Bothparties,inlinewiththeprinciplesoflegality,fairness,equality,mutualagreement,honesty,andtrustworthiness,onavoluntarybasis,andinaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillalltheobligationsstipulatedhereinafter.

PartyAwishestoengagetheserviceofPartyBasEnglishteacher.Thedurationofserviceisoneyear,i.e.from1stdayofAugust,2015to31thdayofJuly,2016.

TasksassignedtoPartyB(seetheappendix).

PartyBsyearlysalaryandotherbenefitswillbeatotalofRMB1000000.(beforetax)(includingasalaryofRMB700000peryearandotherallowancesofRMB300000peryear.)Pleaseseetheappendixfortermsandconditionsonotherremunerationsandbenefitsconcerned.

PartyA’sObligations

PartyAshallinformPartyBofrelevantlaws,DecreesandregulationsofthePeople’sRepublicofChinaaswellasanyinstitutionsandadministrativestipulationsconcernedwithPartyB’semploymentashereinprovided.

PartyAshallconductdirection,supervisionandevaluationofPartyB’swork.

PartyAshallprovidePartyBwithnecessaryworkingfacilities.

PartyAshalldeployfellowstaffforPartyBforcoordinatedaffairs.

PartyAshallpayPartyB’ssalaryregularlyasscheduled.

VI.PartyB’sObligations

PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina’sinternalaffairs.

PartyBshallobservePartyA’sworksystemandregulationsconcerningadministrationofforeignexperts,andshallacceptPartyA’sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA’sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.

PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.

PartyBshallrespectChina’sreligiouspolicies,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.

PartyBshallrespecttheChinesepeople’smoralstandardandcustoms.

I.Revision,CancellationandTerminationoftheContract

BothPartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.

RevisionoftheContract

Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.

PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions:

PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendPartyB’sactionsafterPartyAhaspointeditout.

Accordingtothephysician’sdiagnosis,PartyBfailstoresumenormalworkafteracontinued30-daysickleave.

PartyBhastherighttocancelthecontractwithawrittennoticetoPartyAunderthefollowingconditions:

PartyAhasnotprovidedPartyBwithnecessaryworkingfacilitiesasstipulatedinthecontract.

PartyAhasnotpaidPartyBasscheduled.

Incaseeitherpartyaskstoterminatethiscontract,itshallgivea30daynoticetotheotherpartyinwriting,andthecontractshallonlybeterminatedafter30days.

Thecontractcanbeterminatedwithmutualconsent.

Terminationofthecontract:

Thiscontractshallbeterminatedonceitexpires.

Thiscontractmaybeterminatedwiththemutualconsentofbothparties,anditshallbestrictlyobserveduntilbothpartiesreachanagreementotherwise.

BreachPenalty

Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyof

B000.

IfPartyBaskstocancelthecontractduetoeventbeyondcontrol,itshouldproducecertificationsbythecompetentauthorities;withPartyA’sconsenttocancelthecontract,PartyBpayitsownreturnexpenses;ifPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpayabreachpenaltytoPartyAasstipulatedinthiscontract.

IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB’sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB’sreturnexpensesandpayabreachpenaltytoPartyBasstipulatedinthiscontract.

Theappendixofthecontractisaninseparablepartofthecontractandhasequallegaleffectwiththetextofthiscontract.

Thiscontractshalltakeeffectonthedatesignedbybothpartiesandwillautomaticallyterminateduponexpiration.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty90dayspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.

PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires.

Arbitration

Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtotheorganizationofarbitrationforforeignexpertaffairsintheStateAdministrationofForeignExpertsAffairsandaskforafinalarbitration.Ifallattemptsfail,thetwopartiescanappealtothelocalcourt.

ThisContractissignedatHumanResourcedepartmentofXiamenInstituteofTechnology,induplicate,thisdayof,20,inChineseandEnglish,bothversions

beingequallyvalid.

APPENDIXTOCONTRACT

I.DutiesandjobrequirementsforPartyB

PartyBsworkassignments

TheworkloadofPartyBis_576hoursperschoolyear136weeks,16hours/weekor32

weeks,18hours/week口fororalEnglishteachingor504hoursperschoolyear(36weeks,

14hours/week)forprofessionalcourses.

PartyBshallarrangeoneseminaraboutChineseandWesterncultureeachsemester.

PartyBshallparticipateintheweeklyEnglishCorneronceinaweekfor2hoursorotherextracurricularactivitiesandeventsrelatingtotheDepartmentofCollegeEnglishTeaching.

JobrequirementsforPartyB

PartyBshallarrivebeforethetermstartsinordertogetfamiliarwiththeteachingenvironment.PartyBshallinformPartyAofhis/herarrivalport/stationinXiamen,date,time,flightNo.etc.inadvancesothatPartyAcanarrangetomeetathis/herarrivingplace,andthetransportationfeeshallbecoveredbyPartyB.

PartyBshallabidebytheoverallteachingarrangementsoftheuniversitysuchastheteachinghours,thearrangementoftheclassrooms,andtheuseofteachingfacilitiesetc.PartyBsteaching

schedule,whichhasbeenconfirmed,shallnotbechangedatwill.Anyonewhowishestoadjusthis/herclassesorreadjusttheclassroomsshallgetpermittedbyapplyingtotheTeachingAffairsOfficeinadvance.Anyearlyclassdismissalorbeinglateforclasswithoutanyreasonisnotallowed.

IfPartyBwishestousehis/herownteachingmaterialssuchastextbook,musictape,VCD,DVDetc.,he/sheshallgetpermissionfromtheTeachingAffairsOfficeinadvance.

Whenthecontractends,PartyBshallleavewithin15days.Beforeleaving,PartyBshallreturnthebooksfromthelibrary,theexpertcertificateandallothersbelongingtoPartyA.

II.Salary,Termsandconditionsonotherremunerationsandbenefitsconcerned

Termsonotherremunerationsandbenefits

OtherremunerationsandbenefitsinthiscontractreferstoexpenditurescoveredbyPartyAforbasicmedical(accident)insurances,certificates(Residentpermitetc.)transactionandaccommodation.PartyAandPartyBherebyagreethat,oncePartyBenjoystheotherremunerationsandbenefits,itisdeemedthatPartyAhasperformeditspaymentobligationofthebasicmedical(accident)insurancesandresidentpermitspecifiedbyBureauofForeignExpertsAffairsofthePeople’sRepublicofChina.PartyAonlyneedstoassistPartyBbypurchasingallthebasicmedical(accident)insurancesandtransactingrequiredcertificates.AllcostswillbebornebyPartyB.

Termsonpaymentofsalaryandotherremunerationsandbenefits

PartyBshallbepaidbymonth(withthesumofhis/heryearlysalaryandremunerationsdividedby12),thatisanaveragemonthlypaymentofRMB8333(beforetax)foreachworkingmonthonthe10th-12thdayofthefollowingmonth.Ifthepaymentdatefallonastatutoryholidayorrestdayorunderotherspecialcircumstances,thesalaryshallbepaidthenextdayafterthat.

Ifthepaymentistobedelayedduetoforcemajeure,PartyAshallinformPartyBoftherescheduleddatebeforehand.

IfPartyBfailstofinishhisweeklyworkassignmentasstipulatedinthiscontract,his/hersalaryofthismonth(A)shouldbecalculatedinthefollowing
