1、勞動(dòng)合同Employment Contract甲方(用人單位名稱:Name of Party A (Employer:住所Address:法定代表人(或主要負(fù)責(zé)人:Legal Representative (or Principal Responsible Person:乙方(勞動(dòng)者姓名:Name of Party B (Employee:性別Sex:身份證號(hào)或護(hù)照號(hào)ID Card No. & Passport No.:文化程度Education Background:住所Address:根據(jù)中華人民共和國勞動(dòng)法、中華人民共和國勞動(dòng)合同法等法律、法規(guī)、規(guī)章的規(guī)定,在平等自愿,協(xié)商一致的

2、基礎(chǔ)上,同意訂立本勞動(dòng)合同,共同遵守本合同所列條款。The Parties, intending to be bound hereby, agree to enter into this Employment Contract on the basis of equality, fre e will and mutual consultation pursuant to the Labor Law of the Peoples Republic of China (“PRC”, the Employment Contract Law of the PRC and other laws, reg

3、ulations and rules.第一條勞動(dòng)合同類型及期限Article 1 T ype and T erm of the Employment Contract一.勞動(dòng)合同類型及期限按下列第 1 項(xiàng)確定。The type and term of the Employment Contract shall be determined as set forth in Item _1_below: 1.固定期限:自年月日起至年月日止。Fixed Term: From _ _ to _ 0_.2.無固定期限:自年月日起至法定的解除或終止合同的條件出現(xiàn)時(shí)止。Open-ended: From _ t

4、o the date when a statutory obligation or agreement to terminate the contract arises.3.以完成一定工作為期限:自年月日至年月日終止。Project-based: From _ to the expiration of the term.二.本合同約定試用期,試用期自年月日起至年月日止。This Contract specifies a probationary period commencing on _ _ and ending on _ _第二條工作內(nèi)容、工作地點(diǎn)及要求Article 2 Job Desc

5、ription, Workplace Location and Work Requirements一.甲方聘用乙方從事工作。Party B shall engage in the job of _ .二.工作地點(diǎn):,根據(jù)甲方工作需要,乙方同意甲方可變更乙方工作地點(diǎn)。The workplace is _, which can be changed base on Party As business requirements. Party B agrees with changing workplace by Party A.三.乙方應(yīng)積極遵守公司所有規(guī)章制度,按質(zhì)、按量、按時(shí)完成其本職工作。Pa

6、rty B shall fulfill his job in a high-quality, quantitative and time-efficient manner and abide by all the company rules.第三條工作時(shí)間和休息休假Article 3 Working Hours, Rest and Leave Entitlements一.工作時(shí)間按下列第 1 項(xiàng)確定:The working hours shall be determined as set forth in Item _ 1 below:1.實(shí)行標(biāo)準(zhǔn)工時(shí)制。乙方每日工作時(shí)間不超過8小時(shí),每周工作

7、時(shí)間不超過40小時(shí),每周至少休息一天。The normal working hour system shall be implemented. Party B shall work no more than 8 hours a day, and 40 hours a week, and shall have at least one days rest each week.2.實(shí)行經(jīng)勞動(dòng)保障行政部門批準(zhǔn)實(shí)行的不定時(shí)工作制。A non-fixed working hour system shall be implemented with the necessary approval from t

8、he relevantlabor administration authorities.3.綜合計(jì)算工時(shí)工作制,即經(jīng)勞動(dòng)保障部門審批,乙方所在崗位實(shí)行綜合計(jì)算工時(shí)工作制。Cumulative working hours system approved by the labor and social security department and the Calculation period is _.二.甲方由于生產(chǎn)經(jīng)營需要可以延長(zhǎng)乙方正常工作日的工作時(shí)間及要求乙方休息日加班,因工作能力或效力導(dǎo)致的加班屬于正常工作時(shí)間。Due to its operational needs, Party m

9、ay extend Party Bs working hours on weekdays and work overtime on weekends. Work overtime due to personal working ability or efficiency is considered as normal working hour.第四條勞動(dòng)報(bào)酬及支付方式與時(shí)間Article 4 Working Remuneration, Payment Method and Date of Payment一、甲方每月日以貨幣的形式足額支付乙方上月稅前工資。如遇節(jié)假日則相應(yīng)順延。Party A s

10、hall pay pretax salary of last month to Party B in currency on the_ of every month, In case of holiday is extended accordingly.二、乙方月勞動(dòng)報(bào)酬為基本工資元,績(jī)效工資及其他補(bǔ)助津貼按公司相關(guān)薪酬管理制度執(zhí)行。The monthly remuneration for Party B shall be RMB_ . Performance pay and allowance is implemented according to related remuneration

11、management system.三、乙方工資的增減,獎(jiǎng)金、津貼、補(bǔ)貼的發(fā)放,以及特殊情況下的工資支付等,均按相關(guān)法律法規(guī)及甲方依法制定的規(guī)章制度執(zhí)行。甲方支付給乙方的工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。Party Bs wage increase/decrease, bonuses, allowances and subsidies, as well as the wage payment in special circumstances, shall be governed by relevant laws and re gulations and Party As internal rule

The wages paid by Party A to Party B shall not be less than the minimum wage standard stipulated by the peoples government where the employer is located.四、乙方在享受法定休假日以及依法參加社會(huì)活動(dòng)期間,甲方應(yīng)當(dāng)依法支付工資。During any period when Party B participates in any social activities which citizens are request

13、ed to perform for national or public interests, during statutory working hours, Party A shall pay wages to Party B according to the law.五、甲乙雙方對(duì)工資的其它約定:Other agreements between Party A and Party B:1.甲方可根據(jù)實(shí)際經(jīng)營狀況、內(nèi)部規(guī)章制度,對(duì)乙方的考核結(jié)果以及乙方的工作年限、獎(jiǎng)罰記錄、崗位變化等,調(diào)整乙方的工資水平,但不可低于國家規(guī)定的最低工資標(biāo)準(zhǔn);Party A is entitle to adjus

14、t salary of Party B if there are changes on actual operating condition, working period, reward and disciplinary record or position change of Party B. But will not below the national minimum wage standards.2.因公司業(yè)務(wù)及行業(yè)需要可能超時(shí)工作并且周六、周日需正常工作,員工每月工資總額中已包含了超時(shí)工作及周六、周日的加班工資,法定節(jié)假日加班工資的計(jì)算以基本工資為計(jì)算依據(jù)。Work overtim

15、e as need. Monthly employee payroll contain overtime wages, including Saturday and Sunday. Public holiday overtime pay is calculated on the basis of basic wage.第五條社會(huì)保險(xiǎn)及福利待遇Article 5 Social Insurance and Welfare一.甲乙雙方必須依法按國家及省、市有關(guān)規(guī)定參加社會(huì)保險(xiǎn),按月繳納社會(huì)保險(xiǎn)費(fèi)。乙方繳納部分,由甲方在乙方工資中代為扣繳。Party a and Party B must partic

16、ipate in social insurance and pay social insurance premiums on a monthly basis in accordance with the national and provincial law. The amount payable by Party B shall be withheld by Party B from the Party As monthly wages.二.乙方患病或非因工負(fù)傷,甲方應(yīng)按國家和省、市的有關(guān)規(guī)定給予乙方享受醫(yī)療期和醫(yī)療期待遇。Where Party B has contracted an il

17、lness or sustained a non-work-related injury, Party A should give Party B medical treatment and medical leave accordance with National or provincial regulation.三.乙方患職業(yè)病、因工負(fù)傷的,甲方按職業(yè)病防治法、工傷保險(xiǎn)條例等有關(guān)法律法規(guī)的規(guī)定執(zhí)行。Where Party B has contracted an occupational diseases or industrial injury, party A have to impl

18、ement related provisions according to the "occupation disease prevention law", industrial injury insurance regulations" and other relevant laws and regulations.四.乙方依法享有法定節(jié)假日、年休假、婚假、產(chǎn)假、喪假等假期。Party B shall have public holiday, Annual leave, Marriage leave, Maternity leave and Compassion

19、ate leave according to the National Law.第六條勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Article 6 Labor Protection, Working Conditions and Protections against Occupational Hazards一.甲乙雙方都必須嚴(yán)格執(zhí)行國家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生等規(guī)定。有職業(yè)危害的工種應(yīng)在合同約定中告知,甲方應(yīng)為乙方的生產(chǎn)工作提供符合規(guī)定的勞動(dòng)保護(hù)設(shè)施、勞動(dòng)防護(hù)用品及其他勞動(dòng)保護(hù)條件。乙方應(yīng)嚴(yán)格遵守各項(xiàng)安全操作規(guī)程。甲方必須自覺執(zhí)行國家有關(guān)女職工勞動(dòng)保護(hù)和未成年工特殊保護(hù)規(guī)定。The Parti

Any job exposed to occupational hazards shall be specified in the contract, and Party A shall provide Party B with work safety and hygiene facilities, labor protec

21、tion equipment and other necessary conditions for Party Bs work acti vities. Party B must strictly comply with the work disciplines, operating procedures and safety rules set by Party A. Party A must conscientiously carry out relevant provisions formulated by the state for the protection of female a

22、nd under-aged employees.第七條規(guī)章制度Article 7 Regulation and Rules一. 甲方依法制定的規(guī)章制度,應(yīng)當(dāng)告知乙方。Party A draw the regulation and rules up accordance to law and shall inform Party B.二. 乙方應(yīng)遵守國家和省、市有關(guān)法律法規(guī)和甲方依法制定的規(guī)章制度,按時(shí)完成工作任務(wù),提高職業(yè)技能,遵守安全操作規(guī)程和職業(yè)道德。Party B shall obey the related Law and the Regulation which is draw up

23、 by Party A; to complete task on time, comply with the safety rules and occupation moral.三. 乙方自覺遵守國家和省、市計(jì)劃生育的有關(guān)規(guī)定。Party B shall comply with the Family Planning regulation accordance to the Law.第八條保密條款A(yù)rticle 8 Confidential Agreement簽訂本合同之前甲乙雙方已簽署保密協(xié)議,乙方承諾同意并嚴(yán)格遵守保密協(xié)議中約定的義務(wù)。This contract will be signe

24、d after theConfidential Agreementby both Parties, Party B promises tothe agreement. Party A shall issue a certification documents to Party B, and transfer files and social insurance relationship within fifteen days. 第十二條 爭(zhēng)議處理 Article 12 Dispute Settlement 一. 甲乙雙方協(xié)商解決。 Any dispute shall be solved by

25、negotiation. 二. 甲乙雙方協(xié)商不成,可由爭(zhēng)議的一方申請(qǐng)勞動(dòng)仲裁。 In case of unsuccessful negotiation, the contending party may apply for labor arbitration. 第十三條 雙方需要約定的其他事項(xiàng) Article 13 Other matters considered necessary by the Parties 一. 甲方可根據(jù)工作需要及乙方的身體狀況、工作能力和表現(xiàn)根據(jù)甲方的規(guī)章制度升、降乙方的職 務(wù),乙方愿意服從甲方的安排;入職前,甲方已安排專職翻譯向乙方詳細(xì)翻譯并解釋了甲方的 員工手冊(cè)

26、、薪酬管理制度等規(guī)章制度,乙方已熟知、理解、并同意自覺遵守甲方的相 關(guān)規(guī)章制度。 Where Party A is able to promote or demote Party B base on the needs of work, physical condition, ability and performance, which is according to the Company regulations. Party B is willing to accept Part As arrangement. Pre-commencement, Party A have arranged full-time translator to translate and explain the details of regulations and rules of Employee Handbook Remuneration Rule and .Party B should familiar with, understand, and agree to
