Contractor and Subcontractors (“Subcontractor” means any Person who is engaged by Contractor or another Subcontractor to provide the Services (other than a person engaged as an employee), but does not inclu

2、de the vendor of Products to Contractor) shall comply with Companys drug, alcohol, and search policy (“Policy”) set out in this Exhibit, except to the extent that compliance is penalized under the laws of the United States or violates applicable laws.1.1合規(guī)。 “承包商”和“分包商”（“分包商” 系指因“承包商”或另一“分包商”而從事提供“服務(wù)

Contractor and Subcontractors shall have in place a written controlled substance and alcohol policy, an implementation program, and a training program, that meet or e

4、xceed the requirements provided in this Exhibit. When required by law, Contractor shall comply with U.S. Department of Transportation (DOT) procedures for transportation workplace drug and alcohol testing programs, 49 CFR Part 40, and applicable DOT rules and regulations (or their equivalent in the

Contractor shall have the right to perform reasonable, unannounced searches of the personnel of Contractor or Subcontractors at any time while they are in the Area of Operations, including searches of pers

Contractor shall have the right to perform reasonable, unannounced controlled substance and alcohol tests on the p

9、ersonnel of Contractor or Subcontractors at any time while they are in the Area of Operations. If a test is positive, the individual must be removed from the Area of Operations or cease performance of the Services until reinstatement is permitted by Company. The individual shall be similarly treated

10、 if he/she refuses or fails to have a requested test. Contractor shall conduct an immediate preliminary evaluation into the circumstances of all accidents, injuries, near misses and mishaps in the Area of Operations which arise out of this Contract or the performance of the Services. This evaluati

12、on must include a review of the conduct and behavior of affected individuals following any incident or near miss involving these individuals to determine whether personnel performance contributed to the incident. Alcohol and/or controlled substances test(s) must be required by Contractor when the ev

At a minimum, Contractors

14、 and Subcontractors personnel (before arriving at the Area of Operations) shall receive training on all items listed in Sections1.7(A) to 1.7(D) below and Contractors and Subcontractors supervisors shall receive training on all items listed in Sections1.7(A) to 1.7(E) below:1.7培訓(xùn)。 “承包商”和“分包商”之人員（于抵達(dá)

Contractor shall keep records of activities in compliance with this Exhibit. These records must be maintained for at least twenty-four months a

19、 or alcohol by Contractor or Subcontractors or their personnel is prohibited while within the Area of Operations.(A)禁止“承包商”、“分包商”或其人員在“工作區(qū)域”內(nèi)使用、持有、傳播、購買或者出售任何受控物品或者酒精。(B) The use (in any place) of any controlled substance or alcohol which causes or contributes to unacceptable job performance or unus

Contractor and Subcontractors and their personnel

21、who enter the Area of Operations shall comply with this Policy. Any Person violating this Policy may be removed from the Area of Operations and may be denied future access. In addition, Company may suspend the Services or terminate this Contract as a result of violation of this Policy. In appropriat

In support of this Policy, Company or Contractor may conduc

27、Unless prohibited by applicable law, the following testing may be conducted:(B)測試。 除非適用法律禁止，可進(jìn)行下列測試：(1) Company or Contractor may conduct or have conducted a controlled substance or alcohol test(s) on the personnel of Contractor or Subcontractors upon entering or while within the Area of Operations.
