2、ompanyfunds;斗毆、賭博、恐嚇:走私、疏于職守、不聽(tīng)從上級(jí)合法指示、損害船舶財(cái)產(chǎn)、盜竊公司財(cái)物;Drug/alcoholabuse;吸毒、酗酒;Violationlawsoflocalport;違反港口國(guó)當(dāng)?shù)胤桑籓therbreachesofprinciplesormisbehavior.其他違紀(jì)或不法行為。Date,timeandplaceforaformalinvestigationofthechargesagainsttheseafarerconcerned.對(duì)相關(guān)違規(guī)船員正式調(diào)查的日期、時(shí)間和地點(diǎn)。TheMasterorhisauthorizedrepresentative
3、shallconducttheinvestigationorhearing,givingtheseafarertheopportunitytoexplainordefendhimselfagainstthecharges.Theseproceduresmustbedulydocumentedandenteredtotheshipslogbook.B.船長(zhǎng)或其授權(quán)的代理人應(yīng)該進(jìn)行調(diào)查或聆聽(tīng)、給予被指控船員就所指控事件進(jìn)行自我解釋和辯護(hù)機(jī)會(huì)。這些程序必須進(jìn)行記錄和記入船舶航海日志。Ifaftertheinvestigationorhearing,themasterisconvincedthatim
4、positionofapenaltyisjustified,theMastershallissueawrittennoticeofpenaltyandthereasonsforittotheMaster,withcopiesfurnishedtotheManningAgent.C.如果經(jīng)過(guò)調(diào)查或聆聽(tīng)后,船長(zhǎng)相信對(duì)違紀(jì)船員實(shí)施處罰是正當(dāng)?shù)模L(zhǎng)應(yīng)該向違規(guī)船員簽署一份列明該項(xiàng)處罰理由的書(shū)面處罰通知,書(shū)面處罰通知復(fù)印件應(yīng)該抄送該船員派遣公司。DismissalforjustcausemaybeeffectedbycompanyortheMasterwithoutfurnishingtheseafar
5、erwithanoticeofdismissalifthereisaclearandexitingdangertothesafetyofthecreworthevessel.TheMastershallsendacompletereporttothemanningagencysubstantiatedbywitnesses,testimoniesandanyotherdocumentsinsupportthereof.D.如果有明確和現(xiàn)存對(duì)船舶和船舶人員安全構(gòu)成危險(xiǎn)的情況下,公司或船長(zhǎng)有權(quán)不通知違紀(jì)船員本人的情況下開(kāi)除該船員。船長(zhǎng)應(yīng)該向船員派遣公司提供一份完整的報(bào)告,該報(bào)告應(yīng)該包含有見(jiàn)證人、證
6、詞和對(duì)此事有關(guān)的其他支持材料。SECTION15.TERMINATIONOFEMPLOYMENT第十五部分合同終止Theemploymentoftheseafarershallceasewhentheseafarercompleteshisperiodofcontractualserviceaboardthevessel,signs-offfromthevesselandarrivesatthepointofhire.A,船員完成合同后離船到達(dá)雇傭地,船員雇傭合同即告終結(jié)。Theemploymentoftheseafarerisalsoterminatedwhentheseafarerarri
7、vesatthepointofhireforanyofthefollowingreasons:B.船員因以下原因到達(dá)雇傭地后也定義為船員雇傭合同終結(jié)。Whentheseafarersigns-offandisdisembarkedformedicalreasonspursuanrtoSection17(b)(4)ofthisContract.1.船員根據(jù)本合同第17部分(b)(4)的規(guī)定病原因從船上離船。Whentheseafarersign-offduetoshipwreck,shipsscale,lay-upofvessel,discontinuanceofvoyageorchangeof
8、vesselprincipalinaccordancewithofthisContract.船員根據(jù)本合同的規(guī)定由于海難,船舶拆解,封存,航次終結(jié)或船舶改換船東從船上離船。Whentheseafarer,inwriting,voluntarilyresignsandsignsoffpriortoexpirationofcontractpursuanttoSection16(f)ofthisContract.3.船員根據(jù)本合同第16(f)部分的規(guī)定以書(shū)面形式在合同終結(jié)前自愿辭職從船上離船。3.Whentheseafarerisdischargedforjustcauseasprovidedfor
9、inSection14ofthisContract.4.船員由于本合同第14部分的規(guī)定以正當(dāng)?shù)睦碛杀唤夤碗x船。REPATRIATION第十六部分休假Upontheexpirationofthecontract,thecompanyshallarrangeseafarersdisembark.Ifcouldnotarrangecrewdisembarkatthisportcompanymayarrangesameatnextconvenientport.Theseafarershallbeentitledtoearnedwagesandbenefitsasprovidedinhiscontrac
10、t.A.如果合同到期公司必須安排船員休假,而港口無(wú)法安排,可以安排在下一個(gè)方便港口,船員應(yīng)該繼續(xù)按該合同進(jìn)行并獲得相應(yīng)的薪水和享受相關(guān)福利。Ifthevesselarrivesataconvenientportbeforetheexpirationofthecontract,theMaster/Employermayrepatriatetheseafarerformsuchport,providedtheun-servedportionofthecontractiswithinmutualagreeoptionrange.Theseafarershallbeentitledonlytohise
11、arnedwagesandearnedleavepay.B.如果合同到期前船舶到達(dá)一個(gè)方便港口并且未完成合同的合同部分在雙方同意的選擇期限內(nèi),船長(zhǎng)/雇主可以在這種港口讓船員休假。船員只能獲取他已經(jīng)賺取的薪酬和已經(jīng)賺取的休假帶薪。Whentheseafarerisdischargedforduetocrewindividualsseriousderelictionofduty,theemployershallhavetherighttorecoverthecostsofhisreplacementandrepatriationfromtheseafarerswagesandotherearnin
12、gs.C.雇主因船員個(gè)人的嚴(yán)重失職而解聘船員,雇主有權(quán)從船員工資和其他收入中追回安排船員休假和安排接班船員所產(chǎn)生的費(fèi)用。Theseafarer,whendischargedandrepatriatedasdirectedbytheemployer/master/agencyshallbeentitledtobasicwagesfromdateofsigningoffuntillarrivalatthepointofhireexceptwhenthedischargeisinaccordancewiththeaboveorfordisciplinaryreasons.D.除了是由于前述船員違規(guī)原
13、因,對(duì)于在船長(zhǎng)/雇主/代理人安排下進(jìn)行的休假船員享有從離船到達(dá)雇傭地領(lǐng)取基本工資的權(quán)利。Aseafarerwhorequestsforearlyterminationofhiscontractshallbeliableforhisrepatriationcostaswellasthetransportationcostofhisreplacement.Theemploymentmay,incaseofcompassionateground,assumethetransportationcostoftheseafarersreplacement.E.申請(qǐng)?zhí)崆肮莸拇瑔T除了要負(fù)責(zé)他本人的公休成本也
14、要負(fù)責(zé)接替他的船員的交通費(fèi)用。在體恤事件條件下,雇主應(yīng)該承擔(dān)接班船員交通費(fèi)用。Wheretheseafarersemploymentterminatedbecauseoftransferofregistryofownershiporabandonmentofvesselorlossofvessel.Theseafarersshallbeentitledtocompensationequalto1monthsbasewage,orthebasewagesuntiltheexpirationoftheperiodforwhichhewasengaged.Whichevershallbeleast;
15、providedhoweverthattheseamanisnoremployedasaseamanduringsuchperiodandprovidedfurtherthatduringsuchperiodtheseafarerhasnotrefusedsubstantllyeqivalentseagoingemployment.F.當(dāng)船員合同由于船籍國(guó)的變更或者船東的變更或者棄船或者船損而終止,如果該船員在這個(gè)期間不能再次被雇傭上船,或者該船員不能獲得與海上雇傭期大致相同的收入,該船員有權(quán)獲得相當(dāng)于1個(gè)月的基本工資的補(bǔ)償,或者直到他的雇傭合同期滿為止的基本工資補(bǔ)償,兩者取小者。Themin
16、imumnoticeperiodtobegivenbytheseafarersandcompanyfortheearlyterminationofacrewagreementshallnotbeshorterthensevendays.Companyallowsseafarerstoterminatethecrewagreementasshorternoticeorwithoutnoticewithoutpenaltyforcompassionateorotherurgentreason.IncasethereisconflictwithterminationclauseasperCBAthe
17、ntheterminationclauseaspercontractwillprevailprovidinganadvantageoussituationtotheseafarer.G.海員和公司提前終止海員就業(yè)協(xié)議發(fā)出預(yù)先通知的最短期限為不短于7天。公司允許海員處于值得同情的原因或其他緊急原因提前較短時(shí)間或不通知不被處罰就終止就業(yè)協(xié)議。如果與談判協(xié)議中的終止條款有沖突,則有利于海員的終止條款優(yōu)先。COMPENSATIONANDBENEFITS第十七部分賠償和福利A.COMPENSATIONANDBENEFITSFORDEATHA.死亡賠償和福利Incaseofwork-relateddeat
18、hoftheseafarer,duringthetermofhiscontract,theemployershallpayhisbeneficiariesasperPeoplesRepublicofChinalaws.一旦海員在合同期間因工作死亡,雇主要根據(jù)中華人民共和國(guó)相關(guān)法律對(duì)海員的受益人進(jìn)行賠償。Itisunderstoodaridagreedthatthebenefitsabove-mentionedshallbeseparateanddistinctfrom,andwillbeinadditiontowhateverbenefitswhichtheseafarerisentitled
19、tounderPeoplesRepublicofChinalawsfromthesocialsecuritysystemetc.,ifapplicable.除了以上來(lái)自雇主的補(bǔ)償外,雙方一致同意根據(jù)中華人民共和國(guó)法律體系下的社會(huì)保險(xiǎn)等而獲取的補(bǔ)償也一并歸入船員補(bǔ)償。Theotherliabilitiesoftheemployerwhentheseafarerdiesasaresultofworkrelatedinjuryorillnessduringthetermofemploymentareasfollows:船員在合同期間因工作原因?qū)е碌募膊『蛡Χ劳鰰r(shí),雇主所要承擔(dān)的其他賠償責(zé)任:a.
20、Theemployershallpaythedeceasedsbeneficiaryalloutstandingobligationduetheseafarerunderthiscontract.雇主應(yīng)該根據(jù)本合同向死亡船員受益人轉(zhuǎn)付所有歸屬于死亡船員的應(yīng)有的福利補(bǔ)償。HeemployershalltransporttheremainsandpersonaleffectsoftheseafarertotheChinaatemployersexpenseexceptifthedeathoccurredinaportwherelocalgovernmentlawsorregulationsdono
21、tpermitthetransportofsuchremains.Incasedeathoccursatsea,thedispositionoftheremainsshallbehandledordealtwithinaccordancewiththemastersbestjudgment.Inallcases,theemployer/mastershallcommunicatewiththemanningagencytoadvisefordispositionofseafarersremains.b.除死亡發(fā)生港口當(dāng)?shù)胤苫蚍ㄒ?guī)要求不得轉(zhuǎn)運(yùn)遺骸外,雇主應(yīng)將死亡船員遺骸及個(gè)人物品轉(zhuǎn)運(yùn)回中國(guó),所
22、有因此而產(chǎn)生的費(fèi)用有雇主承擔(dān)。如果死亡發(fā)生在海上,應(yīng)根據(jù)船長(zhǎng)良好職業(yè)判斷處理過(guò)世船員遺骸。但無(wú)論如何,船長(zhǎng)/雇主應(yīng)該向過(guò)世船員的代理公司通報(bào)有關(guān)船員遺骸處理事宜。B.COMPESATIONANDBENEFITSFORINJURYORILLNESSB.工傷或因工作所導(dǎo)致疾病賠償及福利C.Theabilitiesoftheemployerwhentheseafarersufferswork-relatedinjuryorillnessfuringthetermofhiscontractareasfollow:C.船員在合同期內(nèi)因工作而導(dǎo)致的疾病或傷害,雇主應(yīng)該承擔(dān)以下責(zé)任:1.Theemploye
23、rshallcontinuetopaytheseafarerhiswageshiswagesduringthetimeheisonboardvessel.船員受傷或生病后仍然在船期間,雇主應(yīng)該繼續(xù)支付船員工資。Iftheinjuryorillnessrequiresmedicaltreatmentinaforeignport,theemployershallbeliableforthefullcostofsuchmedical,surgicalandhospitaltreatmentaswellasboardandlodginguntiltheseafarerisdeclaredfittowo
24、rkortoberepatriated.However,ifafterrepatriation,theseafarerwillrequiresmedicalattentionarisingformsaidinjuryorillness,heshallbesoprovidedatcosttotheemployeruntilsuchtimeheisdeclaredfitorthedegreeofhisdisabilityhasbeenestablishedbythecompany-designatedphysician/hospital.如果工傷或疾病需要在國(guó)外港口進(jìn)行治療,雇主要承擔(dān)所有藥品,手
25、術(shù)和住院費(fèi)用也包括食宿費(fèi)用到船員被宣布適合工作或返回雇傭地。如果返回雇傭地后船員還需要繼續(xù)治療的,雇主依舊要承擔(dān)其醫(yī)療費(fèi)用到船員痊愈或由雇主指定醫(yī)生/醫(yī)院宣布其殘疾程度為止。Uponsign-offfromthevesselformedicaltreatment,theseafarerisentitledtosicknessallowanceequivalenttohisbasicwageuntilheisdeclaredfittoworkorthedegreeofpermanentdisabilityhasbeenassessedbythecompany-designatedphysicia
26、n/hospitalbutinnocaseshallthisperiodexceedsixth(16)weeks.Forthispurpose,theseafarershallsubmithimselftoapost-employmentmedicalexaminationbyacompany-designatedphysician/hospitalwithinthreeworkingdaysuponhisreturnexceptwhenheisphysicallyincapacitatedtodoso,inwhichcase,awrittennoticetotheagencywithinth
27、esameperiodisdeemedascompliance.Failureoftheseafarertocomplywiththemandatoryreportingrequirementshallresultinhisforfeitureoftherighttoclaimtheabovebenefits.因病治療離船從離船開(kāi)始,船員享有等同于其基本工資的疾病補(bǔ)助,疾病補(bǔ)助發(fā)放時(shí)間到疾病補(bǔ)助治愈或雇主所指定醫(yī)生/醫(yī)院宣布其殘疾程度為止,但無(wú)論如何疾病補(bǔ)助發(fā)放時(shí)間不得超過(guò)16周。為了有效實(shí)施以上目的,船員應(yīng)該于到達(dá)雇傭地后3日內(nèi)由雇主所指定醫(yī)生/醫(yī)院簽發(fā)合同終結(jié)后的體檢報(bào)告,一旦船員客觀上無(wú)
28、法做到,船員以書(shū)面的方式通知其代理機(jī)構(gòu)也可看作對(duì)以上要求的遵從。船員沒(méi)能按上述要求執(zhí)行可視為對(duì)獲取上述權(quán)利的放棄。Uponsign-offtheseafarerfromthevesselformedicaltreatment,theemployershallbearthefullcostofrepatriationintheeventtheseafarerisdeclared(1)fitforrepatriation;or(2)fittoworkbuttheemployerisunabletofindemploymentfortheseafareronboardhisformervesselo
29、ranothervesselortheemployerdespiteearnestefforts.船員離船就醫(yī)后雇主要對(duì)一下情況為船員提供前往雇傭地交通費(fèi)用:(1)船員在國(guó)外就醫(yī)后打到了返回雇傭地就以的條件而要返回雇傭地;(2)船員就醫(yī)后已經(jīng)適合重返工作崗位,但經(jīng)過(guò)雇主全面努力后,船員已經(jīng)不能返回原船或也沒(méi)有合適的另一條船可供船員服務(wù)而需要返回雇傭地。Incaseofpermanenttotalorpartialdisabilityoftheseafarercausedbyeitherinjuryorillnesstheseafarershallbecompensatedinaccordanc
30、ewiththescheduleofbenefitsenumeratedinP&IClubterms&seafarersocialsecurityinChina.Computationofhisbenefitsarisingfromanillnessordiseaseshallbegovernedbytheratesandtheruledofcompensationapplicableatthetimetheillnessordiseasewascontracted.5.一旦由于工傷或者疾病導(dǎo)致船員永久或部分殘疾,船員應(yīng)該根據(jù)保賠協(xié)會(huì)和船員在中國(guó)的社會(huì)保險(xiǎn)項(xiàng)目獲取賠償。賠償標(biāo)準(zhǔn)和賠償額是以工傷
31、和疾病發(fā)生時(shí)的保賠協(xié)會(huì)和社保相關(guān)項(xiàng)目標(biāo)準(zhǔn)進(jìn)行計(jì)算。Nocompensationandbenefitsshallbepayableinrespectofanyinjury,incapacity,disabilityordeathoftheseafarerresultingformhiswillfullyorcriminalactorintentionalbreachofhisduties,providedhowever,thattheemployercanprovethatsuchinjury,incapacity,disabilityordeathisdirectlyattributablet
32、otheseafarer.D.如果雇主能夠證明因?yàn)榇瑔T本人故意行為、故意違反其工作職責(zé)而直接導(dǎo)致船員受傷、殘疾和死亡的,船員不享有賠償權(quán)利。Aseafarerwhoknowinglyconcealsanddoesnotdisclosepastmedicalcondition,disabilityandhistoryinthepre-employmentmedicalexaminationconstitutesfraudulentmisrepresentationandshalldisqualifyhimfromanycompensationandbenefits.Thismayalsobeav
33、alidgroundforterminationofemploymentandimpositionoftheappropriateadministrationandlegalsanctions.E.船員明確知悉在上船前體檢中隱瞞過(guò)往病史構(gòu)成欺騙性誤述,該類(lèi)誤述會(huì)取消其所有賠償和補(bǔ)貼權(quán)利。該類(lèi)誤述也是有效終止該合同的條件,也是實(shí)施合適管理和法律制裁的依據(jù)。NocompensationandbenefitsshallbepayableinrespectofInjuryincurredotherwisethanintheserviceoftheship.船舶服務(wù)之外發(fā)生的其它受傷,船員不享有賠償權(quán)利
34、。Whenrequested,theprincipalshallfurnishtheseafareracopyallpertinentmedicalreportsoranyrecordsatnocosttotheseafarer.G.當(dāng)需要時(shí),雇主應(yīng)該為船員免費(fèi)提供所有船員本人相關(guān)的醫(yī)療報(bào)告和記錄。SECTION18.TRADINGAREA第十八部分航行區(qū)A.SeafareracknowledgesthattheVesselmaytradeworldwideatemployersolediscretion.船員確認(rèn)知道在雇主的決定下船舶可以進(jìn)行全球區(qū)域內(nèi)航行Ifthevesselsailsto
35、awarproneareapromulgatedbyP&Icluborwarriskunderwriters,theEmployershallinformSeafarerandmanningagentinadvanceandensureSeafarer,ManningAgentagreeonthat.如果船舶駛往經(jīng)過(guò)保賠協(xié)會(huì)公布的戰(zhàn)爭(zhēng)或者戰(zhàn)爭(zhēng)高風(fēng)險(xiǎn)區(qū),雇主要提前通知海員及海員的代理機(jī)構(gòu),并確保得到海員和海員的代理機(jī)構(gòu)同意海員隨船前往上訴區(qū)域。Awarbonus,ifany,willbepaidtoSeafarerdirectlybytheEmployerC.如果有戰(zhàn)區(qū)獎(jiǎng)應(yīng)該由雇主直接支付給海員
36、本人。SECTION19.LOSSOFDAMAGETOCREWSPERSONALEFFECTSBYMARINEPERIL第十九部分由于海難事故導(dǎo)致船員個(gè)人物品的損壞和丟失TheseafarershallbereimbursedbytheemployerthefullamountoflossordamagetohispersonaleffectsbutinnocaseshallbeamountexceedtotheamountofTwoThousandUSdollars(US$2000)ifhispersonneleffectsarelostordamagedasaresultofthewrec
37、korlossorstrandingorabandonmentofthevesselorasaresultoffire,flooding,collisionorpiracy.A.由于海盜、碰撞、火災(zāi)、擱淺、沉沒(méi)、棄船所導(dǎo)致的船員個(gè)人物品丟失或損壞,雇主應(yīng)該對(duì)船員就此產(chǎn)生的全部財(cái)產(chǎn)損失進(jìn)行賠償,但最高賠償額度不得超過(guò)2000美元Incaseofpartialloss,theamountshallbedeterminedbymutualagreementofbothpartiesbutinnocasetoexceedtotheamountofTwoThousandUSdollars(US$2000

39、cyshallparticipateinworkinjuryinsurance,medicalinsurance,oldageinsurance,unemploymentinsuranceaswellasothersocialinsuranceinaccordancewiththerelevantprovisionsoftheState,andshallpaypremiumsontimeandinfullforseafarer.Abovefeealreadyincludeleavesubsistenceinmonthlywage.船員派遣公司代表雇主應(yīng)當(dāng)按照國(guó)家法律法規(guī)的規(guī)定為其招募的船員辦理
40、養(yǎng)老保險(xiǎn)、醫(yī)療保險(xiǎn)、工傷保險(xiǎn)、失業(yè)保險(xiǎn)、及其他國(guó)家法律規(guī)定的社會(huì)保險(xiǎn)項(xiàng)目,并按時(shí)足額為船員繳納其應(yīng)當(dāng)繳納的各項(xiàng)費(fèi)用。上述費(fèi)用已包含在工資組成社保金部分。GENERALSAFETY第二十一部分總體安全要求Theseafarershallobserveandfollowanyregulationorrestrictionthatthemastermayimposeconcerningsafety,drugandalcoholandenvironmentalprotection.A.船員要遵從船長(zhǎng)為實(shí)施安全管理、毒品和酒精政策和環(huán)保政策而制定相關(guān)規(guī)章制度或限制。Theseafarershallmakeuseofallappropriatesafetyequipmentprovided
