1、最新(合同模板)之海洋運(yùn)輸貨物保 險條款(附英文)一、義務(wù)局限 本保險分為平安險、水漬險及統(tǒng)統(tǒng)險三種。被保險貨色遭遇損失機(jī), 本保險根據(jù)保險單上訂明承保險別的條目劃定 , 負(fù)補(bǔ)償義務(wù)。(一)平安險本保險擔(dān)任補(bǔ)償:1、被保險貨色在運(yùn)輸途中因?yàn)楸傲託庀蟆⒗纂?、海嘯、地動、大水天 然災(zāi)難造成整批貨色的全數(shù)喪失或推定全損。當(dāng)被保險人請求賠付推 定全損時 , 須將受損貨色及其權(quán)力委付給保險公司。被保險貨色用駁船 運(yùn)往或運(yùn)離海輪的 , 每一駁船所裝的貨色可視作一個整批。推定全損是 指被保險貨色的實(shí)踐全損曾經(jīng)弗成防止 , 或許復(fù)原、修復(fù)受損貨色以及 輸送貨色到原訂目的地的用度跨越該目的地的貨色代價。2、因?yàn)?/p>

2、運(yùn)輸對象遭遇停頓、觸礁、淹沒、互撞、與流冰或其余物體碰 撞以及火警、爆炸不測變亂造成貨色的全數(shù)或部分喪失。3、在運(yùn)輸對象曾經(jīng)產(chǎn)生停頓、觸礁、淹沒、焚毀不測變亂的情況下,貨色在此先后又在海上遭遇卑劣氣象、雷電、海嘯等天然災(zāi)難所造成的部分喪失。4、在裝卸或轉(zhuǎn)運(yùn)時因?yàn)橐患驍?shù)件整件貨色落海造成的全數(shù)或部分喪 失。5、被保險人對遭遇承保責(zé)任內(nèi)風(fēng)險的貨色采用急救、避免或縮小貨損 的步伐而領(lǐng)取的正當(dāng)用度 , 但以不跨越該批被救貨色的保險金額為限。6、運(yùn)輸對象遭受海難后 , 在出亡港因?yàn)樾敦浰瞧鸬膯适б约霸诎胪?港,出亡港因?yàn)樾敦?, 存?zhèn)}以及輸送貨色所發(fā)生的分外用度。7、配合海損的就義、攤派和救濟(jì)用度。

3、8、運(yùn)輸左券訂有“船舶互撞義務(wù)”條目 , 依據(jù)該條目劃定應(yīng)由貨方歸 還船方的喪失。(二)水漬險 除包孕上列平安險的各項(xiàng)義務(wù)外 , 本保險還擔(dān)任被保險貨色因?yàn)楸傲託?象、雷電、海嘯、地動、大水天然災(zāi)難所造成的部分喪失。(三)統(tǒng)統(tǒng)險 除包孕上列平安險和水漬險的各項(xiàng)義務(wù)外 , 本保險還擔(dān)任被保險貨色在 運(yùn)輸途中因?yàn)橥鈦砭壒试啥恋娜珨?shù)或部份喪失。二、除外義務(wù) 本保險對以下喪失不負(fù)補(bǔ)償義務(wù):(一)被保險人的有意行動或過失所造成的喪失。(二)屬于發(fā)貨人責(zé)任所惹起的喪失。(三)在保險義務(wù)開端前 , 被保險貨色已存在的質(zhì)量不良或數(shù)目短差所 造成的喪失。(四)被保險貨色的天然消耗、本色缺點(diǎn)、特點(diǎn)以及時價跌落

4、;運(yùn)輸 拖延所惹起的喪失或用度。(五)本公司陸地運(yùn)輸貨色戰(zhàn)爭險條目和貨色運(yùn)輸歇工險條目劃定的 義務(wù)局限和除外義務(wù)。三、義務(wù)起迄(一)本保險負(fù)“倉至倉”義務(wù) , 自被保險貨色運(yùn)離保險單所載明的起 運(yùn)地堆?;蛸A存地方開端運(yùn)輸時見效 , 包孕失常運(yùn)輸過程當(dāng)中的海上、 陸上、內(nèi)河和駁船運(yùn)輸在內(nèi) , 直至該項(xiàng)貨色抵達(dá)保險單所載明目的地收 貨人的最初堆?;蛸A存地方或被保險人用作調(diào)配、分配或非正常運(yùn)輸 的其余貯存地方為止。如末到達(dá)上述堆棧或貯存地方 , 則以被保險貨色 在最初卸載港全數(shù)卸離海輪后滿六十天為止。如在上述六十天內(nèi)被保 險貨色需轉(zhuǎn)運(yùn)到非保險單所載 明的目的地時 , 則以該項(xiàng)貨色開端轉(zhuǎn)運(yùn) 時終止。(

5、二)因?yàn)楸槐kU人無奈操縱的運(yùn)輸?shù)⒄`、繞道、自愿卸貨、重行裝 載、轉(zhuǎn)載或承運(yùn)人應(yīng)用運(yùn)輸左券賦與的權(quán)限所作的任何航海上的變換 或終止運(yùn)輸左券 , 以致被保險貨色運(yùn)到非保險單所載明目的地時 ,在被 保險人實(shí)時將獲知的情形關(guān)照保險人 , 并在必要時加繳保險費(fèi)的情況下 本保險仍連續(xù)無效 , 保險義務(wù)按以下劃定終止。1、被保險貨色如在非保險單所載明的目的地發(fā)售 , 保險義務(wù)至交貨時 為止, 但豈論任何情況下 , 均以被保險貨色在卸載港全數(shù)卸離海輪后滿 六十天為止。2、被保險貨色如在上述六十天期限內(nèi)連續(xù)運(yùn)往保險單所載原目的地或 其余目的地時 , 保險義務(wù)仍按上述第(一)款的劃定終止。四、被保險人的責(zé)任 被保

6、險人應(yīng)按照如下劃定的應(yīng)盡責(zé)任辦理無關(guān)事項(xiàng) , 如因未執(zhí)行劃定的 責(zé)任而影響保險人好處時 , 本公司對無關(guān)喪失 , 有權(quán)謝絕補(bǔ)償。 (一)當(dāng)被保險貨色運(yùn)抵保險單所載明的目的港(地)當(dāng)前 , 被保險人 應(yīng)實(shí)時提貨 , 當(dāng)發(fā)現(xiàn)被保險貨色遭遇任何喪失 , 應(yīng)即向保險單上所載明 的檢討、理賠代理人請求檢討 , 如發(fā)現(xiàn)被保險貨色整件缺少或有顯然殘 損陳跡應(yīng)即向承運(yùn)人、受托人或無關(guān)政府(海關(guān)、港務(wù)政府等)討取 貨損貨差證實(shí)。假如貨損貨差是因?yàn)槌羞\(yùn)人、受托人或其余無關(guān)方面 的責(zé)任所造成 , 并應(yīng)以書面體式格局向他們提出索賠 , 必要時還須獲得 延伸時效的認(rèn)證。(二)對遭遇承保責(zé)任內(nèi)風(fēng)險的貨色 , 被保險人和本

7、公司均可敏捷采用 正當(dāng)?shù)募本炔椒?, 避免或威少貨色的喪失 , 被保險人采用此項(xiàng)步伐 , 不該 視為廢棄委付的暗示 , 本公司采用此項(xiàng)步伐 , 也不得視為接收委付的暗 示。(三)如遇航程變換或發(fā)明保險單所載明的貨色、船名或航程有脫漏 或錯誤時 , 被深險人應(yīng)在獲悉后即時關(guān)照保險人并在必要時加繳保險費(fèi) 本保險才連續(xù)無效。(四) 在向保險人索賠時 , 必需供應(yīng)以下單證: 保險單本來、提單、發(fā)票、裝箱單、磅碼單、貨損貨差證實(shí)、檢討呈 報及索賠清單。如觸及圈外人義務(wù) , 還須供應(yīng)向義務(wù)方追償?shù)臒o關(guān)函電 及其他需要單證或文件。(五) 在獲悉無關(guān)運(yùn)輸左券中“船舶互攜義務(wù)”條目的實(shí)踐義務(wù)后 , 應(yīng) 實(shí)時關(guān)照

8、保險人。五、索賠刻日 本保險索賠時效 , 認(rèn)被保險貨色在最初卸裁港全數(shù)卸離海輪后起算 , 最 多不跨越二年。OCEAN MARINE CARGO CLAUSESI . Scope of Cover:This insurance is classified into the following three Conditions- Free From Particular Average (F. P. A. ), With Average (W. A. ) and All Risks. Where the goods insured hereunder sustain loss or damage

9、 , the Company shall undertake to indemnify therefor according to the insured Condition specified in the Policy and the Provisions of these Clauses :1. Free From Particular Average (F. P. A. )This insurance covers :1) Total or Constructive Total Loss of the whole consignment hereby insured caused in

10、 the course of transit by natural calamities: heavy weather, lightning, tsunami, earthquake and flood. In case a constructive total loss is claimed for, theInsured shall abandon to the Company the damaged goods and all his rights and title pertaining thereto. The goods on each lighter to or from the

11、 seagoing vessel shall be deemed a separate risk. Constructive Total Loss refers to the loss where an actual total loss appears to be unavoidable or the cost to be incurred in recovering or reconditioning the goods together with the forwarding cost to the destination named in the Policy would exceed

12、 their value on arrival.2) Total or Partial Loss caused by accidents the carrying conveyance being grounded, stranded, sunk or in collision with floating ice or other objects as fire or explosion .3) Partial loss of the insured goods attributable to heavy weather, lightning and/or tsunami, where the

13、 conveyance has been grounded, stranded, sunk or burnt. irrespective of whether the event or events took place or after such accidents.4) Partial of total loss consequent on falling of entire package or packages into sea during loading, transshipment or discharge.5) Reasonable cost incurred by the i

14、nsured on salvaging the goods or averting or minimizing a loss recoverable under the Policy, provided that such cost shall not exceed the sum insured of the consignment so saved.6) Losses attributable to discharge of the insured goods at apert of distress following a sea peril as well as special cha

15、rges arising from loading, warehousing and forwarding of the goods at an intermediate port of call or refuge.7) Sacrifice in and Contribution to General Average and Salvage Charges.8) Such proportion of losses sustained by the shipowners as is to be reimbursed by the Cargo Owner under the Contract o

16、f Affreightment Both to Blame Collision clause.2. With Average (W. A. )Aside from the risks covered under F. P. A. condition asabove, this insurance also covers partial losses of the insured goods caused by heavy weather , lightning, tsunami , earthquake and/or flood.3. All RisksAsidefromthe risksco

17、vered under theF. P.A. and W. A.conditionsas above,thisinsurancealsocoverallrisksoflossof ordamage totheinsuredgoodswhetherpartialortotal, arising from external causes in the cause of transit.II. Exclusions:This insurance does not cover : .1. Loss or damage caused bythe intentionalact or fault of13

18、/ 13the insured.2. Loss or damage fallingunder the liabilityof theconsignor.3. Loss or damage arisingfrom the inferiorquality orshortage of the insured goods prior to the attachment of this insurance.4. Loss or damage arising from normal loss, inherent vice or nature of the insured goods , loss of m

19、arket and/or delay in transit and any expenses arising there from. 5. Risks and liabilities covered and excluded by the ocean marine (cargo) war risks clauses and strike , riot and civil commotion clauses of this Company.III . Commencement to Termination of cover:1. Warehouse to warehouses Clause :T

20、his insurance attaches from the time the goods hereby insured leave the ware-house or place of storage named in thePolicy for the commencementof the transit and continues in force in the ordinary course of transit including sea , land and inland waterway transits and transit in lighter until the ins

21、ured goods are delivered to the consignee s final warehouse or place of storage at the destination named in thePolicy or to any other place used by the insured for allocation or distribution of the goods or for stories other than in the ordinary course of transit. This insurance shall.,however ,be l

22、imitedto sixty(60) days after completionofdischargeof the insured goods from the seagoing vesselatthe finalport ofdischargebefore they reach the abovementionedwarehouseor placeof stories. If prior totheexpire of the above mentioned sixty ( 60) days , the insuredgoods are to be forwarded to a destina

23、tion other than that named in the Policy , this insurance shall terminate at the commencement of such transit.2. If, owing to delay , deviation , forced discharge , reshipment or transshipment beyond the control of the insuredor any change or termination of the voyage arising from the exercise of a

24、liberty granted to the shipowners under the contract of affreightment, the insured goods arrive at a portor place other than that named in the Policy, Subject to immediate notice being given to the Company by the insured and an additional premium being paid, if repaired, this insurance shall remain

25、in force and shall terminate as hereunder :1) If the insured goods are sold at port or place not namedin the Policy , this insurance shall terminate on delivery ofthe goods sold, but in no event shall this insurance extend beyond sixty (60) days after completion of discharge of the insured goods fro

26、m the carrying vessel at such port or place.2) If the insured goods are to be forwarded to the final destination named in the Policy or any other destination, this insurance shall terminate in accordance with Section 1 above.IV . Duty of the insured:It is the duty of the insured to attend to all mat

27、ters as specified hereunder , failing which the company reserves the right to reject his claim for any loss if and when such failure prejudice the rights of the Company :1. The insured shall take delivery of the insured goods in good time upon their arrival at the port of destination named in the Po

28、licy. In the event of any damage to the goods, the insured shall immediately apply for survey to the Survey and/or settling assent stipulated in the Policy. If the insured goods are found short in entire package or packages or to show apparent traces of damage , the insured shall obtain from the Car

29、rier, bailed or other relevant authorities (Customs and Port Authorities etc. ) certificate of loss or damage and/or sbortlanded memo. Should the carrier, bailed or the other relevant authorities be responsible for such shortage, the insured shall lodge a claim with them in writing and , if necessar

30、y , obtain their confirmation of anextension of them the time limit of validity of such claim.2. The insured shall , and the Company also, take reasonable measures immediately in salvaging the goods or preventing or minimizing a loss or damage thereto. The measures so taken by the insured or by the Company shall not be considered respectively, as a waiver of abandonment hereunder , or as an acceptance thereof.3. In case of a change of voyage or any omission or error inthe descriptionof t
