9、s,maintenanceofelectricwiringandplumbingfacilitiesonthearea.第六條、稅費(fèi)Article6 TaxesandFees出租人應(yīng)支付政府部門向其征收的除租房稅金外的所有稅費(fèi)TheLandlordshallpayalltaxesandfeesleviedonhimbytheauthoritiesexcepttherenttax.第七條、租賃房產(chǎn)的狀況Article7.StatusofLeasedProperty7.1出租人應(yīng)不遲于租期的第1大寫壹天將該租賃房產(chǎn)以清潔、良好的狀態(tài)移交給承租人,并在移交的同時(shí)交出該租賃房產(chǎn)的鑰匙.TheLandl
10、ordshalldelivertheleasedpropertytotheTenantinacleanandgoodconditionnolaterthanonthe1st(inwordsfirst)dayoftheleaseterm.TheLandlordshallhandoverkeysoftheleasedpropertyatthetimeofdelivery.6.2 出租人在任何時(shí)間都應(yīng)使該租賃房產(chǎn)保持良好的狀態(tài).出租人應(yīng)對(duì)房產(chǎn)的結(jié)構(gòu)及各項(xiàng)設(shè)施和設(shè)備進(jìn)行維護(hù),并在出現(xiàn)問(wèn)題的情況下及時(shí)糾正或維護(hù);如果出租人沒(méi)有在合理時(shí)間內(nèi)但不遲于接到通知后的一個(gè)星期內(nèi)糾正該問(wèn)題,那么承租人有權(quán)請(qǐng)求賠償和
11、/或糾正該瑕疵,費(fèi)用由出租人承當(dāng),承租人應(yīng)向出租人提供所付費(fèi)用的資料和收據(jù).30天內(nèi)未能解決,承租人有權(quán)立即搬出此房,并不承當(dāng)任何賠償.TheLandlordshallatalltimeskeeptheleasedpropertyingoodcondition.TheLandlordshallprovidemaintenancetothepropertyandrepairdefectssuchascracksonthewallinastructure;electricapplianceworksunproperly;constructionagainstthelocalorcompoundre
12、gulation.IftheLandlordfailstocorrectdefectswithinduetimebutnotlaterthan1weekafterbeingnotified,theTenantshallhavetherighttoclaimdamagesandorcorrectthedefectsattheexpenseoftheLandlord.TheTenantshallprovidetheLandlordwithdocumentationandreceiptsofcostsincurred.Thereshallbenopenaltyprovideditcannotbeso
13、lvedin30days,andTheTenanthastherighttocheckout.6.3 在非因承租人過(guò)錯(cuò)租賃房產(chǎn)出現(xiàn)問(wèn)題的情況下,比方,但不限于空調(diào)故障,出租人應(yīng)在收到承租人的通知后毫不遲延地進(jìn)行維修或糾正.如果出租人未能及時(shí)解決問(wèn)題,那么承租人有權(quán)自行或聘請(qǐng)第三方進(jìn)行維修,維修產(chǎn)生的費(fèi)用由出租人承當(dāng),承租人應(yīng)向出租人提供所付費(fèi)用的資料和收據(jù).同時(shí),出租人應(yīng)向承租人賠償維修費(fèi)用以外的其他損失(假設(shè)有).IncaseofanyproblemofthePremisesnotarisingfromtheTenantsfault,includingbutnotlimitedtoadefe
14、ctiveairconditioner,theLandlordshallcarryoutremedyorrepairwithoutdelayuponreceivinganoticefromtheTenant.IftheLandlordfailstoresolvesuchproblemswithinduetime(notlaterthan1weekafterbeingnotified),theTenantshallhavetherighttohaveitrepairbyitselforanythirdpartyattheexpenseoftheLandlord.TheTenantshallpro
15、videtheLandlordwithdocumentationandreceiptsofcostsincurred.Meanwhile,theLandlordshallindemnifyfromtheTenantanyotherlossinadditiontotherepairfees,ifany.第八條、使用規(guī)那么Article8.RulesofOccupancy承租人應(yīng)遵守以下使用規(guī)那么TheTenantshallfollowtherulesofoccupancyasfollows8.1承租人只應(yīng)將該租賃房產(chǎn)作為其住處.TheTenantshallusetheleasedproperty
16、onlyforresidentialpurpose.8.2 承租人有義務(wù)杜絕在租賃房產(chǎn)內(nèi)從事任何會(huì)對(duì)其他承租人或出租人造成不合理干擾的活動(dòng).TheTenantshallnotallowanythingtobedoneontheleasedpropertythatwouldunreasonablydisturbothertenantsortheLandlord.8.3 在租賃期間,承租人應(yīng)有義務(wù)使該租賃房產(chǎn)保持干凈和良好的條件.正常的損耗應(yīng)指在承租人及其家人的正常和合理使用期間產(chǎn)生的損耗.TheTenantshallhavethedutytokeeptheleasedpropertycleana
17、ndinagoodconditionforthedurationoftheleaseterm.FairwearandtearshallmeansuchwearinthehouseisexposedtoduringthenormalandreasonableusebyaTenantandTenantsfamily.8.4 承租人如果發(fā)現(xiàn)租賃房產(chǎn)中的供電、煤氣或供水設(shè)施、電線或管道已證實(shí)有危險(xiǎn)或可能證實(shí)有危險(xiǎn),應(yīng)毫不遲延地書面通知出租人.TheTenantshallgivewrittennoticetotheLandlordwithoutdelaywhentheTenantbecomesaware
18、ofanyelectrical,gasorwaterinstallation,wiringorpipingontheleasedpropertythatprovestobe,ormayprovetobe,adanger.8.5 承租人應(yīng)當(dāng)補(bǔ)償出租人因更換或修理被承租人或承租人負(fù)責(zé)的人損壞或破壞的租賃房產(chǎn)中的任何用物而導(dǎo)致出租人的所有直接費(fèi)用.出租人必須能夠提供有關(guān)文件和正式發(fā)票以要求付款.正常的損耗不應(yīng)構(gòu)成任何該損壞或破壞.TheTenantshallcompensatetheLandlordforalldirectcostsincurredbytheLandlordinreplacement
19、orrepairofanyitemontheleasedpropertydamagedordestroyedbytheTenantorapersonforwhichtheTenantisresponsible.TheLandlordmustbeabletoprovidedocumentationandofficialinvoicetoclaimpayment.Fairwearandtearshallnotconstituteanysuchdamageordestruction.8.6 承租人應(yīng)采取一切合理的預(yù)防舉措使租賃房產(chǎn)內(nèi)部免受暴風(fēng)雨和其他不利的天氣的影響,并應(yīng)在遇有該類天氣條件的危險(xiǎn)時(shí)采
20、取適當(dāng)舉措,比方保證所有的外部門窗都已平安鎖住或關(guān)閉.TheTenantshalltakeallreasonableprecautionstoprotecttheinterioroftheleasedpropertyagainstdamagesfromstormsandotheradverseweatherconditionsandshall,uponthreatofsuchweathercondition,takeappropriateaction,suchas,butnotrestrictedto,toensurethatallexteriordoorsandwindowsaresecur
21、elylockedorclosed.8.7 承租人應(yīng)遵守已公布的中國(guó)法律和法規(guī),并且不得允許在租賃房產(chǎn)上從事任何非法活動(dòng).TheTenantshallcomplywiththepublishedChineselawsandregulationsandnotpermitanyunlawfulactivitiesontheleasedproperty.第九條、進(jìn)入租賃房產(chǎn)的權(quán)利Article9.RighttoEntertheLeasedProperty9.1出租人進(jìn)入租賃房屋內(nèi)進(jìn)行正常必要的維修保養(yǎng)工作,應(yīng)當(dāng)提前7天書面通知承租人,經(jīng)承租人同意前方可進(jìn)入維修場(chǎng)所;假設(shè)在緊急情況下無(wú)法提前通知承租人
22、,且不緊急進(jìn)入租賃房?jī)?nèi)進(jìn)行搶修或搶救將會(huì)產(chǎn)生嚴(yán)重后果的,出租人有權(quán)在物業(yè)治理人員陪同下,立即進(jìn)入租賃房屋內(nèi)從事緊急維修、搶救工作.UponwrittennoticetheLandlordshallhavetherighttoentertheleasedpropertytoperformnecessarymaintenancework.Inaneventofemergency,theLandlordshallhavetheimmediaterighttoentertheleasedpropertywithoutanypriornotice.9.2租期屆滿前一(大寫壹)個(gè)月之內(nèi),在發(fā)出通知后,出租
23、人有權(quán)讓將來(lái)可能的新租戶參觀該租賃房產(chǎn),但需要提前通知承租方的居住人.Within1(inwordsone)monthsoftheendoftheleasetermtheLandlordshallhavetherightuponwrittennoticetoshowtheleasedpropertytoprospectivenewtenants.第十條、轉(zhuǎn)租權(quán)Article10.SublettingRights經(jīng)出租人同意,承租人有權(quán)以合理事先書面通知出租人全部或局部將租賃房產(chǎn)轉(zhuǎn)租給其關(guān)聯(lián)企業(yè)或?qū)⒈竞贤爬ㄞD(zhuǎn)讓給其關(guān)聯(lián)企業(yè).TheLandlordagreesthattheTenantisent
24、itledtoentirelyorpartiallysubleasethePremisesorassignthisContracttoanyofitsAffiliatesubjecttoareasonablyadvancenoticetotheLandlord.第十一條、終止Article11.Terminate11.1 租期滿11個(gè)月之后,承租人在任何時(shí)候都可通過(guò)提前1大寫壹個(gè)月書面通知終止本合同.After11monthsofthisleasingterm,theTenantmayatanytimeterminatethisContractunderconditionofproviding
25、onemonthpriorwrittennoticetotheLandlord.11.2 如果租金的支付自到期之日起遲延30(大寫叁拾)天以上并至少超過(guò)出租人發(fā)出書面通知后的30(大寫叁拾)天,出租人應(yīng)有權(quán)終止本合同.Intheeventthatpaymentofrentisdelayedformorethan30(inwordsthirty)daysfromthedatedueandatleast30(inwordsthirty)daysafterwrittennoticefromtheLandlordtotheTenantstatingthedelayisissuedtheLandlord
26、shallhavetherighttoterminatethisContract.11.3 如果任何一方資不抵債,或者公司進(jìn)入清算階段,另一方應(yīng)有權(quán)終止本合同.IntheeventthatanyofthepartiesbecomesbankruptorincaseacompanygoesintoliquidationtheotherpartyshallhavetherighttoterminatethisContract.第十二條、違約12.1 由于出租人違約,承租人有權(quán)不支付租金,且已支付的當(dāng)期租金需全額歸還.TheTenantshallhavetherighttowithholdrentp
27、aymentsforLandlordsbreachofcontract12.2 由于承租人違約,出租人有權(quán)不退還承租方已支付的租金.Thelandlordshallhavetherightnottohandbackrentpaymentsfortenantsbreachofcontract.12.3 如果出租人拖延糾正租賃房產(chǎn)上的瑕疵,那么承租人有權(quán)自行糾正瑕疵并從租金中扣除所支出的費(fèi)用,條件是承租人有詳細(xì)的資料和收據(jù)證實(shí)其扣除額.IntheeventthattheLandlordisindelaywithcorrectingdefectsontheleasedpropertytheTenan
28、tshallhavetherighttocorrectdefectshimselfanddeductthecostsfromtherentprovidedtheTenantsupportsthedeductionwithdetaileddocumentationandreceipts.12.4 除了本合同所提到的其他違約,如果本合同的任何一方違反了本合同,受損方應(yīng)有權(quán)就其所受的損失請(qǐng)求賠償.ApartfromotherbreachesofcontractmentionedinthisContract,ifeitherpartytothisContractbreachesthecontract,
29、theinjuredpartyshallhavetherighttobecompensatedfordirectdamagessuffered.12.5在租賃期內(nèi),出租人或承租人中的任何一方均有權(quán)以提前一個(gè)月通知并支付相當(dāng)于一個(gè)月租金額的補(bǔ)償金給對(duì)方為條件提前解除本租賃合同.承租人在收到正式發(fā)票后30天內(nèi)支付補(bǔ)償金給出租人.Duringtheleasingterm,anyPartyhastherighttoterminatethecontractwithonemonthpriorwritennoticeunderconditionofpayingequalonemonthrentalascom
30、pensationtotheotherside.Thetenantwillonlypaythecompensationtothelandlordwithin30daysafterreceivedtaxinvoicefromthelandlord.第十三條、規(guī)章制度Article13 RulesandRegulations承租人應(yīng)遵守出租人為治理租賃房產(chǎn)和公共場(chǎng)地而制定的規(guī)章制度.出租人必須在該規(guī)章生效前3(大寫叁)天書面通知承租人.如果該規(guī)章制度與本合同有沖突,那么以本合同為準(zhǔn).TheTenantshallfollowsuchreasonablerulesandregulationsissue
31、dbytheLandlordforthemanagementoftheleasedpropertyandcommonareas.TheLandlordmustinformtheTenantinwritingofsuchregulationsatleast3(inwordsthree)daysbeforetheeffectivenessoftheregulations.IntheeventsuchrulesandregulationsareincontradictiontothisContract,thetermsofthisContractshallprevail.第十四條、爭(zhēng)議解決Artic
32、le14 DisputeResolution由本合同引起的、或由關(guān)于本合同的履行引起的任何分歧和爭(zhēng)議應(yīng)由合同雙方友好協(xié)商解決.如協(xié)商不成,依據(jù)?中華人民共和國(guó)合同法?規(guī)定,雙方約定交由承租方所在地人民法院裁決.AnydifferencesordisputesarisingfromthisContractorfromagreementsregardingitsperformanceshallbesettledbyanamicableeffortonthepartofbothpartiestothisContract.Ifnegotiationfails,Bothpartiesagreethedi
33、sputeshallbesettledbyapplicationofChineselawunderthejurisdictionofthelocalcourtofthetenant.第十五條、不可抗力Article16.ForceMajeure15.1如果因不可抗力而無(wú)法履行本合同項(xiàng)下的義務(wù),出租人和承租人都不應(yīng)承當(dāng)責(zé)任.不可抗力應(yīng)指不可預(yù)見(jiàn)、超出一方合理限制范圍的事件,比方,但不限于自然力、自然災(zāi)害、勞工爭(zhēng)議、戰(zhàn)爭(zhēng)或者類似戰(zhàn)爭(zhēng)的情形、騷亂、破壞活動(dòng)或者嚴(yán)重的火災(zāi).NeithertheLandlordnortheTenantshallbeliableforfailuretomeetcontra
34、ctualobligationsunderthisContractduetoforcemajeure.ForcemajeureshallmeansuchunforeseeableoccurrencesbeyondthereasonablecontrolofaPartysuchas,butnotrestrictedtoActsofGod,naturaldisasters,labordisputes,warorwarlikeconditions,riot,sabotageandseriousfire.第十六條、其他Article16.MiscellaneousClauses16.1修訂Amendm
35、ents本合同所有的附件、修訂、補(bǔ)充和變更應(yīng)書面做成,并在雙方通過(guò)協(xié)商達(dá)成一致后由雙方合法授權(quán)的代表簽署.它們構(gòu)本錢合同的組成局部,與本合同具有同等效力.Allannexes,amendments,supplementsandalterationstothisContractshallbemadeinwritingandsignedbythedulyauthorizedrepresentativesofbothpartiesupontheagreementreachedbetweenbothpartiesthroughconsultations.TheyshallformintegralpartsofthisContractandhavethesameforceasthisContractitself.16.2 通知Notice出租人和承租人特此約定,所有關(guān)于對(duì)方的權(quán)利或義務(wù)的交給對(duì)方的通知應(yīng)書面作出.TheLandlordandtheTenantagreeherebythatallnoticestobedeliveredtotheotherPartywithregardtoeitherPartysrightsorob
