博士后科研能力提升計劃合同編號：__________甲方（用人單位）：__________地址：__________聯(lián)系電話：__________乙方（博士后研究員）：__________身份證號碼：__________通訊地址：__________聯(lián)系電話：__________鑒于甲方為乙方提供博士后研究機會，乙方向甲方提供科研服務，雙方為明確雙方的權(quán)利義務，經(jīng)友好協(xié)商，特訂立本合同，共同遵照執(zhí)行：第一條研究方向與課題1.1乙方researchdirectionandtopicduringthepostdoctoralperiod,asapprovedthe甲方researchteam,shallbeconsistentwiththedevelopmentstrategyandresearchfieldsofthe甲方.Thespecificresearchtopicshallbeagreeduponbothparties.1.2The甲方shallprovidenecessaryresearchconditions,resourcesandguidancetosupporttheresearchworkofthe乙方.第二條合同期限2.1Thetermofthiscontractshallbe__________yearsstartingfromthedateofsigning.2.2Thecontractmaybeextendeduponmutualagreementofbothparties.第三條乙方的義務3.1The乙方shallcarryouttheresearchworkwithduediligenceandintegrity,andmakecontinuouseffortstoachieveexcellenceinresearch.3.2Duringthetermofthecontract,the乙方shallnotengageinanyotherpaidemploymentorconductanyresearchthatconflictswiththeinterestsofthe甲方.第四條甲方的義務4.2The甲方shallprovidethe乙方withresearchfacilities,resourcesandworkingconditionsnecessaryfortheresearchwork.4.3The甲方shallassistthe乙方inapplyingforrelevantresearchfundsandprovidenecessarysupportfortheresearchprojects.第五條成果歸屬與分享5.1Theresearchresultsgeneratedthe乙方duringthetermofthecontractshallbeownedthe甲方,unlessotherwiseagreedbothparties.5.2The甲方andthe乙方shallnegotiateandagreeonthesharingofeconomicbenefitsderivedfromtheresearchresults,inaccordancewithrelevantlawsandregulationsandtheactualcontributionofeachparty.第六條保密義務6.1Bothpartiesshallkeepconfidentialanybusiness,technicalorotherconfidentialinformationobtainedfromtheotherpartyduringthetermofthiscontract,unlesssuchinformationispubliclyknownorshouldbeknownthereceivingparty.6.2Theconfidentialityobligationshallsurvivetheexpirationorterminationofthiscontract.第七條違約責任7.1Ifeitherpartybreachesanymaterialprovisionofthiscontract,theotherpartymayterminatethiscontractandclaimdamages.7.2Thepartiesagreetoresolveanydisputesarisingoutoforinconnectionwiththiscontractthroughnegotiation.Ifnegotiationfails,eitherpartymaysubmitthedisputetothePeople'sCourtwithjurisdictionovertheplacewherethe甲方islocated.第八條其他8.1Thiscontractmaybeamendedorsupplementedwrittenagreementofbothparties.8.2ThiscontractshallbeeffectiveuponthesigningbothpartiesandshallbevalidforthetermspecifiedinArticle2.8.3IncaseofanydiscrepancybetweentheEnglishversionandtheChineseversionofthiscontract,theChineseversionshallprevail.INWITNESSWHEREOF,thepartieshaveexecutedthiscontractasofthedatefirstabovewritten.甲方（用人單位）：__________By:____________________________Name:__________________________Title:__________________________Date:__________________________乙方（博士后研究員）：__________By:____________________________Name:__________________________Title:__________________________Date:__________________________一、附件列表：1.博士后研究員的個人簡歷2.研究計劃書3.甲方研究團隊的介紹4.甲方提供的科研資源和設施清單5.甲方和乙方簽署的保密協(xié)議6.知識產(chǎn)權(quán)聲明7.研究經(jīng)費申請表格8.科研成果分享協(xié)議二、違約行為及認定：1.乙方未按照合同約定進行科研工作，或未能達到約定的研究目標。2.乙方未經(jīng)甲方同意，從事與合同約定的研究相沖突的其他研究工作或就業(yè)。3.乙方未按照約定保護甲方提供的保密信息。4.甲方未按照約定提供乙方所需的科研資源和條件。5.甲方未按照約定支付乙方的薪酬和福利。6.甲方未按照約定協(xié)助乙方申請研究經(jīng)費。三、法律名詞及解釋：1.博士后研究員：指在博士后科研能力提升計劃中，由甲方聘請進行科學研究工作的人員。2.科研服務：指乙方按照合同約定進行的科學研究工作。3.知識產(chǎn)權(quán)：指研究過程中產(chǎn)生的專利、著作權(quán)等法律保護的權(quán)利。5.科研經(jīng)費：指用于支持乙方進行科研工作的資金。四、執(zhí)行中遇到的問題及解決辦法：1.研究進展緩慢：乙方應與甲方溝通，尋求額外支持和資源；甲方應提供必要的技術和資金支持。2.保密信息泄露：乙方應加強保密意識，遵守保密協(xié)議；甲方應定期進行保密培訓。3.研究經(jīng)費不足：
