元,僅用于支付因乙方責(zé)任給予消費(fèi)者的賠付及損害賠償。(1)PartyBwilleffectpaymentofyuanRMBasGuaranteeFundtoPartyA,whichwillbeusedonlyforthepaymentofclaimsanddamagestoconsumersduetoPartyB'sliability.（二）甲方應(yīng)設(shè)立專(zhuān)項(xiàng)賬戶(hù)并嚴(yán)格管理保障金，按照銀行同期存款利率計(jì)算保障金的利息。(b)PartyAshallsetupaspecialaccountandstrictlymanagetheguaranteefund,andcalculatetheinterestoftheguaranteefundinaccordancewiththedepositrateofthesameperiodoftimeofthebank.第八條甲方的權(quán)利和義務(wù)Article8PartyA’sRightsandObligations（一）甲方應(yīng)當(dāng)建立健全平臺(tái)內(nèi)交易規(guī)則（包括但不限于交易安全保障、交易內(nèi)容審查、消費(fèi)者權(quán)益保護(hù)、不良信息處理等管理制度）。甲方有權(quán)依據(jù)平臺(tái)服務(wù)合同與交易規(guī)則對(duì)乙方違反法律法規(guī)的行為實(shí)施警示、暫停或者終止服務(wù)等措施，并在采取相關(guān)措施之日起

日內(nèi)完成公示。(1)PartyAshallestablishandimprovetherulesfortransactionswithintheplatform(includingbutnotlimitedtothemanagementsystemfortransactionsafetysecurity,reviewoftransactioncontent,protectionofconsumerrightsandinterests,andhandlingofundesirableinformation).PartyAhastheright,inaccordancewiththeplatformservicecontractandtransactionrules,toimplementmeasuressuchaswarning,suspensionorterminationofservicesforthereasonofPartyB'sviolationoflawsandregulationsandshallcompletethepublicannouncementwithindaysfromthedateoftakingrelevantmeasures.第九條乙方的權(quán)利和義務(wù)Article9PartyB’sRightsandObligations（二）乙方有權(quán)在接到甲方轉(zhuǎn)送的知識(shí)產(chǎn)權(quán)權(quán)利人認(rèn)為其知識(shí)產(chǎn)權(quán)受到侵害的通知時(shí)提交附有不存在侵權(quán)行為證據(jù)的聲明。在甲方將該聲明及時(shí)轉(zhuǎn)送到知識(shí)產(chǎn)權(quán)權(quán)利人后十五日內(nèi)，未收到權(quán)利人已經(jīng)投訴或起訴通知的，乙方有權(quán)要求甲方及時(shí)終止所采取的措施。(2)PartyBhavetherighttosubmitastatementwithevidenceofnon-infringementuponreceiptofanotificationtransmittedbyPartyAfromanownerofintellectualpropertyrightsclaiminginfringementofitsrights.PartyBshall,within15daysuponPartyA’sdelivery,withoutdelay,ofthestatementtotheintellectualpropertyrightholderfromwhichnoanynoticeofcomplaintorlawsuit,havetherighttorequestPartyAtoterminatethemeasurestakenintime.（六）乙方應(yīng)全面、真實(shí)、準(zhǔn)確、及時(shí)地披露商品或者服務(wù)信息，保障消費(fèi)者的知情權(quán)和選擇權(quán)等。不得以虛構(gòu)交易、編造用戶(hù)評(píng)價(jià)等方式進(jìn)行虛假或者引人誤解的商業(yè)宣傳，欺騙、誤導(dǎo)消費(fèi)者。(6)PartyBshalldiscloseinformationongoodsorservicesinacomprehensive,truthful,accurateandtimelymannertosafeguardconsumers'righttoknowandchoose,etc.,andshallnotconductfalseormisleadingcommercialpropagandaintheformoffictitioustransactions,fabricateduser’sevaluations,etc.todeceiveormisleadconsumers.第十條合同的變更、解除和續(xù)期Article10Modification,CancellationandRenewalofContract（一）甲乙雙方協(xié)商一致，可以變更合同。法律、行政法規(guī)規(guī)定變更合同應(yīng)當(dāng)辦理批準(zhǔn)、登記等手續(xù)的，依照其規(guī)定。(1)Thetermsofthiscontractmaybechangedoramendedbytheconsensusofbothparties,howeverwherelawsoradministrativeregulationsprovidefortheformalitiesofapprovalorregistration,suchprovisionsshallprevail.（二）合同有效期間，因不可抗力影響合同履行時(shí)，甲乙雙方可以依法解除本合同的權(quán)利義務(wù)，甲方已收取的乙方已經(jīng)支付的費(fèi)用按照約定以下處理：(2)Duringtheeffectiveperiodofthecontract,iftheperformanceofthiscontractisaffectedbyforcemajeure,PartyAandPartyBmayterminatetherightsandobligationshereunderinaccordancewiththelaw,andthefeesthatPartyAhasalreadycollectedandPartyBhasalreadypaids
