1、淺談黃河下游險(xiǎn)工改建加固工程建設(shè)項(xiàng)目法人責(zé)任制李慶安1 俞憲海1 劉桂銀1 錢(qián)萬(wàn)鈞1(1.濟(jì)陽(yáng)黃河河務(wù)局)摘 要 本文通過(guò)結(jié)合亞行菏澤高村險(xiǎn)工改建工程實(shí)踐,闡述項(xiàng)目法人在投資,質(zhì)量,進(jìn)度等方面應(yīng)履行的監(jiān)管責(zé)任,強(qiáng)調(diào)了項(xiàng)目法人在工程建設(shè)中的作用等進(jìn)行了分析總結(jié),并提出見(jiàn)解。關(guān)鍵詞 項(xiàng)目法人 水利工程建設(shè) 四制 作用 險(xiǎn)工近幾年,水利工程建設(shè)項(xiàng)目管理全面推行了建設(shè)項(xiàng)目法人責(zé)任制、招標(biāo)承包制、建設(shè)監(jiān)理制和合同制(簡(jiǎn)稱(chēng)“四制”),把工程建設(shè)項(xiàng)目管理納入了社會(huì)化、專(zhuān)業(yè)化、法制化的軌道,做到高效、嚴(yán)格、科學(xué)、經(jīng)濟(jì),項(xiàng)目法人在建設(shè)項(xiàng)目管理處于了核心地位。目前水利工程建設(shè)過(guò)程中存在的工程建設(shè)延期、已完工程不能
2、及時(shí)驗(yàn)收、工程質(zhì)量水平不高等問(wèn)題,從根本上說(shuō)與項(xiàng)目法人在建設(shè)管理過(guò)程中管理不力密切相關(guān),究其原因,還是項(xiàng)目法人制落實(shí)不到位,黃河下游菏澤東明險(xiǎn)工改建加固工程在建設(shè)過(guò)程中通過(guò)強(qiáng)化項(xiàng)目法人責(zé)任意識(shí),認(rèn)真落實(shí)了項(xiàng)目法人制,在質(zhì)量上、進(jìn)度、投資控制方面成效顯著,項(xiàng)目建設(shè)進(jìn)展順利,按質(zhì),按量,按時(shí)完成了工程建設(shè)任務(wù)。本文通過(guò)菏澤東明險(xiǎn)工改建加固工程項(xiàng)目法人工作實(shí)踐的總結(jié),為在黃河下游險(xiǎn)工改建中落實(shí)項(xiàng)目法人制提供一些基本思路和方法。1 采取多種措施,確??傮w目標(biāo)按期實(shí)現(xiàn)每個(gè)工程項(xiàng)目都應(yīng)有一個(gè)合理建設(shè)周期,因此,項(xiàng)目法人必須科學(xué)安排工期,制訂一系列切實(shí)可行的措施保證在合理時(shí)間內(nèi)完成工程建設(shè)任務(wù)。菏澤東明險(xiǎn)工
3、加固包括黃寨、霍寨、堡城、高村四處險(xiǎn)工,處山東省菏澤市東明縣境內(nèi),位于黃河下游游蕩型河段。黃寨險(xiǎn)工相應(yīng)臨黃大堤右岸上段樁號(hào)183+207187+607,工程長(zhǎng)度4410m,霍寨險(xiǎn)工相應(yīng)臨黃大堤右岸上段樁號(hào)187+607190+000,工程長(zhǎng)度2393m,堡城險(xiǎn)工相應(yīng)臨黃大堤右岸上段樁號(hào)190+000193+350,工程長(zhǎng)度3350m,高村險(xiǎn)工相應(yīng)臨黃大堤右岸上段樁號(hào)206+000209+000,工程長(zhǎng)度3441m,東明險(xiǎn)工共計(jì)117道險(xiǎn)工壩頭,其中包括垛、丁壩。為確保汛前完成,四處險(xiǎn)工同時(shí)施工83天。工程項(xiàng)目這么復(fù)雜、零碎、施工交叉又如此之多、因此要在計(jì)劃工期內(nèi)完成任務(wù),必須確定合理施工總體方
4、案、確定科學(xué)施工順序、嚴(yán)格控制各序施工進(jìn)度。確定總體施工方案要從制定招標(biāo)方案開(kāi)始,確定合理分標(biāo)方案,科學(xué)招標(biāo)順序,在招標(biāo)文件中確定科學(xué)合理的每個(gè)子項(xiàng)的建設(shè)工期。施工單位通過(guò)響應(yīng)招標(biāo)文件中標(biāo)簽約后,要立即組織進(jìn)場(chǎng),項(xiàng)目法人要求施工單位根據(jù)實(shí)際情況,報(bào)出切實(shí)可行的施工組織設(shè)計(jì),與設(shè)計(jì),監(jiān)理,施工單位共同制定項(xiàng)目建設(shè)的實(shí)際控制工期內(nèi),并作為整個(gè)項(xiàng)目建設(shè)期的工期控制依據(jù)。在菏澤東明險(xiǎn)工改建加固建設(shè)期,就是按照第一次會(huì)議確定的施工總體方案控制整個(gè)施工進(jìn)度,正式開(kāi)工后,每天上報(bào)工程量制度,為加快施工進(jìn)度,在工程開(kāi)工之初實(shí)行評(píng)分打分,獎(jiǎng)優(yōu)秀,罰款落后,開(kāi)現(xiàn)場(chǎng)會(huì),通報(bào)批評(píng)等手段,主要檢查監(jiān)理單位,施工單位的投
5、標(biāo)履約情況。對(duì)于個(gè)別施工企業(yè)進(jìn)工慢,轉(zhuǎn)包工程,質(zhì)量不好等常見(jiàn)問(wèn)題進(jìn)行專(zhuān)項(xiàng)治理,采用召開(kāi)工程局主要項(xiàng)目負(fù)責(zé)人,限期改整,上黑名單,通報(bào)等方法。2 提高責(zé)任心,科學(xué)管理工程質(zhì)量提高工程質(zhì)量、避免質(zhì)量隱患、質(zhì)量缺陷和質(zhì)量事故,主要就是強(qiáng)化質(zhì)量責(zé)任意識(shí),有實(shí)效的提高所有參建人員的責(zé)任心。項(xiàng)目法人應(yīng)對(duì)承建的水利工程質(zhì)量終身負(fù)全責(zé)。為明確工程責(zé)任,菏澤東明險(xiǎn)工在建設(shè)初期,就在質(zhì)量監(jiān)督部門(mén)下進(jìn)行核實(shí)造冊(cè)登記,報(bào)上一級(jí)水行政主管部門(mén)批準(zhǔn),質(zhì)量監(jiān)督部門(mén)經(jīng)常不定期抽查與長(zhǎng)期重大分部隱蔽工程檢查相合的方法。對(duì)參建單位的主要負(fù)責(zé)人進(jìn)行逐日考勤,成立獨(dú)立的質(zhì)監(jiān)科跟蹤質(zhì)量管理,發(fā)現(xiàn)問(wèn)題及時(shí)處理。菏澤東明險(xiǎn)工加固工程項(xiàng)目法
6、人在狠抓工程質(zhì)量的同時(shí),很好的處理了質(zhì)量和進(jìn)度、質(zhì)量各成本的關(guān)系。質(zhì)量和進(jìn)度,質(zhì)量和成本是一個(gè)矛盾的統(tǒng)一體,應(yīng)根據(jù)工程建設(shè)的實(shí)際情況,具體特點(diǎn)管理工程質(zhì)量,對(duì)關(guān)鍵部位和重要部位,工程質(zhì)量要嚴(yán)格管理,該返工的必須返工。但就一些次要部位或者非重要部位的質(zhì)量控制就應(yīng)該有一個(gè)度的問(wèn)題,一般來(lái)說(shuō)質(zhì)量越高,成本越高,進(jìn)度相對(duì)較慢,因此,在質(zhì)量管理時(shí)在處理質(zhì)量、進(jìn)度、成本三者關(guān)系時(shí)應(yīng)正確分析,科學(xué)處理,在菏澤東明險(xiǎn)工高村14#壩,因黃河調(diào)水調(diào)沙,壩頭沖刷嚴(yán)重,比設(shè)計(jì)時(shí)發(fā)生了較大的河勢(shì)變化,如果照搬設(shè)計(jì)方案,施工進(jìn)度無(wú)法保證。工程項(xiàng)目法人通過(guò)設(shè)計(jì)單位專(zhuān)家論證,同意施工單位柳石枕與土工布相結(jié)合的方法進(jìn)占,大大的
7、提高了工程進(jìn)度與質(zhì)量。3 充分發(fā)揮監(jiān)理作用,保證工程順利進(jìn)行在目前水利工程建設(shè)中,有這樣一種司空見(jiàn)慣的現(xiàn)象:正式招標(biāo)確定的監(jiān)理單位沒(méi)有或者不能履行投標(biāo)承諾,項(xiàng)目法人還必須做監(jiān)理單位應(yīng)該做的事,監(jiān)理單位也沒(méi)有充分發(fā)揮自己的職能作用。菏澤東明險(xiǎn)工改建加固工程在建設(shè)初期就強(qiáng)調(diào)監(jiān)理單位應(yīng)按規(guī)范充分行使職權(quán),切實(shí)完成項(xiàng)目法人委托的各項(xiàng)任務(wù),項(xiàng)目法人管理施工單位通過(guò)檢查監(jiān)理單位工作效果實(shí)理。同時(shí)為近一步充分發(fā)揮監(jiān)理單位作用,正式發(fā)文授予總監(jiān)十九項(xiàng)權(quán)力,使總監(jiān)責(zé)、權(quán)、利有效結(jié)合。監(jiān)理單位的主要責(zé)任是“三控制、兩管理、一協(xié)調(diào)”,其核心是控制工程質(zhì)量,促進(jìn)工程進(jìn)度,完善工程建設(shè)程序,確保工程資料完整,監(jiān)理單位要
8、圍繞這個(gè)中心開(kāi)展各項(xiàng)工作。監(jiān)理單位在開(kāi)工之初應(yīng)重點(diǎn)抓程序到位、手續(xù)完備、特別要及時(shí)組織技術(shù)交底、批準(zhǔn)實(shí)際施工技術(shù)方案、制訂各種表格、開(kāi)展技術(shù)培訓(xùn),使整個(gè)工程參建各方建設(shè)管理步調(diào)一致、規(guī)范有效。同時(shí)監(jiān)理單位應(yīng)按規(guī)范要求制定分部工程驗(yàn)收計(jì)劃,對(duì)于不能按計(jì)劃完成的要找原因,能采取趕工措施的及時(shí)采取趕工措施, 自身不能解決的問(wèn)題要及時(shí)向項(xiàng)目法人書(shū)面報(bào)告,并提出處理意見(jiàn)和建議,由項(xiàng)目法人負(fù)責(zé)解決。監(jiān)理單位是負(fù)責(zé)組織各參建單位的資料收集整理、迎接檔案專(zhuān)項(xiàng)驗(yàn)收的質(zhì)量責(zé)任主體,因此,從開(kāi)工之日起,監(jiān)理單位就應(yīng)由專(zhuān)人負(fù)責(zé)資料工作,要做到開(kāi)工有資料收集整理計(jì)劃、過(guò)程有檢查、驗(yàn)收前有督辦,使資料工作能滿(mǎn)足驗(yàn)收要求。
9、4 加強(qiáng)調(diào)度管理,確保施工單位履行合同施工單位兌現(xiàn)投標(biāo)承諾,保質(zhì)保量完成工程建設(shè)任務(wù)是其應(yīng)該履行的義務(wù),但在市場(chǎng)經(jīng)濟(jì)情況下,具體承擔(dān)施工任務(wù)的施工組織,尤其是黃河本系統(tǒng)的事業(yè)單位性質(zhì)的水利施工隊(duì)伍往往對(duì)履約情況不重視,因此,在監(jiān)理單位對(duì)施工單位進(jìn)行正常管理外,項(xiàng)目法人加強(qiáng)對(duì)施工單位的調(diào)度管理也十分重要。施工單位是工程建設(shè)的直接責(zé)任者,應(yīng)該按照投標(biāo)承諾按期向項(xiàng)目法人交付合格產(chǎn)品。目前水利工程建設(shè)進(jìn)度緩慢、工程質(zhì)量水平不高、工程不能及時(shí)組織驗(yàn)收交付使用,承擔(dān)施工任務(wù)的往往都是一些所謂事業(yè)單位性質(zhì)或類(lèi)似的水利建設(shè)隊(duì)伍。針對(duì)這些情況,菏澤險(xiǎn)工改建加固工程依靠水行政主管部門(mén),考核這些施工隊(duì)伍投標(biāo)承諾誠(chéng)信
10、情況和施工項(xiàng)目經(jīng)理責(zé)任意識(shí)。把人和設(shè)備作為兩項(xiàng)重點(diǎn)工作來(lái)抓,抓人主要是抓工程局質(zhì)監(jiān)部門(mén)責(zé)任人到位,抓施工技術(shù)人員的儲(chǔ)備和配備,抓項(xiàng)目經(jīng)理的終身責(zé)任制和獎(jiǎng)懲兌現(xiàn)。對(duì)經(jīng)理的終身責(zé)任制要切實(shí)代表公司層行使對(duì)工程管理調(diào)度的權(quán)力,施工技術(shù)人員數(shù)量和質(zhì)量要滿(mǎn)足施工要求,要求項(xiàng)目經(jīng)理從工程投標(biāo)開(kāi)始,工程局內(nèi)部就應(yīng)采取競(jìng)爭(zhēng)機(jī)制,由項(xiàng)目經(jīng)理負(fù)責(zé)組織投標(biāo),項(xiàng)目中標(biāo)后,項(xiàng)目經(jīng)理應(yīng)率領(lǐng)投標(biāo)承諾的班子參加該項(xiàng)目的建設(shè),責(zé)權(quán)利相結(jié)合,使這個(gè)項(xiàng)目經(jīng)理負(fù)責(zé)完成驗(yàn)收任務(wù)。公司應(yīng)對(duì)項(xiàng)目經(jīng)理進(jìn)行考核,如果不能完成驗(yàn)收任務(wù),應(yīng)采取暫停項(xiàng)目經(jīng)理職責(zé)甚至更嚴(yán)厲的手段進(jìn)行處罰。抓設(shè)備,工程局應(yīng)負(fù)責(zé)組織投標(biāo)承諾的機(jī)械設(shè)備按計(jì)劃進(jìn)場(chǎng),勞動(dòng)合作
11、隊(duì)伍可以通過(guò)市場(chǎng)競(jìng)爭(zhēng)選擇。中標(biāo)施工企業(yè)正式組建項(xiàng)目經(jīng)理部后應(yīng)以書(shū)面形式向項(xiàng)目法人、監(jiān)理單位報(bào)告,報(bào)告應(yīng)附切實(shí)可行的施工組織設(shè)計(jì),施工組織設(shè)計(jì)應(yīng)按規(guī)定格式編寫(xiě)。項(xiàng)目法人接到報(bào)告后應(yīng)及時(shí)驗(yàn)收投標(biāo)承諾,同時(shí)將項(xiàng)目經(jīng)理、質(zhì)量檢查員的證件連同總監(jiān)證書(shū)報(bào)招標(biāo)辦備案,證件待工程竣上驗(yàn)收后退回。在進(jìn)駐現(xiàn)場(chǎng)后施工企業(yè)應(yīng)及時(shí)報(bào)告機(jī)械設(shè)備和人員到位情況,原材料要及時(shí)按規(guī)范要求送檢和試驗(yàn),應(yīng)根據(jù)工程實(shí)際情況劃分單元工程、分部工程、單位工程上報(bào)監(jiān)理單位,分部工程、單位工程監(jiān)理審核后應(yīng)報(bào)請(qǐng)質(zhì)監(jiān)部門(mén)核準(zhǔn)。在施工過(guò)程中,施工企業(yè)應(yīng)嚴(yán)格實(shí)行“三檢制”,應(yīng)嚴(yán)格執(zhí)行隱蔽工程和關(guān)鍵部位驗(yàn)收制度,及時(shí)按規(guī)定開(kāi)展單元工程質(zhì)量評(píng)定。5 強(qiáng)
12、化合同管理,及時(shí)進(jìn)行工程結(jié)算菏澤東明險(xiǎn)工改建加固工程強(qiáng)化合同管理,要求參建單位嚴(yán)格執(zhí)行合同。尤其注重及時(shí)與施工單位進(jìn)行工程結(jié)算,對(duì)已完工程的決算進(jìn)行審核。工完帳清不僅是項(xiàng)目法人對(duì)施工單位的要求,也是主管部門(mén)對(duì)項(xiàng)目法人的要求,更是項(xiàng)目法人的責(zé)任。菏澤東明險(xiǎn)工改建加固工程過(guò)程中,項(xiàng)目法人一開(kāi)始就督促監(jiān)理、施工單位及時(shí)計(jì)量,按招標(biāo)文件和合同規(guī)定及時(shí)撥付工程款。工程進(jìn)入施工后期時(shí),要求監(jiān)理單位抓緊完善簽證,督促監(jiān)理單位組織施工單位進(jìn)行工程計(jì)量、工程結(jié)算,督促監(jiān)理單位對(duì)工程結(jié)算進(jìn)行初步審核,為加快進(jìn)度,項(xiàng)目法人和監(jiān)理人員合署審核、交叉審核。通過(guò)采取這些措施基本做到工程完成、結(jié)算完成。6結(jié) 語(yǔ)實(shí)踐證明,在

At present , such problems as the delaying of engineering construction ,the untimely acce
18、ptance of the finished projection as well as the poor engineering quality are existing in the hydraulic engineering construction, which are related to the management ability of legal person .So ,during the reconstruction and reinforcement of the downstream of Yellow River at Dongming vulnerable spot
19、 ,the project legal person responsibility system is enforced , obvious achievements are made in the facets of quality , progress and cost control , in addition , the projects are carried out smoothly , the construction with good quality are finished timely . In this paper, the practice of legal pers
20、on responsibility system used in the reconstruction and reinforcement of the downstream of Yellow River at Dongming vulnerable spot are summarized ,which offer a basic method for the implement of legal person responsibility system during the reconstruction of Yellow River downstream vulnerable spot1
21、 Take multi-measures to assure the realization of general object Every project has its reasonable construction period; therefore, project legal person should arrange the construction period scientifically and take series of feasible measures to assure the engineering finished in a reasonable period.
22、The reinforcement engineering of Dongming vulnerable spot comprises of such four spots as the Huangzhai, Huozhai ,Baocheng and Gaocun ,which are located at the wandering reach of the Lower Yellow River, Dongming county , Heze city. Where ,the Huangzhai vulnerable spot is near to the pile section 187
23、+607190+000 of the yellow river right bank , whose engineering length is 4410m, the Huozhai vulnerable spot is near to the pile section 190+000193+350 of the yellow river right bank , whose engineering length is 2993m, the Baocheng vulnerable spot is near to the pile section 190+000193+350of the yel
24、low river right bank , whose engineering length is 3350 m, the Gaocun vulnerable spot is near to the pile section 206+000209+000of the yellow river right bank , whose engineering length is 3441m, there are 27 vulnerable dams at the Dongming vulnerable spot ,which include Duo and Ding dam. In order t
25、o assure the engineering completed before the flood season, the four spots should be constructed for 83 days simultaneity. Because the engineering condition is complex, fragmental and intersectional, if the construction is finished in the planed period, the reasonable and general construction scheme
26、 should be defined, scientific construction sequence should be determined and construction progress should be controlled strictly. The reasonable construction scheme should begin with biding plan, sub bids proposal should be reasonable, the biding sequence should be scientific, besides, the reasonab
27、le and scientific construction period of sub-projects should be established in the public bidding document.When some construction organization win the bid, they should organize related persons entering the site, the project legal person should call for the construction organization to offer the feas
28、ible construction management plan according to actual condition, and then, design organization, supervising organization as well as construction organization are cooperated to establish the construction scheme which are the basis of the control of construction period. During the reinforcement of Don
29、gming vulnerable spot, the construction scheme defined in the first meeting controls the overall construction progress, after the commence of construction , the quantity should be reported every day ,in order to accelerate the construction progress , method of point rating should be adopted to at be
30、ginning of commence ,the excellent are rewarded , the falling-behind should be fined , the contract implement condition of supervising organization and construction organization should be inspected . Such problems as slow construction progress, subcontract as well as poor construction quality should
31、 be modified, such detailed measures as rectification in limited time, blacklist as well as criticism by circulating a notice2 Increase responsibility and manage the project quality scientifically To increase the engineering quality, avoid hidden danger of quality, quality defect and quality acciden
32、t, the main duty is to strengthen the awareness of quality responsibility and increase the responsibility of all persons involved in the project.Project legal person should be responsible for the quality of hydraulic construction for life. In order to define the project responsibility, at the beginn
33、ing construction of Dongming vulnerable spot ,list and register are done under the supervisor of quality inspecting sector , after the permission of superior administration, quality supervising department inspect the quality of important and large-scale hidden engineering . At the same time, the maj
34、or principal of construction organization should be responsible for the checking on work attendance, independent quality department should be established to track the quality management and detect some problems and deal with the problems.Besides, the project legal person of Dongming vulnerable spot
35、control the engineering quality, he also deals with the relationship between quality and progress, the relationship between quality and cost. As well all know, quality and cost are the contradictory unity, therefore, the construction quality should be managed according to actual condition and detail
36、 characteristics, the quality of key parts should be controlled strictly. Reconstruction should be done if necessary .But ,as for the auxiliary parts of engineering , the quality control should be weaken, because the high quality will lead high cost and low construction speed . As results, during th
37、e quality management, the relationship between quality, cost and construction progress should be analyzed and treated scientifically. During the construction of Gaocun 14th dam of Dongming vulnerable spot , due to the water and sand transferring of Yellow river , the dam is eroded seriously and the
38、water level is changed dramatically , if the design scheme are adopted , then , the construction progress can not reach , so , after the experts argumentation, the project legal person is agree with the construction organization to adopt the willow stone pillow and earthwork cloth ,which increase th
39、e construction speed largely . 3. Make full use of the supervisor and assure the project progress trouble-freeAt present, there is a common phenomenon during the construction of hydraulic engineering, that is: the supervising unit wining the bidding can not abide by the promise of bid, the project l
40、egal must do the job of the supervisor because the supervisors do not make full of his function.At the beginning of the reconstruction of Dongming vulnerable spot , supervising unit is demanded to discharge his duties fully and finish the tasks entrusted by the project legal person, the project lega
41、l person manage the construction unit and check the work efficiency of the supervising unit . At the same time, in order to make full use of the supervising unit , general supervisor is granted nineteen rights by means of formal document .The main responsibility of supervising unit is “three control
42、 ,two management and one coordination”, the core is the control of construction quality , accelerate the construction progress , perfect the construction sequence and assure the project data completely ,besides ,the supervising unit should carry out various of work around the core duty.At the commen

59、designated position, raw material should be delivered to be tested according to the requirement of standard, at the same time, according to the actual condition, the engineering should be divided into element engineering, divisional engineering and unit engineering to be reported to supervising unit.
