信用證軟條款列舉

1、常見(jiàn)的軟條款有這些： 一， 信用證必須獲得外匯當(dāng)局批準(zhǔn)后才生效。 有時(shí)候我們收到的信用證規(guī)定：該信用證必須獲得外匯主管當(dāng)局的核準(zhǔn)才能生效。如： This credit will be operative solely when we get the authority permission that we have already requested. 或者 This credit shall become operative only receipt by us the authorization to that effect of XXX Exchange Institution. 二，

2、受益人必須等到開(kāi)證銀行或者申請(qǐng)人另外通知后才能使該證。 有些信用證中附加了限制條件，如： This credit will be operative only after receipt of further instruction 或 Shipping date to be instructed by the buyer from the opening bank through the advising bank 或 This credit is subject to shipping sample to be accepted by XXX Trading Co.,and verifie

3、d by cable from the opening bank to be advised through the advising bank. 三， 信用證規(guī)定貨物運(yùn)抵目的港后，或經(jīng)過(guò)檢驗(yàn)才能獲得付款。 有時(shí)候買(mǎi)家為了保證貨物按時(shí)運(yùn)抵目的港， 或?yàn)榱吮ＷC貨物的只來(lái)年感， 經(jīng)常在信用證中規(guī) 定，貨物在抵達(dá)目的港后?；蚪?jīng)過(guò)檢驗(yàn)后才能獲得貨款。例如， Letter of copy or cable advice from XXX customers brokers or carrier certifying that the merchandise has arrived in XXX（ 目的

4、港） ，又如 ,Documents are to be delivered on trust receipt to the above account party for the purpose of arranging entry and inspection of the goods by the US Food and Drug Administration（ 做食品藥品的注意 ） upon receipt a written statement from above account party to the effect that merchandise has been insoec

5、ted and released the US Food and Drug Administration.The draft under thi s credit will be paid by us.It s understand that we shall not be responsible for the form,scope,validity enforce ability and the enforcement of such trust receipt. 四，信用證規(guī)定的某些單據(jù)必須由進(jìn)口商或者代理人簽署才能辦理押匯的 （大家經(jīng)常碰到的） 有時(shí)信用證規(guī)定， 某些單據(jù)必須由進(jìn)口商等

6、出具或簽字， 我們出口商才能辦理信用證下的押 匯。如，In spect ion Certificate to be issued by XXX Tradi ng Co.,或 Commercial in voice to be countersigned by the buyer. 五， 信用證下的付款時(shí)間不確定 有的信用證雖然承諾向出口商付款，但是到底什么時(shí)候付款，他又不說(shuō)。如，Payment by us will be subject to receipt of sterling cover from our XXX （place） office 或 Payment under this c

7、redit will be made by us only after arrival of goods in XXX（Place） and availability of Foreign Currency cover from Center Bank of XX. 六， 信用證要求出口商提交不一定能取得到的單據(jù)（大家經(jīng)常碰到的）主要有這些： （一）,運(yùn)輸單據(jù)，如， （1） Container B/L must mark“under deck ”. （2）B/L must be marked“absolutely will not be transshipped” （3）Container B

8、/L with optional stowage clause not accepted. B/L must indicate net net weight（ 凈 凈重）， net weight,gross weight and measurement. （二 ），保險(xiǎn)單據(jù)，如： (1) Insurance policy covering all risks of loss or damage whatsoever cause arising,marine insurance policy covering WA and FPA. (2) Insurance policy issued by

9、XXX insurance company XXX required. (3) Marine insurance policy covering WA against all risks. (三)，檢驗(yàn)報(bào)告，如： (1) Inspection certificate issued by the buyer required. (2) Beneficiary must inform the buyer to inspect the goods at least 7days before loading. (四)，領(lǐng)事發(fā)票 (1) Consular invoice in duplicated is

10、sued by consul of XXX required. (2) Consular invoice issued by consul of XXX required. 七， 虛假的保兌條款 有的銀行雖然自稱(chēng)為保兌銀行，但是該銀行不承擔(dān)真實(shí)的保兌責(zé)任，如， we conform this credit and subject to opening bank s sufficient deposit in our bank,we under and in compliance with the terms of this credit. 八， 貨運(yùn)保險(xiǎn) (1)Marine in sura n

11、ee .for full in voice value plus about 10%. ( 2)Insurance policy ndorsed in blank covering marine and war risks for approximately 10% above CIF value ( 3)Marine WA and war risks indurance certificate in duplicate covering 10% above the CIF of goods including full cover warehouse to warehouse( 承保水漬險(xiǎn)和

12、戰(zhàn)爭(zhēng)險(xiǎn)的海上保險(xiǎn)憑證一 式兩份，保額為上述CIF貨價(jià)全額加10%，保險(xiǎn)期間為倉(cāng)到倉(cāng)) (4) Marine and war risks on usual Lloyd s con按按通常的勞合社險(xiǎn)別承保海上風(fēng)險(xiǎn) 和戰(zhàn)爭(zhēng)險(xiǎn) ) ( 5)Covering all risks including war. (6)Insurance policy in favor of ourselves covering ordinary ocean risks up to XXX(place) ( 7)Insurance to be effected with an insurance company approv

13、ed by us. 九， 貨物運(yùn)輸 (出現(xiàn)較多的 ) (1)Comb ined tran sport shipme nt allowed.tra nssihent not allowed. ( 2)Shipment by approved vessel ( 3)Shipment by standard vessel ( 4)Airway bill without transshipment (5) Ocean bills of loading evidencing shipment from Guangzhou to XX(place) (6) B/L must be dated not la

14、ter than March.1,2008.This credit to expire March,1,2008. (7) Shipment must be effected 60 days before receipt of B/L. ( 8)Cargo must arrive at New York not later than March 5,2008. 十， 信用證的有效期 (常見(jiàn)的 ) (1) We call your attention that this credit is valid for presentation of documents reaches this offi

15、ce. （ 2）Nogotiation must be effected on March 20,2008. （ 3）Draft drown under this L/C must be presented for negotiation within 10 days before the date of shipment. 十一，寄送單據(jù) （謹(jǐn)慎 ） （ 1）Negotiating bank is to forward all docunments to opening bank one airmail within 24 hours after date of Bill of Loadin

16、g. （ 2）All documents to arrive not later than arrival of carrying vessel.Expense caused by non-arrival of docume nts or incomplete documents for shipper s account. （ 3）One set of shipping documents must be airmailed directly to the buyer in one week before shipment has been made and beneficiary s ce

17、rtificate ti this effect is required. （ 4）All documents must bindicate accountee as shipper. 一般審單要注意的事有如下 : 1, 信用證是不是不可撤消的？UCP600規(guī)定,所有信用證都是不可撤消的信用證 2, 是即期的還是遠(yuǎn)期的 ?要是遠(yuǎn)期的 ,利息是由哪方承擔(dān) ?能否請(qǐng)求貼現(xiàn) ? 3, 信用證使用哪種貨幣 ?兌匯風(fēng)險(xiǎn)由哪方承擔(dān) ? 4, 受益人 ,申請(qǐng)人的名稱(chēng) , 地址是否完整和正確 ? 5, 信用證的單價(jià)，總金額是否和合同的規(guī)定相符？是否有about或approximate等字樣？金額 和數(shù)量是否成正比關(guān)系 ? 6, 信用證號(hào)碼是佛人存在前后矛盾? 7, 信用證的有效期到幾時(shí) ?以哪個(gè)地方為準(zhǔn) ?規(guī)定是否合理 ?能否有充足的時(shí)間發(fā)貨 ? 8, 信用證規(guī)定的裝貨港和卸貨港是佛人與買(mǎi)賣(mài)合同的規(guī)定相符? 9, 信用證規(guī)定的裝運(yùn)期是否合理?出口商是否來(lái)的及租船訂倉(cāng)?是否存在雙到期 ?（裝運(yùn)期和有 效期為同一期限 ） 10, 信用證對(duì)船舶是否有限制? 11, 對(duì)轉(zhuǎn)運(yùn) ,分批扎有什么規(guī)定 ? 12, 信用證是否規(guī)定要使用匯票?使用的話金額是多少 ?是否以出口商為出票人 ? 13, 押匯的時(shí)候要提交哪些單據(jù)?這些單據(jù)的數(shù)量是多少?取得這些單據(jù)是否有困難?其中的 規(guī)定是否與合同的規(guī)定相
