Thesubjectmatterofthisinsuranceisthevessel,includingitshull,lifeboats,machinery,equipment,instruments,tackles,bunkersandstores.

ThisinsuranceisclassifiedintoTotalLossCoverandAllRisksCover.

ScopeofCover

TotalLossCover

Thisinsurancecoverstotallossoftheinsuredvesselcausedby:

earthquake,volcaniceruption,lightningorothernaturalcalamities;

grounding,collision,contactwithanyobject,fixed,floatingorotherwise,orotherperilsoftheseas;

fireorexplosions;

violenttheftbypersonsfromoutsidethevesselorpiracy;

jettison;

breakdownoforaccidenttonuclearinstallationsorreactors;

thisinsurancealsocoverstotallossoftheinsuredvesselcausedby:

accidentsinloading,dischargingorshiftingcargoorfuel;

anylatentdefectinamachineryorhullofthevessel;

wrongfulactswillfullycommittedbythemasterorcrewtotheprejudiceoftheInsured'sinterest;

negligenceoftheMaster,creworpilots,repairersorcharterers;

actsofanygovernmentalauthoritytopreventorminimizeapollutionhazardresultingfromdamagetothevesselcausedbyrisksinsuredagainst;

providedsuchlosshasnotresultedfromwantofduediligencebytheInsured,OwnersorManagers.

ThisinsurancecoverstotallossoforpartiallossofordamagetotheinsuredvesselarisingfromthecausesundertheTotalLossCoverandalsocoverstheundermentionedliabilityorexpense:

CollisionLiabilities

ThisinsurancecoverslegalliabilitiesoftheInsuredasaconsequenceoftheinsuredvesselcomingintocollisionorcontactwithanyothervessel,oranyobject,fixed,floatingorotherwise.Howeverthisclausedoesnotcoveranyliabilitiesinrespectof:

lossoflife,personalinjuryorillness;

cargoorotherpropertyon,orengagementsof,theinsuredvessel;

removalordisposalofobstructions,wrecks,cargoesoranyotherthingwhatsoever;

pollutionorcontaminationofanypropertyorthingwhatsoever（includingcostofpreventivemeasuresandclean-upoperations）exceptpollutionorcontaminationoftheothervesselwithwhichtheinsuredvesselisincollisionorpropertyonsuchothervessel.

indirectexpensesarisingfromdelaytoorlossofuseofanyobject,fixed,floatingorotherwise.

Wheretheinsuredvesselisincollisionwithanothervesselandbothvesselsaretoblame,thenunlesstheliabilityofoneorbothvesselsbecomeslimitedbylaw,theindemnityunderthisclauseshallbecalculatedontheprincipleofcross-liabilities.Thisprinciplealsoapplieswhentheinsuredvesselcomesintocontactwithanobject.

TheInsurer'sliability（includinglegalcosts）underthisclauseshallbeinadditiontohisliabilityundertheotherprovisionsofthisinsurance,butshallnotexceedtheinsuredamountofthevesselherebyinsuredinrespectofeachseparateoccurrence.

GeneralAverageandSalvage

Thisinsurancecoverstheinsuredvessel'sproportionofgeneralaverage,salvageorsalvagecharges,butincaseofgeneralaveragesacrificeofthevessel,theInsuredmayrecoverfullyforsuchlosswithoutfirstobtainingcontributionsfromotherparties.

Generalaverageshallbeadjustedinaccordancewiththerelativecontractand/orgoverninglawandpractice.However,wherethecontractofaffreightmentorcarriagedoesnotsoprovide,theadjustmentshallbeaccordingtotheBeijingAdjustmentRulesorsimilarprovisionsofotherrules.

WhereallthecontributinginterestsareownedbytheInsured,orwhentheinsuredvesselsailsinballastandtherearenoothercontributinginterests,theprovisionsoftheBeijingAdjustmentRules(excludingArticle5),orsimilarprovisionsofotherrulesifexpresslyagreed,shallapplyasiftheinterestswereownedbydifferentpersons.Thevoyageforthispurposeshallbedeemedtocontinueformtheportorplaceofdepartureuntilthearrivalofthevesselatthefirstportorplaceofcallthereafterotherthanaportorplaceofrefugeoraportorplaceofcallforbunkeringonly.Ifatanysuchintermediateportorplacethereisanabandonmentoftheadventureoriginallycontemplatedthevoyageshallthereuponbedeemedtobeterminated.

SueandLabour

Wherethereislossordamagetothevesselfromaperilinsuredagainstorwherethevesselisinimmediatedangerfromsuchaperil,andasaresultreasonableexpenditureisincurredbytheInsuredinordertoavertorminimizealosswhichwouldberecoverableunderthisinsurance,theInsurerwillbeliablefortheexpensessoincurredbytheInsured.Thisclauseshallnotapplytogeneralaverage,salvageorsalvagechargesortoexpenditureotherwiseprovidedforinthisinsurance.

TheInsurer'sliabilityunderthisclauseisinadditiontohisliabilityundertheotherprovisionsofthisinsurance,butshallnotexceedanamountequaltothesuminsuredinrespectofthevessel.

Exclusions

Thisinsurancedoesnotcoverloss,damage,liabilityorexpensecausedby:

unseaworthinessincludingnotbeingproperlymanned,equippedorloaded,providedthattheInsuredknew,orshouldhaveknown,ofsuchunseaworthinesswhenthevesselwassenttosea.

negligenceorintentionalactoftheInsuredandhisrepresentative.

ordinarywearandtear,corrosion,rottennessorinsufficientupkeep,ordefectinmaterialwhichtheInsuredshouldhavediscoveredwithduediligence,orreplacementoforrepairtoanypartinunsoundconditionasmentionedabove.

III

Deductible

Partiallosscausedbyaperilinsuredagainstshallbepayablesubjecttothedeductiblestipulatedinthepolicyforeachseparateaccidentoroccurrence(excludingclaimsundercollisionliability,salvageandgeneralaverage,andsueandlabour).

Claimsfordamagebyheavyweatheroccurringduringasingleseapassagebetweentwosuccessiveportsshallbetreatedasbeingduetooneaccident.

Thisclauseshallnotapplytoaclaimfortotallossofthevessel,andthereasonableexpenseofsightingthebottomaftergrounding,ifincurredspeciallyforthatpurpose.

IV

Shipping

UnlesspreviouslyapprovedbytheInsurerandanyamendedtermsofcoverandadditionalpremiumrequiredhavebeenagreed,thisinsurancedoesnotcoverloss,damage,liabilityandexpensecausedunderthefollowingcircumstance:

towageorsalvageserviceundertakenbytheinsuredvessel;

cargoloadingordischargingoperationatseafromorintoanothervessel（notbeingaharbourorinshorecraft）includingwhilstapproaching,lyingalongsideandleaving;

theinsuredvesselsailingwithanintentionofbeingbrokenuporsoldforbreakingup.

V

PeriodofInsurance

ThisinsuranceisclassedintoTimeInsuranceandVoyageInsurance.

TimeInsurance:Thelongestdurationisoneyear,thetimeofcommencementandterminationbeingsubjecttothestipulationinthepolicy.Shouldtheinsuredvesselattheexpirationofthisinsurancebeatseaorindistressorataportofrefugeorofcall,sheshall,providedpreviousnoticebegiventotheInsurer,beheldcoveredtoherportofdestinationwiththepaymentofanadditionalproratadailypremium.However,incaseofatotallossofthevesselduringsuchperiodofextension,anadditionalsixmonthspremiumshallbepaidtotheInsurer.

VoyageInsurance:tobesubjecttothevoyagestipulatedinthepolicy.Thetimeofcommencementandterminationtobedealtwithaccordingtothefollowingprovisions;

Withnocargoonboard:tocommencefromthetimeofunmooringorweighinganchorattheportofsailinguntilthecompletionofcastinganchorormooringattheportofdestination.

Withcargoonboard:tocommencefromthetimeofloadingattheportofsailinguntilthecompletionofdischargeattheportofdestination,butinnocaseshallaperiodofthirtydaysbeexceededcountingfrommidnightofthedayofarrivalofthevesselattheportofdestination.

VI

Termination

Thisinsuranceshallterminateautomaticallyintheeventofpaymentfortotallossoftheinsuredvessel.

UnlesspreviouslyagreedbytheInsurerinwriting,thisinsuranceshallterminateautomaticallyatthetimeofanychangeoftheClassificationSocietyoftheinsuredvessel,changeof,cancellationorwithdrawalofherclasstherein,changeintheownershiporflag,assignmentortransfertonewmanagement,charteronabareboatbasis,requisitionfortitleoruseofthevessel,providedthat,ifthevesselhascargoonboardorisatsea,suchterminationshall,ifrequired,bedeferreduntilarrivalathernextportorfinalportofdischargeordestination.

Incaseofanybreachofwarrantyastocargo,voyage,tradinglimit,towage,salvageservicesordateofsailing,thisinsuranceshallterminateautomaticallyunlessnoticebegiventotheInsurerimmediatelyafterreceiptofadviceandanyadditionalpremiumrequiredbeagreed.

VII

PremiumandReturns

TimeInsurance:Fullpremiumshallbedueandpayableonattachment,andifagreedbytheInsurerpaymentmaybemadebyinstallments,butintheeventoftotallossoftheinsuredvessel,anyunpaidpremiumshallbeimmediatelydueandpayable.

Premiumisreturnableasfollows:

Ifthisinsuranceiscanceledorterminated,premiumshallbereturnedproratadailynetfortheuncommenceddays,butthisclauseshallnotbeapplicabletoclause

VI

Wheretheinsuredvesselislaidupinaportoralay-upareaapprovedbytheInsurerforaperiodexceedingthirtyconsecutivedaysirrespectiveofwhethersheisunderrepairsindockorshipyard,loadingordischarging,50%（fiftypercent）ofnetpremiumforsuchperiodshallbereturnedproratadaily,butinnocaseshallsuchreturnofpremiumberecoverableintheevenoftotallossofthevessel.

IntheeventofanyreturnrecoverableunderthisclausebeingbasedonthirtyconsecutivedayswhichfallonsuccessiveinsuranceseffectedforthesameInsured,suchreturnofpremiumshallbecalculatedprorataseparatelyforthenumberofdayscoveredbyeachinsurance.

VoyageInsurance:Innocaseshallvoyageinsurancebecancelableandthepremiumthereofbereturnableonceitcommences.

VIII

DutyofInsured

Immediatelyuponreceiptofadviceofanyaccidentorlosstotheinsuredvessel,itisthedutyoftheInsuredtogivenoticetotheInsurerwithin48hours,andifthevesselisabroad,totheInsurer'snearestagentimmediately,andtotakeallreasonablemeasuresforthepurposeofavertingorminimizingalosswhichwoulderecoverableunderthisinsurance.

MeasurestakenbytheInsuredortheInsurerwiththeobjectofavertingorminimizingalosswhichwouldberecoverableunderthisinsuranceshallnotbeconsideredaswaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

TheInsuredshallobtainprioragreementoftheInsurerindeterminingtheliabilitiesandexpensesinrespectoftheinsuredvessel.

Insubmittingaclaimforloss,theInsuredshalltransfertotheInsurerallnecessarydocumentsandassisthiminpursuingrecoveryagainstthethirdpartyincaseofthirdpartyliabilitiesorexpensesbeinginvolved.

IX

Tender

Wheretheinsuredvesselisdamagedandrepairsarerequired,theInsuredshalltakesuchtendersasadiligentuninsuredownerwouldtaketoobtainthemostfavourableofferfortherepairsofthedamagedvessel.

TheInsurermayalsotaketendersormayrequirefurthertenderstobetakenfortherepairofthevessel.WheresuchatenderisacceptedwiththeapprovaloftheInsurerandallowanceinrespectoffuelandstoresandwagesandmaintenanceofthemasterandcrewshallbemadeforthetimelostbetweenthedespatchoftheinvitationstotenderrequiredbytheInsurerandtheacceptanceofatender,butthemaximumallowanceshallnotexceedtherateof30%perannumontheinsuredvalueofthevessel.

TheInsuredmaydecidetheplaceofrepairofthedamagedvessel,however,iftheInsuredintakingsuchdecisionsdoesnotactasadiligentuninsuredowner,thentheInsurershallhavearightofvetoconcerningtheplaceofrepairorarepairingfirmdecidedbytheownerordeductanyincreasedcostsresultingtherefromfromtheindemnity.

ClaimandIndemnity

（1）Incaseofaccidentorlossinsuredagainst,noclaimshallberecoverableshouldtheInsuredfalltosubmitclaimdocumenttotheInsurerwithintwoyearsfollowingtheaccidentorloss.

TotalLoss

WheretheinsuredvesseliscompletelydestroyedorsoseriouslydamagedastoceasetobeathingofthekindinsuredorwheretheInsuredisirretrievablydeprivedofthevessel,itmaybedeemedanactualtotalloss,andthefullinsuredamountshallbeindemnified.

Wherenonewsisreceivedofthewhereaboutsoftheinsuredvesseloveraperiodoftwomonthsafterthedateonwhichsheisexpectedtoarriveattheportofdestination,itshallbedeemedanactualtotallossandthefullinsuredamountshallbeindemnified.

Whereanactualtotallossoftheinsuredvesselappearstobeunavoidableorthecostofrecovery,repairand/orsalvageortheaggregatethereofwillexceedtheinsuredvalueofthevessel,itmaybedeemedaconstructivetotallossandthefullinsuredamountshallbeindemnifiedafternoticeofabandonmentofthevesselisgiventotheInsurerirrespectiveofwhethertheInsureracceptstheabandonment.OncetheInsureracceptstheabandonment,thesubjectmatterinsuredbelongstotheInsurer.

PartialLoss

Claimsunderthisinsuranceshallbepayablewithoutdeductionnewforold.

Innocaseshallaclaimbeadmittedinrespectofscraping,derustingorpaintingofthevessel'sbottomunlessdirectlyrelatedtorepairsofplatingdamagedbyaninsuredperil.

Whererepairsforowner'saccountnecessarytomakethevesselseaworthyand/oraroutinedrydockingarecarriedoutconcurrentlywithrepairscoveredbythisinsurance,thenthecostofenteringandleavingdockandthedockduesforthetimespentindockshall
