Party A will take protective measures for theremaining furniture and furnishings.Party A also needsto provide water,electricity, gas and telecom mun icati ons, and in dicat

Party A will be resp on sible for going through all the applicatio ns and approval procedures related to the project.2.2 Party A assigns to be the representative. He will be responsiblefor the supervision and control over the project, and handle the accept

5、anee, alteratio n, registrati on formalities.2.3 Party A en trusts with the con struct ion supervisi on of this project.The supervision company appoints to be the general supervision engineer,clarifies his resp on sibilities in the supervisi on con tract, andsubmits copy ofthe con tract to Party B.2

6、.4 Party A shall be responsiblefor protectingthe surrounding buildings,equipme nts,pipeli nes,trees and Ian dscap ingfrom being damaged, and bearcorresp onding costs.2.5 If it is really necessary to change the original building structureorpipelines, Party A shall be responsible for going through the

7、 corresponding approval procedures.2.6 Party A will coord in ate with releva nt departme nts to do on-site security,fire protect ion, waste disposal, etc., and bear the corresp onding costs.3. Party B s Responsibilities3.1 Party B must be available to attend meetings organized by Party A and prepare

8、 construction plan and schedule.3.2 Party B assig ns as the site reside nt represe ntative. He will beresp on sible for con struct ion orga ni zati on and completio n of the project with goodquality.3.3 Party B shall strictly impleme nt the con struct ionspecificati ons,safetyoperati on procedures,

9、fire safety regulati ons, and environmen talprotect ionregulati ons. It must strictly execute con struct ion abidi ng bycon struct iondraw ingsor practicein struct ions,and complete the quality in specti on record.Party B must participate in the final completion acceptanee, and prepare the project s

10、ettleme nt.3.4 Party B must abide by the provisions on the managementof thecon struct ion sites by the n ati onal or local gover nment and related departme nts,protect the surrounding buildi ngs, equipme nts, pipeli nes, trees and Ian dscap ing from being damaged. Party B also n eed to do a good job

11、 in such things as the con struct ion site security and garbage disposal, and deal well with the issue of disturb ing reside nts brought about by con struct ion.3.5 Without Party As consent or approval of releva nt departme nts, Party Bshall not make any unauthorized changes to originalbuilding stru

12、cture orpipeli nes.3.6 Party B shall be responsible for protecting all the facilities and finished projects before the project is han ded over to Party A.4. Con struct ion Period4.1 Whe n Party A n eeds to complete the project ahead of the time limit, itshould obtain Party Bs agreement and pay the c

13、ost for the measures that Party Btakes to crash the schedule.4.2 If the project progress is in flue need by the delay of Party As delivery date,the practically impacted cycle exte nds accord in gly.4.3 If the project can not be started on time or shutdownhalfway for noreas on because of Party Bs res

14、p on sibility, the practically impacted cycle can notexte nd accord in gly.4.4 The project duration shall be proIonged when the downtime is over eight hours (accumulated in one week) caused by the power failure, water failure, gas stop and force majeure factors because of desig n cha nges or reas on

If all or parts of the project reach to the excelle nt sta ndard,Pa

17、rty A will pay to Party B in creased costs.5.3 Party A and Party B shall promptly handle the concealed work inspectionprocedures of pre-acceptaneein the middle of the project. If Party A do notorga nize covert accepta nee in time, Party B can make self- in specti on and Party A shall admit the resul

18、t. If Party A requires the re-i nspecti on, Party B shall be in accorda nee with the requireme nts for the re-i nspect ion. If the re-i nspecti on result is acceptable, Party A shall bear the re-i nspect ion fee and the project durati on canbe exte nded accord in gly;if re-i nspect ionresult is not

19、acceptable, there-inspection and reworking costs shall be borne by Party B, and the project durati on shall also be exte nded accord in gly.5.4 If materials provided by Party A for the constructiondo not meet then ecessary requireme nts, Party A shall bear resp on sibility for any result ing delaysi

20、n the completi on of the project.5.5 If the quality of Party Bs work results in any accidents, liability for such accide nts shall be borne by Party B.5.6 When the Project is ready for final acceptanee. Party B shall submit toParty A the full as-built docume ntati ons and completi on accepta nee rep

PartyA shall organize the acceptance within 5 day after receiving all the documents.When Party A can not con duct the accepta nce with in the time specified in theCon tract, Party A shall inform Party B without delay and determ ine ano ther datefor the acceptance.Party A, however,shall admit th

Material supplies7.1 Party A is in charge of purchas ing the supplied materials and equipme nts(refer to Ann ex).The materials shall be qualified and meet the desig nrequirements, and be delivered to the scene in time. 26、rpicking up the materials, Party A shall hand over delivery documents to Party Band let Party B bear the tran sportati on expe nse. Party A shall be resp on sible forthe damages to the project caused by quality problems or specificati on differe ncesof the materials and equipme nt supplied by Party

27、A. Party B is resp on sible forstorage of materials provided by Party A, and Party A shall pay /% of thematerial value as the storage fee. Party B shall be resp on siblefor thecompe nsati on associated with the loss caused by improper storage of Party B.7.2 Materials provided by Party B: Any materia

28、ls or equipment supplied by Party B which do not meet the desig n and con structi on requireme nts are prohibited. If the materials have bee n used, the loss caused shall be assumed by Party B.8. Safe Production and Fire Regulations8.1 Con struct ion draw ings provided by Party A or practice that sh

29、ould complywith the fire regulati ons of the Peoples Republic of China and the releva ntfiresafety rules.8.2 Party B should strictly abide byEngineering Safety Technical Regulationsfor Con struct ionand In stallati on , Safety Operati onProcedures , Fire Con trolRegulati on and other releva nt laws

30、and regulati ons.8.3 Party A shall bear all the resultingeconomic losses if the drawingsorin struct ionsviolate the safety operati ng rules, fire con troland fire preve nti ondesign specifications.8.4 Party B shall bear all the result ing econo mic losses if its con struct ion process violates the s

31、afety operati ng rules, fire con trol and fire preve nti on desig nspecificati ons.9. Rewards and Liabilities for Breach of the Con tract9.1 If Party A causes any delays to the completio n of this project, the n Party Amust pay to Party B for each day bey ond the scheduled completi on date.A fine of

32、 will be imposed in respect of each day that the payment is overdue.9.2 If Party B causes any delays to the completion of this project, then Party Bmust pay to Party A for each day beyond the scheduled completion date.If the project n eeds to be completed ahead of the time limit, a reward ofwillbe p

33、rovided by Party A in respect of each daybefore the scheduled completi ondate.9.3 If all or parts of the project reach to the excellent standard, Party A willpayto Party B as a reward.9.4 Party B shall protect the equipments provided by Party A, furniture,furnishings and finished products placed on

If losses are caused, Party B shall bear the compe nsati on resp on sibility.9.5 If Party A instructs Party B to make any alterations to a load bearing walland Party A has not sought and received permissi on from the buildi ng property man ageme nt, Party A shall be resp on sible for any resul

35、t ing costs and shall indemnify Party B for any additi onal expe nses in curred.9.6 If Party B makes any unauthorized changes to load bearing walls or building pipelines and such changes result in damages or loss, it shall be the resp on sibility of Party B to pay for such loss.Engin eeri ng9.7 Part
