PREAMBLETHESTATESPARTIESTOTHISCONVENTION,HAVINGRECOGNIZEDthedesirabilityofdeterminingbyagreementcertainrulesrelatingtothecarriageofgoodsbysea,HAVINGDECIDEDtoconcludeaconventionforthispurposeandhavetheretoagreedasfollows:PARTI.Article1.DefinitionsInthisConvention:1."Carrier"meansanypersonbywhomorinwhosenameacontractofcarriageofgoodsbyseahasbeenconcludedwithashipper.2."Actualcarrier"meansanypersontowhomtheperformanceofthecarriageofthegoods,orofpartofthecarriage,hasbeenentrustedbythecarrier,andincludesanyotherpersontowhomsuchperformancehasbeenentrusted.3."Shipper"meansanypersonbywhomorinwhosenameoronwhosebehalfacontractofcarriageofgoodsbyseahasbeenconcludedwithacarrier,oranypersonbywhomorinwhosenameoronwhosebehalfthegoodsareactuallydeliveredtothecarrierinrelationtothecontractofcarriagebysea.4."Consignee"meansthepersonentitledtotakedeliveryofthegoods.5."Goods"includesliveanimals;wherethegoodsareconsolidatedinacontainer,palletorsimilararticleoftransportorwheretheyarepacked,goodsincludessucharticleoftransportorpackagingifsuppliedbytheshipper.6."Contractofcarriagebysea"meansanycontractwherebythecarrierundertakesagainstpaymentoffreighttocarrygoodsbyseafromoneporttoanother;however,acontractwhichinvolvescarriagebyseaandalsocarriagebysomeothermeansisdeemedtobeacontractofcarriagebyseaforthepurposesofthisConventiononlyinsofarasitrelatestothecarriagebysea.7."Billoflading"meansadocumentwhichevidencesacontractofcarriagebyseaandthetakingoverorloadingofthegoodsbythecarrier,andbywhichthecarrierundertakestodeliverthegoodsagainstsurrenderofthedocument.Aprovisioninthedocumentthatthegoodsaretobedeliveredtotheorderofanamedperson,ortoorder,ortobearer,constitutessuchanundertaking.8."Writing"includes,interalia,telegramandtelex.Article2.Scopeofapplication1.TheprovisionsofthisConventionareapplicabletoallcontractsofcarriagebyseabetweentwodifferentStates,if:(a)theportofloadingasprovidedforinthecontractofcarriagebyseaislocatedinaContracting(b)theportofdischargeasprovidedforinthecontractofcarriagebyseaislocatedinaContracting(c)oneoftheoptionalportsofdischargeprovidedforinthecontractofcarriagebyseaistheactualportofdischargeandsuchportislocatedinaContracting(d)thebillofladingorotherdocumentevidencingthecontractofcarriagebyseaisissuedinaContracting(e)thebillofladingorotherdocumentevidencingthecontractofcarriagebyseaprovidesthattheprovisionsofthisConventionorthelegislationofanyStategivingeffecttothemaretogovernthecontract.2.TheprovisionsofthisConventionareapplicablewithoutregardtothenationalityoftheship,thecarrier,theactualcarrier,theshipper,theconsigneeoranyotherinterestedperson.3.TheprovisionsofthisConventionarenotapplicabletocharter-parties.However,whereabillofladingisissuedpursuanttoacharter-party,theprovisionsoftheConventionapplytosuchabillofladingifitgovernstherelationbetweenthecarrierandtheholderofthebilloflading,notbeingthecharterer.4.Ifacontractprovidesforfuturecarriageofgoodsinaseriesofshipmentsduringanagreedperiod,theprovisionsofthisConventionapplytoeachshipment.However,whereashipmentismadeunderacharter-party,theprovisionsofparagraph3ofthisarticleapply.Article3.InterpretationoftheConventionIntheinterpretationandapplicationoftheprovisionsofthisConventionregardshallbehadtoitsinternationalcharacterandtotheneedtopromoteuniformity.PARTII.LIABILITYOFTHECARRIERArticle4.Periodofresponsibility1.TheresponsibilityofthecarrierforthegoodsunderthisConventioncoverstheperiodduringwhichthecarrierisinchargeofthegoodsattheportofloading,duringthecarriageandattheportofdischarge.2.Forthepurposeofparagraph1ofthisarticle,thecarrierisdeemedtobeinchargeofthegoods(a)fromthetimehehastakenoverthegoodsfrom:(i)theshipper,orapersonactingonhisbehalf;or
(ii)anauthorityorotherthirdpartytowhom,pursuanttolaworregulationsapplicableattheportofloading,thegoodsmustbehandedoverforshipment;
(b)untilthetimehehasdeliveredthegoods:(i)byhandingoverthegoodstotheconsignee;or(ii)incaseswheretheconsigneedoesnotreceivethegoodsfromthecarrier,byplacingthematthedisposaloftheconsigneeinaccordancewiththecontractorwiththelaworwiththeusageoftheparticulartrade,applicableattheportofdischarge;or(iii)byhandingoverthegoodstoanauthorityorotherthirdpartytowhom,pursuanttolaworregulationsapplicableattheportofdischarge,thegoodsmustbehandedover.3.Inparagraphs1and2ofthisarticle,referencetothecarrierortotheconsigneemeans,inadditiontothecarrierortheconsignee,theservantsoragents,respectivelyofthecarrierortheconsignee.Article5.Basisofliability1.Thecarrierisliableforlossresultingfromlossofordamagetothegoods,aswellasfromdelayindelivery,iftheoccurrencewhichcausedtheloss,damageordelaytookplacewhilethegoodswereinhischargeasdefinedinarticle4,unlessthecarrierprovesthathe,hisservantsoragentstookallmeasuresthatcouldreasonablyberequiredtoavoidtheoccurrenceanditsconsequences.2.Delayindeliveryoccurswhenthegoodshavenotbeendeliveredattheportofdischargeprovidedforinthecontractofcarriagebyseawithinthetimeexpresslyagreeduponor,intheabsenceofsuchagreement,withinthetimewhichitwouldbereasonabletorequireofadiligentcarrier,havingregardtothecircumstancesofthecase.3.Thepersonentitledtomakeaclaimforthelossofgoodsmaytreatthegoodsaslostiftheyhavenotbeendeliveredasrequiredbyarticle4within60consecutivedaysfollowingtheexpiryofthetimefordeliveryaccordingtoparagraph2ofthisarticle.4.(a)Thecarrierisliable(i)forlossofordamagetothegoodsordelayindeliverycausedbyfire,iftheclaimantprovesthatthefirearosefromfaultorneglectonthepartofthecarrier,hisservantsoragents;(ii)forsuchloss,damageordelayindeliverywhichisprovedbytheclaimanttohaveresultedfromthefaultorneglectofthecarrier,hisservantsoragentsintakingallmeasuresthatcouldreasonablyberequiredtoputoutthefireandavoidormitigateitsconsequences.(b)Incaseoffireonboardtheshipaffectingthegoods,iftheclaimantorthecarriersodesires,asurveyinaccordancewithshippingpracticesmustbeheldintothecauseandcircumstancesofthefire,andacopyofthesurveyorsreportshallbemadeavailableondemandtothecarrierandtheclaimant.5.Withrespecttoliveanimals,thecarrierisnotliableforloss,damageordelayindeliveryresultingfromanyspecialrisksinherentinthatkindofcarriage.Ifthecarrierprovesthathehascompliedwithanyspecialinstructionsgiventohimbytheshipperrespectingtheanimalsandthat,inthecircumstancesofthecase,theloss,damageordelayindeliverycouldbeattributedtosuchrisks,itispresumedthattheloss,damageordelayindeliverywassocaused,unlessthereisproofthatallorapartoftheloss,damageordelayindeliveryresultedfromfaultorneglectonthepartofthecarrier,hisservantsoragents.6.Thecarrierisnotliable,exceptingeneralaverage,whereloss,damageordelayindeliveryresultedfrommeasurestosavelifeorfromreasonablemeasurestosavepropertyatsea.7.Wherefaultorneglectonthepartofthecarrier,hisservantsoragentscombineswithanothercausetoproduceloss,damageordelayindelivery,thecarrierisliableonlytotheextentthattheloss,damageordelayindeliveryisattributabletosuchfaultorneglect,providedthatthecarrierprovestheamountoftheloss,damageordelayindeliverynotattributablethereto.Article6.Limitsofliability1.(a)Theliabilityofthecarrierforlossresultingfromlossofordamagetogoodsaccordingtotheprovisionsofarticle5islimitedtoanamountequivalentto835unitsofaccountperpackageorothershippingunitor2.5unitsofaccountperkilogramofgrossweightofthegoodslostordamaged,whicheveristhehigher.(b)Theliabilityofthecarrierfordelayindeliveryaccordingtotheprovisionsofarticle5islimitedtoanamountequivalenttotwoandahalftimesthefreightpayableforthegoodsdelayed,butnotexceedingthetotalfreightpayableunderthecontractofcarriageofgoodsbysea.(c)Innocaseshalltheaggregateliabilityofthecarrier,underbothsubparagraphs(a)and(b)ofthisparagraph,exceedthelimitationwhichwouldbeestablishedundersubparagraph(a)ofthisparagraphfortotallossofthegoodswithrespecttowhichsuchliabilitywasincurred.2.Forthepurposeofcalculatingwhichamountisthehigherinaccordancewithparagraph1(a)ofthisarticle,thefollowingrulesapply:(a)Whereacontainer,palletorsimilararticleoftransportisusedtoconsolidategoods,thepackageorothershippingunitsenumeratedinthebilloflading,ifissued,orotherwiseinanyotherdocumentevidencingthecontractofcarriagebysea,aspackedinsucharticleoftransportaredeemedpackagesorshippingunits.Exceptasaforesaidthegoodsinsucharticleoftransportaredeemedoneshippingunit.(b)Incaseswherethearticleoftransportitselfhasbeenlostordamaged,thatarticleoftransport,ifnotownedorotherwisesuppliedbythecarrier,isconsideredoneseparateshippingunit.3.Unitofaccountmeanstheunitofaccountmentionedinarticle26.4.Byagreementbetweenthecarrierandtheshipper,limitsofliabilityexceedingthoseprovidedforinparagraph1maybefixed.Article7.Applicationtonon-contractualclaims1.ThedefencesandlimitsofliabilityprovidedforinthisConventionapplyinanyactionagainstthecarrierinrespectoflossofordamagetothegoodscoveredbythecontractofcarriagebysea,aswellasofdelayindeliverywhethertheactionisfoundedincontract,intortorotherwise.2.Ifsuchanactionisbroughtagainstaservantoragentofthecarrier,suchservantoragent,ifheprovesthatheactedwithinthescopeofhisemployment,isentitledtoavailhimselfofthedefencesandlimitsofliabilitywhichthecarrierisentitledtoinvokeunderthisConvention.3.Exceptasprovidedinarticle8,theaggregateoftheamountsrecoverablefromthecarrierandfromanypersonsreferredtoinparagraph2ofthisarticleshallnotexceedthelimitsofliabilityprovidedforinthisConvention.Article8.Lossofrighttolimitresponsibility1.Thecarrierisnotentitledtothebenefitofthelimitationofliabilityprovidedforinarticle6ifitisprovedthattheloss,damageordelayindeliveryresultedfromanactoromissionofthecarrierdonewiththeintenttocausesuchloss,damageordelay,orrecklesslyandwithknowledgethatsuchloss,damageordelaywouldprobablyresult.2.Notwithstandingtheprovisionsofparagraph2ofarticle7,aservantoragentofthecarrierisnotentitledtothebenefitofthelimitationofliabilityprovidedforinarticle6ifitisprovedthattheloss,damageordelayindeliveryresultedfromanactoromissionofsuchservantoragent,donewiththeintenttocausesuchloss,damageordelay,orrecklesslyandwithknowledgethatsuchloss,damageordelaywouldprobablyresult.Article9.Deckcargo1.Thecarrierisentitledtocarrythegoodsondeckonlyifsuchcarriageisinaccordancewithanagreementwiththeshipperorwiththeusageoftheparticulartradeorisrequiredbystatutoryrulesorregulations.2.Ifthecarrierandtheshipperhaveagreedthatthegoodsshallormaybecarriedondeck,thecarriermustinsertinthebillofladingorotherdocumentevidencingthecontractofcarriagebyseaastatementtothateffect.Intheabsenceofsuchastatementthecarrierhastheburdenofprovingthatanagreementforcarriageondeckhasbeenenteredinto;however,thecarrierisnotentitledtoinvokesuchanagreementagainstathirdparty,includingaconsignee,whohasacquiredthebillofladingingoodfaith.3.Wherethegoodshavebeencarriedondeckcontrarytotheprovisionsofparagraph1ofthisarticleorwherethecarriermaynotunderparagraph2ofthisarticleinvokeanagreementforcarriageondeck,thecarrier,notwithstandingtheprovisionsofparagraph1ofarticle5,isliableforlossofordamagetothegoods,aswellasfordelayindelivery,resultingsolelyfromthecarriageondeck,andtheextentofhisliabilityistobedeterminedinaccordancewiththeprovisionsofarticle6orarticle8ofthisConvention,asthecasemaybe.4.Carriageofgoodsondeckcontrarytoexpressagreementforcarriageunderdeckisdeemedtobeanactoromissionofthecarrierwithinthemeaningofarticle8.Article10.Liabilityofthecarrierandactualcarrier1.Wheretheperformanceofthecarriageorpartthereofhasbeenentrustedtoanactualcarrier,whetherornotinpursuanceofalibertyunderthecontractofcarriagebyseatodoso,thecarrierneverthelessremainsresponsiblefortheentirecarriageaccordingtotheprovisionsofthisConvention.Thecarrierisresponsible,inrelationtothecarriageperformedbytheactualcarrier,fortheactsandomissionsoftheactualcarrierandofhisservantsandagentsactingwithinthescopeoftheiremployment.2.AlltheprovisionsofthisConventiongoverningtheresponsibilityofthecarrieralsoapplytotheresponsibilityoftheactualcarrierforthecarriageperformedbyhim.Theprovisionsofparagraphs2and3ofarticle7andofparagraph2ofarticle8applyifanactionisbroughtagainstaservantoragentoftheactualcarrier.3.AnyspecialagreementunderwhichthecarrierassumesobligationsnotimposedbythisConventionorwaivesrightsconferredbythisConventionaffectstheactualcarrieronlyifagreedtobyhimexpresslyandinwriting.Whetherornottheactualcarrierhassoagreed,thecarrierneverthelessremainsboundbytheobligationsorwaiversresultingfromsuchspecialagreement.4.Whereandtotheextentthatboththecarrierandtheactualcarrierareliable,theirliabilityisjointandseveral.5.Theaggregateoftheamountsrecoverablefromthecarrier,theactualcarrierandtheirservantsandagentsshallnotexceedthelimitsofliabilityprovidedforinthisConvention.6.Nothinginthisarticleshallprejudiceanyrightofrecourseasbetweenthecarrierandtheactualcarrier.Article11.Throughcarriage1.Notwithstandingtheprovisionsofparagraph1ofarticle10,whereacontractofcarriagebyseaprovidesexplicitlythataspecifiedpartofthecarriagecoveredbythesaidcontractistobeperformedbyanamedpersonotherthanthecarrier,thecontractmayalsoprovidethatthecarrierisnotliableforloss,damageordelayindeliverycausedbyanoccurrencewhichtakesplacewhilethegoodsareinthechargeoftheactualcarrierduringsuchpartofthecarriage.Nevertheless,anystipulationlimitingorexcludingsuchliabilityiswithouteffectifnojudicialproceedingscanbeinstitutedagainsttheactualcarrierinacourtcompetentunderparagraph1or2ofarticle21.Theburdenofprovingthatanyloss,damageordelayindeliveryhasbeencausedbysuchanoccurrencerestsuponthecarrier.2.Theactualcarrierisresponsibleinaccordancewiththeprovisionsofparagraph2ofarticle10forloss,damageordelayindeliverycausedbyanoccurrencewhichtakesplacewhilethegoodsareinhischarge.PARTIII.LIABILITYOFTHESHIPPERSArticle12.GeneralruleTheshipperisnotliableforlosssustainedbythecarrierortheactualcarrier,orfordamagesustainedbytheship,unlesssuchlossordamagewascausedbythefaultorneglectoftheshipper,hisservantsoragents.Norisanyservantoragentoftheshipperliableforsuchlossordamageunlessthelossordamagewascausedbyfaultorneglectonhispart.Article13.Specialrulesondangerousgoods1.Theshippermustmarkorlabelinasuitablemannerdangerousgoodsasdangerous.2.Wheretheshipperhandsoverdangerousgoodstothecarrieroranactualcarrier,asthecasemaybe,theshippermustinformhimofthedangerouscharacterofthegoodsand,ifnecessary,oftheprecautionstobetaken.Iftheshipperfailstodosoandsuchcarrieroractualcarrierdoesnototherwisehaveknowledgeoftheirdangerouscharacter:(a)theshipperisliabletothecarrierandanyactualcarrierforthelossresultingfromtheshipmentofsuchgoods,and(b)thegoodsmayatanytimebeunloaded,destroyedorrenderedinnocuous,asthecircumstancesmayrequire,withoutpaymentofcompensation.3.Theprovisionsofparagraph2ofthisarticlemaynotbeinvokedbyanypersonifduringthecarriagehehastakenthegoodsinhischargewithknowledgeoftheirdangerouscharacter.4.If,incaseswheretheprovisionsofparagraph2,subparagraph(b),ofthisarticledonotapplyormaynotbeinvoked,dangerousgoodsbecomeanactualdangertolifeorproperty,theymaybeunloaded,destroyedorrenderedinnocuous,asthecircumstancesmayrequire,withoutpaymentofcompensationexceptwherethereisanobligationtocontributeingeneralaverageorwherethecarrierisliableinaccordancewiththeprovisionsofarticle5.PARTIV.TRANSPORTDOCUMENTSArticle14.Issueofbilloflading1.Whenthecarrierortheactualcarriertakesthegoodsinhischarge,thecarriermust,ondemandoftheshipper,issuetotheshipperabilloflading.2.Thebillofladingmaybesignedbyapersonhavingauthorityfromthecarrier.Abillofladingsignedbythemasteroftheshipcarryingthegoodsisdeemedtohavebeensignedonbehalfofthecarrier.3.Thesignatureonthebillofladingmaybeinhandwriting,printedinfacsimile,perforated,stamped,insymbols,ormadebyanyothermechanicalorelectronicmeans,ifnotinconsistentwiththelawofthecountrywherethebillofladingisissued.Article15.Contentsofbilloflading1.Thebillofladingmustinclude,interalia,thefollowingparticulars:(a)thegeneralnatureofthegoods,theleadingmarksnecessaryforidentificationofthegoods,anexpressstatement,ifapplicable,astothedangerouscharacterofthegoods,thenumberofpackagesorpieces,andtheweightofthegoodsortheirquantityotherwiseexpressed,allsuchparticularsasfurnishedbytheshipper;(b)theapparentconditionofthegoods;(c)thenameandprincipalplaceofbusinessofthecarrier;(d)thenameoftheshipper;(e)theconsigneeifnamedbytheshipper;(f)theportofloadingunderthecontractofcarriagebyseaandthedateonwhichthegoodsweretakenoverbythecarrierattheportofloading;(g)theportofdischargeunderthecontractofcarriagebysea;(h)thenumberoforiginalsofthebilloflading,ifmorethanone;(i)theplaceofissuanceofthebilloflading;(j)thesignatureofthecarrierorapersonactingonhisbehalf;(k)thefreighttotheextentpayablebytheconsigneeorotherindicationthatfreightispayablebyhim;(l)thestatementreferredtoinparagraph3ofarticle23;(m)thestatement,ifapplicable,thatthegoodsshallormaybecarriedondeck;(n)thedateortheperiodofdeliveryofthegoodsattheportofdischargeifexpresslyagreeduponbetweentheparties;and(o)anyincreasedlimitorlimitsofliabilitywhereagreedinaccordancewithparagraph4ofarticle6.2.Afterthegoodshavebeenloadedonboard,iftheshippersodemands,thecarriermustissuetotheshippera"shipped"billofladingwhich,inadditiontotheparticularsrequiredunderparagraph1ofthisarticle,muststatethatthegoodsareonboardanamedshiporships,andthedateordatesofloading.Ifthecarrierhaspreviouslyissuedtotheshipperabillofladingorotherdocumentoftitlewithrespecttoanyofsuchgoods,onrequestofthecarriertheshippermustsurrendersuchdocumentinexchangefora"shipped"billoflading.Thecarriermayamendanypreviouslyissueddocumentinordertomeettheshippersdemandfora"shipped"billofladingif,asamended,suchdocumentincludesalltheinformationrequiredtobecontainedina"shipped"billoflading.3.Theabsenceinthebillofladingofoneormoreparticularsreferredtointhisarticledoesnotaffectthelegalcharacterofthedocumentasabillofladingprovidedthatitneverthelessmeetstherequirementssetoutinparagraph7ofarticle1.Article16.Billsoflading:reservationsandevidentiaryeffect1.Ifthebillofladingcontainsparticularsconcerningthegeneralnature,leadingmarks,numberofpackagesofpieces,weightorquantityofthegoodswhichthecarrierorotherpersonissuingthebillofladingonhisbehalfknowsorhasreasonablegroundstosuspectdonotaccuratelyrepresentthegoodsactuallytakenoveror,wherea"shipped"billofladingisissued,loaded,orifhehadnoreasonablemeansofcheckingsuchparticulars,thecarrierorsuchotherpersonmustinsertinthebillofladingareservationspecifyingtheseinaccuracies,groundsofsuspicionortheabsenceofreasonablemeansofchecking.2.Ifthecarrierorotherpersonissuingthebillofladingonhisbehalffailstonoteonthebillofladingtheapparentconditionofthegoods,heisdeemedtohavenotedonthebillofladingthatthegoodswereinapparentgoodcondition.3.Exceptforparticularsinrespectofwhichandtotheextenttowhichareservationpermittedunderparagraph1ofthisarticlehasbeenentered:(a)thebillofladingisprimafacieevidenceofthetakingoveror,wherea"shipped"billofladingisissued,loading,bythecarrierofthegoodsasdescribedinthebilloflading;and(b)prooftothecontrarybythecarrierisnotadmissibleifthebillofladinghasbeentransferredtoathirdparty,includingaconsignee,whoingoodfaithhasactedinrelianceonthedescriptionofthegoodstherein.4.Abillofladingwhichdoesnot,asprovidedinparagraph1,subparagraph(k),ofarticle15,setforththefreightorotherwiseindicatethatfreightispayablebytheconsigneeordoesnotsetforthdemurrageincurredattheportofloadingpayablebytheconsignee,isprimafacieevidencethatnofreightorsuchdemurrageispayablebyhim.However,prooftothecontrarybythecarrierisnotadmissiblewhenthebillofladinghasbeentransferredtoathirdparty,includingaconsignee,whoingoodfaithhasactedinrelianceontheabsenceinthebillofladingofanysuchindication.Article17.Guaranteesbytheshipper1.Theshipperisdeemedtohaveguaranteedtothecarriertheaccuracyofparticularsrelatingtothegeneralnatureofthegoods,theirmarks,number,weightandquantityasfurnishedbyhimforinsertioninthebilloflading.Theshippermustindemnifythecarrieragainstthelossresultingfrominaccuraciesinsuchparticulars.Theshipperremainsliableevenifthebillofladinghasbeentransferredbyhim.Therightofthecarriertosuchindemnityinnowaylimitshisliabilityunderthecontractofcarriagebyseatoanypersonotherthantheshipper.2.Anyletterofguaranteeoragreementbywhichtheshipperundertakestoindemnifythecarrieragainstlossresultingfromtheissuanceofthebillofladingbythecarrier,orbyapersonactingonhisbehalf,withoutenteringareservationrelatingtoparticularsfurnishedbytheshipperforinsertioninthebilloflading,ortotheapparentconditionofthegoods,isvoidandofnoeffectasagainstanythirdparty,includingaconsignee,towhomthebillofladinghasbeentransferred.3.Suchaletterofguaranteeoragreementisvalidasagainsttheshipperunlessthecarrierorthepersonactingonhisbehalf,byomittingthereservationreferredtoinparagraph2ofthisarticle,intendstodefraudathirdparty,includingaconsignee,whoactsinrelianceonthedescriptionofthegoodsinthebilloflading.Inthelattercase,ifthereservationomittedrelatestoparticularsfurnishedbytheshipperforinsertioninthebilloflading,thecarrierhasnorightofindemnityfromtheshipperpursuanttoparagraph1ofthisarticle.4.Inthecaseofintendedfraudreferredtoinparagraph3ofthisarticle,thecarrierisliable,withoutthebenefitofthelimitationofliabilityprovidedforinthisConvention,forthelossincurredbyathirdparty,includingaconsignee,becausehehasactedinrelianceonthedescriptionofthegoodsinthebilloflading.Article18.DocumentsotherthanbillsofladingWhereacarrierissuesadocumentotherthanabillofladingtoevidencethereceiptofthegoodstobecarried,suchadocumentisprimafacieevidenceoftheconclusionofthecontractofcarriagebyseaandthetakingoverbythecarrierofthegoodsasthereindescribed.PARTV.CLAIMSANDACTIONSArticle19.Noticeofloss,damageordelay1.Unlessnoticeoflossordamage,specifyingthegeneralnatureofsuchlossordamage,isgiveninwritingbytheconsigneetothecarriernotlaterthantheworkingdayafterthedaywhenthegoodswerehandedovertotheconsignee,suchhandingoverisprimafacieevidenceofthedeliverybythecarrierofthegoodsasdescribedinthedocumentoftransportor,ifnosuchdocumenthasbeenissued,ingoodcondition.2.Wherethelossordamageisnotapparent,theprovisionsofparagraph1ofthisarticleapplycorrespondinglyifnoticeinwritingisnotgivenwithin15consecutivedaysafterthedaywhenthegoodswerehandedovertotheconsignee.3.Ifthestateofthegoodsatthetimetheywerehandedovertotheconsigneehasbeenthesubjectofajointsurveyorinspectionbytheparties,noticeinwritingneednotbegivenoflossordamageascertainedduringsuchsurveyorinspection.4.Inthecaseofanyactualorapprehendedlossordamage,thecarrierandtheconsigneemustgiveallreasonablefacilitiestoeachotherforinspectingandtallyingthegoods.5.Nocompensation
