16、資分配制度，結(jié)合乙方的勞動技能、勞動強(qiáng)度、勞動條件、勞動貢獻(xiàn)等確定，實行同工同酬。第十一條甲方應(yīng)嚴(yán)格執(zhí)行吉林省企業(yè)工資支付暫行規(guī)定，及時足額支付乙方的勞動報酬，不得克扣或無故拖欠。第十二條甲方安排乙方延長工作時間或者在法定休息日、法定節(jié)假日工作的，應(yīng)依法安排乙方補(bǔ)休或者按照國家、吉林省相關(guān)規(guī)定向乙方支付加班費(fèi)。五、社會保險、福利待遇第十三條甲乙雙方必須按國家和吉林省有關(guān)社會保險的法律、法規(guī)和政策規(guī)定參加社會保險，依法為乙方繳納各項社會保險費(fèi)。其中，個人繳費(fèi)部分，甲方可從乙方工資中代扣代繳。第十四條乙方在合同期內(nèi)，休息休假、患病或非因工負(fù)傷、患職業(yè)病或因工負(fù)傷、生育、死亡等待遇，以及醫(yī)療期、孕期

18、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動安全衛(wèi)生及有關(guān)規(guī)章制度的教育和培訓(xùn)，提高乙方思想覺悟、職業(yè)道德水準(zhǔn)和職業(yè)技能。第二十條乙方應(yīng)認(rèn)真參加甲方組織的各項必要的教育培訓(xùn)。七、勞動合同的履行、變更第二十一條甲乙雙方按照本合同的約定，依法、全面履行各自的義務(wù)。甲方應(yīng)當(dāng)提供適當(dāng)?shù)墓ぷ鲌鏊?、勞動條件和工作崗位，并按時向乙方支付勞動報酬。第二十二條乙方應(yīng)當(dāng)認(rèn)真履行自己的勞動職責(zé)，并親自完成本合同約定的工作任務(wù)。第二十三條甲、乙雙方協(xié)商一致，可以變更本合同約定的內(nèi)容。并采用書面形式確定。八、勞動合同解除、終止和經(jīng)濟(jì)補(bǔ)償?shù)诙臈l甲乙雙方解除或者終止本合同，應(yīng)當(dāng)按照勞動合同法第、條和吉林省勞動合同條例第、條規(guī)定執(zhí)行。第二十

19、五條甲乙雙方解除或者終止本合同，符合勞動合同法第條規(guī)定情形的，甲方應(yīng)依法向乙方支付經(jīng)濟(jì)補(bǔ)償。第二十六條經(jīng)濟(jì)補(bǔ)償按乙方在甲方工作的年限，每滿一年支付一個月工資的標(biāo)準(zhǔn)向乙方支付。六個月以上不滿一年的，按一年計算；不滿六個月的，向乙方支付半個月工資的經(jīng)濟(jì)補(bǔ)償。如乙方月工資高于本市上年度職工月平均工資三倍的，向其支付經(jīng)濟(jì)補(bǔ)償?shù)臉?biāo)準(zhǔn)按本市上年度職工月平均工資三倍的數(shù)額支付，向其支付經(jīng)濟(jì)補(bǔ)償?shù)哪晗拮罡卟怀^十二年。本條所稱月工資是指乙方在本合同解除或者終止前十二個月的平均工資。第二十七條本合同期限屆滿前三十日內(nèi)，甲方要將終止或續(xù)訂勞動合同意向，以書面形式通知乙方。第二十八條甲方應(yīng)當(dāng)在與乙方解除或者終止本合

20、同之日起十五日內(nèi)，出具解除或者終止勞動合同的證明，并為乙方辦理檔案和社會保險關(guān)系轉(zhuǎn)移手續(xù)。乙方應(yīng)當(dāng)按照本合同約定，與甲方辦理工作交接。甲方應(yīng)當(dāng)向乙方支付經(jīng)濟(jì)補(bǔ)償?shù)?，在辦結(jié)工作交接手續(xù)時支付給乙方。第二十九條甲方違法解除或者終止本合同，乙方要求繼續(xù)履行本合同的，甲方應(yīng)當(dāng)繼續(xù)履行；乙方不要求繼續(xù)履行本合同或者本合同已經(jīng)不能繼續(xù)履行的，甲方應(yīng)當(dāng)依照勞動合同法第八十七條規(guī)定執(zhí)行。乙方違法解除勞動合同，或者違反勞動合同中約定的保密義務(wù)或者競業(yè)限制，給甲方造成損失的，應(yīng)當(dāng)承擔(dān)賠償責(zé)任。九、其它事項第三十條甲方為乙方提供專項培訓(xùn)費(fèi)用，對其進(jìn)行專業(yè)技術(shù)培訓(xùn)，雙方可以訂立專項協(xié)議，約定服務(wù)期。乙方違反服務(wù)期約定
