OntheotherHand,作為合同乙方,Hereinaftercollectivelyreferredtoasthe “PARTIES”.甲方、乙方以下統(tǒng)稱 “合同雙方”。InaccordancewiththeLabourLaw,theProvisionsontheLabourAdministrationRegulationsforForeignInvestmentEnterprisesandotherrelevantlawsandregulationsofthePeople?sRepublicofChina,thePARTIEShaveconcludedthefollowinglabourcontract(hereinafterreferredtoasthe“CONTRAC”T)合同雙方依照《中華人民共和國(guó)勞動(dòng)法》、《外商投資企業(yè)勞動(dòng)管理規(guī)定》以及中華人民共和國(guó)其它相關(guān)法律法規(guī),共同約定以下勞動(dòng)合同 (以下簡(jiǎn)稱 “本合同”)。TheEMPLOYEEwillhavethefollowingposition:該員工將擔(dān)任以下職務(wù):XXXXXXThedutiesandresponsibilitiesoftheEMPLOYEEwillbe,butnotlimitedto:該員工的工作職責(zé)包括但不限于:XXXXXXXXXIfnecessaryduetothemanagementorganisationoftheCOMPANYandorthecompetenceandabilitiesoftheEMPLOYEEtheCOMPANYmayadjusttheposition,dutiesandresponsibilitiesoftheEMPLOYEE.若由于本公司管理編制的需要及/或由于該員工本人資格與能力的原因,本公司可在必要的情況下對(duì)該員工的職務(wù)和工若由于本公司管理編制的需要及作職責(zé)進(jìn)行適當(dāng)調(diào)整。ThetrialperiodwillstartonthedateofsignatureofthisCONTRACT.Thedurationofthetrialperiodisthree(3)months.DuringthetrialperiodtheEMPLOYEEwillbeboundbyallarticlesofthiscontract.試用期自本合同簽署之日起開始,時(shí)間為三個(gè)月。在試用期間,該員工受本合同全部條款所約束。AfterthespecifiedtrialperiodandifnonoticeofterminationisgiventheEMPLOYEEautomaticallybecomesemployedunderthetermsandconditionsofthisCONTRACT.在約定的試用期內(nèi),若該員工沒有收到關(guān)于解除勞動(dòng)關(guān)系的通知,在試用期滿后,該員工自動(dòng)轉(zhuǎn)為本公司正式員工,執(zhí)行本合同規(guī)定的條款。3.1ThedurationofthisCONTRACTistwenty-sixth(26)months.本合同期限為26個(gè)月。ThisCONTRACTmaybeextendeduponagreementofbothPARTIES.AnextensiontothisCONTRACTshallcomeintoforceonlyafterawrittenagreementhasbeensignedbybothPARTIES.本合同經(jīng)合同雙方同意后可以續(xù)簽。只有在合同雙方簽署書面協(xié)議后,續(xù)簽的合同方能生效。TheCOMPANYshalldefineitsownsalarypolicyinaccordancewithregulationsstipulatedbythestateandmunicipalgovernment.TheCOMPANYshallensurethatthemonthlysalaryoftheEMPLOYEEisnotlessthantheminimumpaystandardsetbythelocalgovernment.本公司將依照中華人民共和國(guó)和北京市有關(guān)政策法規(guī)制定本公司的員工工資標(biāo)準(zhǔn)。本公司保證該員工的月工資將不低于當(dāng)?shù)卣?guī)定的最低工資。TheEMPLOYEEwillreceiveagross口monthlyor口annualsalaryofXXXrenminbi(RMBXXX)andincreasethereafterthebasisofthestaffperformance,theeconomicdevelopmentoftheCOMPANYandaccordingtothesalarypolicyoftheCOMPANYapprovedbytheBoardofDirectorsoftheCOMPANY,andetc.該員工稅前工資將為口每月或口每年XXX元人民幣,今后將按照該員工的工作表現(xiàn)、本公司的經(jīng)濟(jì)效益以及由本公司制定并經(jīng)董事會(huì)批準(zhǔn)的工資標(biāo)準(zhǔn)每年遞增。SuchsalaryshallbetransferredtothebankaccountdesignatedbytheEMPLOYEEbetweenthethirdandfifthdayofeachmonth.上述工資將于每月3號(hào)至5號(hào)期間匯入該員工所指定的銀行賬戶。5.1AtthefulldiscretionoftheChiefExecutiveOfficerandbaseduponhis/hergeneralattitudeandtheresultofhis/herworkandfulfilmentofhis/herobjectivesdetailedwithhis/hermanagerandatthebeginningofeachcalendaryeartheEMPLOYEEwillbeentitledtoanannualbonusnotexceedingone(1)monthofsalaryandshallbepaidtotheEMPLOYEEforeachfullcalendaryearwhichtheEMPLOYEEworksfortheCOMPANYintwo(2)instalmentsthefollowingyear.經(jīng)本公司首席執(zhí)行官同意,并且根據(jù)該員工的工作態(tài)度、工作成果及其上級(jí)主管規(guī)定之工作目標(biāo)的完成狀況,該員工將有權(quán)在每個(gè)公歷年初享受年終獎(jiǎng)金(獎(jiǎng)金總額不超過該員工的月工資)。員工為公司工作滿一年時(shí),獎(jiǎng)金將于次年分兩次發(fā)放給個(gè)人。TheEMPLOYEEshallpayindividualincometaxinaccordancewiththerelevantlawsandregulationsofthePeople?sRepublicofChina.TheCOMPANYshallwithholdsuchamountandpayittothecompetenttaxbureau.該員工須按照中華人民共和國(guó)相關(guān)法律法規(guī)繳納個(gè)人所得稅。本公司將為該員工代扣代徼個(gè)人所得稅,并將應(yīng)納稅款上交相應(yīng)稅務(wù)機(jī)關(guān)。篇二:英文英語(yǔ)版本正式勞動(dòng)合同勞動(dòng)合同LaborContract甲方(用人單位):PartyA(employer):性質(zhì):有限責(zé)任公司Property:LimitedLiabilityCompany地址:Address:乙方PartyB(勞動(dòng)者 untilthetaskisfinished.二、工作內(nèi)容和義務(wù) JobContentandResponsibility1、乙方同意根據(jù)甲方工作需要,AccordingtoPartyA’sdemand,在部門,從事 (管理、銷售、技術(shù)、生產(chǎn)、后勤等)工作,并遵守崗位工作制度與合理的工作安排(包括但不限于工作內(nèi)容、工作地點(diǎn))。PartyBagreestoengagein (management/sales/technology/manufacture/logisticsetc.)workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.(Includedbutunlimitedtojobcontent&workingplace.)2、乙方應(yīng)當(dāng)按照甲方崗位職責(zé)要求,保質(zhì)保量完成工作任務(wù);AccordingtoPartyA’spostresponsibilityrequirement,PartyBshouldfinishworkingtaskwithqualityandquantityguaranteed.3、甲方本著“一專多能、一職多崗”的用人原則,可以根據(jù)經(jīng)營(yíng)需要及乙方的工作能力調(diào)整乙方的工作職務(wù)和崗位,乙方應(yīng)服從安排。Basedontheprincipleof“oneskillwithmultipleability,onepostwithmultiplework”,andaccordingtothebusinessdemandandPartyB’scompetence,PartyAmayadjustPartyB’sdutyandpost,whilePartyBshouldobeytheadjustment.三、勞動(dòng)保護(hù)和勞動(dòng)條件 LaborProtection&LaborCondition1、甲方根據(jù)國(guó)家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生的規(guī)定,為乙方提供必要的工作條件和勞動(dòng)保護(hù)設(shè)施,保障乙方的安全與健康;Accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestate,PartyAprovidesnecessaryworkingconditionandlaborprotectionfacilities,insuringPartyB’ssafetyandhealth.2、甲方根據(jù)國(guó)家有關(guān)規(guī)定制定工時(shí)制度,乙方確因生產(chǎn)經(jīng)營(yíng)需要延時(shí)的,甲方應(yīng)當(dāng)依法安排乙方補(bǔ)休或支付相應(yīng)的加班費(fèi);若乙方實(shí)行的是級(jí)別工資,則在當(dāng)月的績(jī)效考核中體現(xiàn);Accordingtotherelevantregulationsofworkinghoursystem,ifPartyBneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyAshallarrangepartyBcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;IfpartyBisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.3、甲方根據(jù)國(guó)家有關(guān)規(guī)定為孕期、產(chǎn)期、哺乳期的女職工提供勞動(dòng)保護(hù);PartyAshouldprovideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththerelevantprovisionsoftheState.4、甲方負(fù)責(zé)對(duì)乙方進(jìn)行政治思想、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動(dòng)安全衛(wèi)生及有關(guān)規(guī)章制度的告知、教育和培訓(xùn)。PartyAisresponsibletoprovidepoliticalideology,professionalethics,businesstechnology,laborsafetyandhygiene,andrelatedrules,educationandtrainingforPartyB.四、勞動(dòng)報(bào)酬Laborremuneration根據(jù)“按勞分配”原則,實(shí)行同工同酬,乙方的報(bào)酬不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。具體薪酬標(biāo)準(zhǔn)、支付方式以及支付時(shí)間按公司制定的《薪酬管理制度》執(zhí)行。Accordingtotheprincipleofdistribution,andequalpayforequalwork,remunerationofPartyBshallnotbelowerthanthelocalminimumwagestandard.Specificcompensationstandards,payment,andtimeissetbythe “thesystemofcompensationmanagement”bythecompany五、社會(huì)保險(xiǎn)SocialInsurance甲方應(yīng)按照國(guó)家有關(guān)社會(huì)保險(xiǎn)的法律、法規(guī)和政策為乙方繳納基本養(yǎng)老、基本醫(yī)療、失業(yè)、工傷、生育保險(xiǎn)費(fèi)用;社會(huì)保險(xiǎn)費(fèi)個(gè)人繳納部分,甲方從乙方工資中代扣代繳。Inaccordancewithnationallaws,regulationsandpoliciesrelatingtosocialinsurance,PartyAshallpaythebasicpension,basicmedical,unemployment,workinjuryandmaternityinsurancecosts,forthePartyB;socialinsurancepremiumspaidbyindividualspartiswithholdwagesfromPartyB.六、勞動(dòng)紀(jì)律和規(guī)章制度 Labordisciplineandregulations1、甲方依法制定的勞動(dòng)紀(jì)律和規(guī)章制度,乙方有義務(wù)遵守;LabordisciplineandregulationslegallystipulatedbypartyA,partyBshallhavethedutytoabidebyit.2、簽訂本合同前,甲方已對(duì)乙方進(jìn)行了勞動(dòng)紀(jì)律、操作規(guī)程、管理制度等相應(yīng)的培訓(xùn);Beforesigningthiscontract,PartyAhastoprovidepartyBthelabordiscipline,operatingprocedures,managementsystemandthecorrespondingtraining乙方應(yīng)當(dāng)遵守甲方的工作操作規(guī)程,服從工作安排;PartyBshallabidebytheworkingprocedures,obeytheworkarrangementofpartyA.4、乙方違反勞動(dòng)紀(jì)律或規(guī)章制度,甲方有權(quán)按本單位的規(guī)章制度,給予紀(jì)律處分,直至解除本合同。IfPartyBviolateslabordisciplineorregulations,PartyAisentitledbytherulesoftheunittogivePartyAdisciplinaryaction,uptoterminatethiscontract.七、勞動(dòng)合同的變更 Thechangeoflaborcontract訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無(wú)法繼續(xù)履行的,經(jīng)雙方協(xié)商同意,予以變更勞動(dòng)合同相關(guān)內(nèi)容。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,bymutualconsent,relatedcontentinlaborcontractsshallbechanged.八、勞動(dòng)合同的解除 Theremoveoflaborcontract雙方協(xié)商一致,勞動(dòng)合同可以解除。Thetwopartymayterminatethelaborcontractwithmutualagreement.乙方有下列情形之一的,甲方可以即行解除勞動(dòng)合同:Ofanyofthefollowingcircumstances,partyAmayimmediatelyterminatethelaborcontract.在試用期內(nèi)被證明不符合錄用條件的;Beenprovennottomeettheconditionsofemploymentduringthetrialperiod.2、采取欺詐手段訂立本合同的; Adoptedfraudulentmeanstoenterintothiscontract.3、嚴(yán)重違反勞動(dòng)紀(jì)律或規(guī)章制度給甲方造成重大損害的;SeriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothePartyA.4、嚴(yán)重失職、營(yíng)私舞弊,或泄露甲方商業(yè)秘密,給甲方利益造成重大損失的;Grossnegligence,malpractice,ordisclosureoftradesecretsPartyA,tocauseheavylossestotheinterestsofthePartyA.5、乙方同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完成本單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)用人單位提出,拒不改正的;PartyAbuiltlaborrelationshipswithotherunit,tocauseaseriousimpactonthecompletionofthetasksoftheunit,orrefusedtocorrecttherulesmadebytheemployer6、被依法追究刑事責(zé)任的。Beinvestigatedforcriminalresponsibilityaccordingtolaw(三)有下列情形之一的,甲方可以提前30日以書面形式通知乙方解除勞動(dòng)合同:Ofthefollowingcircumstances,PartyAcangivenoticetoinformPartyBtoterminatethelaborcontractaheadof30days.1、乙方不能勝任工作,經(jīng)培訓(xùn)或調(diào)整工作崗位仍不能勝任工作的;PartyBisnotcompetentforwork,aftertrainingoradjustmentofjobs.2、乙方患病或者非因工負(fù)傷,醫(yī)療期滿后,不能從事原工作,也不能從事甲方另行安排工作的;PartyBwasillorinjuredduetonon-workrelation,aftercompletionofmedical,PartAisnotcompetentforhisoriginalwork,oralternativearrangedjobs.3、勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行,雙方協(xié)商不能就變更勞動(dòng)合同達(dá)成協(xié)議的。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,mutualconsentcannotbereached,inchangeofthislaborcontracts.(四)有下列情形之一的,甲方可以提前 30日通知工會(huì),經(jīng)工會(huì)同意后,與乙方解除勞動(dòng)合同: Ofthefollowingcircumstances,PartyAcangivenoticeaheadof30days,toinformtheLaborUnion,afteragreement,PartyAmayterminatethelaborcontract.1、甲方依照企業(yè)破產(chǎn)法規(guī)定進(jìn)行重整的;PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw2、甲方生產(chǎn)經(jīng)營(yíng)發(fā)生嚴(yán)重困難的; ProductionandbusinessoperationofPartyAmetseriousdifficulties.3、甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營(yíng)方式調(diào)整,經(jīng)變更勞動(dòng)合同后,仍需裁減人員的;production,technologicalinnovationorbusinessmethodofPartyAadjusted,afterthechangeoflaborcontracts,stillneededtoreducestaff.4、其他因勞動(dòng)合同訂立時(shí)依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行的。Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.(五)乙方有下列情形之一的,甲方不得解除勞動(dòng)合同:Ofanyofthefollowingcircumstances,partyAcannotterminatethelaborcontract.1、在本單位患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者部分喪失勞動(dòng)能力的;Injuredduetooccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.2、患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期內(nèi)的; Illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.3、女職工在孕期、產(chǎn)期、哺乳期的;womenworkersinpregnancy,childbirth,breastfeeding.4、在本單位連續(xù)工作滿十五年,且距法定退休年齡不足五年的;Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.5、法律、行政法規(guī)規(guī)定的其他情形。 Othercircumstancesstipulatedbylawsandadministrativeregulations.(六)乙方解除勞動(dòng)合同,應(yīng)當(dāng)提前三十日(試用期內(nèi)提前三日)以書面形式通知甲方,甲方在乙方完成業(yè)務(wù)以及清理完債權(quán)債務(wù)的情況下,可以解除勞動(dòng)合同。Ofthefollowingcircumstances,PartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.(七)有下列情形之一的,乙方可以通知甲方解除勞動(dòng)合同:Ofthefollowingcircumstances,PartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.1、在試用期內(nèi)的; Duringthetrialperiod.2、甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的;PartyAforcedPartyAtolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按勞動(dòng)合同約定提供勞動(dòng)保護(hù)和勞動(dòng)條件的;PartyAfailedtoprovidethelaborprotectionandlaborconditions.4、甲方未按照勞動(dòng)合同的約定支付工資報(bào)酬的; PartyAfailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法規(guī)規(guī)定勞動(dòng)者可以解除勞動(dòng)合同的其他情形。Othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、勞動(dòng)合同的終止 Terminationoflaborcontracts(一)有下列情形之一的,勞動(dòng)合同即行終止:Ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、勞動(dòng)合同期滿的; Thelaborcontractexpired.2、勞動(dòng)者開始依法享受養(yǎng)老保險(xiǎn)待遇的; Workersbegantoenjoyendowmentinsurancetreatmentlawfully.3、勞動(dòng)者死亡,或者被人民法院宣告死亡或者宣告失蹤的;Laborerdied,orwasdeclareddeadormissingbythepeoplescourt.4、甲方被依法宣告破產(chǎn)的; PartyAwasdeclaredbankruptbythepeoplescourt5、甲方被吊銷營(yíng)業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者提前解散的;BusinesslicenseofPartyBwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法規(guī)規(guī)定的其他情形。 Othercircumstancesstipulatedbylaws,administrativeregulations.(二)乙方應(yīng)在勞動(dòng)合同期滿前
