1、中英文對照租房合同公寓租賃協(xié)議TENANCYAGREEMENT租方:【李寶華】(以下簡稱出租方)(代理人:王峰)Lessor:(hereinafterknownastheLessor).承租方:GIOVANNIDILIBERTO(以下簡稱承租方)。Lessee:(hereinafterknownastheLessee).中介方:【湖岸天地地產(chǎn)顧問有限公司】(以下簡稱中介)Agent:RelocateChinaCompanyLtd(hereinafterknownastheAgent)1,鑒于:WHEREAS:出租方愿意根據(jù)下述條款和條件出租、承租方愿意承租位于該物業(yè)的6-1005單元供其本人或
2、其家人居住(住戶)。TheLessorisagreeabletoleasingout,andtheLesseeisagreeabletoleasing,theapartmentNo.is6-1005inthesaidPropertyasresidencefortheLessees/clientsandhisfamilymembers(Residents)inaccordancewiththefollowingtermsandconditions.就上述事宜,雙方茲協(xié)議如下:Bothpartieshaveenteredintothefollowingagreementwithregardtoth
3、eabovematter:2.出租標的ThePremises:位于中華人民共和國【江蘇省*工業(yè)園區(qū)】的名為【和喬麗晶公寓】的16-1005】單元的全裝修房屋,該房屋總建筑面積約為【130.59平方米,該房屋的配備列于承租人簽收的財產(chǎn)清單之中(以上統(tǒng)稱租賃單元)。ThepremisewithrenovationsandfurnishingsisapartmentBlock6-1005inChateauRegencySIP,215021withaGrossFloorAreaof130.59sqm(hereinafterknownasthePremises).TheFurnishingshavebe
4、enincludedinthepropertyinventorylist.3.房屋用途RentalPurpose:租賃單元僅供居住之用,承租人不得將其用于任何其他用途,也不應將其用于任何違法或不道德行為;未征得出租方之書面同意,承租方不得以任何形式將租賃單元的全部或任何部分轉(zhuǎn)讓、轉(zhuǎn)租或分享給任何第三方。ThePremisesisonlymeantforresidentialpurposes.TheLesseeshallnotusethePremisesoranypartthereofforany川egalorimmoralpurposeorforanyotherpurpose.TheLesse
5、eshallbeforbiddenfromtransferring,sublettingorsharingalloranypartthereofofthePremisestoanythirdpartyinanywaypriortoobtainingwrittenconsentfromtheLessor.4.租賃期限LeaseTerm:租賃期限:租期由2019年3月05日起至2019年3月04日止。(12個月).Thetenancytermshalllastfrom1st/Jan/2019to31st/Dec/2019(12months).5.租金TheRent:房屋租金(人民幣3900元/月)
6、;RentforthePremises(RMB3900/month);包括:Includes:(1)寬帶安裝費;InstallationfeeonTelephoneBroadband;(2)物業(yè)費TaxFeeandManagementfee除上述內(nèi)容之外,其他服務均不包括在租金之內(nèi)。房租尤其不包括:Besidestheaboveitems,otherservicesprovidedbytheLessororitsauthorizedmanagingagentshallnotbeincludedintheRent,especiallythefollowing:(1)寬帶使用費Internetus
7、ingfee.(2)能源使用費(水、電、煤)Utilities(water,gas,electricity).(3)清潔服務CleaningService(4)本地有線電視費LocalCableFee(5)衛(wèi)星電視安裝InstallationfeeofSATTV6.押金SecurityDeposit:相當于人民幣4000元的押金。租賃期滿:承租方需在租約期滿當日搬出單元,在租約期滿后,若屬終止合同,出租方在承租方付清由承租方支付的所有費用后,且不損壞房屋、家電、家具的前提下遷空、點清、交還房屋及設施和所有家電、家具,出租方在7天內(nèi)將全部退還承租押金(不計利息)至承租方。若出租方于到期日7日后仍
8、未能支付,則應就每一遲延退款日,按應退款項金額的0.5%/日之標準向承租方支付滯納金,直至全部款項清償完為止。RequiredonemonthrentalRMB4000asthesecuritydeposit,LesseeshallvacatethePropertyontheexpirydateofthisContract.IfeitherpartydoesntwishtorenewthisContractuponitsexpiry,Lessorshallreturnthe100%deposit(withoutinterest)within7daystoLesseeafterLesseehas
9、clearedtheentirerentalandfees,dontdamageanyfurnitureappliance.TheLessorshallpayafineof0.5%oftheamountdueperdayforeachdaythatdepositisnotreturnedaftersevendaysfromtheduedate,untilalloverduepaymentsarepaid.7.續(xù)租ExtensionofLease租賃期限屆滿,若承租人于租賃期內(nèi)沒有任何違反本協(xié)議項下的任何條款的行為,則承租人可以選擇續(xù)租,但應至少于租賃期限屆滿的兩個月前將此一意圖書面通知出租人,
10、新的租賃條款和條件將由雙方按屆時的情況協(xié)商確定。UpontheexpirationofthisAgreement,theLesseemay,ifithasnotbreachedanyofthetermsandconditionsasstipulatedinthisAgreementduringtheTermchoosetoextendthetermoftheAgreement.However,theLesseeshallgiveatleastwrittennotificationofsuchintentionatleasttwomonthspriortotheexpirationofthete
11、nancytotheLessor.ThetermsandconditionsoftherenewedtenancytermshallbenegotiatedbetweentheParties,basedontheprevailingcircumstances.8.付款Payment租金每三個月支付一次。每季度租金由承租方在第一個月的5號交與出租房(或其代理人)。在承租方入住前,出租方應將附件二中所列的所有家具電器配齊,所有待修整的事項完成,服務設施連接好。在以上事情完成且承租方能夠順利入住的前提下,承租方將在簽訂合同5個工作日內(nèi)付給出租方第一次的三個月租金和押金。Therentwillbepa
12、ideverythreemonths.BeforeLesseemovesin,Lessorhastomakesureallthefurnitureandelectricalapplianceslistedintheappendixarefullyinstalled,alllistedthingstobefixedareproperlydoneandallservicesareconnected.AfterLesseehasbeenallowedtomoveinsmoothlyandalltheaboverequirementaremetsatisfactorily,Lesseeshouldpa
13、ythefirstthreemonthsrentandsecuritydepositwithin5workingdaysaftersigningtheleasecontractbythreeparties.9.維持原狀NochangetothePremises9.1未征得出租人的書面同意,承租人不得改變租賃單元之原狀。若承租人對出租人的房屋任何部分及其任何設施、裝修及配備造成損壞或破損(正常損耗除外),則具有義務按租賃時的狀態(tài)對其進行維修修復或更換,且最遲不得遲于收到出租人通知的24小時內(nèi)作出。PriortoobtainingwrittenconsentfromtheLessor,theLes
14、seeshallnotchangeinanywaytheexistingconditionofthePremise.ShouldtheLesseedamageordestroyanyofthefacilities,RenovationsandFurnishing(normalwearandtearexcepted),theLesseeshallberesponsiblefortherepair,restorationorreplacementofanydamagesmadetothefacilities,renovationsandinstallations(normalwearandtear
15、excepted)andreturnittoTheoriginalconditionasatthecommencemenofthetenancywithin24hoursofnotificationbytheLessor.9.2對于該單元的內(nèi)部結構以及屬出租方的家具電器設備由于非承租方原因(包括自然損耗和不可抗力(如:水災、火災、地震、雷擊等)而引起的損壞,出租方須及時負責安排修理,費用由出租方支付。若出租方在收到承租方書面通知或電話通知后3個工作日內(nèi)未能履行維修義務,則承租方可以自行維修或找第三方維修,維修費用由出租方承擔。IftheinteriorstructureofthePremise
16、soritsfurnitureandappliancesofLessoraredestroyedordamagedforanyreasonsnotowingtothedefaultorneglectofLessee(e.g.bynaturalwearandtearorbyforcemajeureasflood,fire,earthquake,lightingstrike,etc.),LessorshallrepairitimmediatelytoensureitsuseandLessorpayallthecostincurred.IncasethatLessorcannotgivemainte
17、nanceservicewithinthreeworkingdaysafterreceiptofwrittennoticeorphonenoticefromLessee,Lesseecanrepairithimselforaskforexternalmaintenance.AllcostsincurredshallbebornbyLessor.10.遵守規(guī)則RulesandRegulations承租人應遵守出租人或管理公司為管理【和喬麗晶】物業(yè)而規(guī)定的所有規(guī)定。出租人應有權于任何時間及不時就【和喬麗晶】物業(yè)的規(guī)則、條例及規(guī)定作出合理添加、補充、取消或暫停執(zhí)行。TheLesseeshallcom
18、plywithallrelatedrulesandregulationslaidoutbytheLessororthemanagingagentwithregardtotheoverallmanagementofthewholeChateauRegency.TheLessorshallhavetherighttoaddon,makeadditions,cancelortemporarilysuspendexecutionofanyoftherulesandregulationsregardingChateauRegencyatanytimeandfromtimetotime.11.進入Less
19、orsrightofentry為管理或維護公寓及租賃單元或為履行其提供服務的義務,出租人及其妥為授權的人士有權于合理的時間進入租賃單元,若情況允許應事先通知承租人,但緊急情況除外。承租人知悉并授權出租人保留和持有進入租賃單元的鑰匙或電子門卡。TheLesseeshallgrantaccesstotheLessoranditsauthorizedagentsintothePremisesasandwhentheLessordeemsthereisaneedtoundertakethemaintenanceorworkrelatedtothemanagementormaintenanceofthe
20、PropertyandthePremisesortoperformitsobligationsaccordingtothisAgreement,atreasonablehours,althoughpriornoticeshouldbegiventotheLesseeifcircumstancespermitandexcepttheemergency.TheLesseeisawareofandconsentstotheLessorretainingandholdingthekeysorelectroniccardkeystothePremises.12.交還Yieldingupofpremise
21、s在本協(xié)議書屆滿或被提前終止之日,承租人應將租賃單元連同所有設施、裝修及配備按單元出租時的狀態(tài)(正常損壞除外)完好及完整交還給出租人,而無須任何通知或要求;若承租人未能如此交還的,則就每一遲延日,應按本協(xié)議書所規(guī)定之日租金(月租金/30)2倍的標準交納租金,直至妥為交還之日。TheLesseeshall,upontheexpirationorearlyterminationofthisagreement,returnthePremisesanditsattachedfacilities,RenovationsandFurnishingsinitsoriginalstateasatthecomm
22、encementofthetenancy(normalwearandtearexcepted)backtotheLessorregardlessofwhetherhe/shehadobtainpriornoticefromtheLessor.TheLesseeshallpaytwicetheamountofthedailyrent(monthlyrent/30)stipulatedinthisAgreementforeverydaythathe/shefailstoreturnthePremisesanditsattachedfacilities,RenovationsandFurnishin
23、gsinaccordancewiththeaforesaidconditions,tillthedayhe/shefulfilsthesaidobligation.13.違約責任BreachofContract13.1.在租賃期內(nèi),承租方若提前終止合同,需提前一個月書面通知出租方,承租方所付押金作為違約金不予退還,同時承租方應付清此期間內(nèi)承租方應付費用,出租方應退還承租方預先支付的剩余房租(如有)。出租方若提前終止合同,須提前一個月書面通知承租方,出租方除了退還承租方所付押金及剩余租金以外須賠相當于承租方所付押金金額的違約金,同時承租方應付清此期間內(nèi)承租方應付費用。Duringtheleasi
24、ngperiod,ifLesseewantstoearlyterminatethecontract,LesseeshouldnotifyLessorinwrittenformonemonthinadvance.ThedepositwillbeconfiscatedasthedefaultfeeandLesseeshallalsoclearallthefeeswhichshouldbepaidbyLesseeduringthisperiodoftime,theremainingrentpaidbyLesseeinadvance(ifany)afterLesseehaspaidinfullallt
25、heexpenseswhichshallbebornebyLessee.IfLessorwantstoearlyterminatethecontract,LessorshouldnotifyLesseeinwrittenonemonthinadvance.LessorshouldreturnthedepositandtherestpaymentofrentalandinadditiontopaythedefaultfeewhichisequaltotheamountofthedepositpaidbyLessee.Lesseeshallalsoclearallthefeeswhichshoul
26、dbepaidbyLesseeduringthisperiodoftime.13.2.承租方延付費用:若延付費用因承租方引起,承租方應按合同規(guī)定支付上述費用在承租方付款逾期七日內(nèi),出租方有義務向承租方發(fā)出再次書面付款通知.若逾期14日未付,除應及時支付所欠費用外,還應每天支付出租方月租金的0.1%滯納金;延期超過三十天,出租方有權單方面解除合同并沒收押金及保留追索欠款及索賠的權利。LesseeshallpaytheaboverentandallotherfeesinaccordancewiththeprovisionsofthisContract.LessorshallinformLessee
27、againinwrittenformwithin7daysfromtheduedate.Iftherentalisnotpaidwithin14daysfromtheduedate,Lesseeshall,inadditiontopaytherentalinarrears,payLessorlatepaymentchargeof0.1%ofmonthlyrentalperdayoflatepayment.Ifthepaymentofrentalisoverduebymorethan30days,Lessorshallhavetherighttounilaterallyterminatethis
