1、建筑裝飾工程施工合同Contract發(fā)包方（簡稱甲方）Party A:承包方（簡稱乙方）：上海巧點裝飾設計有限公司Party B: i-point design (Inspiration Point Design)根據 <中華人民共和國合同法><中華人民共和國消費者權益保護法><中華人民共和國價格法><上海市合同格式條款監(jiān)督條例>,< 上海市建筑市場管理條例>, 以及其他有關法律法規(guī)規(guī)定的原則，結合本工程的具體情況，甲、乙雙方在平等、自愿、協商一致的基礎上達成如下協議，共同遵守Accordi ng to:“PRC Contract L

2、aw ”, “Law on the Protection of Consumer Interests”, “PRC Price Law ”,“Shanghai Supervision of Contract Terms”, “Shanghai Construction Market Management Regulations”, as well asother laws and regulations relevant to the specific circumstances of this project, parties A and B have herebyequally and v

8、1. 乙方提供的材料：乙方供應的材料、設備 , 如不符合設計、施工要求，應禁止使用。如已使用，對工程造成的損失由乙方負責。如甲方要另增加材料由甲方供應，并應符合下列規(guī)定：Material provided by Party B: Any materials or equipment supplied by Party B which do not meet thedesign and construction requirements are prohibited. Any extra materials requested by Party A whichwere not in the or

9、iginal design must be paid for by Party A.2. 甲方提供的材料：另擬補充附件 <甲方提供材料、設備表 >甲方負責采購供應的材料、設備，應符合設計施工要求的合格產品，并應按時供應到現場。乙方發(fā)現甲方提供的材料、設備有質量問題或規(guī)格差異，應及時向甲方提出，甲方仍要求使用的，由此造成工程損失，責任由甲方承擔。甲方供應的材料按時抵達現場后，由乙方負責保管Material provided by Party A: (see the annex:“Table of Materials to be provided by the Owner”).If P

10、arty A acquires materials for the project, it should first check with Party B that the materialsmatch to the design requirements, and once the materials are in the care of Party B, then Party B isresponsible for the materials. 11、shall be the responsibility of Party A to pay any additional costs incurred by Party B.四、關于工程質量及驗收的約定FULFILMENT OF THIS AGREEMENT1.本工程應符合 <建筑裝飾工程技術規(guī)程>和市建設行政主管部門制定的其它地方標準質量評定驗收標準The execution of this project must be consistent with the“Architectural and Engineering Rules” ofthe city administrat

12、ive departments responsible for the development of buildings and local standardsand quality evaluation acceptance criteria.2. 本工程由乙方進行設計，提供施工圖紙一式兩份，雙方簽字確認3Party B must provide a duplicate copy of the construction designs and drawings, and both copiesshould be signed by both parties.3. 甲方提供的材料、設備質量不合

13、格而影響工程質量，其返工費用由甲方承擔，工期相應順延If materials provided by Party A for the construction do not meet the necessary requirements, Party A shall bear responsibility for any resulting delays in the completion in the project.4. 由于乙方原因造成質量事故，其返工費用由乙方承擔If the quality of Party B's work results in any accidents,

14、 the liability for such accidents shall bethe responsibility of Party B.5.在施工過程中，甲方提出設計修改意見及增減工程項目，須提前與乙方聯系，在雙方簽訂<工程項目變更單>后，方能進行該項目的施工、因此影響工程竣工日期的，責任由甲方承擔。凡甲方私自與施工人員商定更改施工內容、增加施工項目所引起的一切后果，甲方自負，給乙方造成損失的，甲方應予賠償If, during the construction, Party A wishes to propose a change to the design, he sho

15、uld sign a“Change of Project” with Party B and must assume responsibility for resulting delays or increasein costs. If Party A secretly attempts to change to design directly with the construction personneland this action causes loss to Party B, then Party A must compensate Party B for this loss.6. 工

16、程驗收：乙方負責理隱蔽工程和中間工程的檢查與驗收手續(xù)。由乙方組織專門人員進行驗收。一切理隱蔽工程和中間工程的質量由乙方負責The standard of work. It is the responsibility of Party B to make sure that all construction worksare carried out to the requirements of the design and to make sure that all internal walls andhidden construction parts are to the required s

17、tandard.7.工程竣工：乙方完工后即應通知甲方驗收，甲方應在竣工當日組織驗收，并辦理驗收移交手續(xù)，雙方簽<工程質量驗收單 >。如果甲方在規(guī)定時間內不能組織驗收，須及時通知乙方，另定驗收日期。如通過竣工驗收，甲方應承認原竣工日期，并承擔因此造成的乙方的看管費用和其他相關費用Project completion. Party B must notify Party A when the project is complete and ready forinspection by Party A. After inspection both parties must sign an

18、“Engineering Quality Acceptance”document. If Party A is not available to inspect the construction site on the completion date, hemust notify Party B of the soonest available date. Where Party A is not available on the completiondate to retake custody of the location, he must pay any extra costs incu

19、rred by Party B.8. 工程保修期一年。工程竣工驗收后甲、乙雙方簽署<工程保修單 >，憑保修單實行保修，保修期一年，從竣工驗收簽章之日起算One year warranty. After completion of the work and signing of the“Single Warranty”, there shall4be a one year warranty on the construction.五、有關安全生產和防火的約定SAFE PRODUCTION AND FIRE REGULATIONS1.施工圖紙和施工說明應符合防火防事故的要求，主要包括電

20、氣線路等管道暢通、合格。乙方在施工中應采取必要的安全防護和消防措施，保障作業(yè)人員及相鄰關系的安全, 防止相鄰單位的管道堵塞、滲漏水、停電、物品毀壞等事故發(fā)生Construction drawings and construction must be in line with fire prevention regulations, andaccident prevention requirements. This includes electrical circuits and pipelines. Party B shalltake measures to ensure the safety

21、 of workers and neighbors at the constructions site and mustprevent leakage of water, interruptions of power and damage to property.2. 施工中凡涉及改變房屋結構，拆、改承重墻，加大樓（地）面荷載，由甲方向物業(yè)管理部門提出申請，經所在地建設行政主管部門批準后方能施工Any changes to the housing structure or demolition or alteration to load bearing walls or increasein

22、floor load must first be approved by the building property management before construction begins.3. 雙方款項往來均應出具正規(guī)收據和發(fā)票，以備查驗和結算Both parties must provide money exchange receipts and invoices.六、其它事項OTHER MATTERS1. 甲方工作Party A1. 甲方應在開工前確認施工圖紙并騰出足夠的施工空間，以清除影響施工的障礙物。甲方向乙方提供施工需用的水、電等必備條件，并說明使用注意事項When Party

25、struction plans, and the construction must be durable, and must meetthe scheduled completion date.七、違約責任LIABILITY FOR BREACH OF CONTRACT1. 由于甲方原因導致延期開工或中途停工，工期順延If Party A causes any delays to the completion of this project, then the scheduled completion date should be adjusted accordingly.2.由于乙方原因逾

26、期竣工的，每逾期一天，乙方向甲方支付工程造價0.1 ( 大寫 : 千分之一 ) 的違約金If Party B causes any delay to the completion of this project, then Party B must pay to Party A a feeof 0.1 (in words: 1/1000)of the total overall project fee for each day beyond the scheduled completion date.3. 甲方未辦理有關手續(xù)，強行要求乙方拆改原有建筑承重結構及共用設備管線，由此發(fā)生的損失或事故

27、（包括罰款）由甲方負責并承擔責任If Party A instructs Party B to make any alterations to a load bearing wall and Party A has not soughtand received permission from the building property management, Party A shall be responsible for anyresulting costs and shall indemnify Party B for any additional expenses incurred.4.

28、 乙方擅自拆改原有建筑承重結構或共用設備管線，由此發(fā)生的損失或事故（包括罰款），由乙方負責并承擔責任If Party B makes any unauthorized changes to load bearing walls or building pipelines and such changesresult in damages or loss, it shall be the responsibility of Party B to pay for such loss.5.工程未辦理驗收、結算手續(xù)，甲方提前使用或擅自動用工程成品由此造成無法驗收和損失的, 由甲方負責并承擔責任Part

29、y A shall be responsible for any extra costs incurred due to his use of the property before thefinal completion meeting and signing of the“Engineering Quality Acceptance” document.八、糾紛處理方式DISPUTES61. 因工程質量雙方發(fā)生爭議時，憑本合同文本向有關行業(yè)協會申請調解，也可向所在區(qū)、縣建設行政主管部門或消費者協會投訴If there is a dispute between the parties, th
