/上海市出版物發(fā)行管理?xiàng)l例-1-2113:37頁(yè)面功能【字體:大中小】【打印】【關(guān)閉】(2002年10月28日上海市第十一屆人民代表大會(huì)常務(wù)委員會(huì)第四十四次會(huì)議通過(guò)2002年10月29日上海市人民代表大會(huì)常務(wù)委員會(huì)公告第74號(hào)公布)第一章總則第一條為了加強(qiáng)對(duì)出版物發(fā)行的管理,發(fā)展和繁榮文化事業(yè),促進(jìn)社會(huì)主義精神文明建設(shè),根據(jù)國(guó)務(wù)院《出版管理?xiàng)l例》,結(jié)合本市實(shí)際情況,制定本條例。第二條本條例所稱的出版物發(fā)行,是指報(bào)紙、期刊、圖書(shū)、電子出版物和音像制品等出版物的總發(fā)行、批發(fā)、零售等經(jīng)營(yíng)行為。第三條本條例適用于本市行政區(qū)域內(nèi)出版物的發(fā)行以及與發(fā)行相關(guān)的出租、征訂、附送、散發(fā)、展示等行為及其管理。行政法規(guī)對(duì)音像制品的發(fā)行另有規(guī)定的,從其規(guī)定。郵政法對(duì)郵政企業(yè)發(fā)行報(bào)紙、期刊另有規(guī)定的,從其規(guī)定。第四條上海市新聞出版行政部門(mén)(以下簡(jiǎn)稱市出版行政部門(mén))主管本市出版物發(fā)行的監(jiān)督管理工作,負(fù)責(zé)本條例的組織實(shí)施。區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)負(fù)責(zé)本轄區(qū)內(nèi)出版物發(fā)行的監(jiān)督管理工作,業(yè)務(wù)上受市出版行政部門(mén)領(lǐng)導(dǎo)。工商行政、公安、物價(jià)、教育、郵政、海關(guān)等行政管理部門(mén)按照各自職責(zé),做好出版物發(fā)行的相關(guān)監(jiān)督管理工作。第五條市出版行政部門(mén)應(yīng)當(dāng)根據(jù)城市發(fā)展的實(shí)際需要和市民的文化需求,制定出版物發(fā)行的發(fā)展規(guī)劃,經(jīng)市人民政府批準(zhǔn)后向社會(huì)公布。出版物發(fā)行單位和出版物交易市場(chǎng)的設(shè)立,應(yīng)當(dāng)符合本市出版物發(fā)行發(fā)展規(guī)劃規(guī)定的總量、結(jié)構(gòu)和布局要求。第二章從事出版物發(fā)行的許可第六條本市對(duì)出版物的發(fā)行、出租實(shí)行許可制度。從事出版物發(fā)行、出租業(yè)務(wù)的,應(yīng)當(dāng)取得《出版物發(fā)行許可證》(以下簡(jiǎn)稱許可證)。從事出版物總發(fā)行業(yè)務(wù)和全國(guó)性出版物連鎖經(jīng)營(yíng)業(yè)務(wù)的單位,應(yīng)當(dāng)按照國(guó)家有關(guān)規(guī)定辦理許可手續(xù)。中外合資經(jīng)營(yíng)企業(yè)、中外合作經(jīng)營(yíng)企業(yè)、外資企業(yè)從事出版物發(fā)行業(yè)務(wù)的,按照國(guó)家的規(guī)定辦理。第七條從事出版物批發(fā)業(yè)務(wù)的單位或者從事出版物零售、出租業(yè)務(wù)的單位、個(gè)人,應(yīng)當(dāng)具備下列條件:(一)有符合相應(yīng)資質(zhì)要求的管理人員;(二)有固定的經(jīng)營(yíng)場(chǎng)所和必要的經(jīng)營(yíng)設(shè)施;(三)有符合法律、法規(guī)規(guī)定的注冊(cè)資金。第八條出版物連鎖經(jīng)營(yíng)包括直營(yíng)連鎖經(jīng)營(yíng)和加盟連鎖經(jīng)營(yíng)。從事出版物直營(yíng)連鎖經(jīng)營(yíng)業(yè)務(wù)的單位,應(yīng)當(dāng)具備下列條件:(一)具有法人資格;(二)有符合工商行政管理部門(mén)要求的門(mén)店數(shù)量;(三)有符合規(guī)定的連鎖經(jīng)營(yíng)管理制度;(四)有符合法律、法規(guī)規(guī)定的注冊(cè)資金。經(jīng)營(yíng)一年以上的出版物直營(yíng)連鎖經(jīng)營(yíng)單位,可以從事出版物加盟連鎖經(jīng)營(yíng)業(yè)務(wù)。加盟連鎖經(jīng)營(yíng)的,應(yīng)當(dāng)是經(jīng)許可設(shè)立的出版物發(fā)行單位或者個(gè)人。第九條設(shè)立出版物交易市場(chǎng)的單位,應(yīng)當(dāng)具有出版物總發(fā)行資質(zhì),并經(jīng)市出版行政部門(mén)批準(zhǔn)。出版物交易市場(chǎng),應(yīng)當(dāng)符合下列條件:(一)有符合相應(yīng)資質(zhì)要求的管理人員;(二)有符合規(guī)定的交易市場(chǎng)管理制度;(三)有符合法律、法規(guī)、規(guī)章規(guī)定的注冊(cè)資金和經(jīng)營(yíng)場(chǎng)地。第十條單位申請(qǐng)從事出版物批發(fā)、直營(yíng)連鎖經(jīng)營(yíng)業(yè)務(wù)的,應(yīng)當(dāng)向市出版行政部門(mén)提出申請(qǐng)。單位和個(gè)人申請(qǐng)從事出版物零售、出租業(yè)務(wù)的,應(yīng)當(dāng)向區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)提出申請(qǐng)。第十一條市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)應(yīng)當(dāng)自收到從事出版物發(fā)行、出租業(yè)務(wù)的申請(qǐng)材料之日起二十日內(nèi),作出批準(zhǔn)或者不予批準(zhǔn)的決定。予以批準(zhǔn)的,發(fā)給許可證;不予批準(zhǔn)的,應(yīng)當(dāng)書(shū)面說(shuō)明理由。經(jīng)批準(zhǔn)取得許可證的單位和個(gè)人,應(yīng)當(dāng)向工商行政管理部門(mén)依法領(lǐng)取營(yíng)業(yè)執(zhí)照后,方可開(kāi)展經(jīng)營(yíng)活動(dòng)。第十二條出版物連鎖經(jīng)營(yíng)單位增設(shè)直營(yíng)門(mén)店的,應(yīng)當(dāng)于該門(mén)店?duì)I業(yè)之日起二十日內(nèi)向市出版行政部門(mén)備案;接納加盟店的,應(yīng)當(dāng)在簽訂加盟合同之日起二十日內(nèi)向市出版行政部門(mén)備案。第十三條出版物發(fā)行、出租單位和個(gè)人變更出版物發(fā)行經(jīng)營(yíng)范圍、經(jīng)營(yíng)方式事項(xiàng)的,應(yīng)當(dāng)按照本條例第六條第二款、第十條的規(guī)定,重新辦理許可手續(xù);變更其他事項(xiàng)的,應(yīng)當(dāng)?shù)皆鷾?zhǔn)的市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)辦理變更手續(xù)。出版物發(fā)行、出租單位和個(gè)人終止發(fā)行、出租活動(dòng)的,應(yīng)當(dāng)向原批準(zhǔn)的市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)辦理注銷登記,并繳回許可證。出版物連鎖經(jīng)營(yíng)單位關(guān)閉直營(yíng)門(mén)店或者終止加盟店合同的,應(yīng)當(dāng)在關(guān)閉直營(yíng)門(mén)店或者終止加盟合同之日起二十日內(nèi)向市出版行政部門(mén)備案。出版物發(fā)行、出租單位和個(gè)人有前三款規(guī)定情形的,應(yīng)當(dāng)?shù)焦ど绦姓芾聿块T(mén)辦理相應(yīng)手續(xù)。第十四條出版物發(fā)行、出租單位和個(gè)人應(yīng)當(dāng)向原批準(zhǔn)的市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)辦理許可證年度檢驗(yàn)手續(xù)。市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)應(yīng)當(dāng)對(duì)下列事項(xiàng)進(jìn)行檢驗(yàn):(一)從事出版物發(fā)行、出租業(yè)務(wù)的條件;(二)有無(wú)違法經(jīng)營(yíng)行為;(三)有無(wú)違反本條例許可證管理規(guī)定的其他行為。檢驗(yàn)不合格或者逾期未接受檢驗(yàn)的,不得繼續(xù)從事出版物發(fā)行業(yè)務(wù)。第三章出版物發(fā)行的管理第十五條出版物發(fā)行、出租單位和個(gè)人應(yīng)當(dāng)在核定的經(jīng)營(yíng)場(chǎng)所營(yíng)業(yè),并將許可證和營(yíng)業(yè)執(zhí)照置于核定經(jīng)營(yíng)場(chǎng)所的醒目位置。許可證和營(yíng)業(yè)執(zhí)照不得涂改、轉(zhuǎn)讓、出租和出借。第十六條出版物發(fā)行單位和個(gè)人通過(guò)互聯(lián)網(wǎng)開(kāi)展出版物發(fā)行業(yè)務(wù)的,應(yīng)當(dāng)在開(kāi)展業(yè)務(wù)前,持許可證、網(wǎng)站名或者所鏈接網(wǎng)站名、電子郵件地址等材料,向原批準(zhǔn)的市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)備案。出版物發(fā)行單位和個(gè)人通過(guò)互聯(lián)網(wǎng)開(kāi)展出版物發(fā)行業(yè)務(wù)的,應(yīng)當(dāng)在網(wǎng)站或者網(wǎng)頁(yè)的醒目位置標(biāo)明出版物發(fā)行許可證編號(hào)、發(fā)證部門(mén)、備案編號(hào),所經(jīng)營(yíng)出版物的名稱、出版單位及標(biāo)準(zhǔn)書(shū)號(hào)、刊號(hào)、版號(hào),其中屬進(jìn)口出版物的,還應(yīng)當(dāng)同時(shí)標(biāo)明進(jìn)口單位名稱。第十七條出版物交易市場(chǎng)應(yīng)當(dāng)成立市場(chǎng)管理組織。市場(chǎng)管理組織根據(jù)國(guó)家和本市的有關(guān)規(guī)定,管理市場(chǎng)內(nèi)的交易活動(dòng)。第十八條出版物批發(fā)單位不得向無(wú)許可證的單位和個(gè)人批發(fā)出版物。出版物發(fā)行、出租單位和個(gè)人不得向無(wú)許可證的單位和個(gè)人購(gòu)進(jìn)出版物。出版物交易市場(chǎng)不得向無(wú)許可證的單位和個(gè)人提供出版物發(fā)行的經(jīng)營(yíng)場(chǎng)所。第十九條出版物批發(fā)單位,應(yīng)當(dāng)在進(jìn)貨之日起三日內(nèi)將進(jìn)貨憑證復(fù)印件報(bào)送市出版行政部門(mén)備案。對(duì)首次在本市發(fā)行的出版物,市出版行政部門(mén)認(rèn)為需要提供出版物樣本的,應(yīng)當(dāng)書(shū)面告知當(dāng)事人。當(dāng)事人應(yīng)當(dāng)在書(shū)面告知的期限內(nèi)提供出版物樣本。市出版行政部門(mén)應(yīng)當(dāng)在接到樣本之日起十日內(nèi)審查完畢并將出版物樣本返還給當(dāng)事人,但有本條例第二十二條禁止內(nèi)容或者情形的出版物樣本除外。第二十條出版物發(fā)行單位在經(jīng)營(yíng)場(chǎng)所以外的地點(diǎn)舉辦出版物展銷活動(dòng)的,應(yīng)當(dāng)在舉辦展銷前,向舉辦地的區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)備案。出版物發(fā)行行業(yè)協(xié)會(huì)舉辦出版物展銷活動(dòng)的,按前款規(guī)定執(zhí)行。第二十一條中學(xué)小學(xué)教科書(shū)的發(fā)行單位由市出版行政部門(mén)、教育行政部門(mén)會(huì)同物價(jià)主管部門(mén)以招標(biāo)或者其他公開(kāi)、公正的方式確定,其他任何單位或者個(gè)人不得從事中學(xué)小學(xué)教科書(shū)的發(fā)行業(yè)務(wù)。中學(xué)小學(xué)教科書(shū)的發(fā)行單位不得搭配銷售或者強(qiáng)行推銷中學(xué)小學(xué)教輔材料。第二十二條不得發(fā)行、出租、征訂、附送、散發(fā)或者展示含有法律、行政法規(guī)和國(guó)家其他規(guī)定禁止內(nèi)容的出版物、出版物宣傳資料。禁止發(fā)行、出租、征訂、附送、散發(fā)或者展示非法進(jìn)口、侵犯他人著作權(quán)以及有法律、法規(guī)規(guī)定不得發(fā)行的其他情形的出版物、出版物宣傳資料。有前兩款規(guī)定禁止內(nèi)容或者情形的出版物的鑒定由市出版行政部門(mén)負(fù)責(zé),其所屬的出版物鑒定機(jī)構(gòu)可以承擔(dān)具體的鑒定工作。第二十三條市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)根據(jù)已經(jīng)取得的違法嫌疑證據(jù)或者舉報(bào),對(duì)涉嫌違法從事出版物發(fā)行活動(dòng)的行為進(jìn)行查處時(shí),可以檢查與違法活動(dòng)有關(guān)的物品;對(duì)有證據(jù)證明是與違法活動(dòng)有關(guān)的物品,可以查封或者扣押。行政執(zhí)法人員執(zhí)行公務(wù)時(shí)應(yīng)當(dāng)出示執(zhí)法證件。對(duì)被市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)告知禁止發(fā)行的出版物,從事出版物發(fā)行業(yè)務(wù)的單位和個(gè)人應(yīng)當(dāng)及時(shí)上繳或者聽(tīng)候處理,不得隱藏、變賣、轉(zhuǎn)移、毀損。第四章法律責(zé)任第二十四條違反本條例規(guī)定的行為,《出版管理?xiàng)l例》已規(guī)定處罰的,依照《出版管理?xiàng)l例》處罰。違反本條例規(guī)定的下列行為,由市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)視情節(jié)輕重給予處罰:(一)違反本條例第六條第一款規(guī)定,無(wú)許可證從事出版物出租業(yè)務(wù)的,責(zé)令停止違法行為,沒(méi)收違法所得,處二千元以下的罰款。(二)違反本條例第九條第一款規(guī)定,擅自設(shè)立出版物交易市場(chǎng)的,責(zé)令停止違法行為,沒(méi)收違法所得,違法所得在一萬(wàn)元以上的,處違法所得二倍以上十倍以下的罰款;沒(méi)有違法所得或者違法所得在一萬(wàn)元以下的,處五千元以上二萬(wàn)元以下的罰款。(三)違反本條例第十二條、第十六條第一款規(guī)定,增設(shè)直營(yíng)門(mén)店、接納加盟店或者通過(guò)互聯(lián)網(wǎng)開(kāi)展出版物發(fā)行業(yè)務(wù),未按規(guī)定備案的,責(zé)令限期改正,逾期未改正的,沒(méi)收違法所得,處一百元以上一千元以下的罰款。(四)違反本條例第十三條第一款規(guī)定,未辦理許可證變更手續(xù)的,責(zé)令限期改正,處一百元以上五百元以下的罰款。(五)違反本條例第十五條第一款規(guī)定,在核定的經(jīng)營(yíng)場(chǎng)所以外營(yíng)業(yè)的,責(zé)令改正,處五百元以上五千元以下的罰款。(六)違反本條例第十五條第二款規(guī)定,涂改、轉(zhuǎn)讓、出租或者出借許可證的,責(zé)令限期改正,沒(méi)收違法所得,處一千元以上一萬(wàn)元以下的罰款;情節(jié)嚴(yán)重的,并處責(zé)令停業(yè)整頓或者吊銷許可證。(七)違反本條例第十八條規(guī)定,從事出版物發(fā)行、出租業(yè)務(wù)的單位和個(gè)人或者出版物交易市場(chǎng),向無(wú)許可證的單位和個(gè)人批發(fā)出版物、購(gòu)進(jìn)出版物或者提供出版物發(fā)行經(jīng)營(yíng)場(chǎng)所的,沒(méi)收出版物和違法所得,處五百元以上五千元以下的罰款;情節(jié)嚴(yán)重的,并處責(zé)令停業(yè)整頓或者吊銷許可證。(八)違反本條例第十九條規(guī)定,未報(bào)送進(jìn)貨憑證復(fù)印件備案或者提供出版物樣本的,責(zé)令限期改正,逾期未改正的,每種出版物處五百元的罰款。(九)違反本條例第二十一條第二款規(guī)定,搭配銷售或者強(qiáng)行推銷中學(xué)小學(xué)教輔材料的,責(zé)令停止違法行為,沒(méi)收違法所得,處一千元以上五千元以下的罰款。(十)違反本條例第二十二條規(guī)定,出租、征訂、附送、散發(fā)、展示含有禁止內(nèi)容或者情形的出版物或者出版物宣傳資料的,沒(méi)收出版物或者出版物宣傳資料和違法所得,違法所得在一萬(wàn)元以上的,處違法所得二倍以上十倍以下的罰款;沒(méi)有違法所得或者違法所得在一萬(wàn)元以下的,處五千元以上二萬(wàn)元以下的罰款;情節(jié)嚴(yán)重的,并處責(zé)令停業(yè)整頓或者吊銷許可證。第二十五條對(duì)違反本條例規(guī)定向無(wú)許可證的單位和個(gè)人購(gòu)進(jìn)出版物,以及出租、征訂、附送、散發(fā)、展示的出版物或者出版物宣傳資料有本條例第二十二條規(guī)定內(nèi)容或者情形的,當(dāng)事人說(shuō)明、指認(rèn)來(lái)源,經(jīng)查證屬實(shí)的,除沒(méi)收出版物、出版物宣傳資料和違法所得外,可以減輕或者免除本條例規(guī)定的其他行政處罰。第二十六條對(duì)拒絕、阻礙行政管理部門(mén)工作人員依法執(zhí)行職務(wù),尚不夠刑事處罰的,由公安部門(mén)依照《中華人民共和國(guó)治安管理處罰條例》處理;構(gòu)成犯罪的,依法追究刑事責(zé)任。第二十七條當(dāng)事人對(duì)市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)的具體行政行為不服的,可以依照《中華人民共和國(guó)行政復(fù)議法》或者《中華人民共和國(guó)行政訴訟法》的規(guī)定,申請(qǐng)行政復(fù)議或者提起行政訴訟。當(dāng)事人對(duì)具體行政行為逾期不申請(qǐng)復(fù)議,不提起訴訟,又不履行的,作出具體行政行為的市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)可以申請(qǐng)人民法院強(qiáng)制執(zhí)行。第二十八條市出版行政部門(mén)或者區(qū)、縣負(fù)責(zé)出版管理的行政部門(mén)直接負(fù)責(zé)的主管人員或者其他直接責(zé)任人員玩忽職守、濫用職權(quán)、徇私舞弊的,由其所在單位或者上級(jí)主管部門(mén)依法給予行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。第五章附則第二十九條本條例有關(guān)用語(yǔ)的定義:報(bào)紙,是指有固定名稱、刊期、開(kāi)版,每周至少出版一期的連續(xù)出版物。期刊,是指有固定名稱和欄目,用卷、期或者年、季、月、旬、周順序編號(hào),成冊(cè)的連續(xù)出版物。圖書(shū),是指各類書(shū)籍、畫(huà)冊(cè)、掛歷、圖片、年畫(huà)、年歷等出版物。電子出版物,是指以數(shù)字代碼方式將圖文聲像等信息編輯加工后存儲(chǔ)在磁、光、電介質(zhì)上,通過(guò)計(jì)算機(jī)或者具有類似功能的設(shè)備讀取使用,用以表達(dá)思想、普及知識(shí)和積累文化,并可復(fù)制發(fā)行的大眾傳播媒體。第三十條本條例自2003年1月1日起施行?!渡虾J袌D書(shū)報(bào)刊市場(chǎng)管理?xiàng)l例》同時(shí)廢止。RegulationsofShanghai(Adoptedatthe44thSessionoftheStandingCommitteeofthe11thShanghaiMunicipalPeople'sCongressonOctober28,)ChapterIGeneralProvisionsArticle1TheseRegulationsareformulatedforthepurposesofstrengtheningtheadministrationofthedistributionofpublications,developingandprosperingculturalundertakings,andpromotingthesocialistideologicalandethicalconstruction,inaccordancewiththe"RegulationsontheAdministrationofPublications"bytheStateCouncilandinthelightofthisMunicipality'sactualcircumstances.Article2ThedistributionofpublicationmentionedintheseRegulationsreferstotheactsofthegeneraldistribution,wholesaleandretailbusinessoperationofnewspapers,periodicals,books,electronicpublicationsandaudio-videoproducts,andotherpublications.Article3TheseRegulationsshallapplytothedistributionanddistribution-relatedrenting,subscription-soliciting,giving-as-compliment,sending-out,andexhibitionofpublicationsandtheadministrationthereofinthisMunicipality'sadministrativearea.Wherethereareprovisionsotherwiseprovidedbyadministrativeregulationsonaudio-videoproducts,suchprovisionsshallprevail.Wherethereareprovisionsprovidedbythepostallawonpostalenterprises'distributionofnewspapersandperiodicals,suchprovisionsshallprevail.Article4TheShanghaimunicipaladministrativedepartmentofpressandpublication(hereinafterreferredtoasMPPA)shallbeinchargeofthesupervisoryandadministrativeworkofthisMunicipality'sdistributionofpublications,andshallberesponsiblefororganizingtheimplementationoftheseRegulations.ThedistrictandcountyadministrativedepartmentsinchargeoftheadministrationofpublicationshallberesponsibleforthesupervisoryandadministrativeworkofpublicationdistributionintheirrespectiveadministrativeareasandbeundertheleadershipoftheMPPAinprofessionalwork.Theadministrativedepartmentsofindustryandcommerceadministration,publicsecurity,pricecontrol,education,postalserviceandcustomsshall,accordingtotheirrespectiveduties,dowellinsupervisionandadministrativeworkrelatedtopublicationdistribution.Article5TheMPPAshall,accordingtotheactualneedsofdevelopmentoftheMunicipalityandtheculturaldemandsofcitizens,workoutthedevelopmentprogramforpublicationdistributionand,uponapprovalbytheMunicipalPeople'sGovernment,announcetheprogramtothemasses.Theestablishmentofdistributionunitsofpublicationsandtradingmarketsofpublicationsshallconformtotherequirementsoftotalamount,structureandlayoutsetforthbythisMunicipality'sdevelopmentprogramforpublicationdistribution.ChapterIILicensingofConductingPublicationDistributionArticle6ThisMunicipalityshalladoptthelicensingsystemofpublicationdistributionandrenting.Thosewhoareengagedinpublicationdistributionorrentingbusinessshallobtainthe"LicenseofPublicationDistribution"(hereinafterreferredtoastheLicense).UnitsthatareengagedingeneraldistributionbusinessofpublicationsandchainoperationbusinessofnationwidepublicationsshallgothroughlicensingformalitiesaccordingtotherelevantStateprovisions.Chinese-foreignequitablejointventures,Chinese-foreigncontractualjointventuresandforeign-fundedenterprisesthatareengagedinpublicationdistributionbusinessshalldoasprovidedbytheState.Article7Unitsengagedinpublicationwholesalebusinessorunitsandindividualpersonsengagedinpublicationretailbusinessorrentingbusinessshallmeetthefollowingconditions:(1)Havingmanagerialpersonnelthatmeettherequirementsofappropriatequalification;(2)Havingfixedbusinessoperationsitesandnecessarybusinessoperationfacilities;and(3)Havingregisteredcapitalincompliancewiththeprovisionsoflawsandregulations.Article8Thechainoperationofpublicationsincludesbothdirectchainoperationandalliedchainoperation.Unitsengagedindirectchainoperationbusinessshallmeetthefollowingconditions:(1)Havinglegalpersonality;(2)Havingthenumberofoutletsrequiredbytheindustrialandcommercialadministrativedepartment;(3)Havingtheadministrationsystemofchainoperationasrequired;and(4)Havingtheregisteredcapitalprovidedbylawsandregulations.Theunitengagedindirectchainoperationofpublicationsforoveroneyearmayconductalliedchainoperationbusinessofpublications.Thoseengagedinalliedchainoperationshallbetheunitsorindividualpersonsofpublicationdistributionestablishedwithpermission.Article9TheunitthatsetsupthetradingmarketofpublicationsshallhavethequalificationsforgeneraldistributionofpublicationsandhaveobtainedapprovalfromtheMPPA.Thetradingmarketofpublicationsshallmeetthefollowingconditions:(1)Havingmanagerialpersonnelthatmeettherequirementsofappropriatequalifications;(2)Havingtheadministrationsystemoftradingmarketrequiredbytheprovisions;(3)Havingtheregisteredcapitalandoperationsitesincompliancewiththeprovisionsoflawsandregulations.Article10Theunitapplyingforconductingwholesale,directchainoperationbusinessofpublicationsshalllodgeanapplicationtotheMPPA.Theunitandindividualpersonapplyingforconductingretailandrentingbusinessofpublicationsshalllodgeanapplicationtothedistrict/countyadministrativedepartmentinchargeofpublicationadministration.Article11TheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationdistributionshall,within20daysfromthedateofreceivingtheapplicationmaterialsforconductingdistributionandrentingbusinessofpublications,makeadecisionofapprovalordenialoftheapplication.Apermitshallbeissuedtotheapproved;andreasonsshallbegiveninwritingtothedenied.Theunitorindividualpersonthathasobtainedthepermituponapprovalshalltakeoutthebusinesslicensefromtheindustrialandcommercialadministrativedepartmentbeforebeingallowedtolaunchanybusinessactivity.Article12Thechainoperationunitofpublicationsthatsetsupanotherdirectoperationoutletinadditionshall,within20daysfromthebusinessopeningdateoftheoutlet,reporttotheMPPAfortherecord;thoseacceptingalliedoutletsshall,within20daysfromthedateofsigninganalliancecontract,reporttotheMPPAfortherecord.Article13Iftheunitsorindividualpersonsthatdistributeorrentpublicationsalterthebusinessscopeandbusinessformofpublicationdistribution,theyshallgothroughanewpermissionformalitiesaccordingtotheprovisionsofArticle6,Clause2andArticle10oftheseRegulations.Ifalteringothermatters,theyshallgothroughalterationformalitieswiththeoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration.Whentheunitsandindividualpersonsthatdistributeandrentoutpublications,terminatethedistributingandrentingactivities,theyshallgothroughcancellationformalitieswiththeoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration,andsurrenderthepermit.Whenthechainoperationunitsofpublicationsshutdowntheirdirectoperationoutletsorterminatethealliedstorecontracts,theyshallreporttotheMPPAfortherecordwithin20daysfromthedateofshuttingdowntheirdirectoperationoutletsorterminatingalliedstorecontracts.Iftheunitsandindividualpersonsthatdistributeandrentoutpublicationshavethecasessetforthintheprecedingthreeclauses,theyshallgothroughappropriateformalitieswiththeindustrialandcommercialadministrativedepartment.Article14Theunitsandindividualpersonsthatdistributeandrentoutpublicationsshallgothroughtheannualpermitinspectionformalitieswiththeoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration.TheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministrationshallinspectoverthefollowingmatters:(1)Conditionsforconductingpublicationdistributionandrentoutbusiness;(2)Anyactsofillegaloperation;and(3)AnyotheractsinviolationoftheprovisionsoftheseRegulationsonlicenseadministration.Thosewhofailintheinspectionordonotundergobeforethedeadlinetheinspectionshallnotcontinuetoconductthepublicationdistributionbusiness.ChapterIIIAdministrationofPublicationDistributionArticle15Theunitsandindividualpersonsthatdistributeandrentoutpublicationsshalldobusinessinthecheckedandratifiedoperationsites,andplacethepermitandbusinesslicenseontheconspicuouspositionofthecheckedandratifiedoperationsite.Thepermitandbusinesslicenseshallnotbealtered,transferred,leasedoutorlent.Article16Whentheunitsandindividualpersonsthatdistributepublications,launchdistributionbusinessthroughInternet,theyshallreporttotheoriginalapprovingauthority,theMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministrationfortherecordwiththepermit,websitenameorthenameofwebsitetheylinkto,e-mailaddressandotherrelevantmaterialsbeforelaunchingbusiness.IftheunitsandindividualpersonsthatdistributepublicationslaunchpublicationdistributionbusinessthroughInternet,theyshallhavethenumberofpermitofpublicationdistribution,thepermit-issuingdepartment,thenumberofreportfortherecord,thenameofpublicationinoperation,thepublishingunitandthestandardbooknumber,periodicalnumber,aswellaseditionnumber,andthenameofimportunitfortheimportedpublications,ifany,markedontheconspicuousplaceofwebsiteorwebpage.Article17Thepublicationtradingmarketshallsetupthemarketadministrationorganization,whichshallcontrolovertradingactivitiesinthemarketaccordingtorelevantprovisionssetbytheStateandthisMunicipality.Article18Publicationwholesaleunitsshallnotwholesalepublicationstoanyunitorindividualpersonthatdoesnothavealicence.Unitsandindividualpersonsthatdistributeandrentoutpublicationsshallnotpurchasepublicationsfromanyunitorindividualpersonthatdoesnothavealicence.Publicationtradingmarketsshallnotprovidebusinesssitesofpublicationdistributionforanyunitorindividualpersonthatdoesnothavealicence.Article19Publicationwholesaleunitsshall,withinthreedaysfromthedateofpurchase,submittheduplicateofpurchasevouchertotheMPPAfortherecord.WhereanypublicationisdistributedinthisMunicipalityforthefirsttime,theMPPA,ifitrequiresasampleofthepublication,shallnotifythepartyconcernedinwriting.Thepartyconcernedshall,withintheprescribedtimeperiodasnotifiedinwriting,providethepublicationsample.TheMPPAshall,within10daysfromthedateofreceivingthesample,completetheexaminationandreturnthesampletothepartyconcerned,exceptforthepublicationsamplewithcontentsorcasesbannedinArticle22oftheseRegulations.Article20Publicationdistributingunits,whenholdingpublicationexhibitionactivityinplacesotherthantheirbusinesssites,shall,beforeholdingtheexhibition,reporttothedistrict/countyadministrativedepartmentinchargeofpublicationadministrationinthelocalitywheretheexhibitionisheldfortherecord.Wherethepublicationdistributorsassociationholdspublicationexhibitionactivity,theprovisionsintheprecedingclauseshallbefollowed.Article21ThedistributionunitsofmiddleandprimaryschooltextbooksshallbedesignatedthroughbiddingorotheropenandimpartialformsbytheMPPAandtheeducationaladministrationtogetherwiththecompetentpricecontroldepartment.Anyotherunitsorindividualpersonsshallnotconductthedistributionbusinessofmiddleandprimaryschooltextbooks.Thedistributionunitsofmiddleandprimaryschooltextbooksshallnotselltie-inorimportunatelymiddleandprimaryschoolteachingauxiliarymaterials.Article22Nopublicationsorpublicationpublicitymaterialswithcontentsbannedbylaws,administrativeregulationsorotherState-setprovisionsshallbedistributed,rent,subscription-solicited,givenascompliment,sentoutorexhibited.Nopublicationsorpublicationpublicitymaterialsimportedillegally,infringinguponotherpersons'copyrights,andhavingothercasesthatdistributionisbannedbylawsandregulationsshallbedistributed,rent,subscription-solicited,givenascompliment,sentoutorexhibited.TheMPPAshallberesponsiblefortheappraisalofpublicationswithcontentsorcasesbannedintheprecedingtwoclauses,anditsaffiliatedpublicationappraisalagencymayundertakethespecificappraisalwork.Article23TheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration,when,basedontheobtainedevidenceofsuspectedoffenceorontip-offs,makinginvestigationoveractssuspectedofconductingillegalpublicationdistribution,mayexaminearticlesrelatedtoillegalactivities,andmaysealupordistrainarticlesprovedwithevidencetoberelatedtoillegalactivities.Administrativelawenforcersshallproducelaw-enforcementcertificationwhenperformingofficialduties.InrespecttopublicationswhosedistributionisbannedbynotificationoftheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministration,theunitorindividualpersonengagedinthedistributionbusinessofthepublicationsshallpromptlyhandtheminorwaitforhandling,withnoconcealment,selloff,shiftordestructionofsuchpublicationsbeingallowed.ChapterIVLegalLiabilityArticle24Wherethe"RegulationsonAdministrationofthePublication"haveprovidedpenaltiesonactsthatviolatetheprovisionsoftheseRegulations,suchactsshallbepunishedinaccordancewiththe"RegulationsonAdministrationofthePublication".ThefollowingactsinviolationoftheprovisionsoftheseRegulationsshallbepunishedbytheMPPAorthedistrict/countyadministrativedepartmentinchargeofpublicationadministrationaccordingtotheseriousnessofthecases:(1)Thosewho,inviolationoftheprovisionsofArticle6,Clause1oftheseRegulations,conductpublicationrentingbusinesswithoutlicenceshallbeorderedtostoptheirillegalacts,theirillegalgainsshallbeconfiscated,andtheyshallbepenalizedwithafineoflessthan2,000yuan.(2)Thosewho,inviolationoftheprovisionsofArticle9Clause1oftheseRegulations,setuppublicationtradingmarketswithoutauthorization,shallbeorderedtostoptheirillegalacts,theirillegalgainsshallbeconfiscatedandtheyshallbepenalizedwithafineofbetweennotlessthantwiceandnotmorethantentimestheillegalgainsiftheillegalgainsismorethan10,000yuan.Iftherearenoillegalgainsoriftheillegalgainsarelessthan10,000yuan,theyshallbepenalizedwithafineofbetweennotlessthan5,000yuanandnotmorethan20,000yuan.(3)Thosewho,inviolationoftheprovisionsofArticle12,Article16Clause1oftheseRegulations,addadirectoperationoutlet,takeinanalliedstore,orlaunchpublicationdistributionbusinessthroughInternetwithoutreportingfortherecordasrequiredshallbeorderedtocorrectwithinaprescribedtimeperiod,and,iftheyfailtocorrectbeforethedeadline,theirillegalgainsshallbeconfiscated,andtheyshallbepenalizedwithafinenotlessthan100yuanandnotmorethan1,000yuan.(4)Thosewho,inviolationoftheprovisionsofArticle13Clause1oftheseRegulations,failtogothroughthepermitalterationformalitiesshallbeorderedtocorrectwithinaprescribedtimeperiod,andbepenalizedwithafineofbetweennotlessthan100yuanandnotmorethan500yuan.(5)Thosewho,inviolationoftheprovisionsofArticle15Clause1oftheseRegulations,dobusinessinaplaceotherthanthecheckedandratifiedoperationsiteshallbeorderedtocorrect,andshallbepenalizedwithafineofbetweennotlessthan500yuanandnotmorethan5,000yuan.(6)Thosewho,inviolationoftheprovisionsofArticle15Clause2oftheseRegulations,alter,transfer,leaseorlendthelicenseshallbeorderedtocorrectwithinaprescribedtimeperiod,theirillegalgainsshallbeconfiscatedandtheyshallbepenalizedwithafineofbetweennotlessthan1,000yuanandnotmorethan10,000yuan.Ifthecaseisserious,thewrongdoershallbecumulativelyorderedtostopbusinessforrectification,orhavethelicencerevoked.(7)Anyunitorindividualpersonengagedinpublicationdistributionandrentingbusiness,orpublicationtradingmarketsthat,inviolationoftheprovisionsofArticle18oftheseRegulations,wholesale,orpurchasepublicationsfromorprovidepublicationoperationsitesforunitsorindividualpersonswhodonothavethelicence,shallhavethepublicationsandillegalgainsconfiscatedandshallbepenalizedwithafineofbetweennotlessthan500yuanandnotmorethan5,000yuan.Ifthecaseisserious,thewrongdoershallbecumulativelyorderedtostopbusinessforrectification,orhavethelicencerevoked.(8)Thosewho,inviolationoftheprovisionsofArticle19oftheseRegulations,failtosubmitduplicatesofpurchasevouchersfortherecord,orfailtoprovidesamplesofpublications,shallbeorderedtocorrectwithinaprescribedtimeperiodand,iftheyfailtocorrectbeforethedeadline,theyshallbepenalizedwithafineof500yuanforeachkindofpublications.(9)Thosewho,inviolationoftheprovisionsofArticle21Clause2oftheseRegulations,selltie-inorimportunatelymiddleandprimaryschoolteachingauxiliarymaterials,shallbeorderedtostoptheirillegalacts,havetheirillegalgainsconfiscated,andbepenalizedwithafineofbetweennotlessthan1,000yuanandnotmorethan5,000yuan.(10)Thosewho,inviolationoftheprovisionsofArticle22oftheseRegulations,rentout,solicitsubscriptionsfor,giveasacompliment,sendoutorexhibitpublicationsorpublicationpublicitymaterialswiththebannedcontentsorcasesshallhavethepublicationsorpublicationpublicitymaterialsandillegalgainsconfiscatedandbepenalizedwithafineofbetweennotlessthantwiceandnotmorethantentimestheillegalgainswhichismorethan10,000yuan,orbepenalizedwithafineofbetweennotlessthan5,000yuanandnotmorethan20,000yuaniftherearenoillegalgains,oriftheillegalgainsarelessthan10,000yuan.Ifthecaseisserious,thewrongdoershallbecumulativelyorderedtostopbusinessforrectificationorhavethelicencerevoked.Article25Whereapersonpurchasespublications,inviolationoftheprovisionsoftheseRegulation,fromunitsorindividualpersonsthatdonothavethelicenceorrents,solicitssubscriptionsfor,givesasacompliment,sendsoutorexhibitspublicationsorpublicationpublicitymaterialswithcontentsorcasessetforthinArticle22oftheseRegulations,andthatpersongivesoridentifiesthesourcewhichprovestrueafterverification,theadministrativepunishmentsetforthintheseRegulationsotherthantheconfiscationofpublications,publicationpublicitymaterialsandillegalgainsmaybemitigatedorexempted.Article26Thosewhoresistorimpedethefunctionariesofadministrativedepartmentsinperformingtheirdutiesaccordingtolaw,toanextentnotseriousenoughforcrimi
