/上海市出版物發(fā)行管理條例-1-2113:37頁面功能【字體:大中小】【打印】【關閉】(2002年10月28日上海市第十一屆人民代表大會常務委員會第四十四次會議通過2002年10月29日上海市人民代表大會常務委員會公告第74號公布)第一章總則第一條為了加強對出版物發(fā)行的管理,發(fā)展和繁榮文化事業(yè),促進社會主義精神文明建設,根據(jù)國務院《出版管理條例》,結合本市實際情況,制定本條例。第二條本條例所稱的出版物發(fā)行,是指報紙、期刊、圖書、電子出版物和音像制品等出版物的總發(fā)行、批發(fā)、零售等經(jīng)營行為。第三條本條例適用于本市行政區(qū)域內(nèi)出版物的發(fā)行以及與發(fā)行相關的出租、征訂、附送、散發(fā)、展示等行為及其管理。行政法規(guī)對音像制品的發(fā)行另有規(guī)定的,從其規(guī)定。郵政法對郵政企業(yè)發(fā)行報紙、期刊另有規(guī)定的,從其規(guī)定。第四條上海市新聞出版行政部門(以下簡稱市出版行政部門)主管本市出版物發(fā)行的監(jiān)督管理工作,負責本條例的組織實施。區(qū)、縣負責出版管理的行政部門負責本轄區(qū)內(nèi)出版物發(fā)行的監(jiān)督管理工作,業(yè)務上受市出版行政部門領導。工商行政、公安、物價、教育、郵政、海關等行政管理部門按照各自職責,做好出版物發(fā)行的相關監(jiān)督管理工作。第五條市出版行政部門應當根據(jù)城市發(fā)展的實際需要和市民的文化需求,制定出版物發(fā)行的發(fā)展規(guī)劃,經(jīng)市人民政府批準后向社會公布。出版物發(fā)行單位和出版物交易市場的設立,應當符合本市出版物發(fā)行發(fā)展規(guī)劃規(guī)定的總量、結構和布局要求。第二章從事出版物發(fā)行的許可第六條本市對出版物的發(fā)行、出租實行許可制度。從事出版物發(fā)行、出租業(yè)務的,應當取得《出版物發(fā)行許可證》(以下簡稱許可證)。從事出版物總發(fā)行業(yè)務和全國性出版物連鎖經(jīng)營業(yè)務的單位,應當按照國家有關規(guī)定辦理許可手續(xù)。中外合資經(jīng)營企業(yè)、中外合作經(jīng)營企業(yè)、外資企業(yè)從事出版物發(fā)行業(yè)務的,按照國家的規(guī)定辦理。第七條從事出版物批發(fā)業(yè)務的單位或者從事出版物零售、出租業(yè)務的單位、個人,應當具備下列條件:(一)有符合相應資質要求的管理人員;(二)有固定的經(jīng)營場所和必要的經(jīng)營設施;(三)有符合法律、法規(guī)規(guī)定的注冊資金。第八條出版物連鎖經(jīng)營包括直營連鎖經(jīng)營和加盟連鎖經(jīng)營。從事出版物直營連鎖經(jīng)營業(yè)務的單位,應當具備下列條件:(一)具有法人資格;(二)有符合工商行政管理部門要求的門店數(shù)量;(三)有符合規(guī)定的連鎖經(jīng)營管理制度;(四)有符合法律、法規(guī)規(guī)定的注冊資金。經(jīng)營一年以上的出版物直營連鎖經(jīng)營單位,可以從事出版物加盟連鎖經(jīng)營業(yè)務。加盟連鎖經(jīng)營的,應當是經(jīng)許可設立的出版物發(fā)行單位或者個人。第九條設立出版物交易市場的單位,應當具有出版物總發(fā)行資質,并經(jīng)市出版行政部門批準。出版物交易市場,應當符合下列條件:(一)有符合相應資質要求的管理人員;(二)有符合規(guī)定的交易市場管理制度;(三)有符合法律、法規(guī)、規(guī)章規(guī)定的注冊資金和經(jīng)營場地。第十條單位申請從事出版物批發(fā)、直營連鎖經(jīng)營業(yè)務的,應當向市出版行政部門提出申請。單位和個人申請從事出版物零售、出租業(yè)務的,應當向區(qū)、縣負責出版管理的行政部門提出申請。第十一條市出版行政部門或者區(qū)、縣負責出版管理的行政部門應當自收到從事出版物發(fā)行、出租業(yè)務的申請材料之日起二十日內(nèi),作出批準或者不予批準的決定。予以批準的,發(fā)給許可證;不予批準的,應當書面說明理由。經(jīng)批準取得許可證的單位和個人,應當向工商行政管理部門依法領取營業(yè)執(zhí)照后,方可開展經(jīng)營活動。第十二條出版物連鎖經(jīng)營單位增設直營門店的,應當于該門店營業(yè)之日起二十日內(nèi)向市出版行政部門備案;接納加盟店的,應當在簽訂加盟合同之日起二十日內(nèi)向市出版行政部門備案。第十三條出版物發(fā)行、出租單位和個人變更出版物發(fā)行經(jīng)營范圍、經(jīng)營方式事項的,應當按照本條例第六條第二款、第十條的規(guī)定,重新辦理許可手續(xù);變更其他事項的,應當?shù)皆鷾实氖谐霭嫘姓块T或者區(qū)、縣負責出版管理的行政部門辦理變更手續(xù)。出版物發(fā)行、出租單位和個人終止發(fā)行、出租活動的,應當向原批準的市出版行政部門或者區(qū)、縣負責出版管理的行政部門辦理注銷登記,并繳回許可證。出版物連鎖經(jīng)營單位關閉直營門店或者終止加盟店合同的,應當在關閉直營門店或者終止加盟合同之日起二十日內(nèi)向市出版行政部門備案。出版物發(fā)行、出租單位和個人有前三款規(guī)定情形的,應當?shù)焦ど绦姓芾聿块T辦理相應手續(xù)。第十四條出版物發(fā)行、出租單位和個人應當向原批準的市出版行政部門或者區(qū)、縣負責出版管理的行政部門辦理許可證年度檢驗手續(xù)。市出版行政部門或者區(qū)、縣負責出版管理的行政部門應當對下列事項進行檢驗:(一)從事出版物發(fā)行、出租業(yè)務的條件;(二)有無違法經(jīng)營行為;(三)有無違反本條例許可證管理規(guī)定的其他行為。檢驗不合格或者逾期未接受檢驗的,不得繼續(xù)從事出版物發(fā)行業(yè)務。第三章出版物發(fā)行的管理第十五條出版物發(fā)行、出租單位和個人應當在核定的經(jīng)營場所營業(yè),并將許可證和營業(yè)執(zhí)照置于核定經(jīng)營場所的醒目位置。許可證和營業(yè)執(zhí)照不得涂改、轉讓、出租和出借。第十六條出版物發(fā)行單位和個人通過互聯(lián)網(wǎng)開展出版物發(fā)行業(yè)務的,應當在開展業(yè)務前,持許可證、網(wǎng)站名或者所鏈接網(wǎng)站名、電子郵件地址等材料,向原批準的市出版行政部門或者區(qū)、縣負責出版管理的行政部門備案。出版物發(fā)行單位和個人通過互聯(lián)網(wǎng)開展出版物發(fā)行業(yè)務的,應當在網(wǎng)站或者網(wǎng)頁的醒目位置標明出版物發(fā)行許可證編號、發(fā)證部門、備案編號,所經(jīng)營出版物的名稱、出版單位及標準書號、刊號、版號,其中屬進口出版物的,還應當同時標明進口單位名稱。第十七條出版物交易市場應當成立市場管理組織。市場管理組織根據(jù)國家和本市的有關規(guī)定,管理市場內(nèi)的交易活動。第十八條出版物批發(fā)單位不得向無許可證的單位和個人批發(fā)出版物。出版物發(fā)行、出租單位和個人不得向無許可證的單位和個人購進出版物。出版物交易市場不得向無許可證的單位和個人提供出版物發(fā)行的經(jīng)營場所。第十九條出版物批發(fā)單位,應當在進貨之日起三日內(nèi)將進貨憑證復印件報送市出版行政部門備案。對首次在本市發(fā)行的出版物,市出版行政部門認為需要提供出版物樣本的,應當書面告知當事人。當事人應當在書面告知的期限內(nèi)提供出版物樣本。市出版行政部門應當在接到樣本之日起十日內(nèi)審查完畢并將出版物樣本返還給當事人,但有本條例第二十二條禁止內(nèi)容或者情形的出版物樣本除外。第二十條出版物發(fā)行單位在經(jīng)營場所以外的地點舉辦出版物展銷活動的,應當在舉辦展銷前,向舉辦地的區(qū)、縣負責出版管理的行政部門備案。出版物發(fā)行行業(yè)協(xié)會舉辦出版物展銷活動的,按前款規(guī)定執(zhí)行。第二十一條中學小學教科書的發(fā)行單位由市出版行政部門、教育行政部門會同物價主管部門以招標或者其他公開、公正的方式確定,其他任何單位或者個人不得從事中學小學教科書的發(fā)行業(yè)務。中學小學教科書的發(fā)行單位不得搭配銷售或者強行推銷中學小學教輔材料。第二十二條不得發(fā)行、出租、征訂、附送、散發(fā)或者展示含有法律、行政法規(guī)和國家其他規(guī)定禁止內(nèi)容的出版物、出版物宣傳資料。禁止發(fā)行、出租、征訂、附送、散發(fā)或者展示非法進口、侵犯他人著作權以及有法律、法規(guī)規(guī)定不得發(fā)行的其他情形的出版物、出版物宣傳資料。有前兩款規(guī)定禁止內(nèi)容或者情形的出版物的鑒定由市出版行政部門負責,其所屬的出版物鑒定機構可以承擔具體的鑒定工作。第二十三條市出版行政部門或者區(qū)、縣負責出版管理的行政部門根據(jù)已經(jīng)取得的違法嫌疑證據(jù)或者舉報,對涉嫌違法從事出版物發(fā)行活動的行為進行查處時,可以檢查與違法活動有關的物品;對有證據(jù)證明是與違法活動有關的物品,可以查封或者扣押。行政執(zhí)法人員執(zhí)行公務時應當出示執(zhí)法證件。對被市出版行政部門或者區(qū)、縣負責出版管理的行政部門告知禁止發(fā)行的出版物,從事出版物發(fā)行業(yè)務的單位和個人應當及時上繳或者聽候處理,不得隱藏、變賣、轉移、毀損。第四章法律責任第二十四條違反本條例規(guī)定的行為,《出版管理條例》已規(guī)定處罰的,依照《出版管理條例》處罰。違反本條例規(guī)定的下列行為,由市出版行政部門或者區(qū)、縣負責出版管理的行政部門視情節(jié)輕重給予處罰:(一)違反本條例第六條第一款規(guī)定,無許可證從事出版物出租業(yè)務的,責令停止違法行為,沒收違法所得,處二千元以下的罰款。(二)違反本條例第九條第一款規(guī)定,擅自設立出版物交易市場的,責令停止違法行為,沒收違法所得,違法所得在一萬元以上的,處違法所得二倍以上十倍以下的罰款;沒有違法所得或者違法所得在一萬元以下的,處五千元以上二萬元以下的罰款。(三)違反本條例第十二條、第十六條第一款規(guī)定,增設直營門店、接納加盟店或者通過互聯(lián)網(wǎng)開展出版物發(fā)行業(yè)務,未按規(guī)定備案的,責令限期改正,逾期未改正的,沒收違法所得,處一百元以上一千元以下的罰款。(四)違反本條例第十三條第一款規(guī)定,未辦理許可證變更手續(xù)的,責令限期改正,處一百元以上五百元以下的罰款。(五)違反本條例第十五條第一款規(guī)定,在核定的經(jīng)營場所以外營業(yè)的,責令改正,處五百元以上五千元以下的罰款。(六)違反本條例第十五條第二款規(guī)定,涂改、轉讓、出租或者出借許可證的,責令限期改正,沒收違法所得,處一千元以上一萬元以下的罰款;情節(jié)嚴重的,并處責令停業(yè)整頓或者吊銷許可證。(七)違反本條例第十八條規(guī)定,從事出版物發(fā)行、出租業(yè)務的單位和個人或者出版物交易市場,向無許可證的單位和個人批發(fā)出版物、購進出版物或者提供出版物發(fā)行經(jīng)營場所的,沒收出版物和違法所得,處五百元以上五千元以下的罰款;情節(jié)嚴重的,并處責令停業(yè)整頓或者吊銷許可證。(八)違反本條例第十九條規(guī)定,未報送進貨憑證復印件備案或者提供出版物樣本的,責令限期改正,逾期未改正的,每種出版物處五百元的罰款。(九)違反本條例第二十一條第二款規(guī)定,搭配銷售或者強行推銷中學小學教輔材料的,責令停止違法行為,沒收違法所得,處一千元以上五千元以下的罰款。(十)違反本條例第二十二條規(guī)定,出租、征訂、附送、散發(fā)、展示含有禁止內(nèi)容或者情形的出版物或者出版物宣傳資料的,沒收出版物或者出版物宣傳資料和違法所得,違法所得在一萬元以上的,處違法所得二倍以上十倍以下的罰款;沒有違法所得或者違法所得在一萬元以下的,處五千元以上二萬元以下的罰款;情節(jié)嚴重的,并處責令停業(yè)整頓或者吊銷許可證。第二十五條對違反本條例規(guī)定向無許可證的單位和個人購進出版物,以及出租、征訂、附送、散發(fā)、展示的出版物或者出版物宣傳資料有本條例第二十二條規(guī)定內(nèi)容或者情形的,當事人說明、指認來源,經(jīng)查證屬實的,除沒收出版物、出版物宣傳資料和違法所得外,可以減輕或者免除本條例規(guī)定的其他行政處罰。第二十六條對拒絕、阻礙行政管理部門工作人員依法執(zhí)行職務,尚不夠刑事處罰的,由公安部門依照《中華人民共和國治安管理處罰條例》處理;構成犯罪的,依法追究刑事責任。第二十七條當事人對市出版行政部門或者區(qū)、縣負責出版管理的行政部門的具體行政行為不服的,可以依照《中華人民共和國行政復議法》或者《中華人民共和國行政訴訟法》的規(guī)定,申請行政復議或者提起行政訴訟。當事人對具體行政行為逾期不申請復議,不提起訴訟,又不履行的,作出具體行政行為的市出版行政部門或者區(qū)、縣負責出版管理的行政部門可以申請人民法院強制執(zhí)行。第二十八條市出版行政部門或者區(qū)、縣負責出版管理的行政部門直接負責的主管人員或者其他直接責任人員玩忽職守、濫用職權、徇私舞弊的,由其所在單位或者上級主管部門依法給予行政處分;構成犯罪的,依法追究刑事責任。第五章附則第二十九條本條例有關用語的定義:報紙,是指有固定名稱、刊期、開版,每周至少出版一期的連續(xù)出版物。期刊,是指有固定名稱和欄目,用卷、期或者年、季、月、旬、周順序編號,成冊的連續(xù)出版物。圖書,是指各類書籍、畫冊、掛歷、圖片、年畫、年歷等出版物。電子出版物,是指以數(shù)字代碼方式將圖文聲像等信息編輯加工后存儲在磁、光、電介質上,通過計算機或者具有類似功能的設備讀取使用,用以表達思想、普及知識和積累文化,并可復制發(fā)行的大眾傳播媒體。第三十條本條例自2003年1月1日起施行?!渡虾J袌D書報刊市場管理條例》同時廢止。RegulationsofShanghai(Adoptedatthe44thSessionoftheStandingCommitteeofthe11thShanghaiMunicipalPeople'sCongressonOctober28,)ChapterIGeneralProvisionsArticle1TheseRegulationsareformulatedforthepurposesofstrengtheningtheadministrationofthedistributionofpublications,developingandprosperingculturalundertakings,andpromotingthesocialistideologicalandethicalconstruction,inaccordancewiththe"RegulationsontheAdministrationofPublications"bytheStateCouncilandinthelightofthisMunicipality'sactualcircumstances.Article2ThedistributionofpublicationmentionedintheseRegulationsreferstotheactsofthegeneraldistribution,wholesaleandretailbusinessoperationofnewspapers,periodicals,books,electronicpublicationsandaudio-videoproducts,andotherpublications.Article3TheseRegulationsshallapplytothedistributionanddistribution-relatedrenting,subscription-soliciting,giving-as-compliment,sending-out,andexhibitionofpublicationsandtheadministrationthereofinthisMunicipality'sadministrativearea.Wherethereareprovisionsotherwiseprovidedbyadministrativeregulationsonaudio-videoproducts,suchprovisionsshallprevail.Wherethereareprovisionsprovidedbythepostallawonpostalenterprises'distributionofnewspapersandperiodicals,suchprovisionsshallprevail.Article4TheShanghaimunicipaladministrativedepartmentofpressandpublication(hereinafterreferredtoasMPPA)shallbeinchargeofthesupervisoryandadministrativeworkofthisMunicipality'sdistributionofpublications,andshallberesponsiblefororganizingtheimplementationoftheseRegulations.ThedistrictandcountyadministrativedepartmentsinchargeoftheadministrationofpublicationshallberesponsibleforthesupervisoryandadministrativeworkofpublicationdistributionintheirrespectiveadministrativeareasandbeundertheleadershipoftheMPPAinprofessionalwork.Theadministrativedepartmentsofindustryandcommerceadministration,publicsecurity,pricecontrol,education,postalserviceandcustomsshall,accordingtotheirrespectiveduties,dowellinsupervisionandadministrativeworkrelatedtopublicationdistribution.Article5TheMPPAshall,accordingtotheactualneedsofdevelopmentoftheMunicipalityandtheculturaldemandsofcitizens,workoutthedevelopmentprogramforpublicationdistributionand,uponapprovalbytheMunicipalPeople'sGovernment,announcetheprogramtothemasses.Theestablishmentofdistributionunitsofpublicationsandtradingmarketsofpublicationsshallconformtotherequirementsoftotalamount,structureandlayoutsetforthbythisMunicipality'sdevelopmentprogramforpublicationdistribution.ChapterIILicensingofConductingPublicationDistributionArticle6ThisMunicipalityshalladoptthelicensingsystemofpublicationdistributionandrenting.Thosewhoareengagedinpublicationdistributionorrentingbusinessshallobtainthe"LicenseofPublicationDistribution"(hereinafterreferredtoastheLicense).UnitsthatareengagedingeneraldistributionbusinessofpublicationsandchainoperationbusinessofnationwidepublicationsshallgothroughlicensingformalitiesaccordingtotherelevantStateprovisions.Chinese-foreignequitablejointventures,Chinese-foreigncontractualjointventuresandforeign-fundedenterprisesthatareengagedinpublicationdistributionbusinessshalldoasprovidedbytheState.Article7Unitsengagedinpublicationwholesalebusinessorunitsandindividualpersonsengagedinpublicationretailbusinessorrentingbusinessshallmeetthefollowingconditions:(1)Havingmanagerialpersonnelthatmeettherequirementsofappropriatequalification;(2)Havingfixedbusinessoperationsitesandnecessarybusinessoperationfacilities;and(3)Havingregisteredcapitalincompliancewiththeprovisionsoflawsandregulations.Article8Thechainoperationofpublicationsincludesbothdirectchainoperationandalliedchainoperation.Unitsengagedindirectchainoperationbusinessshallmeetthefollowingconditions:(1)Havinglegalpersonality;(2)Havingthenumberofoutletsrequiredbytheindustrialandcommercialadministrativedepartment;(3)Havingtheadministrationsystemofchainoperationasrequired;and(4)Havingtheregisteredcapitalprovidedbylawsandregulations.Theunitengagedindirectchainoperationofpublicationsforoveroneyearmayconductalliedchainoperationbusinessofpublications.Thoseengagedinalliedchainoperationshallbetheunitsorindividualpersonsofpublicationdistributionestablishedwithpermission.Article9TheunitthatsetsupthetradingmarketofpublicationsshallhavethequalificationsforgeneraldistributionofpublicationsandhaveobtainedapprovalfromtheMPPA.Thetradingmarketofpublicationsshallmeetthefollowingconditions:(1)Havingmanagerialpersonnelthatmeettherequirementsofappropriatequalifications;(2)Havingtheadministrationsystemoftradingmarketrequiredbytheprovisions;(3)Havingtheregisteredcapitalandoperationsitesincompliancewiththeprovisionsoflawsandregulations.Article10Theunitapplyingforconductingwholesale,directchainoperationbusinessofpublicationsshalllodgeanapplicationtotheMPPA.Theunitandindividualpersonapplyingforconductingretailandrentingbusinessofpublicationsshalllodgeanapplicationtothedistrict/countyadministrativedepartmentinchargeofpublicationadministration.Article11TheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationdistributionshall,within20daysfromthedateofreceivingtheapplicationmaterialsforconductingdistributionandrentingbusinessofpublications,makeadecisionofapprovalordenialoftheapplication.Apermitshallbeissuedtotheapproved;andreasonsshallbegiveninwritingtothedenied.Theunitorindividualpersonthathasobtainedthepermituponapprovalshalltakeoutthebusinesslicensefromtheindustrialandcommercialadministrativedepartmentbeforebeingallowedtolaunchanybusinessactivity.Article12Thechainoperationunitofpublicationsthatsetsupanotherdirectoperationoutletinadditionshall,within20daysfromthebusinessopeningdateoftheoutlet,reporttotheMPPAfortherecord;thoseacceptingalliedoutletsshall,within20daysfromthedateofsigninganalliancecontract,reporttotheMPPAfortherecord.Article13Iftheunitsorindividualpersonsthatdistributeorrentpublicationsalterthebusinessscopeandbusinessformofpublicationdistribution,theyshallgothroughanewpermissionformalitiesaccordingtotheprovisionsofArticle6,Clause2andArticle10oftheseRegulations.Ifalteringothermatters,theyshallgothroughalterationformalitieswiththeoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration.Whentheunitsandindividualpersonsthatdistributeandrentoutpublications,terminatethedistributingandrentingactivities,theyshallgothroughcancellationformalitieswiththeoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration,andsurrenderthepermit.Whenthechainoperationunitsofpublicationsshutdowntheirdirectoperationoutletsorterminatethealliedstorecontracts,theyshallreporttotheMPPAfortherecordwithin20daysfromthedateofshuttingdowntheirdirectoperationoutletsorterminatingalliedstorecontracts.Iftheunitsandindividualpersonsthatdistributeandrentoutpublicationshavethecasessetforthintheprecedingthreeclauses,theyshallgothroughappropriateformalitieswiththeindustrialandcommercialadministrativedepartment.Article14Theunitsandindividualpersonsthatdistributeandrentoutpublicationsshallgothroughtheannualpermitinspectionformalitieswiththeoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration.TheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministrationshallinspectoverthefollowingmatters:(1)Conditionsforconductingpublicationdistributionandrentoutbusiness;(2)Anyactsofillegaloperation;and(3)AnyotheractsinviolationoftheprovisionsoftheseRegulationsonlicenseadministration.Thosewhofailintheinspectionordonotundergobeforethedeadlinetheinspectionshallnotcontinuetoconductthepublicationdistributionbusiness.ChapterIIIAdministrationofPublicationDistributionArticle15Theunitsandindividualpersonsthatdistributeandrentoutpublicationsshalldobusinessinthecheckedandratifiedoperationsites,andplacethepermitandbusinesslicenseontheconspicuouspositionofthecheckedandratifiedoperationsite.Thepermitandbusinesslicenseshallnotbealtered,transferred,leasedoutorlent.Article16Whentheunitsandindividualpersonsthatdistributepublications,launchdistributionbusinessthroughInternet,theyshallreporttotheoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministrationfortherecordwiththepermit,websitenameorthenameofwebsitetheylinkto,e-mailaddressandotherrelevantmaterialsbeforelaunchingbusiness.IftheunitsandindividualpersonsthatdistributepublicationslaunchpublicationdistributionbusinessthroughInternet,theyshallhavethenumberofpermitofpublicationdistribution,thepermit-issuingdepartment,thenumberofreportfortherecord,thenameofpublicationinoperation,thepublishingunitandthestandardbooknumber,periodicalnumber,aswellaseditionnumber,andthenameofimportunitfortheimportedpublications,ifany,markedontheconspicuousplaceofwebsiteorwebpage.Article17Thepublicationtradingmarketshallsetupthemarketadministrationorganization,whichshallcontrolovertradingactivitiesinthemarketaccordingtorelevantprovisionssetbytheStateandthisMunicipality.Article18Publicationwholesaleunitsshallnotwholesalepublicationstoanyunitorindividualpersonthatdoesnothavealicence.Unitsandindividualpersonsthatdistributeandrentoutpublicationsshallnotpurchasepublicationsfromanyunitorindividualpersonthatdoesnothavealicence.Publicationtradingmarketsshallnotprovidebusinesssitesofpublicationdistributionforanyunitorindividualpersonthatdoesnothavealicence.Article19Publicationwholesaleunitsshall,withinthreedaysfromthedateofpurchase,submittheduplicateofpurchasevouchertotheMPPAfortherecord.WhereanypublicationisdistributedinthisMunicipalityforthefirsttime,theMPPA,ifitrequiresasampleofthepublication,shallnotifythepartyconcernedinwriting.Thepartyconcernedshall,withintheprescribedtimeperiodasnotifiedinwriting,providethepublicationsample.TheMPPAshall,within10daysfromthedateofreceivingthesample,completetheexaminationandreturnthesampletothepartyconcerned,exceptforthepublicationsamplewithcontentsorcasesbannedinArticle22oftheseRegulations.Article20Publicationdistributingunits,whenholdingpublicationexhibitionactivityinplacesotherthantheirbusinesssites,shall,beforeholdingtheexhibition,reporttothedistrict/countyadministrativedepartmentinchargeofpublicationadministrationinthelocalitywheretheexhibitionisheldfortherecord.Wherethepublicationdistributorsassociationholdspublicationexhibitionactivity,theprovisionsintheprecedingclauseshallbefollowed.Article21ThedistributionunitsofmiddleandprimaryschooltextbooksshallbedesignatedthroughbiddingorotheropenandimpartialformsbytheMPPAandtheeducationaladministrationtogetherwiththecompetentpricecontroldepartment.Anyotherunitsorindividualpersonsshallnotconductthedistributionbusinessofmiddleandprimaryschooltextbooks.Thedistributionunitsofmiddleandprimaryschooltextbooksshallnotselltie-inorimportunatelymiddleandprimaryschoolteachingauxiliarymaterials.Article22Nopublicationsorpublicationpublicitymaterialswithcontentsbannedbylaws,administrativeregulationsorotherState-setprovisionsshallbedistributed,rent,subscription-solicited,givenascompliment,sentoutorexhibited.Nopublicationsorpublicationpublicitymaterialsimportedillegally,infringinguponotherpersons'copyrights,andhavingothercasesthatdistributionisbannedbylawsandregulationsshallbedistributed,rent,subscription-solicited,givenascompliment,sentoutorexhibited.TheMPPAshallberesponsiblefortheappraisalofpublicationswithcontentsorcasesbannedintheprecedingtwoclauses,anditsaffiliatedpublicationappraisalagencymayundertakethespecificappraisalwork.Article23TheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration,when,basedontheobtainedevidenceofsuspectedoffenceorontip-offs,makinginvestigationoveractssuspectedofconductingillegalpublicationdistribution,mayexaminearticlesrelatedtoillegalactivities,andmaysealupordistrainarticlesprovedwithevidencetoberelatedtoillegalactivities.Administrativelawenforcersshallproducelaw-enforcementcertificationwhenperformingofficialduties.InrespecttopublicationswhosedistributionisbannedbynotificationoftheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration,theunitorindividualpersonengagedinthedistributionbusinessofthepublicationsshallpromptlyhandtheminorwaitforhandling,withnoconcealment,selloff,shiftordestructionofsuchpublicationsbeingallowed.ChapterIVLegalLiabilityArticle24Wherethe"RegulationsonAdministrationofthePublication"haveprovidedpenaltiesonactsthatviolatetheprovisionsoftheseRegulations,suchactsshallbepunishedinaccordancewiththe"RegulationsonAdministrationofthePublication".ThefollowingactsinviolationoftheprovisionsoftheseRegulationsshallbepunishedbytheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministrationaccordingtotheseriousnessofthecases:(1)Thosewho,inviolationoftheprovisionsofArticle6,Clause1oftheseRegulations,conductpublicationrentingbusinesswithoutlicenceshallbeorderedtostoptheirillegalacts,theirillegalgainsshallbeconfiscated,andtheyshallbepenalizedwithafineoflessthan2,000yuan.(2)Thosewho,inviolationoftheprovisionsofArticle9Clause1oftheseRegulations,setuppublicationtradingmarketswithoutauthorization,shallbeorderedtostoptheirillegalacts,theirillegalgainsshallbeconfiscatedandtheyshallbepenalizedwithafineofbetweennotlessthantwiceandnotmorethantentimestheillegalgainsiftheillegalgainsismorethan10,000yuan.Iftherearenoillegalgainsoriftheillegalgainsarelessthan10,000yuan,theyshallbepenalizedwithafineofbetweennotlessthan5,000yuanandnotmorethan20,000yuan.(3)Thosewho,inviolationoftheprovisionsofArticle12,Article16Clause1oftheseRegulations,addadirectoperationoutlet,takeinanalliedstore,orlaunchpublicationdistributionbusinessthroughInternetwithoutreportingfortherecordasrequiredshallbeorderedtocorrectwithinaprescribedtimeperiod,and,iftheyfailtocorrectbeforethedeadline,theirillegalgainsshallbeconfiscated,andtheyshallbepenalizedwithafinenotlessthan100yuanandnotmorethan1,000yuan.(4)Thosewho,inviolationoftheprovisionsofArticle13Clause1oftheseRegulations,failtogothroughthepermitalterationformalitiesshallbeorderedtocorrectwithinaprescribedtimeperiod,andbepenalizedwithafineofbetweennotlessthan100yuanandnotmorethan500yuan.(5)Thosewho,inviolationoftheprovisionsofArticle15Clause1oftheseRegulations,dobusinessinaplaceotherthanthecheckedandratifiedoperationsiteshallbeorderedtocorrect,andshallbepenalizedwithafineofbetweennotlessthan500yuanandnotmorethan5,000yuan.(6)Thosewho,inviolationoftheprovisionsofArticle15Clause2oftheseRegulations,alter,transfer,leaseorlendthelicenseshallbeorderedtocorrectwithinaprescribedtimeperiod,theirillegalgainsshallbeconfiscatedandtheyshallbepenalizedwithafineofbetweennotlessthan1,000yuanandnotmorethan10,000yuan.Ifthecaseisserious,thewrongdoershallbecumulativelyorderedtostopbusinessforrectification,orhavethelicencerevoked.(7)Anyunitorindividualpersonengagedinpublicationdistributionandrentingbusiness,orpublicationtradingmarketsthat,inviolationoftheprovisionsofArticle18oftheseRegulations,wholesale,orpurchasepublicationsfromorprovidepublicationoperationsitesforunitsorindividualpersonswhodonothavethelicence,shallhavethepublicationsandillegalgainsconfiscatedandshallbepenalizedwithafineofbetweennotlessthan500yuanandnotmorethan5,000yuan.Ifthecaseisserious,thewrongdoershallbecumulativelyorderedtostopbusinessforrectification,orhavethelicencerevoked.(8)Thosewho,inviolationoftheprovisionsofArticle19oftheseRegulations,failtosubmitduplicatesofpurchasevouchersfortherecord,orfailtoprovidesamplesofpublications,shallbeorderedtocorrectwithinaprescribedtimeperiodand,iftheyfailtocorrectbeforethedeadline,theyshallbepenalizedwithafineof500yuanforeachkindofpublications.(9)Thosewho,inviolationoftheprovisionsofArticle21Clause2oftheseRegulations,selltie-inorimportunatelymiddleandprimaryschoolteachingauxiliarymaterials,shallbeorderedtostoptheirillegalacts,havetheirillegalgainsconfiscated,andbepenalizedwithafineofbetweennotlessthan1,000yuanandnotmorethan5,000yuan.(10)Thosewho,inviolationoftheprovisionsofArticle22oftheseRegulations,rentout,solicitsubscriptionsfor,giveasacompliment,sendoutorexhibitpublicationsorpublicationpublicitymaterialswiththebannedcontentsorcasesshallhavethepublicationsorpublicationpublicitymaterialsandillegalgainsconfiscatedandbepenalizedwithafineofbetweennotlessthantwiceandnotmorethantentimestheillegalgainswhichismorethan10,000yuan,orbepenalizedwithafineofbetweennotlessthan5,000yuanandnotmorethan20,000yuaniftherearenoillegalgains,oriftheillegalgainsarelessthan10,000yuan.Ifthecaseisserious,thewrongdoershallbecumulativelyorderedtostopbusinessforrectificationorhavethelicencerevoked.Article25Whereapersonpurchasespublications,inviolationoftheprovisionsoftheseRegulation,fromunitsorindividualpersonsthatdonothavethelicenceorrents,solicitssubscriptionsfor,givesasacompliment,sendsoutorexhibitspublicationsorpublicationpublicitymaterialswithcontentsorcasessetforthinArticle22oftheseRegulations,andthatpersongivesoridentifiesthesourcewhichprovestrueafterverification,theadministrativepunishmentsetforthintheseRegulationsotherthantheconfiscationofpublications,publicationpublicitymaterialsandillegalgainsmaybemitigatedorexempted.Article26Thosewhoresistorimpedethefunctionariesofadministrativedepartmentsinperformingtheirdutiesaccordingtolaw,toanextentnotseriousenoughforcrimi
