī)定辦妥一切手續(xù)。七、該信用證及其項下業(yè)務(wù)往來函電及單據(jù)，如因郵、電或其他方式傳遞過程中發(fā)生遺失、延誤、錯漏，貴行當(dāng)不負(fù)責(zé)。八、由于開立信用證所基于的基礎(chǔ)合同發(fā)生糾紛或由于第三方原因造成貴行損失的，我公司承擔(dān)賠償責(zé)任。九、該信用證如需修改，由我公司向貴行提出書面申請，貴行根據(jù)具體情況確定能否辦理修改。我公司

17、確認(rèn)所有修改當(dāng)由信用證受益人接受時才能生效。我公司保證支付因信用證修改而產(chǎn)生的一切費用（包括受益人拒絕承擔(dān)的有關(guān)銀行費用）。十、我公司在收到貴行開出的信用證、修改副本后，保證及時與申請書核對，如有不符之處，保證在接到副本之日起的兩個工作日之內(nèi)通知貴行。如未通知，當(dāng)視為正確無誤。十一、本不可撤銷信用證申請書（正面）以及信用證修改申請書一律用英文填寫，如我公司用中文填寫引起歧義，貴行概不負(fù)責(zé)。因申請書（含修改申請書）字跡不清或詞義含混而引起的一切后果由我公司負(fù)責(zé)。十二、我公司已全面、準(zhǔn)確地閱讀并理解了不可撤銷跟單信用證申請書和本承諾書的各項條款。我公司特做出如上承諾，保證嚴(yán)格遵守。十三、本承諾書在貴行解除該信用證項下的全部對外責(zé)任前和我公司在該信用證業(yè)務(wù)項下承擔(dān)的全部債務(wù)（如有）清償完畢前一直有效。十四、（此為選擇性條款，雙方的選擇是：1
