2、he Lease or Rent Contract Law of die People's Republic Of China and related regulations provided by the Tianjin government.根據(jù)中華人民共和國租賃合同法甲乙雙方在自愿、平等、互利的基礎(chǔ)上,經(jīng)協(xié)商 一致,訂立本合同。內(nèi)容如下:1: Tiie property to be leased is described as 出租物業(yè):Location 地點:Area而積:2: Rental fees 租金:2.1: RMB per month.房屋月租為人民幣元:大寫:萬 仟
3、 佰 拾 元整。2.2: Rental should be payable onmonth base in advance The first rental shall bepaid before moving in and the following rental shall be received by within theday ofeach succeeding month's term.租金每個月付一次。具體付款日期:前支付,甲方收到為準(zhǔn)。2.3: Any delayed of the rental shall be charged 0.2% of the monthly r
4、ental day by day as a pcnalty. Delayed payment more than 7 days shall be regarded as a breach of the contract, THE LESSOR shall have the right to take back the premises after a prior written notice to THE LESSEE, and THE LESSEE shall bear all the responsibilities caused by such breach乙方如逾期支付租金,每逾期一天
5、,則乙方需按月租金的0.2%支付滯納金,欠交租金 超過七天,視同違約,甲方有權(quán)收回房屋,并由乙方承擔(dān)一切違約責(zé)任。2.4: Rental is to be paid in cash in RMB YUAN.THE LESSOR will make out receipt租金以人民幣支付,甲方出具收據(jù)。3:押金 Deposit:3.1: At the time of signing of the contract, a deposit of months" equivalent rental RMB shall be paid by THE LESSEE in cash.簽約時,承租人
6、須支付相當(dāng)于月房租的押金,即人民幣元整。該押金不得沖抵房款。3.2: The deposit shall be refundable after its expiration or early termination (with same currency and with no interest thereupon), providing all furnishings, contents and rental property- are not subject to any loss of unusual damage. and all the various bills have bee
7、n duly settled.在合同到期或解約后,甲方在乙方不拖欠任何費用和保持室內(nèi)設(shè)施完好的情況下即返 還押金。4:租期 Lease term:4.1: From the date / to / for continuousmonths .If residence is overstayed, one month rent is due to lessor, even if over say is less than one month.乙方租用該房期限為個月,即自 年 月 日至 年 月 日止。超過該租期,不足一個月按一個月計算。4.2: No early termination eithe
8、r by THE LESSOR or by THE LESSEE is allowed during the lease period; otherwise, one month rental penalty for such early termination shall be paid to the counter party.在租賃合同期內(nèi),甲乙雙方任何一方未經(jīng)對方同意中途擅自解除合同的,應(yīng)向?qū)Ψ街?付一個月的房租作為違約金。4.3: At its expiration ,with a must of 30 days prior written notice to THE LESSOR.
9、 THE LESSEE retains his priority to renew this lease. THE LESSOR shall also inform THE LESSEE 30 days in advance whether the rental will be adjusted. If the occupants decide not to renew lease within THE LESSEE* term. THE LESSEE shall give a prior written notice to THE LESSOR.本合同期滿時,乙方有優(yōu)先續(xù)租權(quán),但須提前30天
10、給予甲方書而通知,取得甲方的同 意,并簽訂續(xù)租合同。甲方亦須在30天前通知乙方是否變動租金。4.4: If Force Majeure (such as earthquake, typhoon, flood, non-man-made fire, government order etc.)Cause to terminating the contract, THE LESSEE and THE LESSOR should be free of duty.因洪水、地震、或政府拆遷、征用等不可抗力原因,造成雙方不得不中止合同,雙方 不承擔(dān)違約責(zé)任,按實際天數(shù)計算房租。4.5: In case t
11、hat the property ownership is transferred during the lease, THE LESSEE has the right to continue to use the said premises according to the contract without any disturbance from THE LESSOR or any the third party.在租賃期間,甲方的房屋所有權(quán)發(fā)生轉(zhuǎn)移,乙方有權(quán)繼續(xù)主張本合同的權(quán)利和義務(wù), 甲方及第三方不能損害乙方的權(quán)利和義務(wù)。5: Lease Term租賃條件:5.1: These pre
12、mises are limited of residential use only by THE LESSEE and are prohibited from registering as legal address for any company or agency, or using as public office乙方不得將該房屋用作公司或代表處的注冊地址。5.2: THE LESSEE shall not carry in the premises any unlawful of illegal activities which are not allowed according to
13、 China laws and the leasing regulations of the government. Otherwise, THE LESSOR shall have the right to take back the premises after a prior written notice to THE LESSEE 乙方不得在岀租房屋內(nèi)進行違反中國法律及政府對岀租房屋用途有關(guān)規(guī)立的行為,否 則甲方有權(quán)在書而通知乙方后收回房屋。5.3: THE LESSEE shall not partly or totally sublet, sell, lend, mortgage,
14、 exchange, exchange the said premises or use it so as to raise any joint-venture or become a certain shareholder without the written permission from THE LESSOR. Otherwise, THE LESSOR can terminate the contract and confiscate the deposit. THE LESSEE and the third party shall return the property uncon
15、ditionally to THE LESSOR. THE LESSEE shall bear all the responsibilities caused here from未經(jīng)甲方書而同意,乙方不得將出租房屋轉(zhuǎn)租、分租、轉(zhuǎn)讓、轉(zhuǎn)借、聯(lián)營、入股、抵 押或與他人調(diào)劑交換使用,否則甲方有權(quán)終止合同并沒收押金。乙方及第三方必須無條件 退還出租房,且由乙方承擔(dān)一切違約責(zé)任。5.4: THE LESSEE should pay in time the water, gas, electricity ? heating fee, the Tel-Bills, TV receiving , managi
16、ng fee and the lease related invoice taxes on actual user basis Delayed payment more than 15 days shall be regarded as a breach of the contract. THE LESSOR shall have the right to take back the premises after a prior written notice to THE LESSEE, and THE LESSEE shall bear all the responsibilities ca
17、used by such breach乙方應(yīng)按時支付因租用該出租房屋而產(chǎn)生的有關(guān)費用,包括:水費、電費、煤氣費、 曖氣費、存車費、電話費和有線電視收視費、物業(yè)管理費、發(fā)票稅金等費用。如經(jīng)甲方催 促,乙方仍欠交費用,超過15天,中方有權(quán)收回房屋,并由乙方承擔(dān)一切違約責(zé)任。5.5: The damage of the premises or the fittings that is within the control of THE LESSEE shall be borne by THE LESSEE; And THE LESSEE shall contact the management of
18、fice or THE LESSOR instantly If THE LESSEE refuses to compensate or to contact the management office to repair, THE LESSOR shall have the right to repair and charge the cost from THE LESSEE. Tlic cost of repairs to the said premises, if damaged by Force Maj cure (such as earthquake, typhoon, flood,
19、non-man-madc fire, etc.), reasonable wear and tear or by accidents beyond THE LESSEE% control should be borne by THE LESSOR.因乙方使用不當(dāng),房屋及其內(nèi)的設(shè)施出現(xiàn)損壞,乙方應(yīng)及時聯(lián)絡(luò)管理機構(gòu)進行維修, 并負(fù)擔(dān)有關(guān)維修費用。若乙方拒不維修或賠償,甲方有權(quán)代為維修,維修所需費用由乙方 承擔(dān):但由于不可抗力.如地震、臺風(fēng)、洪水、非人為的火災(zāi)等.自然損耗或乙方以外的 原因造成的損壞,由甲方承擔(dān)冇關(guān)費用。5.6: THE LESSEE, upon written permission
20、 ofTHE LESSOR, may make additions or alterations dealing with water, electricity supply or fire protection, at his own expense, subject to necessaiy permits or licenses required by the authorities concerned and under the supervision of TIIE LESSOR No structural alterations can be removed from the pr
21、emises, upon expiration or termination of this contract. No reimbursement for said additions and any structural damage to the premises must be repaired or compensated by THE LESSEE租賃期內(nèi),乙方對出租房屋進行裝修或增加設(shè)施須征得甲方同意并經(jīng)政府冇關(guān)部門批 準(zhǔn),并由甲方執(zhí)行監(jiān)理,所需費用由乙方承扣。雙方解約時,乙方不能移走口行添加的結(jié) 構(gòu)性設(shè)施,甲方亦不必對上述添加設(shè)施進行補償。如損壞原有Z設(shè)施,由乙方負(fù)責(zé)修復(fù)或 賠償
22、。5.7: THE LESSEE shall obey the regulations made by the management office such as not to litter or take any private use of public area and etc.租用房屋z內(nèi)部衛(wèi)生,設(shè)施保養(yǎng)、維護均由乙方負(fù)責(zé)。乙方不得占用公共場所及通道 作任何用途。5.8: THE LESSEE shall have the right to move in after paying off the deposit and the first term of rental.乙方在付清押金
23、,首期租金后即叮入住。5.9: In case there is a cut of water, power or any other hitch which is caused by the accident beyond the control ofTHE LESSEE, THE LESSOR shall take the responsibility to assist and push the authorities concerned to repair and resume it as soon as possible若由于甲方以外原因?qū)е鲁鲎夥课萃Kk娀蚱渌收?,甲方有義務(wù)敦
24、促并協(xié)助有 關(guān)部門搶修,使之盡快得以恢復(fù)。5.10: THE LESSEE shall not store in or out of the premises any inflammable or dangerous thing, nor let any corrosive or dirty thing come out of the premises乙方須做好安全及防火工作,不得在房屋內(nèi)外存儲或排放有害,腐蝕性或污臭物質(zhì), 嚴(yán)禁存儲易燃,易爆品。5.11: Insurance: THE LESSOR will retain insurance on his property and belo
25、ngings, and THE LESSEE will be responsible for his own property brought into or kept in proximity of the premises .If there is anything lost, THE LESSOR shall assist to conduct investigations, but has no responsibility to compensate it.乙方須負(fù)責(zé)好自己帶來的財物,妥善保管,如有總外,甲方可協(xié)助調(diào)查,但不負(fù)責(zé)賠 償。5.12: THE LESSEE shall r
26、eturn the property intact to THE LESSOR at the expiration of the contract if there is no renewal thereupon. THE LESSOR shall have the right to take any effective measures to take back the premises in case that THE LESSEE refuses to move out at the expiration of the contract.租賃期滿,若甲、乙雙方未達(dá)成續(xù)租協(xié)議,乙方應(yīng)于租期屆滿時或之前遷離出租房屋 并將鑰匙及房屋按租用時之狀況歸還甲方。若乙方逾期不遷離或不歸還岀租房屋,則甲方 有權(quán)采取有效措施收回出租房屋并另行處理。5.13: THE LESSOR or his nominees, with the p
