4.甲方如因業(yè)務(wù)拓展變化需要對乙方的工作崗位及工作區(qū)域進(jìn)行調(diào)整，乙方應(yīng)當(dāng)接受。如因甲方公司業(yè)務(wù)擴(kuò)展需要或公司合并分立等變更，乙方同意按照法律規(guī)定延續(xù)此合同，并接受甲方安排，在____(某地區(qū))工作。

三、工資Salary

乙方每月的基本工資：RMB績效工資：RMB綜合福利金：RMB，工資總額為RMB元(該金額尚未扣除稅金、住房費用以及社會保險中個人應(yīng)繳的部份)，另甲方予以乙方工資總額7%的住房公積金(如法律規(guī)定住房公積金繳交基數(shù)有上限，則依照法規(guī)執(zhí)行)。試用期滿，經(jīng)考核后,根據(jù)考核結(jié)果確定是否正式錄用，正式錄用后薪金保持不變。甲方將視公司的盈利情況和乙方的考核結(jié)果，于每年的三月份進(jìn)行薪金調(diào)整。

四、工資的發(fā)放Payment

五、超時工作OverTime

乙方應(yīng)致力于提高工作效率，按時完成生產(chǎn)、工作任務(wù)。如因特殊情況需要加班，可自行安排。如乙方希望通過自行安排加班取得加班費，則乙方必須在加班前四小時填寫加班申請表呈總經(jīng)理審批。否則，視為無效加班，詳見《員工手冊》。

六、加班費OTCompensation

乙方經(jīng)甲方批準(zhǔn)在工作日加班，甲方必須支付給乙方基本工資150%的報酬;休息日被安排工作而甲方又不能夠給予乙方同等時間的補(bǔ)休，則甲方須支付給乙方基本工資200%的報酬;若在國家法定休假日被安排工作,甲方付給乙方基本工資300%的報酬。

七、假期與福利Holiday&Benefits

八、勞動紀(jì)律Discipline

乙方應(yīng)嚴(yán)格遵守甲方制定的各項規(guī)章制度和勞動紀(jì)律(詳請請參照《員工手冊》執(zhí)行)

PartyBshallstrictlyobeyPartyA’regulationsanddiscipline.PleaserefertoPartyAsemployeemanual.

九、保密協(xié)議Confidentiality

乙方需嚴(yán)格保守工作過程中接觸和了解到的公司商業(yè)秘密(包括生產(chǎn)技巧、工藝流程、技術(shù)秘密、管理方法、產(chǎn)銷策略、貨源情報、設(shè)計圖紙、成本價格和客戶資料)，否則將受到行政處罰(如無條件解雇、賠償?shù)?;觸犯刑法的，甲方將有權(quán)移交司法機(jī)關(guān)處理。乙方調(diào)離甲方，應(yīng)得到甲方同意，并將所有商業(yè)秘密資料移交甲方，同時承擔(dān)不向外泄露的義務(wù)，并保證半年內(nèi)不得利用甲方商業(yè)秘密在生產(chǎn)同類且與甲方有競爭關(guān)系的產(chǎn)品的其他企業(yè)內(nèi)任職。否則，甲方有權(quán)要求乙方賠償因此而帶來的一切經(jīng)濟(jì)損失。

十、合同終止Termination

1.終止本合同條件Terminationconditions

A.試用期間，雙方皆可即時通知對方解除本合同;

Duringtheprobationperiod,eithersidecanterminatethecontractbyimmediateeffect.

B.試用期滿后，任何一方欲解除合同，須提前三十日以書面形式通知對方。否則，違約方須向守約方支付違約金(違約金為乙方一個月的工資)，若造成守約方經(jīng)濟(jì)損失的，應(yīng)依法承擔(dān)賠償責(zé)任。

A.乙方在試用期間達(dá)不到甲方的要求;PartyB’sperformancecan’tmeetPartyA’srequirement.

3.乙方在下列情況下終止本合同不需向甲方補(bǔ)償

A.被非法限制人身自由的手段強(qiáng)迫勞動的;

PartyBisforcedtoworkbyillegalmeans.

B.未按本合同約定支付勞動報酬或勞動條件的;

PartyBcannotgetthesalaryorworkingconditionswhichagreedinthecontract.

十一、甲、乙雙方須共同遵守國家有關(guān)法規(guī)以及甲方《員工手冊》的有關(guān)規(guī)定。

十二、本合同自甲方蓋章、乙方簽署之日起生效。

四、勞動報酬

五、社會保險及其他保險福利待遇

SocialWelfareandBenefits

第八條甲方按國家和地方政策規(guī)定為乙方辦理社會保險有關(guān)手續(xù)，并承擔(dān)相應(yīng)的義務(wù)。Article8:PartyAshalldealwiththerelevantformalitiesofsocialsecurityforPartyBaccordingtothecountryandlocalpoliciesandtakeuptherelevantliabilities.

第九條乙方患職業(yè)病或因工負(fù)傷后的工資和醫(yī)療補(bǔ)助執(zhí)行按照國家和地方的有關(guān)法律法規(guī)執(zhí)行。Article9:ThesalaryandMedicarebenefitsofPartyBincaseofoccupationaldiseasesorwork-relatedinjuriesshallbepaidinaccordancewiththerelevantnationalanlocallawsandregulations.

第十條乙方患職業(yè)病或因工負(fù)傷的待遇按國家的有關(guān)規(guī)定執(zhí)行。

六、勞動保護(hù)、勞動條件和職業(yè)危害防護(hù)

Laborprotection,laborconditionandoccupationalharmpreventionandcure

第十一條甲方根據(jù)生產(chǎn)崗位的需要，按照國家有關(guān)勞動安全、衛(wèi)生的規(guī)定為乙方配備必要的安全防護(hù)措施，發(fā)放必要的勞動保護(hù)用品。Article11:PartyAshallequipPartyBwiththenecessarysafetyprotectionmeasuresandissuethenecessarylaborprotectionarticlesaccordingtotheneedsofthepostandtherulesofthelaborsafetyandhygiene.

第十二條甲方應(yīng)當(dāng)建立、健全職業(yè)病防治責(zé)任制度，加強(qiáng)對職業(yè)病防治的管理，提高職業(yè)病防治水平。

Article12:PartyAshallsetupandoptimizetheoccupationaldiseasecureresponsibilitysystem,enforcethemanagementovertheoccupationaldiseaseandpromotethecureleveloftheoccupationaldisease.

七、勞動合同的解除、終止和經(jīng)濟(jì)補(bǔ)償

第十三條甲乙雙方解除、變更、終止、續(xù)訂勞動合同應(yīng)當(dāng)依照《勞動合同法》和國家及省、市等有關(guān)規(guī)定執(zhí)行。

Article13:Ifthepartiesrevoke,modify,terminateandextentthelaborcontract,theyshallperformthemaccordingtotherelevantrulesoftheLaborContractLawandthecountry,provinceandcityetc.

第十四條甲方應(yīng)在解除或者終止勞動合同時，為乙方出具解除或者終止勞動合同的證明，并在15日內(nèi)為勞動者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具解除或者終止勞動合同的證明后10日內(nèi)辦理工作移交，如涉及經(jīng)濟(jì)補(bǔ)償?shù)陌磭矣嘘P(guān)規(guī)定在辦結(jié)工作交接時支付。

八、勞動爭議處理

LaborDisputeResolutions

第十五條雙方發(fā)生爭議，任何一方當(dāng)事人可向甲方所在地的勞動爭議仲裁委員會申訴，由仲裁委員會依法調(diào)解或裁決。如對仲裁不服，向甲方所在地人民法院起訴，一方當(dāng)事人期滿不起訴但又不執(zhí)行裁決的，另方當(dāng)事人可向人民法院申請強(qiáng)制執(zhí)行。

Article17：Affairsunmentionedinthiscontractshallbeexecutedaccordingtopresentlaws,statutesandregulationsofthestate.Incaseanycontradictionarisesbetweenthearticlesofthiscontractandlaws,statutesorpoliciesofthestate,thelattershallbereferredtoasfinal.

第十八條本合同一式兩份，甲乙雙方各執(zhí)一份，經(jīng)甲乙雙方簽字蓋章后生效。

五、保證金deposit

六、甲方義務(wù)obligationsofpartya

1.甲方須按時將房屋及附屬設(shè)施（詳見附件）交付乙方使用。

2.房屋設(shè)施如因質(zhì)量原因、自然損耗或災(zāi)害而受到損壞，甲方有修繕并承擔(dān)相關(guān)費用的責(zé)任。

3.甲方應(yīng)確保出租的房屋享有出租的權(quán)利，反之如乙方權(quán)益因此遭受損害，甲方應(yīng)負(fù)賠償責(zé)任。

七、乙方義務(wù)obligationsofpartyb

1.乙方應(yīng)按合同的規(guī)定按時支付定金、租金及保證金。

八、合同終止及解除的規(guī)定terminationanddissolutionofthecontract

1.乙方在租賃期滿后如需退租或續(xù)租，應(yīng)提前兩個月通知甲方，由雙方另行協(xié)商退租或續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。

九、違約及處理breachofthecontract

1.甲、乙雙方任何一方在未征得對方諒解的情況下，不履行本合同規(guī)定條款，導(dǎo)致本合同中途中止，則視為該方違約，雙方同意違約金為人民幣___________元整，若違約金不足彌補(bǔ)無過錯方之損失，則違約方還需就不足部分支付賠償金。

6.WorkingProtection&WorkingConditions

a.TheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.

b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.

c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.

7.LabourDiscipline

a.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,the

EmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;

b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.

c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretforthe

EmployerduringtheperiodofthisContract;Thisobligationofconfidentialityshallsurvivethe

terminationofthisContractforaperiodoftwo(2)years.

8.Termination,Modification,RenewandDischargeoftheContract

a.TherelevantclausesoftheContractmaybemodifiedbytheparties:
