20、 day after the landscape construction completed and pass the acceptance examine: 5.3 其它：Others 甲方需委派一位人員，就此工程設(shè)計(jì)方向的事宜上，負(fù)責(zé)批復(fù)乙方的設(shè)計(jì)。如甲方要求乙方對已同意的設(shè)計(jì)提供重大修改，或進(jìn)行合同之外的設(shè)計(jì)工作，應(yīng)被視為額外服務(wù)項(xiàng)目，收費(fèi)應(yīng)由甲乙雙方共同協(xié)定。Party A shall appoint a staff to in charge of Party Bs engineering design approval. If Party A request Party B to

21、be make major adjustment on the design approved by Party A, or work on the design out of this contract scope, should be considered an additional service, fees should be design by mutual agreement of both parties.第六章 雙方責(zé)任Chapter6 Responsibilities of parties6.1 甲方責(zé)任 Responsibilities of Party A 甲方按本合同協(xié)

22、定提交的內(nèi)容，在協(xié)定的時(shí)間內(nèi)向乙方提交資料及文件，并對其完整性、正確性及時(shí)限負(fù)責(zé)。另外，甲方還應(yīng)提供關(guān)于場地條件的數(shù)據(jù)，包括公用事業(yè)、地理?xiàng)l件、道路使用權(quán)、限制條件等。 Party A shall submit the data and documents content in according to this contract stipulated, in agreed time limit, and be responsible for its integrity, correctness and time limit. In addition, Party A shall also p

23、rovide the data about the conditions at the jobsite, including utilities, geographical conditions, road use right, constraints, etc. 甲方提交上述資料及文件超過規(guī)定期限15天以內(nèi)，乙方按合同規(guī)定交付設(shè)計(jì)文件時(shí)間順延；期限超過15天以上時(shí)，乙方有權(quán)重新確定提交設(shè)計(jì)文件時(shí)間。 Party A delay to submitted the data and documents referred above in excess of the prescribed peri

24、od within 15 days, Party B postpone deliver the design documents in according to the contract stipulation time. If the delay time more than 15 days, Party B has the right to determine a new submitted time for the design documents 甲方變更委托設(shè)計(jì)項(xiàng)目、規(guī)模、條件或因提交的資料錯(cuò)誤，或所提資料作較大修改，以致造成乙方設(shè)計(jì)需返工時(shí)，雙方除需另行協(xié)商簽訂補(bǔ)充合同（或另訂合同

25、）、重新明確有關(guān)條款外，甲方應(yīng)按乙方所耗工作量向乙方支付返工費(fèi)。 Party B design reworked causes by Party A change design projects, scale, conditions or because of the presented material mistakes, or mentioned material major revision. Both parties shall sign a supplementary agreement (or sign a new agreement) and redefine relevant

26、terms, Party A shall pay associated rework fee to Party B in according to the workload. 在合同履行期間，甲方要求終止或解除合同，乙方未開始設(shè)計(jì)工作的，不退還甲方已付的定金；已開始設(shè)計(jì)工作的，甲方根據(jù)乙方已進(jìn)行的實(shí)際工作量，另行議定。 During the implement of the contract, Party A request to terminate or rescind the contract, Party B has not started design work, does not r

27、eturn prepaid deposit to Party a; design work has begun, Party A can negotiate with Party B for the fee in according to the actual workload. 甲方應(yīng)按本合同第五章規(guī)定的金額和時(shí)間向乙方支付設(shè)計(jì)費(fèi)用，每逾期一天，需承擔(dān)應(yīng)支付金額千分之二的逾期違約金。逾期超過十四天以上時(shí)，乙方有權(quán)暫停履行下階段工作，并書面通知甲方。 Party pay the design fee in according to the clause fifth of this contra

28、ct, Late payment shall pay 0.2 % of the late payment amount penalty per day, if the late payment is overdue more than 14 days, Party B has the right to suspend its work for next stage, and notice in writing to Party A. 甲方要求乙方比合同規(guī)定時(shí)間提前提交設(shè)計(jì)文件時(shí)，甲方應(yīng)支付趕工費(fèi)。 Party A requests Party B to submit the design do

29、cuments before contract stipulated time, Party A shall pay the rush cost. 甲方應(yīng)為乙方派駐現(xiàn)場的工作人員提供工作、生活交通等方面的便利條件，但費(fèi)用由乙方自行承擔(dān)。Party A should provide Party Bs on-site staffs work, living and traffic conveniences, but the cost shall be bear by Party B. 甲方應(yīng)保護(hù)乙方的設(shè)計(jì)版權(quán)，未經(jīng)乙方同意，甲方對乙方交付的設(shè)計(jì)文件不得向第三方轉(zhuǎn)讓，否則，乙方有權(quán)索賠。Party

30、A shall protect Party Bs design copyright, Party A should not transfer the design documents to third party without the agreement of Party B, or else, Party B has the right to claim for compensation. 甲方有權(quán)在本項(xiàng)目對外宣傳時(shí)使用乙方標(biāo)識。 Party A has the right to use the logo of Party B in advertising the project.6.2

31、乙方責(zé)任 乙方按本合同協(xié)定提交的內(nèi)容、份數(shù)、在協(xié)定的時(shí)間內(nèi)向甲方提交成果，并對其完整性、正確性、及時(shí)性負(fù)責(zé)。2.1 Party b shall submit the result content, number of copies stipulated in the agreement in time, and be responsibility of its completeness, correctness and timeliness. 乙方對設(shè)計(jì)文件出現(xiàn)的遺漏、錯(cuò)誤或甲方不滿意之處負(fù)責(zé)修改或補(bǔ)充。由于乙方設(shè)計(jì)錯(cuò)誤造成工程質(zhì)量事故損失，乙方除負(fù)責(zé)采取補(bǔ)救措施外，應(yīng)免收受損失部分的 設(shè)計(jì)費(fèi)

32、，并根據(jù)損失程度向甲方償付賠償金。經(jīng)甲方或上級主管部門審查后，在原定任務(wù)書設(shè)計(jì)范圍內(nèi)的必要修改，乙方負(fù)責(zé)承擔(dān)。 Party B shall modify or resupply the design document if there appeared omissions, false or unsatisfied by Party A. Due to the engineering quality accidents loss caused by Party Bs design error, party B shall reduce the relevant part design fee,

33、 in addition to take remedial measures and be liability for compensation according to the loss to Party As damages. After examination by Party A or superior departments in charge, amendments request within the scope the original specification design, Party B shall be liable. 由于乙方自身原因，延誤了設(shè)計(jì)文件交付時(shí)間，每延誤

34、一天，應(yīng)減收該項(xiàng)目設(shè)計(jì)費(fèi)的千分之二。Due to reason of Party B, if delivery time being delayed, Party B should reduce the project design fee of 2/1000 per delayed days. 乙方交付設(shè)計(jì)文件后，參加有關(guān)上級審查及根據(jù)審查結(jié)論負(fù)責(zé)不超出原定計(jì)劃任務(wù)書范圍內(nèi)的必要調(diào)整補(bǔ)充。不再計(jì)取費(fèi)用。 After delivering design documents, Party B shall participate in relevant superior examination,

Supplement within the scope of original plan task, shall not charge for any additional fee. 乙方不得向第三方擴(kuò)散、轉(zhuǎn)讓甲方提交的產(chǎn)品圖紙等技術(shù)經(jīng)濟(jì)資料。如發(fā)生以上情況，甲方有權(quán)索賠。Party B shall not spread or transfer product drawings, other technical and economic data submit

If above circumstance happened, Party A has the right to claim for compensation. 乙方同意配合甲方按工程進(jìn)度要求調(diào)整出圖順序，付款方式可另行協(xié)商。Party B agrees to coordinate Party A to adjust drawing deliver order according to the schedule require, payment method can be separately negotiate by both p

37、arties. 乙方必須根據(jù)設(shè)計(jì)標(biāo)準(zhǔn)、技術(shù)規(guī)范、設(shè)計(jì)任務(wù)說明等相關(guān)景觀設(shè)計(jì)標(biāo)準(zhǔn)進(jìn)行設(shè)計(jì)，提交符合質(zhì)量的設(shè)計(jì)文件。Party B must submit the quality design documents in accordance with design standards, technical specifications and design task of relevant landscape design standards. 乙方必須在滿足方案標(biāo)準(zhǔn)的前提下，選料用材時(shí)要注意到景觀效果和造價(jià)的關(guān)系，作到既滿足景觀效果的要求，又最大限度的降低造價(jià)。Party B shall cho

38、ose materials quality in accordance with landscape effect and price under the standards of scheme, in satisfies the requirements effect and maximum reduce cost.第七章 補(bǔ)充條款 Supplemental condition 7.1 合同終止 Termination of contract 甲方因自身原因不能履行本合同，應(yīng)按照合同付清已完成階段設(shè)計(jì)任務(wù)對應(yīng)的設(shè)計(jì)費(fèi), 并承擔(dān)合同總額的10%給乙方作為違約金，合同終止。Party A una

39、ble to perform the contract due to its own reason, should pay the design fee of completed phase in accordance with the contract, and bear the 10% of the total contract amount as liquidated penalty, terminate the contract. 乙方因自身原因無法履行合同，應(yīng)退回全部設(shè)計(jì)費(fèi)用，并承擔(dān)合同總額的10%給甲方作為違約金，合同終止。Party B unable to perform the contract due to its own reason, should pay 10% of the total contract amount as liquidated penalty, and terminate the contract.7 .1.3 由于不可抗力因素致使合同無法履行時(shí)，雙方應(yīng)及時(shí)協(xié)商解決。When unable to fulfill the contract due to force majeure factors, both parties should be resolved through consultation
