RepairAgreement修理協(xié)議

ThisRepairAgreement(“Agreement”)isenteredintobetweenthecustomer(“Customer”)andtherepairserviceprovider(“Provider”)onthedateofrepairservice.

本修理協(xié)議（以下簡稱“協(xié)議”）是由客戶（以下簡稱“客戶”）和修理服務(wù)提供商（以下簡稱“提供商”）在維修服務(wù)當(dāng)天簽署的。

TheProvideragreestoproviderepairservicestotheCustomer,subjecttothetermsandconditionssetforthinthisAgreement.

提供商同意按照本協(xié)議規(guī)定的條款和條件為客戶提供維修服務(wù)。

Services服務(wù)

TheProvidershallproviderepairservicesonthefollowingitems:

*電子產(chǎn)品（手機(jī)、電腦等）

*家居設(shè)備（冰箱、空調(diào)、洗衣機(jī)等）

*汽車和摩托車

TheProvidershallproviderepairservicesinatimelyandprofessionalmanner,usingcompetentandexperiencedtechnicians.

提供商應(yīng)該及時、專業(yè)地提供維修服務(wù)，并使用有能力和經(jīng)驗的技術(shù)人員。

Fees費(fèi)用

Thepartiesagreethatthefeesfortherepairservicesshallbecalculatedaccordingtothefollowingterms:

*根據(jù)維修服務(wù)所需的工時計算費(fèi)用

*根據(jù)所需的零部件計算費(fèi)用

*一次性收取維修服務(wù)費(fèi)用

Thefeesfortherepairservicesshallbepaidinfullbeforetheservicesarerendered.

在提供維修服務(wù)之前，必須全額支付維修服務(wù)費(fèi)用。

Warranties保修

TheProviderwarrantsitsrepairservicestotheCustomerforaperiodof90daysfromthedateofservice.IfthedefectormalfunctionisduetotheProvider’sworkmanshiporparts,theProvidershallrepairorreplacethedefectivepartsatnochargetotheCustomer.

提供商為客戶提供的維修服務(wù)的保修期為服務(wù)日起90天。如果故障或故障歸因于提供商的工藝或部件，則提供商應(yīng)免費(fèi)維修或更換有缺陷的部件。

IfCustomerengagesathirdpartytoworkonanyequipmentthatwasservicedbytheProvider,theProvider’swarrantyshallbevoidandtheProvidershallnotbeliableforanydamages,expenses,orlossesarisingfromsuchthirdpartywork.

如果客戶聘請第三方對提供商已服務(wù)的任何設(shè)備進(jìn)行維修，提供商的保修將失效，并且提供商不對由該第三方工作引起的任何損害、費(fèi)用或損失承擔(dān)責(zé)任。

LimitationofLiability責(zé)任限制

Totheextentpermittedbylaw,theProvidershallnotbeliableforanydamages,expenses,orlossesarisingfromanycauserelatedtotherepairservicesprovidedunderthisAgreement,includingbutnotlimitedtopersonalinjury,propertydamage,lostprofits,oranyotherconsequential,incidental,orindirectdamages.

在法律允許的范圍內(nèi)，提供商不對本協(xié)議下提供的維修服務(wù)與損壞、費(fèi)用或損失有關(guān)的任何原因承擔(dān)責(zé)任，包括但不限于人身傷害、財產(chǎn)損失、損失利潤或任何其他附帶、偶然或間接損失。

GoverningLawandJurisdiction適用法律和司法管轄

ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsofthejurisdictionwheretherepairservicesareprovided.AnydisputesarisingfromorrelatedtothisAgreementshallbesubjecttotheexclusivejurisdictionofthecourtsinthatjurisdiction.

本協(xié)議應(yīng)受法律規(guī)管，并按照提供修理服務(wù)的司法管轄區(qū)的法律進(jìn)行解釋。由本協(xié)議引起或與本協(xié)議有關(guān)的任何爭議均應(yīng)受該司法管轄區(qū)法院的專屬管轄。

Miscellaneous其他條款

ThisAgreementconstitutestheentireagreementbetweenthepartiesandsupersedesallpriororcontemporaneousagreementsorunderstandings,whetherwrittenororal,relatingtothesubjectmatterofthisAgreement.

本協(xié)議構(gòu)成雙方之間的全部協(xié)議，并取代所有與本協(xié)議主題相關(guān)的先前或同時的書面或口頭協(xié)議或理解。

ThisAgreementmaynotbeamended,modified,orchangedexceptinwritingsignedbybothparties.

除非雙方均簽署書面協(xié)議，否則本協(xié)議不得修改、修改或更改。

ThefailureofeitherpartytoenforceanyprovisionofthisAgreementshallnotbeconstruedasawaiverofsuchprovisionortherighttoenforcesuchprovision.
