的支付、解除及留置權(quán)放棄的書面承諾”。該等書面承諾應(yīng)附有：Requiredforeachprogresspaymentshallbeone"ContractorAffidavitofPayment,Release,andWaiverofLiensforProgressPayment"fortheWorkcoveredbytheApplicationforPayment.Attachedtothataffidavitshallbethefollowing:針對(duì)付款申請(qǐng)金額中可歸因于分包商和材料供應(yīng)商工程的部分，從該等分包商（包括材料供應(yīng)商）獲得下列其中一項(xiàng)分包商和材料供應(yīng)商的書面承諾：OneofthefollowingsubcontractorsandmaterialsupplieraffidavitsfromeachSubcontractors,includingeachmaterialsupplier,forthatportionofthesumsetforthintheApplicationwhichisattributabletohisportionoftheWork:(1)如果其工程仍在進(jìn)行中，“分包商和材料供應(yīng)商對(duì)分期付款的支付、解除及留置權(quán)放棄的書面承諾”。A"SubcontractorsandMaterialSupplierAffidavitofPayment,Release,andWaiverofLiensforProgressPayment"iftheWorkbyhimisstillinprogress.(2)如果其工程已竣工，“分包商和材料供應(yīng)商對(duì)最終付款的支付、解除及留置權(quán)放棄的書面承諾”。A"SubcontractorsandMaterialSupplierAffidavitofPayment,Release,andWaiverofLiensforFinalPayment"iftheWorkbyhimiscomplete.TheCompanyacknowledgestoEDCthatitremainsliabletoEDCtoperformalltheliabilitiesandobligationsassumedbytheCompanyundertheContract.公司向EDC承諾仍然承擔(dān)合同規(guī)定的應(yīng)向EDC履行的相關(guān)責(zé)任和義務(wù)。受托人在本承諾函項(xiàng)下對(duì)貴司的付款義務(wù)無附加條件，受托人承諾不因委托人未履行與受托人的約定或認(rèn)為貴司違反目標(biāo)協(xié)議或其他原因而抗辯履行本承諾函項(xiàng)下的付款義務(wù)。委托人與受托人在委托款項(xiàng)的金額范圍內(nèi)承擔(dān)連帶付款責(zé)任。如果受托人未能在規(guī)定期限按規(guī)定方式支付全部委托款項(xiàng)，則視為受托人違反了本承諾函、委托人違反了本承諾函及目標(biāo)協(xié)議。貴司可以向委托人與受托人同時(shí)求償并追究違約責(zé)任。TheConsigneeshallpayyouaccordingtothisPromisewithoutanyadditionalcondition.AndtheConsigneepromisesnottodefendanypayingobligationunderthisPromisebecausetheConsignorfailstoperformtheagreementwiththeConsigneeortheConsignordeemsyouhavebreachedthetargetagreementoranyotherreason.TheConsignerandtheConsigneeshallundertakeincidentalresponsibilityintheamountrangeoftheentrustedpayment.IftheConsigneefailstopayallentrustedpaymentinthespecifiedtimeandinspecifiedterm,thentheConsigneewillbedeemedashasbreachedthisPromise,andtheConsignorhasbreachedthisPromiseandthetargetagreement.Y
